R. 5442</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210930">September 30, 2021</action-date><action-desc><sponsor name-id="C001114">Mr. Curtis</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to submit to Congress a report on actions taken by the Secretary to ensure compliance with disclosure requirements relating to foreign influence.</official-title></form><legis-body id="H7C8994729DEF4806AE3E39A8AE23DD20" style="OLC"><section id="H1055958109D24DB795911EE79F507262" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fix Nondisclosure of Influence in Health Research Act</short-title></quote> .</text></section><section id="H43D125B51CE940C88B80EEDE6F99BCA6"><enum>2.</enum><header>Report on progress to address undue foreign influence</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act and annually thereafter, the Secretary of Health and Human Services shall prepare and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate, in a manner that does not compromise national security, a report on actions taken by the Secretary—</text><paragraph id="H75098D257DA241009D4A17739166E85A"><enum>(1)</enum><text>to address cases of noncompliance with disclosure requirements or research misconduct related to foreign influence, including—</text><subparagraph id="H28D9CD2B25734AB0AB8DAD3EADC9BF0B"><enum>(A)</enum><text>the number of potential noncompliance cases investigated by the National Institutes of Health or reported to the National Institutes of Health by a research institution, including relating to undisclosed research support, undisclosed conflicts of interest or other conflicts of commitment, and peer review violations;</text></subparagraph><subparagraph id="H4EAECA2E547C46838FA0F51A08D24AC2"><enum>(B)</enum><text>the number of cases referred to the Office of Inspector General of the Department of Health and Human Services, the Office of National Security of the Department of Health and Human Services, the Federal Bureau of Investigation, or other law enforcement agencies;</text></subparagraph><subparagraph id="H56CCFF9319BA4D6498C8507EA05DA27A"><enum>(C)</enum><text>a description of enforcement actions taken for noncompliance related to undue foreign influence; and</text></subparagraph><subparagraph id="HB5A666E015744A019EE1127249ABFC21"><enum>(D)</enum><text>any other relevant information; and</text></subparagraph></paragraph><paragraph id="H67C4F62D7ED048FD90A886A7CC0A0440"><enum>(2)</enum><text>to prevent, address, and mitigate instances of noncompliance with disclosure requirements or research misconduct related to foreign influence. </text></paragraph></section></legis-body></bill>
