Russell National School Lunch Act to require the Secretary of Agriculture to carry out a grant program to make grants to eligible local educational agencies to carry out food waste reduction programs, and for other purposes.</official-title></form><legis-body id="H2E32D14D19ED4329B2CD6F9B5CBAE36F" style="OLC"> 
<section id="H71C84353D0494C3BA0DF3B4662E544E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Food Recovery Act of 2021</short-title></quote>.</text></section> <section id="HE47FD05AC49D4534BAA2D6E276203256"><enum>2.</enum><header>School food waste reduction grant program</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) is amended by inserting before subsection (b) the following:</text>

<subsection id="H87636F874BD34449A61DB27D7E77E782"><enum>(a)</enum><header>School food waste reduction grant program</header> 
<paragraph id="HB55DC3D3A95E46D5A329049A8A38E395"><enum>(1)</enum><header>Grant program established</header> 
<subparagraph id="H9B77183E6E6B4E2482B43F6AA2FF7A84"><enum>(A)</enum><header>In general</header><text>The Secretary shall carry out a program to make grants, on a competitive basis, to eligible local educational agencies to carry out food waste measurement and reporting, prevention, education, and reduction projects.</text></subparagraph> <subparagraph id="H537FDDCE2A9043308651D76D24BB1000"><enum>(B)</enum><header>Regional balance</header><text display-inline="yes-display-inline">In awarding grants under this subsection, the Secretary shall, to the maximum extent practicable, ensure that—</text> 
<clause id="HC2602EFF02004417BA435144F6F2D16B"><enum>(i)</enum><text>a grant is awarded to an eligible local educational agency in each region served by the Administrator of the Food and Nutrition Service; and</text></clause> <clause id="H642DEED5806F450B85EFD81321B659DE"><enum>(ii)</enum><text>equitable treatment of rural, urban, and tribal communities.</text></clause></subparagraph></paragraph> 
<paragraph id="H96A07FA287ED41FF995077E0F2E9C390"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a grant under this subsection, an eligible local educational agency shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> <paragraph id="H080D74180FF04354BB385098FD722A45"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In making grants under this subsection, the Secretary shall give priority to an eligible local educational agency that demonstrates in the application under paragraph (2) that such eligible local educational agency will use the grant to—</text> 
<subparagraph id="HF161FD5ECB8248B095DD7137F339B1B9"><enum>(A)</enum><text>carry out experiential education activities that encourage children enrolled in such eligible local educational agency to participate in food waste measurement and education;</text></subparagraph> <subparagraph id="H8E7EA012EBD9457E9C878EE6E6D56FB2"><enum>(B)</enum><text>prioritize the best use of food in accordance with the Food Recovery Hierarchy published by the Administrator of the Environmental Protection Agency;</text></subparagraph> 
<subparagraph id="H67ECFFE1D2B74BE39DE6F2B684DF03A7"><enum>(C)</enum><text>with respect to food waste prevention and reduction, collaborate with other eligible local educational agencies, tribes, nongovernmental and community-based organizations, and other community partners;</text></subparagraph> <subparagraph id="H4C8A80A0A1FD4F4BB47C25A1A9CAF12C"><enum>(D)</enum><text>evaluate the activities described in subparagraphs (A) through (C) and make evaluation plans; and</text></subparagraph> 
<subparagraph id="H88D7E83B19004531AC144689B15E9E8C"><enum>(E)</enum><text>establish a food waste measurement, prevention, and reduction project with long-term sustainability.</text></subparagraph></paragraph> <paragraph id="HB90B3E8660704405B7688B2CE0CFA5EC"><enum>(4)</enum><header>Federal share</header> <subparagraph id="H460F6EBAE29B4093BA5F9A4D0136BA5E"><enum>(A)</enum><header>In general</header><text>The Federal share of a food waste measurement, prevention, and reduction project funded through a grant awarded under this subsection shall not exceed 75 percent of the total cost of such food waste reduction project.</text></subparagraph> 
