Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To keep children safe and protect their interests on the internet, and for other purposes.</official-title></form><legis-body id="HE657FDB856AE4325892A05F968770D3A" style="OLC"><section section-type="section-one" id="H4F8E25076869425AB071DA29B62554D4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kids Internet Design and Safety Act</short-title></quote> or the <quote><short-title>KIDS Act</short-title></quote>. </text></section><section id="H1CCEE708626649ACA3976A27A2205FC0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H304EDE6D440242A1AE635F066928A838"><enum>(1)</enum><text>Children increasingly consume digital entertainment on the internet and are uniquely susceptible to manipulation online, given their lack of important neurological and psychological capabilities which are developed later in adulthood.</text></paragraph><paragraph id="H9B81F4FCA5E04E67B7A3CCFDC4C569F8"><enum>(2)</enum><text>Today’s digital media environment, which is constantly evolving and now includes high-tech experiences, such as augmented reality and virtual reality, is largely designed in non-transparent ways to ensure children interact with content that reflect the interests and goals of content producers, online platforms, and marketers.</text></paragraph><paragraph id="H136BBA27A5124B8E89EB5F9BDB3629F8"><enum>(3)</enum><text>Artificial intelligence, machine learning, and other complex systems are used to make continuous decisions about how online content for children can be personalized to increase engagement.</text></paragraph><paragraph id="H31A1F921282A4EFB883CBDB1ACE9CD9E"><enum>(4)</enum><text>Online companies gather, analyze, and use data for behavioral marketing directed at children.</text></paragraph><paragraph id="H7F15817FC2724EF3844593EF4DE6E413"><enum>(5)</enum><text>Companies employ sophisticated strategies, including neuromarketing, to affect consumer behavior and manipulate online users' decision making.</text></paragraph><paragraph id="H8F9563CA6C8F426FBA7974A09BCB31E2"><enum>(6)</enum><text>Branded content in various forms of multimedia, including native advertising and influencer marketing, exposes children to marketing that is inherently manipulative or purposely disguised as entertainment or other information.</text></paragraph></section><section id="HFA6691A19F4A4136B7B8CEDEE96E89A3"><enum>3.</enum><header>Definitions</header><subsection id="H8299A7AB4F3243FD8ACDAE8E8D3808D1"><enum>(a)</enum><header>In general</header><text>In this Act:</text><paragraph id="H738D4F34C8C243F495155415EA3271F6"><enum>(1)</enum><header>Algorithmic process</header><text>The term <term>algorithmic process</term> means a computational process, including one derived from machine learning or other artificial intelligence techniques, that processes personal information or other data for the purpose of determining the order or manner that a set of information is provided to a user of an online platform, including the provision of commercial content, the display of social media posts, or any other method of automated decision making, content selection, content recommendation, or content amplification. </text></paragraph><paragraph id="HF9C1353F91FB40DF9C2D4FCB29EAAA11"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H1216DDB86BDE4F849027709BCA6C211D" commented="no"><enum>(3)</enum><header>Constructive knowledge</header><subparagraph id="HA508DE70F18E45B09D1AD70C8AEA64E8" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>constructive knowledge</term> means, for purposes of section 4, with respect to knowledge that a user of an online platform is a covered user, knowledge that is imputed to the operator of the online platform if—</text><clause id="H0DC33B6652304C90B89887322028E77B" commented="no"><enum>(i)</enum><text>the operator directly or indirectly collects, uses, profiles, buys, sells, classifies, or analyzes (using an algorithmic process or other form of data analytics) data about the user to estimate, identify, or classify the age, age range, or proxy thereof;</text></clause><clause id="H5208906C222748FB83DA11980C4DB104" commented="no"><enum>(ii)</enum><text>the