which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide incentives for the purchase of water-efficient products, and for other purposes.</official-title></form><legis-body id="HECA9E617D560404791108807E95B1E7C" style="OLC"><section id="H04E1B33E00CD4148BF03811D62A16F48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Advanced Technologies for Efficient Resource Use Act of 2021</short-title></quote>.</text></section><section id="H80041B812E4C4BBB9E2B1E34F658E13E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HE5D379253B644FAEBE51C5FE1D14C8D6"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H442E4F2A09D746BC9BC5FE3200277119"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given such term in section 7902(a) of title 5, United States Code.</text></paragraph><paragraph id="HECC2852B67084E4FA4DF4E721FA6A2B3" commented="no"><enum>(3)</enum><header>Covered consumer</header><text>The term <term>covered consumer</term> means an individual served by an eligible entity.</text></paragraph><paragraph id="H9E5EC16AE93C4CFE89C6DF6BEDF6722B"><enum>(4)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HD7AD21A1E4AA4939B2D90DBD54EE8B1B"><enum>(A)</enum><text>a State, local, or Tribal government;</text></subparagraph><subparagraph id="H2E41A3496F5847E98991D0A53DF7073E"><enum>(B)</enum><text>a drinking water utility or wastewater utility;</text></subparagraph><subparagraph id="H947BB87AC0A84E58A6E0BD9FE9EE23DA"><enum>(C)</enum><text>a municipal water authority or a regional water authority; or</text></subparagraph><subparagraph id="HE62080F1C7174432806F43E12A0EE48E"><enum>(D)</enum><text>a nonprofit organization.</text></subparagraph></paragraph><paragraph id="HC5D99D616B0D431C8EBEAB31D78917E8"><enum>(5)</enum><header>Incentive</header><text display-inline="yes-display-inline">The term <term>incentive</term> includes—</text><subparagraph id="H7FD08B6B31E4492BB90A39B583141B82"><enum>(A)</enum><text>rebates, vouchers, and other financial incentives; and</text></subparagraph><subparagraph id="HA8D2E7147AA84D968B48C88F442889A7"><enum>(B)</enum><text>the direct installation of a WaterSense product.</text></subparagraph></paragraph><paragraph id="H1FA42FCEB48E44B38DDFF51E15EDD841" commented="no"><enum>(6)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization that—</text><subparagraph id="H18842408F1B34FEFB20934E0F2E44AA1"><enum>(A)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>); and</text></subparagraph><subparagraph id="H43B7EAEEFAF64340A86AFEC63A11D340"><enum>(B)</enum><text>is exempt from taxation under section 501(a) of such Code.</text></subparagraph></paragraph><paragraph id="HA16851CB5FBA4AFB859713AFCECF2D7C" commented="no"><enum>(7)</enum><header>Product</header><text display-inline="yes-display-inline">The term <term>product</term> means a product, building, landscape, facility, process, or service.</text></paragraph><paragraph id="H07E3839DFCCB4EA48D0F8C2257656644"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="H09C97727CD54431B913F455E16111FCD" commented="no"><enum>(9)</enum><header>WaterSense product</header><text display-inline="yes-display-inline">The term <term>WaterSense product</term> means a product that is certified to display the WaterSense label under the WaterSense program established under section 324B of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294b">42 U.S.C. 6294b</external-xref>).</text></paragraph></section><section id="HA81AB05AA3EA4616AA66DD35D5B7A32E"><enum>3.</enum><header>Federal procurement of WaterSense products</header><subsection id="H58727601794B41D18ACCD3498757547D" display-inline="no-display-inline"><enum>(a)</enum><header>Procurement</header><paragraph id="HE13EAAE16F2D41889D1EA8E2BC87BE10"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), in procuring any water-consuming product, the head of an agency shall procure a WaterSense product.