<section id="idA2995B78ED1C4BB290F2B313FC2A94A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Unjust Red Flag Laws Act of 2021</short-title></quote>.</text></section> <section id="id173A8006D2354512A91A2AEA855D8A6B"><enum>2.</enum><header>Prohibition on funding for implementation and enforcement of red flag laws or rules</header> <subsection id="id346A7A6A02174468ADAC27DCC6CEC173"><enum>(a)</enum><header>Prohibition on funding</header><text>None of the funds made available for any Federal department or agency may be used to—</text>
<paragraph id="id58912a8b95ba44d798c81fcc8b65ef14"><enum>(1)</enum><text>implement or enforce Federal red flag laws; or</text></paragraph> <paragraph id="id524A6F50CA3D4F81A560056DCC2B9CF2"><enum>(2)</enum><text>provide assistance to States, local, tribal, or territorial government departments or agencies for the implementation or enforcement of red flag laws. </text></paragraph></subsection>
<subsection id="id40D9D8FD3CC44F68811CD42F7848EFA5"><enum>(b)</enum><header>Red flag laws defined</header><text>In this section, the term <term>red flag laws</term> means—</text> <paragraph id="id0fe66d7099544bdba0c0669b491642f3"><enum>(1)</enum><text>a risk-based, temporary, and preemptive protective order that authorizes the removal of firearms without due process.</text></paragraph></subsection></section>
