id="H5C1010F10ACB4965BF1815BE52496C57" section-type="section-one" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fishery Resource Disasters Improvement Act</short-title></quote>.</text></section><section id="H89DF4EAFB91442769F7B3E9D8149A70A" changed="not-changed"><enum>2.</enum><header>Fishery resource disaster relief</header><text display-inline="no-display-inline">Section 312(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1861a">16 U.S.C. 1861a(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1B473698B8E8445DB00F52E210E093D6" changed="not-changed"><subsection id="H247DB2C0BC6D4662965DB60ED5F4CC86" changed="not-changed"><enum>(a)</enum><header>Fishery resource disaster relief</header><paragraph id="HF6CF30FBEAE64A079C9731127ECD5D8C" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H98689E0A071D44EFAD5AEC12C35E61B3" changed="not-changed"><enum>(A)</enum><header>Allowable cause</header><text>The term <term>allowable cause</term> means a natural cause, discrete anthropogenic cause, or undetermined cause.</text></subparagraph><subparagraph id="H0BB1757DF7BE44CD9B267500A8852F59" changed="not-changed"><enum>(B)</enum><header>Anthropogenic cause</header><text>The term <term>anthropogenic cause</term> means an anthropogenic event, such as an oil spill or spillway opening—</text><clause id="HA0E2525D85574468AAEBC73C624AA975" changed="not-changed"><enum>(i)</enum><text>that could not have been addressed or prevented by fishery management measures; and</text></clause><clause id="H098E602C0DAB4972A38CFDC997633CE7" changed="not-changed"><enum>(ii)</enum><text>that is otherwise beyond the control of fishery managers to mitigate through conservation and management measures, including regulatory restrictions imposed as a result of judicial action or to protect human health or marine animals, plants, or habitats. </text></clause></subparagraph><subparagraph id="HBAC9F16E00974A47BEDCBC2F2FBA6760" changed="not-changed"><enum>(C)</enum><header>Fishery resource disaster</header><text>The term <term>fishery resource disaster</term> means a disaster that is determined by the Secretary in accordance with this subsection and—</text><clause id="HD08FA56D7D5A44CEAB8EFB3FEEDF7AC6" changed="not-changed"><enum>(i)</enum><text>is an unexpected large decrease in fish stock biomass or other change that results in significant loss of access to the fishery resource, which may include loss of fishing vessels and gear for a substantial period of time and results in significant revenue or subsistence loss due to an allowable cause; and</text></clause><clause id="H246FBEFF62634512B35C068198C573A8" changed="not-changed"><enum>(ii)</enum><text>does not include—</text><subclause id="H7BE29FFA26AB47F1AD479074E07F93FD" changed="not-changed"><enum>(I)</enum><text>reasonably predictable, foreseeable, and recurrent fishery cyclical variations in species distribution or stock abundance; or</text></subclause><subclause id="H2339B57F892C4250A4C853D11AA60AC3" changed="not-changed"><enum>(II)</enum><text>reductions in fishing opportunities resulting from conservation and management measures taken pursuant to this Act. </text></subclause></clause></subparagraph><subparagraph id="HB5E7CA70DE12491480BF6F1BE15FA364" changed="not-changed"><enum>(D)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given such term in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>), and the term <term>Tribal</term> means of or pertaining to such an Indian tribe.</text></subparagraph><subparagraph id="H1B2710627C3249F88242A0B868CC72C1" changed="not-changed"><enum>(E)</enum><header>Natural cause</header><text>The term <term>natural cause</term>—</text><clause id="HD582325741A84964B475C0A05F82D941" changed="not-changed"><enum>(i)</enum><text>means a weather, climatic, hazard, or biology-related event, such as—</text><subclause id="H4E62A08A61684F10ACDDC12097ED4A3B" changed="not-changed"><enum>(I)</enum><text>a hurricane;</text></subclause><subclause id="HF3EB2C2D81074F7A914FD33A7033FA81" changed="not-changed"><enum>(II)</enum><text>a flood;</text></subclause><subclause id="H37F574B9B8574DB8BFF4E3875DEC47EB" changed="not-changed"><enum>(III)</enum><text>a harmful algal bloom;</text></subclause><subclause id="H9D0B0B64DD7C4880B31DE76FA05B69BA" changed="not-changed"><enum>(IV)</enum><text>a tsunami;</text></subclause><subclause id="H2F889097E66A460C9317D7FC4FCE76F9" changed="not-changed"><enum>(V)</enum><text>a hypoxic zone;</text></subclause><subclause id="H62E01FC00FD54AEC915596C217188AC9" changed="not-changed"><enum>(VI)</enum><text>a drought;</text></subclause><subclause id="H8105436F2CD94864856D37D98D270ED0" changed="not-changed"><enum>(VII)</enum><text>El Niño effects on water temperature; </text></subclause><subclause id="HCF00873F09C74F9B9B9AB3495DD4C8AF" changed="not-changed"><enum>(VIII)</enum><text>a marine heat wave; or </text></subclause><subclause id="HF2AB587B6B2D49AD88B1F721C16E0474" changed="not-changed"><enum>(IX)</enum><text>disease; and </text></subclause></clause><clause id="H43F86D5B6EB0433093A547CD61B8A278" changed="not-changed"><enum>(ii)</enum><text>does not mean a normal or cyclical variation in a species distribution or stock abundance.