</text></paragraph><paragraph id="HD469D274F48A47E586CD58F923E5C453"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply if—</text><subparagraph id="H080ABAAE0C844B0597B687ED754DABD4"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to the type of water-consuming product being procured, the head of an agency finds, in writing, that—</text><clause id="HA6F4900D04FD461682AA81380A3CAF56"><enum>(i)</enum><text display-inline="yes-display-inline">no WaterSense product is cost-effective over the life of such type of product, taking current and future water and wastewater cost savings into account; or</text></clause><clause id="HD9D639A354164EFAB81B001678862C9F"><enum>(ii)</enum><text>no WaterSense product of such type is reasonably available to meet the functional requirements of the agency; or</text></clause></subparagraph><subparagraph id="HE79306F3B7EA4767A213D4EB23C509B5"><enum>(B)</enum><text display-inline="yes-display-inline">the water-consuming product being procured is designed for use in combat or combat-related missions.</text></subparagraph></paragraph></subsection><subsection id="HF4A8E48983214C89973446FA80C58C9E" commented="no"><enum>(b)</enum><header>Installation and maintenance</header><text display-inline="yes-display-inline">As applicable, the head of an agency that procures a WaterSense product under subsection (a)(1) shall use a certified professional (including a licensed plumber or a licensed mechanical contractor, as appropriate) to install and maintain such product.</text></subsection><subsection id="HCCE954A6140C4697B6D062D284AA6F4A" commented="no"><enum>(c)</enum><header>Measures To reduce water consumption</header><text>The head of each agency shall consider adopting measures to reduce agency water consumption, including such measures as the use of—</text><paragraph id="H2E149FCD95B34EEABCFFC0C387C8719F" commented="no"><enum>(1)</enum><text>water reuse, reclamation, or recycling technology;</text></paragraph><paragraph id="HAFF56A732A7B46F9A04A054EA3E39B2C" commented="no"><enum>(2)</enum><text>water leak detection technology; and</text></paragraph><paragraph id="H0295E656B5364A9ABD4883D96A64D10C" commented="no"><enum>(3)</enum><text>products that—</text><subparagraph id="HC6E395AAFFCC4FFA8807C2793D027BB9"><enum>(A)</enum><text>do not consume water; and</text></subparagraph><subparagraph id="H30139460639C4B4EBD87DBE48FE248EB"><enum>(B)</enum><text>perform similar functions as comparable water-consuming products.</text></subparagraph></paragraph></subsection><subsection id="HA9F228D04B814C3880D069A79946175F" commented="no"><enum>(d)</enum><header>Listing of WaterSense products</header><text display-inline="yes-display-inline">The Administrator of General Services shall clearly identify and prominently display, in a listing of water-consuming products, WaterSense products.</text></subsection><subsection id="HC6AABC993CB3418E94EC5D2605BFBD62"><enum>(e)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this section, the Administrator of the Environmental Protection Agency and the Director of the Office of Management and Budget shall issue regulations to carry out this section.</text></subsection></section><section id="HD0505BD933E9449287233E803CBD9C66"><enum>4.</enum><header>Incentives for the purchase of WaterSense products</header><subsection id="H7E6C3F0FDE304FF39AD1D7B6575109E1" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a program to provide grants to eligible entities to provide incentives to covered consumers for the purchase of a WaterSense product.</text></subsection><subsection id="H3458AD91542440D78567FD0EC2B2EC16"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an eligible entity shall—</text><paragraph id="HC7D4AE2DB3904726934A8DCA6BD70CBD"><enum>(1)</enum><text>submit an application to the Administrator at such time, in such form, and containing such information as the Administrator may require; and</text></paragraph><paragraph id="H4EC54DD8F6CD4E5FA882F9DF807622AC"><enum>(2)</enum><text>provide assurances, which the Administrator determines are satisfactory, that the eligible entity will use such grant to supplement, but not supplant, other incentives that are available to a covered consumer for the purchase of a WaterSense product.