R. 5467</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210930">September 30, 2021</action-date><action-desc><sponsor name-id="S001183">Mr. Schweikert</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to clarify that artificial intelligence and machine learning technologies can qualify as a practitioner eligible to prescribe drugs if authorized by the State involved and approved, cleared, or authorized by the Food and Drug Administration, and for other purposes.</official-title></form><legis-body id="H333E456AC6A24B1B9810CE2E86A26A69" style="OLC"><section id="H9D3FD7316AAD4935B9FF0FF4FC7282FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Technology Act of 2021</short-title></quote>.</text></section><section id="H7DBC7D3B180E47F3A7D6F8D37815C1DC"><enum>2.</enum><header>Prescription of drugs by artificial intelligence or machine learning technologies</header><text display-inline="no-display-inline">Section 503(b) of Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/353">21 U.S.C. 353(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD28CBA4794E748609E650568E116014C" display-inline="no-display-inline"><paragraph id="HA1DA1C7FE4194912AB734E15E8FCC85F" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>practitioner licensed by law to administer such drug</term> includes artificial intelligence and machine learning technology that are—</text><subparagraph id="H2ADB6367259E4CBBA2D591C63B579674"><enum>(A)</enum><text display-inline="yes-display-inline">authorized pursuant to a statute of the State involved to prescribe the drug involved; and</text></subparagraph><subparagraph id="HF87C287269D548C5A6229DCCCE31ECDA"><enum>(B)</enum><text display-inline="yes-display-inline">approved, cleared, or authorized under section 510(k), 513, 515, or 564.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
