R. 5436</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210930">September 30, 2021</action-date><action-desc><sponsor name-id="B001285">Ms. Brownley</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the sale of a firearm unless the firearm or packaging carries a label that provides the number of the National Suicide Prevention Lifeline.</official-title></form><legis-body id="H5E263210847F48F28D62B163BCC986BC" style="OLC"><section id="HF5CD5090BBF94BD78782D5D43D626A52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Suicide Prevention Act</short-title></quote>.</text></section><section id="H40C3BC6D47A04A61BA918B7678E09AD8"><enum>2.</enum><header>Labeling requirement</header><subsection id="H62860E810F844622AC9D0F523B043260"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding the exclusion of firearms from the definition of consumer product in section 3(a)(5)(E) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)(E)</external-xref>), it shall be unlawful for a manufacturer or retailer to sell or offer for sale any firearm that does not meet the requirements of subsection (b).</text></subsection><subsection id="HC11BCE01F67E48538E7246EBCBD0AFED"><enum>(b)</enum><header>National Suicide Prevention Hotline label</header><text>A firearm meets the requirements of this subsection if a clear and conspicuous label is attached to the firearm or appears on any packaging of the firearm and on any descriptive material included with the firearm that—</text><paragraph commented="no" id="H0DA26C4AAEB946E4AC7ECAC66C513132"><enum>(1)</enum><text>is written in both English and Spanish;</text></paragraph><paragraph id="H626A2D82B3944D8C9DC0B56CFA73FA1D"><enum>(2)</enum><text display-inline="yes-display-inline">in English, reads <quote>IF YOU OR SOMEONE YOU KNOW IS CONTEMPLATING SUICIDE, PLEASE CALL THE NATIONAL SUICIDE PREVENTION LIFELINE AT</quote> followed by the toll-free phone number of the National Suicide Prevention Lifeline, maintained by the Assistant Secretary for Mental Health and Substance Use under section 520E–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-36c">42 U.S.C. 290bb–36c</external-xref>), or any successor to such toll-free number; and</text></paragraph><paragraph id="H2A3218EDF029498A98BB5262C3520CA7"><enum>(3)</enum><text display-inline="yes-display-inline">contains a yellow triangle containing an exclamation mark that appears immediately before the words <quote>IF YOU</quote> on the label.</text></paragraph></subsection><subsection id="HDCA2830EC15C40859FB37C1CF26CAC99"><enum>(c)</enum><header>Enforcement</header><text>A violation of the prohibition in subsection (a) shall be treated as a violation of section 19(a) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2068">15 U.S.C. 2068</external-xref>). Any person who violates subsection (a) shall be subject to the penalties set forth in section 20 and 21 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069</external-xref>; 2070).</text></subsection><subsection id="H7F37DEBB216F482DA2C5FD7DF4AE2A5B"><enum>(d)</enum><header>Retailer defined</header><text>In this section, the term <quote>retailer</quote> includes a dealer, as such term is definition in section 921(a) of title 18, United States Code.</text></subsection><subsection id="H4B45E557E7784F7E8345BD8BA8A60732"><enum>(e)</enum><header>Effective date</header><text>This Act shall take effect on the date that is two years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
