R. 5418</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210929">September 29, 2021</action-date><action-desc><sponsor name-id="C001120">Mr. Crenshaw</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HHM00">Homeland Security</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Department of Transportation and other agencies from promulgating rules requiring a person to provide proof of a COVID–19 vaccination in order to engage in interstate commerce, and for other purposes.</official-title></form><legis-body id="H67041A0B1F464ED7B7923F2B45AEFB08" style="OLC"><section id="H3D535DA8B96145C7B9E8CA303DDAC2DA" section-type="section-one"><enum>1.</enum><header>Prohibition on proof of vaccination requirements</header><subsection id="H36D761AD972A404BB5EC8280B4BA83B4"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, an agency or department described in subsection (b) may not promulgate any rule to require a person to provide proof of a COVID–19 vaccination of any kind in order to engage in interstate commerce.</text></subsection><subsection id="HE9EC15B3C0D441F58B89A6A754148A8B"><enum>(b)</enum><header>Agencies and departments described</header><text>An agency or department referred to in subsection (a) is any of the following:</text><paragraph id="HCC74ED5FC3FE4CDD9746AA1E4E66F50C"><enum>(1)</enum><text>The Department of Transportation.</text></paragraph><paragraph id="HC868A589F20440F4A95E4EF492A1EA38"><enum>(2)</enum><text>The National Railroad Passenger Corporation (commonly referred to as <quote>Amtrak</quote>).</text></paragraph><paragraph id="HCD5409981E39471AB4589C1594EF7A2A"><enum>(3)</enum><text>The Surface Transportation Board.</text></paragraph><paragraph id="H527217EB75304B1C94CC63ABB1B4F70B"><enum>(4)</enum><text>The Transportation Security Administration.</text></paragraph><paragraph id="H0FD647D8FCFC4333ADE9A46C9EAE332C"><enum>(5)</enum><text>The National Transportation Safety Board.</text></paragraph><paragraph id="H1B9DB2A6AE8648E688CFCB0D14DCC9D4"><enum>(6)</enum><text>The Federal Maritime Commission.</text></paragraph><paragraph id="H1A01653A2EE748B0A4CDF8FDB1478427"><enum>(7)</enum><text>The Department of Commerce.</text></paragraph></subsection><subsection id="H39F12194C27D4B34953A97BE4F86DF1C"><enum>(c)</enum><header>Limitation on the use of HHS suspension of entries and imports authority</header><text display-inline="yes-display-inline">Section 361(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264(e)</external-xref>) is amended by adding at the end the following: <quote>Nothing in this section shall be construed to authorize the Secretary of Health and Human Services to mandate vaccination against COVID–19 as a prerequisite for engaging in interstate commerce or travel.</quote>.</text></subsection></section></legis-body></bill>