</text></clause></subparagraph><subparagraph id="H17024E42DA584736BE7F485E14822E14" changed="not-changed"><enum>(F)</enum><header>12-month revenue loss</header><text>The term <term>12-month revenue loss</term> means the percentage reduction, as applicable, in commercial, charter, headboat, or processor revenue for the 12 months during which the fishery resource disaster occurred, when compared to average annual revenue in the most recent 5 years when no fishery resource disaster occurred or equivalent for stocks with cyclical life histories.</text></subparagraph><subparagraph id="H9E430FD1899E4657BFE14069E9C7CD21" changed="not-changed"><enum>(G)</enum><header>Undetermined cause</header><text>The term <term>undetermined cause</term> means a cause in which the current state of knowledge does not allow the Secretary to identify the exact cause, and there is no current conclusive evidence supporting a possible cause of the fishery resource disaster.</text></subparagraph></paragraph><paragraph id="H4CA1DA6BFF4B4326B13470C54270B475" changed="not-changed"><enum>(2)</enum><header>General authority</header><subparagraph id="H24ABEFA837244DFEBF1780EF3A750673" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary shall have the authority to determine the existence, extent, and beginning and end dates of a fishery resource disaster under this subsection in accordance with this subsection.</text></subparagraph><subparagraph id="HBA7B7EB117884FC48E53CD77065A9758" changed="not-changed"><enum>(B)</enum><header>Availability of funds</header><text>After the Secretary determines that a fishery resource disaster has occurred, the Secretary is authorized to make sums available, from funds appropriated for such purposes, to be used by the affected State, Tribal government, or interstate marine fisheries commission, or by the Secretary in cooperation with the affected State, Tribal government, or interstate marine fisheries commission.</text></subparagraph><subparagraph id="HAE3377F55336419B8B6526D84547CA43" changed="not-changed"><enum>(C)</enum><header>Savings clause</header><text>The requirements under this subsection shall take effect only with respect to requests for a fishery resource disaster determination submitted after the date of enactment of the <short-title>Fishery Resource Disasters Improvement Act</short-title>.</text></subparagraph></paragraph><paragraph id="HF91ADAE7D69840C7B65BCA7EC248952F" changed="not-changed"><enum>(3)</enum><header>Initiation of a fishery resource disaster review</header><subparagraph id="HD39DC49E41974F9E8F8BB930BEFD022C" changed="not-changed"><enum>(A)</enum><header>Eligible requesters</header><text>Not later than 1 year after the date of the conclusion of the fishing season, a request for a fishery resource disaster determination may be submitted to the Secretary, if the Secretary has not independently determined that a fishery resource disaster has occurred, by—</text><clause id="H87B6717B80C04078B9FBAB3A2B0D155E" changed="not-changed"><enum>(i)</enum><text>the Governor of an affected State;</text></clause><clause id="HE5E187889561490083D6CE7643A7D5B6" changed="not-changed"><enum>(ii)</enum><text>an official Tribal resolution; or</text></clause><clause id="H0F19D9BA522C4EA988C2CC421FC3BC7E" changed="not-changed"><enum>(iii)</enum><text>any other comparable elected or politically appointed representative as determined by the Secretary.</text></clause></subparagraph><subparagraph id="H965C5CFD6B5E46A1BD2D2808A7F85E87" changed="not-changed"><enum>(B)</enum><header>Required information</header><text>A complete request for a fishery resource disaster determination under subparagraph (A) shall include—</text><clause id="H8AA6F9F669E346B3B8DFE0988A9FEC2F" changed="not-changed"><enum>(i)</enum><text>identification of all presumed affected fish stocks;</text></clause><clause id="H85D94D18404F4D6CBF5F64EF2A5EA1B1" changed="not-changed"><enum>(ii)</enum><text>identification of the fishery as Federal, non-Federal, or both;</text></clause><clause id="H35B91987ABBA41FE82CAA3026190953B" changed="not-changed"><enum>(iii)</enum><text>the geographical boundaries of the fishery;</text></clause><clause id="HAA5B0745E66143BE911CFD2AA1081683" changed="not-changed"><enum>(iv)</enum><text>preliminary information on causes of the fishery resource disaster, if known; and</text></clause><clause id="HE77A23F2090B44E1BC98DE638E5C5B76" changed="not-changed"><enum>(v)</enum><text>information needed to support a finding of a fishery resource disaster, including—</text><subclause id="H1D5EC3B8A7454A6BBAF6F6CF90799981" changed="not-changed"><enum>(I)</enum><text>information demonstrating the occurrence of an unexpected large decrease in fish stock biomass or other change that results in significant loss of access to the fishery resource, which could include the loss of fishing vessels and gear, for a substantial period of time; </text></subclause><subclause id="H231CB9F0017641F1B16177ECB227F94E" changed="not-changed"><enum>(II)</enum><text>12-month revenue loss or subsistence loss for the affected fishery, or if a fishery resource disaster has occurred at any time in the previous 5-year period, the most recent 5 years when no fishery resource disaster occurred;</text></subclause><subclause id="H300F1A3B778B47A2B07D2431CC26C257" changed="not-changed"><enum>(III)</enum><text>if applicable, information on lost resource tax revenues assessed by