operator has or receives data or reporting related to the age of the user on the online platform under the self-regulatory guidelines described in section 1304 of the Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6503">15 U.S.C. 6503</external-xref>) that documents risks and controls, including the existence of operator-controlled data analytics and content analytics capabilities and functions or outputs;</text></clause><clause id="H58184127C1364D5691D103CDC4A21B08" commented="no"><enum>(iii)</enum><text>the operator has or receives complaints from parents or other third parties about the age of the user, whether through the operator's complaint mechanism, by email, or other means conveniently accessible by such parents or third parties;</text></clause><clause id="H305F4646045D4C4FAD2F2901E7CB3D27" commented="no"><enum>(iv)</enum><text>the operator has or receives data or reporting or information from the operator’s internal communications, including documentation about its advertising practices, such as an advertisement insertion order, or other promotional material to marketers, that indicates that data is being collected from the user because the user is within a particular age range; or</text></clause><clause id="H4E5250337EB24261BDDC669779254526" commented="no"><enum>(v)</enum><text>the operator knows that— </text><subclause commented="no" id="H7B50EA082C094487937D1A9990E521FF"><enum>(I)</enum><text>a provider of content on the platform communicates to an advertising network that the content is intended for users of a particular age range or likely to appeal to users of a particular age range, whether directly or indirectly; and </text></subclause><subclause commented="no" id="HAD225864B1804DE785A037876D395CE9"><enum>(II)</enum><text>the user is shown that content.</text></subclause></clause></subparagraph><subparagraph id="H0E7BA8AA52AF4F9198B2291C5CE2463E" commented="no"><enum>(B)</enum><header>Additional factors</header><text>The Commission may issue guidance or promulgate rules in accordance with section 553 of title 5, United States Code, that indicate factors, in addition to those described in subparagraph (A), that should be considered to be constructive knowledge for purposes of this Act.</text></subparagraph></paragraph><paragraph id="H175DF2211ED14BA9B8D41D8A7C258D33"><enum>(4)</enum><header>Covered user</header><text>The term <term>covered user</term> means an individual under the age of 16. </text></paragraph><paragraph commented="no" id="H983CCFA0A3D144108629710DCF578FFE"><enum>(5)</enum><header>Directed to children</header><text>The term <term>directed to children</term> means the targeting of covered users by an online platform or portion of an online platform, as demonstrated by, with respect to such platform or portion of a platform—</text><subparagraph commented="no" id="H79CEEF64A48B4BF281B4C8F1A8A4F6E9"><enum>(A)</enum><text>its subject matter;</text></subparagraph><subparagraph commented="no" id="H14A1072B43EB4480B3D5DDADB42AB209"><enum>(B)</enum><text>its visual content;</text></subparagraph><subparagraph commented="no" id="H2A5DA39958D9402CB79D599A23329476"><enum>(C)</enum><text>the use of animated characters or child-oriented activities for children and related incentives;</text></subparagraph><subparagraph commented="no" id="H15A573324A784C33B046E83D8ABA8922"><enum>(D)</enum><text>music or other audio content;</text></subparagraph><subparagraph commented="no" id="H0FD8FDE0D4C04595A743A49F39DA824D"><enum>(E)</enum><text>the age of models used;</text></subparagraph><subparagraph commented="no" id="HA68F93EF71A247059EE2CA81F3BB46F6"><enum>(F)</enum><text>the presence of—</text><clause commented="no" id="HEC0B747E92764EB3937C809B53D0C76F"><enum>(i)</enum><text>child celebrities; or</text></clause><clause commented="no" id="H8EA578BA4FF34F0F8E89E062ACB2E3EC"><enum>(ii)</enum><text>celebrities who appeal to covered users;</text></clause></subparagraph><subparagraph commented="no" id="HFF19FAD414B74940810F8976FBA7B871"><enum>(G)</enum><text>the language used;</text></subparagraph><subparagraph commented="no" id="HC229A8F8896846D68599C5049F42DB59"><enum>(H)</enum><text>advertising content used on, or used to advertise, such platform; or</text></subparagraph><subparagraph commented="no" id="HED97AC63333A48198E29E0D39AB94076"><enum>(I)</enum><text>reliable empirical evidence relating to—</text><clause commented="no" id="H2F70F6B5AA554DB8B468BA59854EB992"><enum>(i)</enum><text>the composition of the audience of such platform; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB70E3E263752469CA7BBDDD6BC7FECD6"><enum>(ii)</enum><text>the intended audience of such platform.