</text></paragraph></subsection><subsection id="HAEC6DAECADA14B17857977A72D053B37" commented="no"><enum>(c)</enum><header>Evaluation criteria for applications</header><paragraph id="H25F08B8A153C4717B682D50F7A9B153E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In evaluating an application submitted under subsection (b)(1), the Administrator shall consider—</text><subparagraph id="H619FA8A91062403D94ADE0564244DF3D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the estimated effect of providing incentives;</text></subparagraph><subparagraph id="H8339F627761B4FCCBE986497B4A99A7E" commented="no"><enum>(B)</enum><text>if the eligible entity previously received a grant under this section—</text><clause id="H490995E987D04EC3A2C95185701A70BF"><enum>(i)</enum><text>the degree to which the use of such grant encouraged the purchase of WaterSense products; and</text></clause><clause id="H7AB08DA920A0441CA478A3B1E1624F59"><enum>(ii)</enum><text>whether there are amounts of such grant that remain unused; and</text></clause></subparagraph><subparagraph id="H12C0D8AFD28C45FFB5DBD2904A098A9B"><enum>(C)</enum><text>whether the eligible entity promotes or implements a program to recycle or manage the disposal of any products that are replaced as a result of the provision of incentives under this section.</text></subparagraph></paragraph><paragraph id="H2C9D320172094566ADB9BDC9A5CF7CAC"><enum>(2)</enum><header>Priority</header><text>The Administrator shall prioritize providing grants under this section to eligible entities that will provide incentives to low- and middle-income households.</text></paragraph></subsection><subsection id="H799C2DFC8028490EA7DE6D924B8C89D4" display-inline="no-display-inline"><enum>(d)</enum><header>Use of grant</header><paragraph id="HAC835FAEE13443EA8FB3293285A66993"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall—</text><subparagraph id="H30E55561D9E04089B3325DAD0CC7F2C7"><enum>(A)</enum><text>use such grant to provide incentives to covered consumers that purchase a WaterSense product; or</text></subparagraph><subparagraph id="HC5AF330DCCEF464783D84468A84F7E17"><enum>(B)</enum><text>with approval from the Administrator, provide some, or all, of such grant to another eligible entity for use in accordance with subparagraph (A).</text></subparagraph></paragraph><paragraph id="H94C51710EA604A888096E435B2CAE26C"><enum>(2)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Not more than 50 percent of each grant provided under this section may be used to pay for the administrative cost of providing incentives in accordance with paragraph (1).</text></paragraph><paragraph id="H3DA55DDEE7F647AA946AD2506CA934F1"><enum>(3)</enum><header>Incentive amounts</header><text display-inline="yes-display-inline">With respect to rebates, vouchers, and other such financial incentives, an eligible entity shall determine the amount to provide based on the following:</text><subparagraph id="HC5C510E5EA554B81A3E2685AFE613269"><enum>(A)</enum><text>The amount of the grant provided to the eligible entity under this section.</text></subparagraph><subparagraph id="H06E41C56E6934596946CB6865FFC07C4"><enum>(B)</enum><text>The amount of any other incentives that are available to a covered consumer for the purchase of a WaterSense product.</text></subparagraph><subparagraph id="H4A0D473B7F6548C186F6A65E3AD44F20"><enum>(C)</enum><text>The estimated amount necessary to encourage a covered consumer to purchase a WaterSense product.</text></subparagraph><subparagraph id="HCACCABAB3E03477191BF1CC69FDF1005"><enum>(D)</enum><text>As applicable, the costs to a covered consumer for onsite preparation, assembly, and installation of a WaterSense product.</text></subparagraph></paragraph></subsection><subsection id="HD93F340EAD3E4E51AFF9E4389FF5D39E" commented="no"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="HD82F81580769437A87B8E30BA735A43D" commented="no"><enum>(1)</enum><text>$50,000,000 for fiscal year 2022;</text></paragraph><paragraph id="HA778868764F64165BA2A473B1EDB3C42" commented="no"><enum>(2)</enum><text>$100,000,000 for fiscal year 2023;</text></paragraph><paragraph id="HDC4E4E2FA7AC4BC191645B12C4E37D78" commented="no"><enum>(3)</enum><text>$150,000,000 for fiscal year 2024;</text></paragraph><paragraph id="H425D81BDF9984FEFA94E9249FF67DEC9" commented="no"><enum>(4)</enum><text>$100,000,000 for fiscal year 2025; and</text></paragraph><paragraph id="HE6674C4B654E4022BB9372B4563BE056" commented="no"><enum>(5)</enum><text>$50,000,000 for fiscal year 2026.</text></paragraph></subsection></section><section id="HADAC85218438466C80751B2378AB7251"><enum>5.</enum><header>Exclusion from gross income of amounts received as incentives for the purchase of WaterSense products</header><subsection id="HFE6486A792304657A52A637155D2DDCE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 140 the following new section:</text><quoted-block style="OLC" id="H261D2DA9EA71456082015B72BE2D2652"><section id="H11698B192ACC45DEACC644DDB69C7AB5"><enum>139I.