local communities, such as a raw fish tax and local sourcing requirements; and</text></subclause><subclause id="H4D903478766E49B89773C96567EF0A08" commented="no" changed="not-changed"><enum>(IV)</enum><text>if applicable and available, information on 12-month revenue loss for charter, headboat, or processors related to the information provided under subclause (I), subject to section 402(b). </text></subclause></clause></subparagraph><subparagraph id="HA71F72090A7F404D9DF52177C805BFFC" changed="not-changed"><enum>(C)</enum><header>Assistance</header><text>The Secretary may provide data and analysis assistance to an eligible requester described in paragraph (1), if—</text><clause changed="not-changed" id="H218ECDEF4AF4453F85439B5AEF5E899B"><enum>(i)</enum><text>the assistance is so requested; </text></clause><clause changed="not-changed" id="HE1CE37FE7017457EA7A6CB0F479E6E1B"><enum>(ii)</enum><text>the Secretary is in possession of the required information described in subparagraph (B); and </text></clause><clause changed="not-changed" id="H95118DB718EF4E4BB9C1B5E581A58F98"><enum>(iii)</enum><text>the data is not available to the requester, in carrying out the complete request under subparagraph (B). </text></clause></subparagraph><subparagraph changed="not-changed" id="H4BF56D02E6904ADFB3EC747D02DA2526"><enum>(D)</enum><header>Initiation of review</header><text>The Secretary shall have the discretion to initiate a fishery resource disaster review without a request.</text></subparagraph></paragraph><paragraph id="HCC4B623FAB3F491181042DE2E9655F69" changed="not-changed"><enum>(4)</enum><header>Review process</header><subparagraph id="HB6AB3F50294245019F80844F1F7F0F3E" changed="not-changed"><enum>(A)</enum><header>Interim response</header><text>Not later than 20 days after receipt of a request under paragraph (3), the Secretary shall provide an interim response to the individual that—</text><clause id="H9E2EFE4EBC594E79BA6BFDE8A964D6E3" changed="not-changed"><enum>(i)</enum><text>acknowledges receipt of the request;</text></clause><clause id="H70C68B1C7B1C42B6AEB6271108388BEA" changed="not-changed"><enum>(ii)</enum><text>provides a regional contact within the National Oceanographic and Atmospheric Administration;</text></clause><clause id="H851CDE5ED1A1482FBE952B109348967B" changed="not-changed"><enum>(iii)</enum><text>outlines the process and timeline by which a request shall be considered; and</text></clause><clause id="H35A518D00F734E389F3CFBC3CC8C422F" changed="not-changed"><enum>(iv)</enum><text>requests additional information concerning the fishery resource disaster, if the original request is considered incomplete.</text></clause></subparagraph><subparagraph id="H130A33D36A214C59937EE3594E32FE13" changed="not-changed"><enum>(B)</enum><header>Evaluation of requests</header><clause id="HB360F1424BA34AB4A769FD247D16CD5D" changed="not-changed"><enum>(i)</enum><header>In general</header><text>The Secretary shall complete a review, within the time frame described in clause (ii), using the best scientific information available, in consultation with the affected fishing communities, States, or Tribes, of—</text><subclause id="H5AC8435D65634FAA85F0D9E7A55AC632" changed="not-changed"><enum>(I)</enum><text>the information provided by the requester and any additional information relevant to the fishery, which may include—</text><item id="H8B318799F1E74FD0ACD178AC0A5046E9" changed="not-changed"><enum>(aa)</enum><text>fishery characteristics;</text></item><item id="H275CF51D52454CF18377042EC895F642" changed="not-changed"><enum>(bb)</enum><text>stock assessments;</text></item><item id="H2B6CF20DDA16469A851FE772408E5E6C" changed="not-changed"><enum>(cc)</enum><text>the most recent fishery independent surveys and other fishery resource assessments and surveys conducted by Federal, State, or Tribal officials;</text></item><item id="HF48AEAEB8F9A45B6896973C912FA88FE" changed="not-changed"><enum>(dd)</enum><text>estimates of mortality; and</text></item><item id="HCDFBCE3E61B44D74A8CC3C041FA637DF" changed="not-changed"><enum>(ee)</enum><text>overall effects; and</text></item></subclause><subclause id="HE514A1F5D8784A99A206AADFC356904E" changed="not-changed"><enum>(II)</enum><text>the available economic information, which may include an analysis of—</text><item id="H52115FF24FEF4B5C82A45AD67D60AF3E" changed="not-changed"><enum>(aa)</enum><text>landings data;</text></item><item id="HFA9463220CBD45BD9EE741CD9C63AEE1" changed="not-changed"><enum>(bb)</enum><text>revenue;</text></item><item id="H9528AB22A9BF4AF7AA1C92E9CCC79A07" changed="not-changed"><enum>(cc)</enum><text>the number of participants involved;</text></item><item id="H41E5631E5C9141478655524E9665A4BD" changed="not-changed"><enum>(dd)</enum><text>the number and type of jobs and persons impacted, which may include—</text><subitem id="HA4BE3DAA704D49CDBF1BADF1AFA06FB9" changed="not-changed"><enum>(AA)</enum><text>fishers;</text></subitem><subitem id="HC106701A030846679DB349C0D9686F45" changed="not-changed"><enum>(BB)</enum><text>charter fishing operators; </text></subitem><subitem id="H7980050569A24C10BA2DF60A243C6697" changed="not-changed"><enum>(CC)</enum><text>subsistence users;</text></subitem><subitem id="HAEE43846D0FD4B1EBD58BA8701A23CCE" changed="not-changed"><enum>(DD)</enum><text>United