which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To promote integrity in elections for Federal office by prohibiting automatic voter registration and requiring voter identification, and for other purposes.</official-title></form><legis-body id="HB99C1A9AF2A2425CA576FBA029D7484C" style="OLC"><section id="H76EDFBEAC2A24FF3A66650A9B0FF5516" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Believe In Delaware Election Nobility Act</short-title></quote> or the <quote><short-title>BIDEN Act</short-title></quote>. </text></section><section id="HE0013C8C8E9346FAAB8A2E523BAC8501"><enum>2.</enum><header>Restrictions on certain voter registration activities</header><subsection id="H87F9B0F9BF544E23A47F66048D8A30DD"><enum>(a)</enum><header>Prohibition of automatic voter registration</header><text display-inline="yes-display-inline">Section 8 of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507</external-xref>) is amended—</text><paragraph id="H76465390376C4B11A652E1F42D460066"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph><paragraph id="H832EB8B1873741168D648481A1648AD9"><enum>(2)</enum><text>by inserting after subsection (i) the following new subsection:</text><quoted-block style="OLC" id="H9A48645DDFEF4BCD8742B7912BE355D6" display-inline="no-display-inline"><subsection id="H908A642C04094CCCAEBDEF93254478DD"><enum>(j)</enum><header>Prohibiting registration pursuant to automatic voter registration system</header><paragraph id="H9738BA2100044BA8B02A52235D940596"><enum>(1)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A State may not register an individual to vote in elections for Federal office pursuant to an automatic voter registration system.</text></paragraph><paragraph id="HCB558F19363A441782A7DC5FBD9AD489"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subsection, the term <quote>automatic voter registration system</quote> means, with respect to a State, a system that registers an individual to vote in elections for Federal office in the State, if eligible, by electronically transferring the information necessary for registration from government agencies to election officials of the State so that, unless the individual affirmatively declines to be registered, the individual will be registered to vote in such elections. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA828C13FF3494CB2B336779FD7A7B927" display-inline="no-display-inline"><enum>(b)</enum><header>Voter registration deadline</header><text display-inline="yes-display-inline">Section 8(a)(1) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507(a)(1)</external-xref>) is amended by striking <quote>not later than the lesser of 30 days, or the period provided by State law, before the date of the election</quote> each place it appears and inserting <quote>not later than the fourth Saturday prior to the date of the election</quote>.</text></subsection><subsection id="H177B030CFAF844588BDDED5F7003F0E7"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall apply with respect to the regularly scheduled general election for Federal office held in 2022 and any succeeding election for Federal office.</text></subsection></section><section id="H59144CB10448489F9441EAC2833C3122" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Requiring in person voters to provide identification</header><subsection id="H6420E1198E12484A8EEEEB0099DEBF58"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>) is amended—</text><paragraph id="H9C137AA9C3C5453D94630EBA8BD4E0C6"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph><paragraph id="HF2B0AC0455094D36B7691EEFDB09D3B8"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text><quoted-block style="OLC" id="HB4E034C05E35413298C5EB2BAF18209B" display-inline="no-display-inline"><section id="HB16AB6E6A6274AC292EA2DF3B33AC48E"><enum>304.</enum><header>Mandatory provision of identification for in person voting</header><subsection id="HF95DA85577CE49F2BA01432E19831A40"><enum>(a)</enum><header>Identification requirements for voters who vote in person</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and except as provided in subsection (b) and section 302(a), the appropriate State or local election official may not provide an individual a ballot to vote in person at a polling place in the State in an election for Federal office unless the individual provides to such official proof of identity and address.</text></subsection><subsection id="HE8C2DDAE08E14CDBB59932E12F253D7B"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), the appropriate State or local election official shall provide a ballot for an election for Federal office to an individual who desires to vote in person if the individual presents the appropriate State or local election official with a sworn written statement attesting to the individual’s identity.