</enum><header>Incentives for the purchase of WaterSense products</header><subsection id="H54616C19F10B44789E4FFBFC7CDB5C25"><enum>(a)</enum><header>In general</header><text>In the case of an individual, gross income does not include any amount received as an incentive under section 3 of the <short-title>Water Advanced Technologies for Efficient Resource Use Act of 2021</short-title>.</text></subsection><subsection id="HEAEDF4B7F0414215814DDA49CAC0431D"><enum>(b)</enum><header>Denial of double benefit</header><paragraph id="H60230CEE530445AE86CB6954FB5B3C4E"><enum>(1)</enum><header>Deductions and credits</header><text>No deduction or credit under this subtitle shall be allowed for any expenditure with respect to which any amount excluded under subsection (a) was provided.</text></paragraph><paragraph id="H53DA5697027B4E3CB25477C7A736802B"><enum>(2)</enum><header>Basis adjustment</header><text>The adjusted basis of any property with respect to which an amount excluded under subsection (a) is provided shall be reduced by the amount so excluded.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDC24C1A272A047679C65A8A9FE5ED5DE"><enum>(b)</enum><header>Conforming amendment</header><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting before the item relating to section 140 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H33608D682D55428B98FEC8616CBDE6A5"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 139I. Incentives for the purchase of WaterSense products.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2A1962404BD74836B277F4420AD4C9EF"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this section.</text></subsection></section><section id="HD875E5334FB44E4B9B30A63C219960E1" section-type="subsequent-section" display-inline="no-display-inline"><enum>6.</enum><header>Modifications to income exclusion for conservation subsidies</header><subsection id="H105C8D858F0D4C3083DFF7340BF8321C"><enum>(a)</enum><header>In general</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/136">section 136</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H048B2C070F394F24AD93E0314E61778A"><enum>(1)</enum><text>by striking <quote>any subsidy provided</quote> and inserting</text><quoted-block display-inline="yes-display-inline" id="H9A1B9A765F5E4CBC85EA3BFFED2B9D72" style="OLC"><text>any subsidy—</text><paragraph id="HA47B1A28A8164C9DB8190E6DE454188B"><enum>(1)</enum><text>provided</text></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph><paragraph id="HCEEE819F8508452AA60ABE6D4DA4CEC8"><enum>(2)</enum><text>by striking the period at the end and inserting a comma, and</text></paragraph><paragraph id="HD16A6017D154429DBD3A9118A181B1CC"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H6C901C56C0C645D8A1A32536267215B1" style="OLC"><paragraph id="H15EE388BB04B420AA85949D2041368DE"><enum>(2)</enum><text>provided (directly or indirectly) by a public utility to a customer, or by a State or local government to a resident of such State or locality, for the purchase or installation of any water conservation or efficiency measure, or</text></paragraph><paragraph id="H09892B8E109D4551B2E7732BAFD40095"><enum>(3)</enum><text>provided (directly or indirectly) by a storm water management provider to a customer, or by a State or local government to a resident of such State or locality, for the purchase or installation of any storm water management measure.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA7DFA4A654B44FE4BAC026E4E5BF8A51"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HCDA8ADC73F79402AAD4C02D837965B23"><enum>(1)</enum><header>Definition of water conservation or efficiency measure and storm water management measure</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/136">Section 136(c)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph id="HD2B82AA8FDED46789C39B79FAD8B1FC2"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Energy conservation measure</header-in-text></quote> in the heading thereof and inserting <quote><header-in-text level="subsection" style="OLC">Definitions</header-in-text></quote>,</text></subparagraph><subparagraph id="H43DE8AFD4813453A8DD5861777B5E84F"><enum>(B)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">In general</header-in-text></quote> in the heading of paragraph (1) and inserting <quote><header-in-text