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H631163A28246446484A23BFF0289D618"><enum>(6)</enum><header display-inline="yes-display-inline">Host-selling</header><text display-inline="yes-display-inline">The term <term>host-selling</term> refers to commercial video content that features the same characters or individuals as in the adjacent noncommercial content.</text></paragraph><paragraph commented="no" id="HAD5E81182762440289D27494AD9AAC92"><enum>(7)</enum><header>Influencer marketing</header><text>The term <term>influencer marketing</term> means a tactic by which a company compensates individuals who are deemed to have the potential to review, promote, or sell a product or service online to an intended target audience.</text></paragraph><paragraph id="H9468D07E9ADE4D18BA04D0EF44AC96BB"><enum>(8)</enum><header>Online platform</header><text>The term <term>online platform</term> means any public-facing website, online service, online application, or mobile application which is operated for commercial purposes.</text></paragraph><paragraph id="H11827C2072C945EBB98084A77B97964B"><enum>(9)</enum><header>Operator</header><text>The term <term>operator</term> means any person who, for commercial purposes, in interstate or foreign commerce, operates or provides an online platform.</text></paragraph><paragraph id="HC76FE184D33A45A48A971E6DD0BDB197"><enum>(10)</enum><header>Person</header><text>The term <term>person</term> means any individual, partnership, corporation, trust, estate, cooperative, association, or other entity.</text></paragraph></subsection></section><section id="H263D2CB6618746E292ED0167A723B7F6"><enum>4.</enum><header>Regulation of acts and practices on child-directed platforms</header><subsection id="HD537E9BB026C47EFB7EE48C0EE40CEAC"><enum>(a)</enum><header>Prohibition on certain interface elements</header><paragraph id="H701C25CF1FC548AD9A1C44C3BF2337BC"><enum>(1)</enum><header>In general</header><subparagraph id="H174ED84C5AEF475282751313EFD4EE7B"><enum>(A)</enum><header>Prohibition</header><text>It is unlawful for an operator to operate or provide— </text><clause id="HB04FA7C353E747A09A304EE743AE5D6B"><enum>(i)</enum><text>an online platform or a portion of an online platform directed to children that incorporates an interface element described in subparagraph (B); and</text></clause><clause id="HA8C7BA3F74B143D4A9FE908C9B76679F"><enum>(ii)</enum><text>any online platform that employs an interface element described in subparagraph (B) with respect to a user if the operator has actual or constructive knowledge that the user is a covered user.</text></clause></subparagraph><subparagraph id="H3B5A4E04F4EE49798E084D4D8123000C"><enum>(B)</enum><header>Interface elements described</header><text>The interface elements described in this subparagraph are the following:</text><clause id="HD7D71F18277B44B189584333954207CF"><enum>(i)</enum><text>Any auto-play setting that, without input from the covered user, commences additional video content directly following the video content initially selected by the user.</text></clause><clause id="HB96CBAAACB6B415CB159D8A3310A9E08"><enum>(ii)</enum><text>Messages or alerts that encourage a covered user who is not actively using the platform to engage with the platform.</text></clause><clause id="H95AF4774EBF34DA7A785E85C1DB56C8D"><enum>(iii)</enum><text>Displaying the quantity of positive engagement or feedback that a covered user has received from other users.