which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a task force on the implications of amending the Atomic Energy Act of 1954 to remove exemptions from environmental laws for spent nuclear fuel and high-level radioactive waste to allow for consent-based siting of geologic repositories.</official-title></form><legis-body id="H650DFACD06C44E6BAF35DC783191D078" style="OLC"><section id="HB11B1DD9388E49259F76A2DD733947EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Waste Task Force Act of 2021</short-title></quote>.</text></section><section id="H365A7F2D20454EDEBFC3D781DE965D96"><enum>2.</enum><header>Task force</header><subsection id="H2122FED20616406283D71A79931C5016"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE9740463015747B1929FED78731C2918"><enum>(1)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with a significant representation of communities of color, low-income communities, or Tribal and indigenous communities that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects, as compared to other communities.</text></paragraph><paragraph id="H66AFEE971833490AA252CFE3884B13A8"><enum>(2)</enum><header>EPA representative</header><text>The term <term>EPA representative</term> means the member of the Task Force appointed under subsection (c)(2)(B)(i).</text></paragraph><paragraph id="H9032F634ACE04CBBBBB041A4196E43DA" commented="no"><enum>(3)</enum><header>High-level radioactive waste</header><text>The term <term>high-level radioactive waste</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph commented="no" id="H7D98F34660954A03A963B3530134B951"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means an Indian tribe included on the list published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="H2FB43C419AF94EBF90CB50249CE5B8BE" commented="no"><enum>(5)</enum><header>Spent nuclear fuel</header><text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph commented="no" id="HD809DCCCE7BE4293818E9FA94FB85CC1"><enum>(6)</enum><header>Task Force</header><text>The term <term>Task Force</term> means the task force established under subsection (b).</text></paragraph></subsection><subsection id="HCC53A6F9E2ED4684BC075E8868F6CCFB"><enum>(b)</enum><header>Establishment</header><text>The Administrator of the Environmental Protection Agency shall establish a task force, to be known as <quote>Task Force on the Implications of Amending the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> to Remove Exemptions from Environmental Laws for Spent Nuclear Fuel And High-Level Radioactive Waste to Allow for Consent-Based Siting of Geologic Repositories</quote>—</text><paragraph id="H8D91C0D2C747417F8088540A5DB716F6"><enum>(1)</enum><text>to continue the work of the 2012 Blue Ribbon Commission on America’s Nuclear Future, which found that consent was necessary to successfully arrive at permanent disposal sites for nuclear waste; and</text></paragraph><paragraph id="H8CB861A9D46640F1991D8A03D249A5AB"><enum>(2)</enum><text>to analyze the implications of amending the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) to remove exemptions from environmental laws for spent nuclear fuel from commercial reactors and high-level radioactive waste from defense and commercial origins in order to create a consent-driven pathway to addressing the disposal challenges of commercial and defense nuclear waste. </text></paragraph></subsection><subsection id="H83A8E8D1AA284152B9EA04CFEB96A328"><enum>(c)</enum><header>Membership</header><paragraph id="HFD4768E9624B4C0AB18B0134988D84C8"><enum>(1)</enum><header>In general</header><text>The Task Force shall include a balanced representation of—</text><subparagraph id="H88266393845B4E2BADDDBCEBAE0CB41E"><enum>(A)</enum><text>Federal, State, Tribal, and local government agencies; </text></subparagraph><subparagraph id="H21AF5A34B78F4E6AA287AB2B6707F54F"><enum>(B)</enum><text>nongovernmental organizations; </text></subparagraph><subparagraph id="H277A2CEB331E4ADF9DB94038BEA1488C"><enum>(C)</enum><text>unions; and </text></subparagraph><subparagraph id="H89DCA6AF0C464ED7ACB0D57EBD68127E"><enum>(D)</enum><text>the private sector. </text></subparagraph></paragraph><paragraph id="HF679B87C0F8248DBB1F49990CB9B9BA8"><enum>(2)</enum><header>Members</header><subparagraph id="H0E331402AB3C4CF58C64043E4961B79F"><enum>(A)</enum><header>In general</header><text>The Task Force shall be composed of not more than 30 members who represent entities that—</text><clause id="H94012818EC694AE486070CDAE1DEBD89"><enum>(i)</enum><text>are currently affected by the storage, treatment, or management of commercial or defense nuclear waste; or </text></clause><clause id="H71D894C9353142A19B283FBF5CE07400"><enum>(ii)</enum><text>have cognizable and well-understood interests in the objectives of the Task Force.