<subparagraph id="H2FD318142C6846FE8400BA621B0EBD05"><enum>(B)</enum><header>Federal matching</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, an eligible local educational agency shall provide matching funds in the form of cash or in-kind contributions, including facilities, equipment, or services provided by State and local governments, nonprofit organizations, and private sources.</text></subparagraph></paragraph> <paragraph id="HB81856C793EC4AFFA4D93F188434322F"><enum>(5)</enum><header>Use of funds</header><text>An eligible local educational agency that receives a grant under this section shall use funds under such grant to carry out at least one of the following:</text> 
<subparagraph id="H7FE10DFCA6DF4A438F6B293B8EA893F8"><enum>(A)</enum><text display-inline="yes-display-inline">Planning a food waste measurement, prevention, and reduction project.</text></subparagraph> <subparagraph id="H08D35B5A7073446DBECFDD34A7D02FA3"><enum>(B)</enum><text>Carrying out activities under such a project.</text></subparagraph> 
<subparagraph id="H8496FB9C18B944CB96BBF990DCAB4D96"><enum>(C)</enum><text>Providing training to support such a project.</text></subparagraph> <subparagraph id="H9E580C2CB63E4D9F9710E37958D06D52"><enum>(D)</enum><text>Purchasing equipment to support such a project.</text></subparagraph> 
<subparagraph id="H8345DF40370741F6BC1AC25CD31EC412"><enum>(E)</enum><text>Offering food waste education to students enrolled in such eligible local educational agency.</text></subparagraph></paragraph> <paragraph id="HD7AD20FEB96B4DC9A45A2706A0B38576"><enum>(6)</enum><header>Requirement</header><text display-inline="yes-display-inline">A food waste measurement and reporting, prevention, education, and reduction project funded by a grant under this subsection shall comply with the nutrition requirements of the school lunch program under this Act or the school breakfast program established under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), as applicable, including by offering no less than the minimum quantities of required food components.</text></paragraph> 
<paragraph id="HEA56D7531CA748A3BC338ED4BEAA8A2E"><enum>(7)</enum><header>Evaluation</header> 
<subparagraph id="HD63D990FAAE44DF483A32B2B727E3CE7"><enum>(A)</enum><header>Agreement</header><text>As a condition of receiving a grant under this subsection, each eligible local educational agency shall agree to cooperate in an evaluation by the Secretary of the project carried out using grant funds.</text></subparagraph> <subparagraph id="HEB39EE7D020B4250AB31A070348CEE73"><enum>(B)</enum><header>Periodic evaluation</header><text>Not later than 2 years after the date of the enactment of this paragraph and every 2 years thereafter, the Secretary shall carry out an evaluation of the grants made under this section that includes—</text> 
<clause id="HCA8BED81A324400E9320E5946311979A"><enum>(i)</enum><text>the amount of Federal funds used to carry out such grants; and</text></clause> <clause id="HFBD9D9B005624BCE815A17578783D63B"><enum>(ii)</enum><text>an evaluation of the outcomes of the projects carried out pursuant to such grants.</text></clause></subparagraph></paragraph> 
<paragraph id="H778EFCE44D7E4CFB8F7AAF1A84B3D9A2"><enum>(8)</enum><header>Definition of eligible local educational agency</header><text>In this subsection, the term <term>eligible local educational agency</term> means a local educational agency that participates in the school lunch program under this Act or the school breakfast program established under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HD5C242BD8AF740FE8F4C09E3E9C85938"><enum>3.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 21(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b–1(b)</external-xref>) is amended—</text> 
<paragraph id="HC179A4217B3D41E5937175F9E32D5F06"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H1EE13B325D7D4054BE3E1029EDB8258A"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H64C3B8E940EE404D85A276B3A759DA9F"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H444CF403238E47E2B6CB97480B8E9AD9" style="OLC"> <paragraph id="HCA401BF12AC04F83B243F3906105566C"><enum>(4)</enum><text display-inline="yes-display-inline">food waste measurement, prevention, and reduction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