States fish processors; and</text></subitem><subitem id="HF8A68E683BDE4418AACDD4D52CEA7268" changed="not-changed"><enum>(EE)</enum><text>an owner of a related fishery infrastructure or business affected by the disaster, such as a marina operator, recreational fishing equipment retailer, or charter, headboat, or tender vessel owner, operator, or crew; </text></subitem></item><item id="H845524A227A141EF8F0F093192ED4956" changed="not-changed"><enum>(ee)</enum><text>an impacted Indian Tribe;</text></item><item id="H2464F142F4264A80AE4B1E6A72191BBE" changed="not-changed"><enum>(ff)</enum><text>other forms of disaster assistance made available to the fishery, including prior awards of disaster assistance for the same event;</text></item><item id="H5C39106F62E84187B68EEAB9985B44A1" changed="not-changed"><enum>(gg)</enum><text>the length of time the resource, or access to the resource, has been restricted;</text></item><item id="HC56CCC4EA25A4CE5A6A86DDF3C9CAD39" changed="not-changed"><enum>(hh)</enum><text>status of recovery from previous fishery resource disasters; </text></item><item id="HDACD587D5DDA480C837D883616478E43" changed="not-changed"><enum>(ii)</enum><text>lost resource tax revenues assessed by local communities, such as a raw fish tax; and</text></item><item id="HA2030DCFFD24447FBEEB0DF088E78A55" changed="not-changed"><enum>(jj)</enum><text>other appropriate indicators to an affected fishery, as determined by the National Marine Fisheries Service.</text></item></subclause></clause><clause id="H40A64F3C2D1D4E26AEAF4778B7CF75B9" changed="not-changed"><enum>(ii)</enum><header>Time frame</header><text>The Secretary shall complete the review described in clause (i), if the fishing season, applicable to the fishery—</text><subclause id="H60CEE8C5E45F424197D843A712694470" changed="not-changed"><enum>(I)</enum><text>has concluded or there is no defined fishing season applicable to the fishery, not later than 120 days after the Secretary receives a complete request for a fishery resource disaster determination; </text></subclause><subclause id="H436C5807C2D34577B4DB760230086877" changed="not-changed"><enum>(II)</enum><text>has not concluded, not later than 120 days after the conclusion of the fishing season; or</text></subclause><subclause id="H6083581DC84948B18CF1149166831778" changed="not-changed"><enum>(III)</enum><text>is expected to be closed for the entire fishing season, not later than 120 days after the Secretary receives a complete request for a fishery resource disaster determination.</text></subclause></clause></subparagraph><subparagraph id="H6DE2EEFCA82A4B4FA4CE5FEB5A50DE48" changed="not-changed"><enum>(C)</enum><header>Fishery resource disaster determination</header><text>The Secretary shall make the determination of a fishery resource disaster based on the criteria for determinations listed in paragraph (5).</text></subparagraph><subparagraph id="HA4B6296B267C4BD5AF147731A095EA69" changed="not-changed"><enum>(D)</enum><header>Notification</header><text>Not later than 14 days after the conclusion of the review under this paragraph, the Secretary shall notify the requester and the Governor of the affected State or Tribal representative of the determination of the Secretary.</text></subparagraph></paragraph><paragraph id="H9B0A8AA2563B482F878EFF177BEB8911" changed="not-changed"><enum>(5)</enum><header>Criteria for determinations</header><subparagraph id="H531E582420664CF39F1A33D7505F3D98" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary shall make a determination about whether a fishery resource disaster has occurred, based on the revenue loss thresholds under subparagraph (B), and, if a fishery resource disaster has occurred, whether the fishery resource disaster was due to—</text><clause id="HC491E538AB4C4F1EA359B1AFFDBA3492" changed="not-changed"><enum>(i)</enum><text>a natural cause;</text></clause><clause id="HB37910BAFDFC4F19848278D9435FF5A1" changed="not-changed"><enum>(ii)</enum><text>an anthropogenic cause; </text></clause><clause id="HB853465A25924D5EB2C788E5FB55BB60" changed="not-changed"><enum>(iii)</enum><text>a combination of a natural cause and an anthropogenic cause; or</text></clause><clause id="HFA09902C3E4D49C7B4E09A12903A2694" changed="not-changed"><enum>(iv)</enum><text>an undetermined cause. </text></clause></subparagraph><subparagraph id="H2B0A38E1AC1448B4A48B445E8259117F" changed="not-changed"><enum>(B)</enum><header>Revenue loss thresholds</header><clause id="H186CCD54204C4BEF8A32C1FC3E96E399" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Based on the information provided or analyzed under paragraph (4)(B), the Secretary shall apply the following 12-month revenue loss thresholds in determining whether a fishery resource disaster has occurred:</text><subclause id="H3A8D2AD4D5324CCFAF58B33CA8B0C55A" changed="not-changed"><enum>(I)</enum><text>Losses greater than 80 percent may result in a positive determination that a fishery resource disaster has occurred, based on the information provided or analyzed under paragraph (4)(B).