</text></clause><clause id="HA37BD898EE8A4392806461A68F1C804C"><enum>(iv)</enum><text>Any interface element or setting that unfairly encourages a covered user, due to their age or inexperience, to share personal information, submit content, or spend more time engaging with the platform.</text></clause><clause id="HAE49FAD0C0FC49AFBBD19DDE6DA3B020"><enum>(v)</enum><text>Any interface element that provides a covered user with badges or other visual award symbols based on elevated levels of engagement with the platform.</text></clause><clause id="HE31824A8AA434013A401ED40CD23CF09"><enum>(vi)</enum><text>Any interface element that maximizes a covered user’s spending on the platform, unfairly encourages a covered user to spend money on the platform, facilitates a financial transaction by a covered user on the platform without notification to the covered user's parent, or facilitates a financial transaction by a covered user on the platform that is not in the interest of the covered user.</text></clause></subparagraph></paragraph><paragraph id="H0501AF38F17B4B61B8CCB7BD9E8DF565"><enum>(2)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act and not less frequently than every 5 years thereafter, the Commission shall promulgate regulations under section 553 of title 5, United States Code, that establish any additions or exceptions to the prohibitions under paragraph (1). The Commission may only establish such an exception on the basis that the exception is necessary to provide essential functionality for an online platform and is consistent with the best interests of covered users. </text></paragraph></subsection><subsection id="H9F152FC89140473BB8BEEBB4B860FDA9"><enum>(b)</enum><header>Prohibition on amplification of certain content; user reporting mechanism</header><paragraph id="H3E7C210C78DB4950A51BCD71DF339087"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for an operator to operate or provide— </text><subparagraph id="H6DC4D6AA1298429F9580E121BFDD3A44"><enum>(A)</enum><text>an online platform or portion of an online platform directed to children that employs an algorithmic process described in paragraph (2) on the platform; </text></subparagraph><subparagraph id="HBAC87FEEC479436390B21DA0B2452B7E"><enum>(B)</enum><text>any online platform that employs an algorithmic process described in paragraph (2) with respect to a user of the platform if the operator of the platform has actual or constructive knowledge that the user is a covered user; and</text></subparagraph><subparagraph id="HCE18A4C9A519496984685BEFAD59F257"><enum>(C)</enum><text>an online platform that does not include a mechanism for users or other third parties to report suspected violations of any requirement of this paragraph.</text></subparagraph></paragraph><paragraph id="HAAB754CD0CA348C18FAAECF54783787F"><enum>(2)</enum><header>Algorithmic process described</header><text>An algorithmic process described in this paragraph is an algorithmic process that amplifies, promotes, or encourages covered users' consumption of videos and other forms of content that—</text><subparagraph id="HE26DFAFF94B4464CA2E035901DC3F832"><enum>(A)</enum><text>are of a non-educational nature (as determined by the Commission); and</text></subparagraph><subparagraph id="H651B75E9B16041F0B3F2AB9DB83B79DF"><enum>(B)</enum><text>involve—</text><clause id="HFD875DBAA78F4496A07DB2E71DC866EA"><enum>(i)</enum><text>sexual material; </text></clause><clause id="H2054285D6D794C12B57ED4343A5ED37A"><enum>(ii)</enum><text>promotion of physical or emotional violence or activities that can reasonably be assumed to result in physical or emotional harm, including self-harm, use of weapons, and bullying; </text></clause><clause id="H56BD9B4CE9E540558498E8963E1CBAB8"><enum>(iii)</enum><text>activities that are unlawful for covered users to engage in or the promotion of such activities; or</text></clause><clause id="H0373937B855946ADA31113E24749A370"><enum>(iv)</enum><text>wholly commercial content that is not reasonably recognizable as such to a covered user.