</text></clause></subparagraph><subparagraph id="H488F1661FE2242149A2AECFFD5AACD3F"><enum>(B)</enum><header>Federal members</header><text>Not more than 5 members of the Task Force shall be representatives of the Federal Government, of whom—</text><clause id="H0D8D025A94A549619B929DF778CB4E80"><enum>(i)</enum><text>1 shall be appointed by the Administrator of the Environmental Protection Agency to represent the Environmental Protection Agency;</text></clause><clause id="HE9497B11EE454D48A72FC06CE40FCEC8"><enum>(ii)</enum><text>1 shall be appointed by the Secretary of Energy to represent the Department of Energy;</text></clause><clause id="H21DC4A60A8EE438AAAF68D05D68C86F5"><enum>(iii)</enum><text>1 shall be appointed by the Nuclear Regulatory Commission to represent the Nuclear Regulatory Commission;</text></clause><clause id="HD33BCBEA4FA443729A1D30BA36311217"><enum>(iv)</enum><text>1 shall be appointed by the Director of the White House Office of Science and Technology Policy to represent the White House Office of Science and Technology Policy; and</text></clause><clause id="H93E0E6C879DA4D90A08CC7EE25E20766"><enum>(v)</enum><text>1 shall be appointed by the Secretary of Transportation to represent the Department of Transportation.</text></clause></subparagraph><subparagraph id="HAC1041CF1996455A83F78F949CA9878D"><enum>(C)</enum><header>Non-Federal members</header><clause id="H2E830DDA05AE49D79D47F8BD74EACF1F"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the EPA representative shall appoint the non-Federal members of the Task Force.</text></clause><clause id="H7E88C643BEE649979E707D89D2D25378"><enum>(ii)</enum><header>State government representatives</header><subclause id="H8A877C8B3FCB487391CA8660663F4C21"><enum>(I)</enum><header>In general</header><text>The EPA representative shall select not fewer than 7 States, representing a geographical balance from across the United States, the governments of which shall be represented on the Task Force.</text></subclause><subclause id="H639F6CB3DDCB4A7AAADDFF59024EAF7D"><enum>(II)</enum><header>Appointment</header><text>The Governor of a State selected under subclause (I), or an appropriate agency of the State, such as a State department of ecology or State environment department, if the Governor determines it to be appropriate, shall appoint the representative of the State government who shall serve on the Task Force.</text></subclause></clause><clause id="H69E96BF8631F4C37B13B11965F42C2B3"><enum>(iii)</enum><header>Other non-Federal members</header><subclause id="HB57644A264604317B7072804A2010461"><enum>(I)</enum><header>Geographic and historical balance</header><text>In selecting the non-Federal members of the Task Force, the EPA representative shall ensure—</text><item id="HCD91061F34D442A5972A83E7C07CABAF"><enum>(aa)</enum><text>a geographical balance among the non-Federal members from across the United States; and</text></item><item id="H57827EED2CF24E02888D7D5382A1EADC"><enum>(bb)</enum><text>a balance of historical concerns with respect to nuclear waste.</text></item></subclause><subclause id="H645D0F2B8CC04559BC17F6A0C514DD57"><enum>(II)</enum><header>Interests</header><text>In selecting the non-Federal members of the Task Force, the EPA representative shall ensure that not fewer than 18 members are selected from among representatives of—</text><item id="HD04B029B24C9493599218DA48F519B97"><enum>(aa)</enum><text>Indian Tribes;</text></item><item id="HBA85B3C0C44E480D95750DF45E8B1815"><enum>(bb)</enum><text>national environmental interest groups;</text></item><item id="H8F4F5B5E3C444807958F0A9E2DC18726"><enum>(cc)</enum><text>regional environmental justice groups;</text></item><item id="H6B56432E1AC94DCD91F7FF86B36AC478"><enum>(dd)</enum><text>industry;</text></item><item id="H72500E34B4614600975F22C781B12AF4"><enum>(ee)</enum><text>labor organizations;</text></item><item id="HBE2296793DB146E08C170DBBE8C92259"><enum>(ff)</enum><text>professional societies; and</text></item><item id="H9A89368CFFD84B139C91C4218A4B02FB"><enum>(gg)</enum><text>safety- and health-related organizations. </text></item></subclause></clause></subparagraph><subparagraph id="H67F035DA1F4D44A4AC56638E7A0EE6C1"><enum>(D)</enum><header>Selection of Chair</header><text>The non-Federal members of the Task Force appointed under subparagraph (C) shall select the Chair of the Task Force from among the non-Federal members.