</text></subsection><subsection id="HEC67952FFD9D4A17A0F236F454CCEA68"><enum>(c)</enum><header>Effective date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in 2022 and any succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H50CD2453E58A41AEBCA3BBFAA6365A29" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>.</text></subsection><subsection id="HEE048948266648DC8D318D4C7F98388C" display-inline="no-display-inline"><enum>(c)</enum><header>Conforming amendments relating to repeal of existing photo identification requirements for certain voters</header><paragraph id="H7E4437536E5B4F72B63FA06ECFBE97CD"><enum>(1)</enum><header>In general</header><text>Section 303 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>) is amended—</text><subparagraph id="H98A86A4F0E5F41E1B0D00C07CFC1312D"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="section">and requirements for voters who register by mail</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">and requirements for mail-in registration forms</header-in-text></quote>;</text></subparagraph><subparagraph id="H629B8EE4D2074580A5CC1D10F48A6226"><enum>(B)</enum><text>in the heading of subsection (b), by striking <quote><header-in-text level="subsection">for Voters Who Register by Mail</header-in-text></quote> and inserting <quote><header-in-text level="subsection">for Mail-In Registration Forms</header-in-text></quote>;</text></subparagraph><subparagraph id="H0726A1805CC04FEDA35D91B1EB7C573A"><enum>(C)</enum><text>in subsection (b), by striking paragraphs (1) through (3) and redesignating paragraphs (4) and (5) as paragraphs (1) and (2), respectively; and</text></subparagraph><subparagraph id="HC821123D34894BA2BA0D4940714AE455"><enum>(D)</enum><text>in subsection (c), by striking <quote>subsections (a)(5)(A)(i)(II) and (b)(3)(B)(i)(II)</quote> and inserting <quote>subsection (a)(5)(A)(i)(II)</quote>.</text></subparagraph></paragraph><paragraph id="HBCA48B5AFF4746A7AFB4AB9B4AA2B334" display-inline="no-display-inline"><enum>(2)</enum><header>Clerical Amendment</header><text>The table of contents of such Act is amended by amending the item relating to section 303 to read as follows:</text><quoted-block style="OLC" id="HCFD5F2D568524378971D49688507FA94" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 303. Computerized statewide voter registration list requirements and requirements for mail-in registration forms.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB56A86EC09274EB5BA769955D22DF816"><enum>(d)</enum><header>Clerical amendments</header><text>The table of contents of such Act is amended—</text><paragraph id="HB7EA83CC84954F1C88FDA755606355DD"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306; and</text></paragraph><paragraph id="HE50C132341D349CD8B5D2DF9340239D7"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block id="H832CC65805424387ADA596F48FD82ED3" style="OLC"><toc><toc-entry idref="HB99C1A9AF2A2425CA576FBA029D7484C" level="section">Sec. 304. Mandatory provision of identification for in person voting. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HFE685C4D15844C2B8731D7EB08115ACA" section-type="subsequent-section" display-inline="no-display-inline"><enum>4.</enum><header>Requirements with respect to voting by absentee ballot</header><subsection id="H3122EAD9C90A4C7FB70852E79962412A"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>), as amended by section 3(a), is amended—</text><paragraph id="HEA5C6F6AF622459398C15C93678BAD2A"><enum>(1)</enum><text>by redesignating sections 305 and 306 as sections 306 and 307, respectively; and</text></paragraph><paragraph id="H949C016F07454B0A995C0580072BAC44"><enum>(2)</enum><text>by inserting after section 304 the following new section:</text><quoted-block style="OLC" id="H3605BFB1FF75416B9E155162B3F653FC" display-inline="no-display-inline"><section id="H1E654EA9FA0746FFA8696A3E88206255"><enum>305.</enum><header>Requirements with respect to voting by absentee ballot</header><subsection id="H41CA9CA29D8E428EB0CBC81BA0D1E8F7"><enum>(a)</enum><header>Individuals eligible To receive absentee ballot</header><paragraph id="H700959467B794878814A38D66885E4C6"><enum>(1)</enum><header>Excusable reasons to receive absentee ballot</header><text>A State may not provide to an individual an absentee ballot to vote in an election for Federal office unless such individual meets the application requirements described in paragraph (2) and is unable to vote in person at the appropriate polling place in the State on the date of the election for any of the following reasons:</text><subparagraph id="HF19BBA52F04A478493D3E82AD7DE6739"><enum>(A)</enum><text display-inline="yes-display-inline">The business or occupation of the individual prevents such individual from voting in person on the date of the election.