</text></clause></subparagraph></paragraph></subsection><subsection id="H119B5169DFBD4A9392AEE0441C75586E"><enum>(c)</enum><header>Prohibition on certain advertising methods</header><paragraph id="HBBF170B95B5A453DAD4614B86724FB6D"><enum>(1)</enum><header>In general</header><text>It shall be unlawful for an online operator to operate or provide—</text><subparagraph id="HB09C70D0AEFF41BE95B0E69B39C6228B"><enum>(A)</enum><text>an online platform or portion of an online platform directed to children that employs an algorithmic process to present any of the content described in paragraph (2) to users of the platform; and</text></subparagraph><subparagraph id="H83A3DE2536C143278BFB893065B7DC3B"><enum>(B)</enum><text>any online platform that employs an algorithmic process to present any of the content described in paragraph (2) to a covered user if the operator of the platform has actual or constructive knowledge that the user is a covered user.</text></subparagraph></paragraph><paragraph id="HF96CA9FC06194CF2A3F8C82644D939F4"><enum>(2)</enum><header>Content described</header><text>The content described in this paragraph is the following:</text><subparagraph id="HC77489F36D104119B8A103008231ADB4"><enum>(A)</enum><text>Content that includes host-selling. </text></subparagraph><subparagraph id="H52D06899E76E43B19034D0899C7E5114"><enum>(B)</enum><text>Program-length advertisements.</text></subparagraph><subparagraph id="HF7825E1CBCEC40E4A1F3018042FF7E08"><enum>(C)</enum><text>Influencer marketing.</text></subparagraph><subparagraph id="H0317E5613D2D4CCEB23BBE801BF759F3"><enum>(D)</enum><text>Online advertising or material with considerable commercial content involving alcohol, nicotine, or tobacco.</text></subparagraph><subparagraph id="HD3C39EB2AC1F4629A012D1086094D5B6"><enum>(E)</enum><text>Online advertising or material with considerable commercial content with any imbedded interactive elements that take advantage of covered users' inexperience or credulity in noncommercial child-directed content.</text></subparagraph><subparagraph id="H5E8FEAFCCA634AF7AC891734EC487A7B"><enum>(F)</enum><text>Content that includes product placement.</text></subparagraph></paragraph><paragraph id="H5FC20FDC94AB40AC94FD1EFA71D5E62C"><enum>(3)</enum><header>Program-length advertisement</header><text>For purposes of this subsection, the term <term>program-length advertisement</term> shall be defined by the Commission through regulation or other public guidance.</text></paragraph></subsection><subsection id="H68D29A22599244D2B3DD4EC534B7D6F5"><enum>(d)</enum><header>Prohibition on use of personal information</header><text>It shall be unlawful for an online platform to use age verification information collected from a covered user for any commercial purpose if—</text><paragraph id="HD13EE8526403425D96F0C18C3682CF51"><enum>(1)</enum><text>the online platform is directed to children; or</text></paragraph><paragraph id="HEF29F0B862DF40CEA4A1DA77171AA1AB"><enum>(2)</enum><text>the operator of the online platform has constructive knowledge that the user is a covered user.</text></paragraph></subsection><subsection id="H25212F37448340CDBE7A478DF4805C06"><enum>(e)</enum><header>Requirement To distinguish commercial content from noncommercial content</header><text>The Commission shall promulgate regulations in accordance with section 553 of title 5, United States Code, to require any online platform or portion of an online platform that is directed to children, or with respect to which the operator of the platform or portion of the platform has constructive knowledge that covered users use the platform or portion of the platform, to incorporate online visual elements or other indicators that distinguish commercial content from noncommercial content.</text></subsection><subsection id="HDBA0AD2111284292A24719C15E388409"><enum>(f)</enum><header>Rulemaking</header><text>The Commission shall promulgate, in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this section.</text></subsection><subsection id="H68C8994689504F41890CFEF90B31D30D"><enum>(g)</enum><header>Effective date</header><text>The requirements of this section shall apply to online platforms beginning on the date that is 1 year after the date of enactment of this Act. </text></subsection></section><section id="HA3226CC87E074895ADDF357201A27722"><enum>5.