level="paragraph" style="OLC">Energy conservation measure</header-in-text></quote>, and</text></subparagraph><subparagraph id="HB8E9EC61C52241939D43FF6668AE3841"><enum>(C)</enum><text>by redesignating paragraph (2) as paragraph (4) and by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H64ADAD785B3C4B48A3C2C0662DD83A2D" style="OLC"><paragraph id="H76DC87352FA94F4E89499C5477E17AA7"><enum>(2)</enum><header>Water conservation or efficiency measure</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>water conservation or efficiency measure</term> means any evaluation of water use, or any installation or modification of property, the primary purpose of which is to reduce consumption of water or to improve the management of water demand with respect to one or more dwelling units.</text></paragraph><paragraph id="H28A5008DA9BC47FFAE2CA40567DE0A77"><enum>(3)</enum><header>Storm water management measure</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>storm water management measure</term> means any installation or modification of property primarily designed to reduce or manage amounts of storm water with respect to one or more dwelling units.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3C8FBE2133A34DAD9FC7CA74DAA77818"><enum>(2)</enum><header>Definition of public utility</header><text>Section 136(c)(4) of such Code (as redesignated by paragraph (1)(C)) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H0EFCD69E92BC4A24A69F2F50E35F6727" style="OLC"><subparagraph id="HEEA427A2978B4A1C87114F3B95C1EFC3"><enum>(B)</enum><header>Public utility</header><text>The term <term>public utility</term> means a person engaged in the sale of electricity, natural gas, or water to residential, commercial, or industrial customers for use by such customers.</text></subparagraph><subparagraph id="H63FFFF323EDA46108738FABA33B93F31"><enum>(C)</enum><header>Storm water management provider</header><text>The term <term>storm water management provider</term> means a person engaged in the provision of storm water management measures to the public.</text></subparagraph><subparagraph id="H80EA6F7D8CF241F0B369350B200674C0"><enum>(D)</enum><header>Person</header><text>For purposes of subparagraphs (B) and (C), the term <term>person</term> includes the Federal Government, a State or local government or any political subdivision thereof, or any instrumentality of any of the foregoing.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H677389A58A164E478465ED1E70CCE66A"><enum>(3)</enum><header>Clerical amendments</header><subparagraph id="H4E2E5C3FB82440B28C951AFD2FF26829"><enum>(A)</enum><text>The heading of section 136 of such Code is amended—</text><clause id="HEABC6E614E1940DF85B4F49F0001AC2B"><enum>(i)</enum><text>by inserting <quote><header-in-text level="section" style="OLC">and water</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">energy</header-in-text></quote>, and</text></clause><clause id="H8EFA204CE17D40729E397910F107C012"><enum>(ii)</enum><text>by striking <quote><header-in-text level="section" style="OLC">provided by public utilities</header-in-text></quote>.</text></clause></subparagraph><subparagraph id="H90DB046353B54FBF9A4B38E026A1BD95"><enum>(B)</enum><text>The item relating to section 136 in the table of sections of part III of subchapter B of chapter 1 of such Code is amended—</text><clause id="H89A95187898D4D2996B8B723BC786478"><enum>(i)</enum><text>by inserting <quote>and water</quote> after <quote>energy</quote>, and</text></clause><clause id="HA10AF2C50B30436B80A17300A9C4E08F"><enum>(ii)</enum><text>by striking <quote>provided by public utilities</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H203BA31B47074AEDB20BE0D7A42969BF"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after the date of enactment of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HA41726E040344A4F96B304A3007DAA71"><enum>(d)</enum><header>No inference</header><text>Nothing in this section or the amendments made by this section shall be construed to create any inference with respect to the proper tax treatment of any subsidy received directly or indirectly from a public utility, a storm water management provider, or a State or local government for any water conservation measure or storm water management measure before the date of the enactment of this section.</text></subsection></section></legis-body></bill>