</text></subparagraph><subparagraph id="H3AD37080927D483C96BFAA8D61BEFA8B"><enum>(B)</enum><text>The individual is unable to vote in person on the date of the election because such individual provides care to a parent, spouse, or child with an illness, disability, or injury that requires constant care. </text></subparagraph><subparagraph id="H784B33C006454816B5E0C2FA4F7F8A1D"><enum>(C)</enum><text>The individual suffers from a physical ailment or is an individual with a disability that substantially limits any major life activities.</text></subparagraph><subparagraph id="HBB14A42D711C44E6BAA48D2628D6A603"><enum>(D)</enum><text>The individual will be absent from the jurisdiction in which the individual is registered to vote on the date of the election.</text></subparagraph><subparagraph id="H0E896C223D1946799030BBC070D1D29B"><enum>(E)</enum><text>The individual is unable to vote in person on the date of the election due to sincerely held religious beliefs.</text></subparagraph><subparagraph id="H3EAD65B06B654B929DE1724F995EE73C"><enum>(F)</enum><text display-inline="yes-display-inline">The individual is entitled to vote by absentee ballot under any other Federal law.</text></subparagraph></paragraph><paragraph id="H336C80F68D2D43E0A12A979D46B89505"><enum>(2)</enum><header>Application requirements</header><text display-inline="yes-display-inline">A State may not provide to an individual an absentee ballot to vote in an election for Federal office unless—</text><subparagraph id="H3475BAA7FAE945F59A918044A6CDE258"><enum>(A)</enum><text display-inline="yes-display-inline">the individual submits an application to the appropriate State or local election official and such application is received by the official not later than noon on the date before the date of the election; and</text></subparagraph><subparagraph id="HB6782706F51F458E9DC15CD08196AE8A"><enum>(B)</enum><text>the application includes—</text><clause id="H20B0F1E8380A476BA36B0EC5C7C23893"><enum>(i)</enum><text>the individual’s name and address;</text></clause><clause id="H90CD1437BF5640DEB244A09FD4D5C9CC"><enum>(ii)</enum><text display-inline="yes-display-inline">the reason such individual is unable to vote in person at the appropriate polling place in the State on the date of the election and such reason is an excusable reason described in paragraph (1); and</text></clause><clause id="H7FBD9AD2C09F470BAE01B6CF216ED4C2"><enum>(iii)</enum><text display-inline="yes-display-inline">a sworn written statement attesting to the individual’s identity.</text></clause></subparagraph></paragraph></subsection><subsection id="HCF22669D9EE842F7A44E5971C3171C06" display-inline="no-display-inline"><enum>(b)</enum><header>Restrictions on delivery of voted absentee ballots</header><text display-inline="yes-display-inline">A voted absentee ballot delivered to the appropriate election official in an election for Federal office by an individual who is not the voter shall not be counted unless the individual who delivers such ballot is acting with respect to the individual’s official duties as authorized by law and is—</text><paragraph id="H648514184BB840FA9F4081CEF46B2D68"><enum>(1)</enum><text>an election official;</text></paragraph><paragraph id="HDA038A7A399746F886EF11E76D04B5A8"><enum>(2)</enum><text>an employee of the United States Postal Service; or</text></paragraph><paragraph id="H2088977321B24E69BC6BD7AD3F50343E"><enum>(3)</enum><text>any other individual who is authorized by law to collect and transmit United States mail.</text></paragraph></subsection><subsection id="H9072A42C1BCE44ECA628A652999CE7D4"><enum>(c)</enum><header>Requirements for collection of absentee ballots</header><text display-inline="yes-display-inline">The appropriate State or local election official shall collect voted absentee ballots in an election for Federal office delivered to such official in a carrier envelope which is designed to protect such ballots from tampering, removal, or substitution without detection and which shall—</text><paragraph id="HDF1FC0A5B90C4218BC4DF1015C1A0E8B"><enum>(1)</enum><text>contain absentee ballots from a single jurisdiction; </text></paragraph><paragraph id="HDB96CD995DDA4B0EB6AD061C99A3ED46"><enum>(2)</enum><text>be labeled to reflect the jurisdiction for which the absentee ballots are to be counted; and</text></paragraph><paragraph id="HD57A78B82CA848A8904EC3AA68543A93"><enum>(3)</enum><text display-inline="yes-display-inline">be sealed by such official at the time at which the polls in the election close on the date of the election.