</enum><header>Online content labeling</header><subsection id="HFF1099B196E343FF92433F32538109F8"><enum>(a)</enum><header>Content labeling system report</header><text>Not later than the date that is 1 year after the date of enactment of this Act, the Commission shall submit to Congress a report—</text><paragraph id="H364A3FFB2DE0458298B44244F1CA4D89"><enum>(1)</enum><text>containing recommendations for a labeling system to allow covered users and parents to identify noncommercial, educational, and enriching content for covered users online; and </text></paragraph><paragraph id="H4FBDD1AE1C54491C96C9BD245BD55B67"><enum>(2)</enum><text>addressing considerations regarding how such labeling system should—</text><subparagraph id="H1D1C579A46394B8EAC6D39C7F6AEF352"><enum>(A)</enum><text>analyze content based on evidence-based criteria;</text></subparagraph><subparagraph id="H2AE8029852E643E4B21DA7B0752CEB36"><enum>(B)</enum><text>employ an easy-to-understand visual cue for parents to identify content described in paragraph (1);</text></subparagraph><subparagraph id="HE6888B240EC2427582D3E1AD8E5196DF"><enum>(C)</enum><text>receive regular review to determine its effectiveness; and</text></subparagraph><subparagraph id="H0428948DBDA14265BC759BDF4B12FF15"><enum>(D)</enum><text>include a mechanism for users to report to the Commission complaints of mislabeled content and for the Commission to remedy such instances of mislabeled content.</text></subparagraph></paragraph></subsection><subsection id="HE6301E11F0D64B4CBBFD01106A74D7BC"><enum>(b)</enum><header>Consultation</header><text>The report described in subsection (a) shall be developed by the Commission in consultation with an advisory board, to be created and convened by the Commission, which is comprised of experts in child development, child health, education, and media.</text></subsection></section><section id="H4F4BCE32506546769C076D562BE37700"><enum>6.</enum><header>Transparency and auditing</header><subsection id="H8F57A7A35BC34509BC0257383F4000BD"><enum>(a)</enum><header>Transparency</header><text>The Commission shall promulgate regulations in accordance with section 553 of title 5, United States Code, requiring an operator of an online platform which is directed to children to publish and maintain a publicly accessible digital record of the viewable or playable content of each such platform. Such regulations shall require the operator to ensure that such record does not include personal information (as defined in section 1302 of the Children's Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501</external-xref>)) or, as appropriate, user-generated content.</text></subsection><subsection id="HFB7FB2CAD3554083AF0B9970C9F5303F"><enum>(b)</enum><header>Annual platform audits</header><text>The regulations promulgated pursuant to subsection (a) shall include the establishment of an annual audit process, to be conducted by the Commission during the 5-year period subsequent to the date of enactment of this Act, for each of the 25 online platforms directed to children with the highest total number of covered users, to evaluate the level of compliance by each such platform with the requirements under this Act. </text></subsection><subsection id="HE7043AD50E3A4174916C029F47D0F284"><enum>(c)</enum><header>Report</header><text>The Commission shall submit annual reports to Congress based on the audits described in subsection (b) that—</text><paragraph id="H8C68D62E6F314118828EBF70B5572111"><enum>(1)</enum><text>describe the level of compliance by the platforms described in such subsection with the requirements under this Act; and</text></paragraph><paragraph id="H9CF20E68F09A47749071B36B0C7AADB0"><enum>(2)</enum><text>provide recommendations for such legislation and administrative actions as the Commission determines appropriate based on the audit findings.</text></paragraph></subsection></section><section id="H2293C367BFED46DA8084C44E1CE17157"><enum>7.</enum><header>Grant program</header><subsection id="HF3BDBDB004F044F8B8E403477953790B"><enum>(a)</enum><header>Establishment</header><paragraph id="H9E0C3958DA1F4B2EB1DE3F670AAA88D6"><enum>(1)</enum><header>In general</header><text>The Secretary of Commerce (in this section referred to as the <term>Secretary</term>) shall make grants to eligible persons to foster the creation and promotion of advertisement-free and educational online content (such as videos and applications) for covered users.