</text></subclause><subclause id="H538610C7B2304B65AEBE26138F9F5CDE" changed="not-changed"><enum>(II)</enum><text>Losses between 35 percent and 80 percent shall be evaluated to determine whether economic impacts are severe enough to declare that a fishery resource disaster has occurred. </text></subclause><subclause id="H0F027AEEBE424E5D88B8951975AE9DBA" changed="not-changed"><enum>(III)</enum><text>Losses less than 35 percent shall not be eligible for a determination that a fishery resource disaster has occurred.</text></subclause></clause><clause id="H68077213834249DBB01D0580F44214C6" changed="not-changed"><enum>(ii)</enum><header>Charter fishing</header><text>In making a determination of whether a fishery resource disaster has occurred, the Secretary shall consider the economic impacts to the charter fishing industry to ensure financial coverage for charter fishing businesses. </text></clause><clause id="H461E3CBE1E02424FA705C7CE2DF19DEB" changed="not-changed"><enum>(iii)</enum><header>Subsistence loss</header><text>In considering subsistence loss, the Secretary shall evaluate the severity of loss to the fishing community instead of applying the revenue loss thresholds described in clause (i).</text></clause></subparagraph><subparagraph id="HABDB289012A849B08034D44D3DB1EEDC" changed="not-changed"><enum>(C)</enum><header>Ineligible fisheries</header><text>A fishery subject to overfishing in any of the 3 years preceding the date of a determination under this subsection is not eligible for a determination of whether a fishery resource disaster has occurred unless the Secretary determines that overfishing was not a contributing factor to the fishery resource disaster.</text></subparagraph><subparagraph id="HB07C87A0164849FFB447793B0FF2D871" changed="not-changed"><enum>(D)</enum><header>Exceptional circumstances</header><text>In an exceptional circumstance where substantial economic impacts to the affected fishery and fishing community have been subject to a disaster declaration under another statutory authority, such as in the case of a natural disaster or from the direct consequences of a Federal action taken to prevent, or in response to, a natural disaster for purposes of protecting life and safety, the Secretary may determine a fishery resource disaster has occurred without a request.</text></subparagraph></paragraph><paragraph id="HEC9BC6DACBBC410DB12656224760821F" changed="not-changed"><enum>(6)</enum><header>Disbursal of appropriated funds</header><subparagraph id="H829764B8475742839D736B85E95A0943" changed="not-changed"><enum>(A)</enum><header>Authorization</header><text>The Secretary shall allocate funds available under paragraph (9) for fishery resource disasters.</text></subparagraph><subparagraph id="H7D5386D9F01A4B8A99597A485C19CADA" changed="not-changed"><enum>(B)</enum><header>Allocation of appropriated fishery resource disaster assistance</header><clause id="H7F31081C97FC4991B5081117344D71F5" changed="not-changed" commented="no"><enum>(i)</enum><header>Notification of funding availability</header><text>When there are appropriated funds for 1 or more fishery resource disasters, the Secretary shall notify—</text><subclause changed="not-changed" commented="no" id="H2496DDE46FDB4079BBBD24768D870F0E"><enum>(I)</enum><text>the public; and </text></subclause><subclause changed="not-changed" commented="no" id="H2AFA2BF83F2147FD99B3B8AA7C43665D"><enum>(II)</enum><text>representatives of affected fishing communities with a positive disaster determination that is unfunded,</text></subclause><continuation-text continuation-text-level="clause">of the availability of funds, not more than 14 days after the date of the appropriation or the determination of a fishery resource disaster, whichever occurs later. </continuation-text></clause><clause id="H801A88D020FB4A4AA857F10B778E4FBD" changed="not-changed"><enum>(ii)</enum><header>Extension of deadline</header><text>The Secretary may extend the deadline under clause (i) by 90 days to evaluate and make determinations on eligible requests.</text></clause></subparagraph><subparagraph id="H695D0586D9044ED1A6695F6EF8C74F46" changed="not-changed"><enum>(C)</enum><header>Considerations</header><text>In determining the allocation of appropriations for a fishery resource disaster, the Secretary shall consider commercial, charter, headboat, or seafood processing revenue losses and may consider the following factors:</text><clause id="H67924D4BD8CC4FC988FF63AED4C2C60F" changed="not-changed"><enum>(i)</enum><text>Direct economic impacts.</text></clause><clause id="H79AE45A989304943BA83B7BE73799A87" changed="not-changed"><enum>(ii)</enum><text>Uninsured losses.</text></clause><clause id="H9E8AFD0F31254E159A7426E8E9FFD6D5" changed="not-changed"><enum>(iii)</enum><text>Losses of subsistence and Tribal ceremonial fishing opportunity.</text></clause><clause id="H83DC1BAB11A04FF4BA404B463DB0CACE" changed="not-changed"><enum>(iv)</enum><text>Losses of recreational fishing opportunity.</text></clause><clause id="HA155BAE8CAAC4D14992AA4FE44BB1D64" changed="not-changed"><enum>(v)</enum><text>Aquaculture operations revenue loss.</text></clause><clause id="H1EDCC07C315C4506A346DFE8F5319B6D" changed="not-changed"><enum>(vi)</enum><text>Direct revenue losses to a fishing community.</text></clause><clause id="H56697A7D60F34C9B88D616B517B4AAFB" changed="not-changed"><enum>(vii)</enum><text>Treaty obligations.