</text></paragraph></subsection><subsection id="H47B346AA79A64B44A838B2057E7BA683" display-inline="no-display-inline"><enum>(d)</enum><header>Prohibiting use of drop boxes for collection of ballots</header><text>A State may not use a drop box for the collection of voted absentee ballots in an election for Federal office unless the drop box is located inside a building which serves as an office for a State or local election official.</text></subsection><subsection id="HE7F6AB0733B548F98B663F426927E8B6" display-inline="no-display-inline"><enum>(e)</enum><header>Prohibiting acceptance of absentee ballots received after date of election</header><text>A State may not accept a voted absentee ballot in an election for Federal office which is not received by the appropriate State or local election official prior to the time at which the polls in the election close on the date of the election.</text></subsection><subsection id="HFF04607F8DAB416EA02D271A4CF382E1" display-inline="no-display-inline"><enum>(f)</enum><header>Exception for absent military and overseas voters</header><text>This section, except with respect to the absentee ballot collection requirements specified in subsection (c), shall not apply with respect to any individual who is entitled to vote by absentee ballot under the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20301">52 U.S.C. 20301 et seq.</external-xref>).</text></subsection><subsection id="H1F639D53991340FCAA1D6CD88C745047"><enum>(g)</enum><header>Effective date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in 2022 and any succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE72CA3129C984E8A9EA0E47995D14409"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>), as amended by section 3(b), is amended by striking <quote>and 304</quote> and inserting <quote>304, and 305</quote>.</text></subsection><subsection id="HEF4C6A0DA9A24225955E49D545990D30"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act, as amended by section 3(d), is amended—</text><paragraph id="H1E70C1934B03440FA29C9BC08DCBAEA6"><enum>(1)</enum><text>by redesignating the items relating to sections 305 and 306 as relating to sections 306 and 307; Requirements with respect to voting by absentee ballot.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H31EE87458E0448A48E6BD50D9BF7C979"><enum>5.</enum><header>Prohibition against early voting period</header><subsection id="H6832ED2851A94551965E2D7C53156943" display-inline="no-display-inline"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>), as amended by section 3(a) and section 4(a), is amended—</text><paragraph id="H8798FF2E42714A94B0FE34BC03647346"><enum>(1)</enum><text>by redesignating sections 306 and 307 as sections 307 and 308, respectively; and</text></paragraph><paragraph id="H7691D190F1CA4621B6EC234B3C43CEB4"><enum>(2)</enum><text>by inserting after section 305 the following new section:</text><quoted-block style="OLC" id="H7988577ACF224DA883C79C4248EE66EA" display-inline="no-display-inline"><section id="HEA1E8CA4934A497CBEA5CDFE37CDE6CD"><enum>306.</enum><header>Prohibition against early voting period</header><subsection id="H7E0EAC1F604B4C90AA01E5D223E9F302"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State may not allow individuals to vote at a polling place in the State in an election for Federal office during an early voting period which occurs prior to the date of the election in the same manner as voting is allowed on such date.</text></subsection><subsection id="HEAC85F944409426FA1E963DDE8860D47"><enum>(b)</enum><header>Effective date</header><text>This section shall apply with respect to the regularly scheduled general election for Federal office held in 2022 and any succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H58AC3F4589AB48C49681C965783E6540" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>), as amended by section 3(b) and section 4(b), is amended by striking <quote>and 305</quote> and inserting <quote>305, and 306</quote>.</text></subsection><subsection id="H89A6A944ECE741F4B828267FFA147840"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act, as amended by section 3(d) and section 4(c), is amended—</text><paragraph id="H6F06D0391FBF4611950337F6CA808E8A"><enum>(1)</enum><text>by redesignating the items relating to sections 306 and 307 as relating to sections 307 and 308, respectively; and</text></paragraph><paragraph id="H2BF27F80B4F74812B15A6A27CA98B6BF"><enum>(2)</enum><text>by inserting after the item relating to section 305 the following new item:</text><quoted-block style="OLC" id="H4948D64FFE1E4F5D86D21C0137BADE89" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 306.