</text></paragraph><paragraph id="HCB1BECEBE302464D9BE9A4DE1D2AA7D4"><enum>(2)</enum><header>Eligible person</header><text>For purposes of this section, the term <term>eligible person</term> means a person that has submitted an application, as approved by the Secretary pursuant to the eligibility requirements developed under subsection (b), for the creation and promotion of advertisement-free and educational online content for covered users.</text></paragraph></subsection><subsection id="H05B1A7C9B72E4DEAA84A469C2A874CA0"><enum>(b)</enum><header>Advisory council</header><text>The Secretary shall establish and convene an Advisory Council on Children’s Online Content, which shall be—</text><paragraph id="HED1B7A3550CD41A9BF3B7405F8505743"><enum>(1)</enum><text>comprised of experts in education, child development, psychology, online media, and other related disciplines; and</text></paragraph><paragraph id="H3CA614607A334FC5A9B2A8302A4EFF78"><enum>(2)</enum><text>tasked with developing evidence-based criteria for grant eligibility and grant distribution.</text></paragraph></subsection><subsection id="H993A444E4BF2491AB2421EC5A00210B2"><enum>(c)</enum><header>Authorization of appropriations</header><paragraph id="H95D88F99ABB842F59379B995459478B1"><enum>(1)</enum><header>In general</header><text>To carry out this section, there is authorized to be appropriated—</text><subparagraph id="H97CEBD9F64BD43CD9A628DE58E56C9C3"><enum>(A)</enum><text> for fiscal year 2021, $4,000,000; </text></subparagraph><subparagraph id="HEA04CF61444041AAA4C1FC5BA2607116"><enum>(B)</enum><text>for fiscal year 2022, $8,000,000; </text></subparagraph><subparagraph id="HC3B7CE96A77940C19CFE2EBA37EEC2C0"><enum>(C)</enum><text> for fiscal year 2023, $10,000,000; and </text></subparagraph><subparagraph id="HFC98404303634277BF34B018FE556847"><enum>(D)</enum><text>for fiscal year 2024, $12,000,000. </text></subparagraph></paragraph><paragraph commented="no" id="HA57CA24A18FD4C19BF9047A955EB1B45"><enum>(2)</enum><header>Availability of funds</header><text>Any amount appropriated under this subsection for any fiscal year shall remain available for the purposes of carrying out any application approved during such fiscal year for an additional period of 1 year after the end of such fiscal year.</text></paragraph></subsection></section><section id="H1E0CA12BE0FD4ABD8BAEF0C6B3C485A5"><enum>8.</enum><header>Federal Trade Commission study</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall conduct and publish a study, using any compulsory processes available to the Commission as necessary, relying on public data and information if available and sufficient, and incorporating public comment, on harms resulting from interface elements and advertising methods on online platforms that are directed to children (and best practices for avoiding such harms), including the following: </text><paragraph id="H4C233ED10AE44CE29F2D202037BA2FFE"><enum>(1)</enum><text>The use of algorithmic processes and any other automated systems used for non-commercial content recommendation or amplification on platforms that are directed to covered users.</text></paragraph><paragraph id="H9B7B4438E2F34143ADF66FBDC764205E"><enum>(2)</enum><text>The effect of algorithmic processes and any other automated systems used for non-commercial content recommendation or amplification on platforms that are directed to covered users.</text></paragraph></section><section id="HCF32F2708FA64789BB93063018711C34"><enum>9.