</text></clause><clause id="H47D707D70E124EC4A2DA29AFA873571C" changed="not-changed"><enum>(viii)</enum><text>Other economic impacts. </text></clause></subparagraph><subparagraph id="HA56F2A3CCFD446B9A8B3FE2CBC97A09F" changed="not-changed"><enum>(D)</enum><header>Spend plans</header><text>To receive an allocation from funds available under paragraph (9), a requester with an affirmative fishery resource disaster determination shall submit a spend plan to the Secretary, not more than 120 days after receiving notification that funds are available, that shall include the following information, if applicable:</text><clause id="HEE9A14589E014E98ADE3FDC944F7AC04" changed="not-changed"><enum>(i)</enum><text>Objectives and outcomes, with an emphasis on addressing the factors contributing to the fishery resource disaster and minimizing future uninsured losses, if applicable.</text></clause><clause id="HBADC12182E2D41ECB2FFC88E6D7A9A61" changed="not-changed"><enum>(ii)</enum><text>Statement of work.</text></clause><clause id="HCD7092B742304A88A8ECB6A700AB0A7E" changed="not-changed"><enum>(iii)</enum><text>Budget details.</text></clause></subparagraph><subparagraph id="H4CC56DAD1E104CCD82BE44BEEA84DD2F" changed="not-changed"><enum>(E)</enum><header>Regional contact</header><text>If so requested, the Secretary shall provide a regional contact within the National Oceanic and Atmospheric Administration to facilitate review of spend plans and disbursal of funds. </text></subparagraph><subparagraph id="H7E57930568FF4212B2A8C09498E33B6C" changed="not-changed"><enum>(F)</enum><header>Disbursal of funds</header><clause id="HAE21F73F27A0440F8CAF90D0956D2581" changed="not-changed"><enum>(i)</enum><header>Availability</header><text>Funds shall be made available to grantees not later than 90 days after the date the Secretary receives a complete spend plan.</text></clause><clause id="HB77F8DA9BDC6425E9E44880E2979FE64" changed="not-changed"><enum>(ii)</enum><header>Method</header><text>The Secretary may provide an allocation of funds under this subsection in the form of a grant, direct payment, cooperative agreement, loan, or contract.</text></clause><clause id="H6666596F17E04D7A91386989A9B11BF3" changed="not-changed"><enum>(iii)</enum><header>Eligible uses</header><subclause id="H52B77764E66F478888B72905E0F8C52D" changed="not-changed"><enum>(I)</enum><header>In general</header><text>Funds allocated for fishery resources disasters under this subsection shall restore the fishery affected by such a disaster, prevent a similar disaster in the future, or assist the affected fishing community, and shall prioritize the following uses, which are not in order of priority:</text><item id="HE2529ABDE49243BCA6559F29F1448E24" changed="not-changed"><enum>(aa)</enum><text>Habitat conservation and restoration and other activities, including scientific research, that reduce adverse impacts to the fishery or improve understanding of the affected species or its ecosystem.</text></item><item id="HAD4018E2FE6141869D9F9668D729DE89" changed="not-changed"><enum>(bb)</enum><text>The collection of fishery information and other activities that improve management of the affected fishery.</text></item><item id="H56829DA964664573B5DA8AF85B5048C6" changed="not-changed"><enum>(cc)</enum><text>In a commercial fishery, capacity reduction and other activities that improve management of fishing effort, including funds to offset budgetary costs to refinance a Federal fishing capacity reduction loan or to repay the principal of a Federal fishing capacity reduction loan. </text></item><item id="H3EE0FAC0C24749D3B173B83CC1F625A7" changed="not-changed"><enum>(dd)</enum><text>Developing, repairing, or improving fishery-related public infrastructure.</text></item><item id="H800FD4E27FAA4618BCB5085BD3BE5374" changed="not-changed"><enum>(ee)</enum><text>Direct assistance to a person, fishing community (including assistance for lost fisheries resource levies), or a business to alleviate economic loss incurred as a direct result of a fishery resource disaster, particularly when affected by a circumstance described in paragraph (5)(D).</text></item><item id="HE2FE949B1C814879AFE343934C3BA9A0" changed="not-changed"><enum>(ff)</enum><text>Hatcheries and stock enhancement to help rebuild the affected stock or offset fishing pressure on the affected stock.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H81DD41E53F2845F181A5CD3492673E75" changed="not-changed"><enum>(II)</enum><header>Displaced fishery employees</header><text>Where appropriate, individuals carrying out the activities described in items (aa) through (dd) of subclause (I) shall be individuals who are, or were, employed in a commercial, charter, or Tribal fishery for which the Secretary has determined that a fishery resource disaster has occurred.</text></subclause></clause></subparagraph></paragraph><paragraph id="H434ACEC30A9C4EF4AFA5591D58CF4EAD" changed="not-changed"><enum>(7)</enum><header>Limitations</header><subparagraph id="HB897C020A96E4FDD861A9E3102B92BAA" changed="not-changed"><enum>(A)</enum><header>Federal share</header><clause id="HB40B01469CD3458E8ADA54F159DCE6E3" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), the Federal share of the cost of any activity carried out under the authority of this subsection shall not exceed 75 percent of the cost of that activity.