which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To regulate bump stocks in the same manner as machineguns.</official-title></form><legis-body id="H873A36969B8F4F9E8CD80027A55EBB68" style="OLC"><section id="HDA57AC6A8D124BF78579C2420487E37D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Bump Stock Loophole Act of 2021</short-title></quote>.</text></section><section id="HC94A3880D872430B982025F14A38A35F"><enum>2.</enum><header>Bump stocks</header><subsection id="HA20F09E496FF4192A84989E56473EA09"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H31C63339EFB3440C9AB90572D28FC734"><enum>(1)</enum><text>in subsection (a), by striking <quote>and (8) a destructive device.</quote> and inserting <quote>(8) a destructive device; and (9) a bump stock.</quote>; and</text></paragraph><paragraph id="H5422F594739948EEBA44124489E822A6"><enum>(2)</enum><text>by adding at the end the following new subsections:</text><quoted-block id="H09DFD87373A44EB593F7DE181BDDF7D4" style="OLC"><subsection id="H36D1288007844D6AB35EAF544803EC58"><enum>(n)</enum><header>Bump stock</header><text>The term <term>bump stock</term> means any of the following:</text><paragraph id="HC3F24B381B90475E9CCA7DB38C2ECA00"><enum>(1)</enum><text>Any manual, power-driven, or electronic device that is designed such that when the device is attached to a semiautomatic weapon, the device eliminates the need for the operator of a semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="H787A740B08C14F42984D3D70DB9A1612"><enum>(A)</enum><text>materially increases the rate of fire of the semiautomatic weapon, or</text></subparagraph><subparagraph id="H843E74E7D6BC482EA36849DDE888C877"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph><paragraph id="H5457011A789B4EFCACB4183B6BADB79E"><enum>(2)</enum><text>Any part or combination of parts that is designed and functions to eliminate the need for the operator of a semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="H429FDE1E29404387B334AD01CC9ED0AF"><enum>(A)</enum><text>materially increases the rate of fire of a semiautomatic weapon, or</text></subparagraph><subparagraph id="H4BD5E0FA26ED4B7DB9B1E68FDDE55A3B"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph><paragraph id="HF9773637FE424828BAB2390CBE829A70"><enum>(3)</enum><text>Any semiautomatic weapon that has been modified in any way that eliminates the need for the operator of the semiautomatic weapon to make a separate movement for each individual function of the trigger and—</text><subparagraph id="HED5CCEAD3D464CE8BF11438C8552BE2E"><enum>(A)</enum><text>materially increases the rate of fire of the semiautomatic weapon, or</text></subparagraph><subparagraph id="H98162443018E479AAFEE14ECB7DBE73E"><enum>(B)</enum><text>approximates the action or rate of fire of a machinegun.</text></subparagraph></paragraph></subsection><subsection id="H7D2E9B99EC8445B7A9299582135D13C7"><enum>(o)</enum><header>Semiautomatic weapon</header><text>The term <term>semiautomatic weapon</term> means any repeating weapon that—</text><paragraph id="HB82BD845935C4F40B7D576FE6B0162A5"><enum>(1)</enum><text>utilizes a portion of the energy of a firing cartridge or shell to extract the fired cartridge case or shell casing and chamber the next round, and</text></paragraph><paragraph id="H3435C6480F7B41DEABB8CA6F63858BF3"><enum>(2)</enum><text>requires a separate function of the trigger to fire each cartridge or shell.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H38F170107C5C4857B00438F45EB0861A"><enum>(b)</enum><header>Amendments to title <enum-in-header>18</enum-in-header>, United States Code</header><paragraph id="H34B4DFE183D9428E9AC412000DD54915"><enum>(1)</enum><text>Section 921(a) of title 18, United States Code, is amended—</text><subparagraph id="HFEBA7B95277A4DC8BFAED467054319F5"><enum>(A)</enum><text>in paragraph (3), by striking <quote>muffler or firearm silencer</quote> and inserting <quote>muffler, firearm silencer, or bump stock</quote>; and</text></subparagraph><subparagraph id="HEC211DFAEF62470388E888E3538196F0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H2A4CC59B8A6F475B984046394F7E6D56" style="OLC"><paragraph id="H416FF593749D4BB493062E78E0C8128D" indent="up1"><enum>(36)</enum><text>The term <term>bump stock</term> has the meaning given such term in section 5845(n) of the National Firearms Act (<external-xref legal-doc="usc" parsable-cite="usc/26/5845">26 U.S.C. 5845(n)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HED5326BF621F4B47AF873F45927292C4"><enum>(2)</enum><text>Section 922 of title 18, United States Code, is amended—</text><subparagraph id="H20A598EF9D7040D9BC5A2BEF98A7DA75"><enum>(A)</enum><text>in each of subsections (a)(4) and (b)(4), by inserting <quote>bump stock,</quote> before <quote>machinegun</quote>; and</text></subparagraph><subparagraph id="H5864C68846994EB7BF10EEEF8484576E"><enum>(B)</enum><text>in subsection (o)—</text><clause id="HE0EADE730D724921985AEAD405440755"><enum>(i)</enum><text>in paragraph (1), by inserting <quote>or bump stock</quote> before the period; and</text></clause><clause id="H9CD0A67EBB5E46099752B48E23B41101"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="H90101F37F2234BE390B6611524A981BA"><enum>(I)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></subclause><subclause id="HE413322BBA164DBAA9F43781FBCCB94E"><enum>(II)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; or</quote>; and</text></subclause><subclause id="H684B04B2B1804DE7AE99ECE984D04014"><enum>(III)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H4F854C7F832547F6A8CAB213D276AA82" display-inline="no-display-inline"><subparagraph id="HD24029B060AC4532A5E8B4D4E3883A7F" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">the otherwise lawful possession of a bump stock that, on or before the date that is 1 year after the date of the enactment of this subparagraph, is registered to the possessor in accordance with <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph></paragraph></subsection><subsection id="HEFDBCA3DF68E4B6C9214854ADCD436E8"><enum>(c)</enum><header>Effective date</header><paragraph id="H6E6F0BAD46494236BB553D50030DA51C"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text></paragraph><paragraph id="HF1BDAFC5B8774148A569B720875256FE"><enum>(2)</enum><header>Application to possession on date of enactment</header><text>Notwithstanding paragraph (1), any person on the date of the enactment of this Act possessing a bump stock as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845(n)</external-xref> of the Internal Revenue Code of 1986 (as amended by this Act) shall, not later than the date that is 1 year after the date of the enactment of this Act, register such bump stock in accordance with <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986 and include with such registration the information required under section 5841(a) of such Code. Such registration shall become a part of the National Firearms Registration and Transfer Record required to be maintained by such section. The prohibition on possession of an unregistered firearm under section 5861 of such Code shall not apply to a bump stock described in this Act on any date that is 1 year or less after the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