</enum><header>Administration and enforcement</header><subsection id="H0EE8981E08864504BEDAD5A2CB69519C"><enum>(a)</enum><header>In general</header><text>This Act shall be enforced by the Commission under the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subsection><subsection id="HC4540E3E339D4FFEAF42CAA5C81F984C"><enum>(b)</enum><header>Actions by Commission</header><paragraph id="H13D9B83718B84141AD7900E7C59E861F"><enum>(1)</enum><header>In general</header><text>The Commission shall prevent any person from violating this Act or any regulation promulgated by the Commission under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties, as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. </text></paragraph><paragraph id="HC4168B4CB8A24C00B290C65958689EBB"><enum>(2)</enum><header>Penalties and privileges</header><text>Any person that violates this Act or any regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act in the same manner, by the same means, and with the same jurisdiction, power, and duties, as though all applicable terms and provisions of the Federal Trade Commission Act were incorporated into and made a part of this Act.</text></paragraph></subsection><subsection id="HDFC3C487B9A049F98F9B29754CAB1689"><enum>(c)</enum><header>Civil penalty</header><text>A violation of this Act, or a regulation promulgated under this Act, shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subsection><subsection id="H7BDB090B6D3F48818BD63CBFB93DDB4B"><enum>(d)</enum><header>Enforcement by States</header><paragraph id="H6B571A32E0534DA2896DE3108E730256"><enum>(1)</enum><header>In general</header><text>If the attorney general of a State has reason to believe that an interest of the residents of the State has been or is being threatened or adversely affected by a violation of this Act or a regulation promulgated under this Act, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States to obtain appropriate relief.</text></paragraph><paragraph id="H1D57B5D3B29A4048A30CA04930757ED1"><enum>(2)</enum><header>Rights of commission</header><subparagraph id="H11A24792CB72452CA71EF8E5094EA60E"><enum>(A)</enum><header>Notice to commission</header><clause id="HE72B70234B6B4254AB8AA00629C9132C"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), the attorney general of a State, before initiating a civil action under paragraph (1), shall provide written notification to the Commission that the attorney general intends to bring such civil action.</text></clause><clause id="H1670C5063DF54F0B8028606DD080143E"><enum>(ii)</enum><header>Contents</header><text>The notification required under clause (i) shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause id="HAC5641608F0241D58FAF0052B8FBD248"><enum>(iii)</enum><header>Exception</header><text>If it is not feasible for the attorney general of a State to provide the notification required under clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph id="H965FBE1E7A774E01A7EE7784D3938BB5"><enum>(B)</enum><header>Intervention by commission</header><text>The Commission may—</text><clause id="HC54D639784AD475BBD41F960829FCF3A"><enum>(i)</enum><text>intervene in any civil action brought by the attorney general of a State under paragraph (1); and</text></clause><clause id="HAF0CDF450EEE4FB98B2B483DC34E56F1"><enum>(ii)</enum><text>upon intervening—</text><subclause id="H14BB7614849A4971BF3D99C4C40FC41B"><enum>(I)</enum><text>be heard on all matters arising in the civil action; and</text></subclause><subclause id="H2BBDAE8CF25D49EC8B74DD0390189A66"><enum>(II)</enum><text>file petitions for appeal of a decision in the civil action.</text></subclause></clause></subparagraph></paragraph><paragraph id="H4A810D295C6B47E8BCA71FE29CD581ED"><enum>(3)</enum><header>Investigatory powers</header><text>Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence. </text></paragraph></subsection><subsection id="H234FE3334A8C43BAB7FE1DB6CAA494A1"><enum>(e)</enum><header>Effect on other laws</header><paragraph id="H4C02C9E715F84B458409A5273ECACA2A"><enum>(1)</enum><header>Authority of the Commission</header><text>Nothing contained in this Act shall be construed to limit the authority of the Commission under any other provisions of law.</text></paragraph><paragraph id="H2CF6009392344B2890BFC0920D78CCF0"><enum>(2)</enum><header>Relation to State law</header><text>Nothing in this Act may be construed to preempt any provision of State law that provides greater protection to consumers than is provided in this Act.</text></paragraph></subsection></section></legis-body></bill>