</text></clause><clause id="HD4AFFF74AF074D4ABF34B036758F9C57" changed="not-changed"><enum>(ii)</enum><header>Waiver</header><text>The Secretary may waive the non-Federal share requirements of this subsection, if the Secretary determines that—</text><subclause id="HB38629AB5C0B4A3B806CC5DA487DA9F4" changed="not-changed"><enum>(I)</enum><text>no reasonable means are available through which the recipient of the Federal share can meet the non-Federal share requirement; and</text></subclause><subclause id="H666583A5FBB24CA7A3149CEDA84CF201" changed="not-changed"><enum>(II)</enum><text>the probable benefit of 100 percent Federal financing outweighs the public interest in imposition of the non-Federal share requirement.</text></subclause></clause><clause id="H12BEABBF2FBC47B69E2AFD97A127F177" changed="not-changed"><enum>(iii)</enum><header>Exception</header><text>The Federal share shall be equal to 100 percent in the case of—</text><subclause changed="not-changed" id="H28AE76B658314519B7C3BB9B5D0BA5BF"><enum>(I)</enum><text>direct assistance as described in paragraph (6)(F)(iii)(I)(ee); or</text></subclause><subclause changed="not-changed" id="H54CB6944458D48FCAE64CC2A54463CB1"><enum>(II)</enum><text>assistance to subsistence or Tribal fisheries. </text></subclause></clause></subparagraph><subparagraph id="HB25BE604D97A40E58649D061E7A12507" changed="not-changed"><enum>(B)</enum><header>Limitations on administrative expenses</header><clause id="H1472D8F43B814C37B863496F2A4CD613" changed="not-changed"><enum>(i)</enum><header>Federal</header><text>Not more than 3 percent of the funds available under this subsection may be used for administrative expenses by the National Oceanographic and Atmospheric Administration.</text></clause><clause id="H0A6D130344344EB386E236F6B0981783" changed="not-changed"><enum>(ii)</enum><header>State or tribal governments</header><text>Of the funds remaining after the use described in clause (i), not more than 5 percent may be used by States, Tribal governments, or interstate marine fisheries commissions for administrative expenses. </text></clause></subparagraph><subparagraph id="H1614F25526FB4293AE719AA7826A1F35" changed="not-changed"><enum>(C)</enum><header>Fishing capacity reduction program</header><clause id="H973F99E591F3408CAD12918FD6695519" changed="not-changed"><enum>(i)</enum><header>In general</header><text>No funds available under this subsection may be used as part of a fishing capacity reduction program in a fishery unless the Secretary determines that adequate conservation and management measures are in place in such fishery.</text></clause><clause id="H92674C98EC834B2DABF3C2C35DDBAA80" changed="not-changed"><enum>(ii)</enum><header>Assistance conditions</header><text>As a condition of providing assistance under this subsection with respect to a vessel under a fishing capacity reduction program, the Secretary shall—</text><subclause id="H0CEEFDC9259842528E2BAD09D4991AE0" changed="not-changed"><enum>(I)</enum><text>prohibit the vessel from being used for fishing in Federal, State, or international waters; and</text></subclause><subclause id="H0777CC2CF67F4ADC9A403C649472FCEC" changed="not-changed"><enum>(II)</enum><text>require that the vessel be—</text><item id="H93753F0B8AE847DA9197A09B95CB1348" changed="not-changed"><enum>(aa)</enum><text>scrapped or otherwise disposed of in a manner approved by the Secretary;</text></item><item id="H4CB52A675D4042C79A73C79FF5821EEB" changed="not-changed"><enum>(bb)</enum><text>donated to a nonprofit organization and thereafter used only for purposes of research, education, or training; or</text></item><item id="H5206C323502C4C4698DED9F916FFA403" changed="not-changed"><enum>(cc)</enum><text>used for another non-fishing purpose provided the Secretary determines that adequate measures are in place to ensure that the vessel cannot reenter any fishery anywhere in the world.</text></item></subclause></clause></subparagraph><subparagraph id="H0F0EEF95777A4031A3F0AA9CDB40F9A3" changed="not-changed"><enum>(D)</enum><header>No fishery endorsement</header><clause id="HCB72107F679B4A2EB09FC226DFBC14C2" changed="not-changed"><enum>(i)</enum><header>In general</header><text>A vessel that is prohibited from fishing under subparagraph (C)(ii)(I) shall not be eligible for a fishery endorsement under section 12113(a) of title 46, United States Code.</text></clause><clause id="H4E64B58762BE42478A97F887DD4DC6FC" changed="not-changed"><enum>(ii)</enum><header>Noneffective</header><text>A fishery endorsement for a vessel described in clause (i) shall not be effective.</text></clause><clause id="H91E2955DD59F458E8365A4EEE630C087" changed="not-changed"><enum>(iii)</enum><header>No sale</header><text>A vessel described in clause (i) shall not be sold to a foreign owner or reflagged.</text></clause></subparagraph></paragraph><paragraph id="H8180C669A8DE4B7A9989B162A49D4F37" changed="not-changed"><enum>(8)</enum><header>Public information on data collection</header><text>The Secretary shall make available and update as appropriate, information on data collection and submittal best practices for the information described in paragraph (4)(B).</text></paragraph><paragraph id="H9392B18090F142F4A98A39445FC78D41" changed="not-changed"><enum>(9)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection $377,000,000 for the period of fiscal years 2021 through 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H4BDEA284BF0B4ADBB05051692EF60AEB" changed="not-changed"><enum>3.</enum><header>Magnuson-Stevens Fishery Conservation and Management Act</header><subsection id="H72ABAB7AA2A94C15B9D38C7E78692E28" changed="not-changed"><enum>(a)</enum><header>Repeal</header><text>Section 315 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1864">16 U.S.C. 1864</external-xref>) is repealed.</text></subsection><subsection id="H11721D3272BB4AE08E779B8B1E9F3F44" changed="not-changed"><enum>(b)</enum><header>Report</header><text>Section 113(b)(2) of the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/16/460ss">16 U.S.C. 460ss</external-xref> note) is amended—</text><paragraph id="H7A6B72DEB6F640858D9A02E0C3A4EEA1" changed="not-changed"><enum>(1)</enum><text>in 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/4107">16 U.S.C. 4107</external-xref>) is repealed.</text></subsection><subsection id="HBA74B521F3B74FF99F20B08D633CF917" changed="not-changed"><enum>(b)</enum><header>Technical edit</header><text>Section 3(k)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(k)(1)</external-xref>) is amended by striking <quote>(as determined by the Secretary of Commerce under section 308(b) of the Interjurisdictional Fisheries Act of 1986)</quote> and inserting id="H09E7ECC4C0D5440AB6548BB0C50277B1" changed="not-changed"><enum>5.</enum><header>Budget requests; reports</header><subsection id="H6D5A92BBF96446F2B10F81E67B4F6677" changed="not-changed"><enum>(a)</enum><header>Budget request</header><text>In the budget justification materials submitted to Congress in support of the budget of the Department of Commerce for each fiscal year (as submitted with the budget of the President under section 1105(a) of title 31, United States Code), the Secretary of Commerce shall include a separate statement of the amount requested to be appropriated for that fiscal year for outstanding unfunded fishery resource disasters. </text></subsection><subsection id="HAAB59A39A05047BF82D0FD9C4B4072F6" changed="not-changed"><enum>(b)</enum><header>Driftnet Act Amendments of 1990 report and bycatch reduction agreements</header><paragraph id="H83A78F155C9A41A38EB47800BFD485EF" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>) is amended—</text><subparagraph id="H9FB973A23A894121BF56150BA3EB8166" changed="not-changed"><enum>(A)</enum><text>in section 202(h), by striking paragraph (3); legal-doc="usc" parsable-cite="usc/16/1826h">16 U.S.C. 1826h</external-xref>) is amended—</text><subparagraph id="HB14C96A04C9840AC86379D2FF77CCFFF" changed="not-changed"><enum>(A)</enum><text>by inserting <quote>(a) <header-in-text style="OLC" level="subsection">In general</header-in-text>.—</quote> before <quote>The Secretary</quote> and indenting appropriately; and</text></subparagraph><subparagraph id="H2F802A1DDF5940C6BC5642EA78FFA65E" changed="not-changed"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" include—</text><paragraph id="HFC07E862145C4100B2993DA6808F223B" changed="not-changed"><enum>(1)</enum><text>a description of the actions taken to carry out the provisions of section 206 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826">16 U.S.C. 1826</external-xref>), including—</text><subparagraph id="H7B4ADEDE6AA8485A825272DC59C4E5AD" changed="not-changed"><enum>(A)</enum><text>an evaluation of the progress of those efforts, the impacts on living marine resources, including available observer data, and specific plans for further action;</text></subparagraph><subparagraph id="HF0664B69007842EBB3B822C6F83B89F5" changed="not-changed"><enum>(B)</enum><text>a list and description of any new fisheries developed by nations that conduct, or authorize their nationals to conduct, large-scale driftnet fishing beyond the exclusive economic zone of any nation; and</text></subparagraph><subparagraph id="H1776CB8F3EC64AA2925B03308826B2C3" changed="not-changed"><enum>(C)</enum><text>a list of the nations that conduct, or authorize their nationals to conduct, large-scale driftnet fishing beyond the exclusive economic zone of any nation in a manner that diminishes the effectiveness of or is inconsistent with any international agreement governing large-scale driftnet fishing to which the United States is a party or otherwise subscribes; and</text></subparagraph></paragraph><paragraph id="H9AC3C187D32A40E3A8C7C788BD3F7C8F" changed="not-changed"><enum>(2)</enum><text>a description of the actions taken to carry out the provisions of section 202(h) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1822">16 U.S.C. 1822(h)</external-xref>).</text></paragraph></subsection><subsection id="H7F1F2AE354CF4574BA846024E9E0C256" changed="not-changed"><enum>(c)</enum><header>Certification</header><text>If, at any time, the Secretary, in consultation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, identifies any nation that warrants inclusion in the list described under subsection (b)(1)(C), due to large scale drift net fishing, the Secretary shall certify that fact to the President. Such certification shall be deemed to be a certification for the purposes of section 8(a) of the Fishermen's Protective Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/22/1978">22 U.S.C. 1978(a)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