</text></subparagraph></paragraph><paragraph id="HC1743B237B8143749F28D15B8375D4DA"><enum>(3)</enum><header>Compensation; expenses</header><subparagraph id="H10C24FA10F5C4A3CB14A857F8D14E42F"><enum>(A)</enum><header>Compensation</header><text>A member of the Task Force shall serve without compensation.</text></subparagraph><subparagraph id="HB07089EFD5104F2197244B597D4B74CA"><enum>(B)</enum><header>Expenses</header><text>A member of the Task Force shall receive reimbursement from the Administrator of the Environmental Protection Agency at the applicable Federal per diem rate for all out-of-pocket expenses incurred in carrying out the duties of the Task Force.</text></subparagraph></paragraph></subsection><subsection id="HAEAE9B6091FC4E819C3BCCD18016473C"><enum>(d)</enum><header>Grants</header><text>Subject to the approval of the Federal members of the Task Force appointed under subsection (c)(2)(B), the Chair of the Task Force may provide participation grants to task force members from un­der­re­sourced communities, environmental justice communities, or nonprofit organizations that are located in environmental justice communities and represent and work on behalf of environmental justice communities with respect to issues relating to the storage and disposal of spent nuclear fuel and high-level radioactive waste.</text></subsection><subsection id="H7BBF7CA6052B40319AC76740A6E91480"><enum>(e)</enum><header>Duties</header><paragraph id="HED6CCE008AED4B05B1E30028A6CBDA59"><enum>(1)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Task Force shall submit to Congress and the President a report, in unclassified form, that—</text><subparagraph id="H7E3DB21A69574027AE2EEBCB393B6986"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H97A09F3CF3944E609F23EB824D1577BB"><enum>(i)</enum><text>provides a clear explanation of what constitutes <term>consent-based siting</term>; and </text></clause><clause id="HC14A152597DC4AA4B4F3E7B197B547D1" indent="up1"><enum>(ii)</enum><text>includes recommendations on how consent-based siting could be practically implemented; </text></clause></subparagraph><subparagraph id="H9ED1F775075B4F06A1668E9B97611946"><enum>(B)</enum><text>describes and evaluates, taking into consideration the consent-based siting recommendations of the 2012 Blue Ribbon Commission for America’s Nuclear Future—</text><clause id="HD47B242B243342F9A8E7ADC6FD9AA7A1"><enum>(i)</enum><text>the implications of amending the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) to remove exemptions from environmental laws, such as the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) (commonly known as the <quote>Resource Conservation and Recovery Act of 1976</quote>), for spent nuclear fuel and high-level radioactive waste, while maintaining Federal minimum standards;</text></clause><clause id="H4463CB34E20C4870959B8CE23773A1C8"><enum>(ii)</enum><text>the likely allocations of precise regulatory responsibilities under any amendment to the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) described and evaluated under clause (i); and</text></clause><clause id="H547A1B6D5FD847AF9D04B32822D29E44" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>the timeframe necessary for developing regulations in accordance with clause (ii) and subparagraph (C); and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="HA4DAA85313294ADD9B1FC3B371AF85D1"><enum>(C)</enum><text>includes recommendations for appropriate legislative and regulatory changes based on the matters described and evaluated under subparagraph (B).</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HEC27F43054634312B95715641026BD62"><enum>(2)</enum><header>Notice and comment</header><subparagraph display-inline="no-display-inline" commented="no" id="H9035482D44DB4FB3B004810441A787E4"><enum>(A)</enum><header>In general</header><text>In preparing the report under paragraph (1), the Task Force shall provide public notice and an opportunity for comment on the matters described in paragraph (1).</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="H18BBA952D9814DEDAC0EDA2B2A7B82DD"><enum>(B)</enum><header>Requirement</header><text>To ensure sufficient opportunity for timely public input on the matters described in paragraph (1), the Task Force shall provide not fewer than 3 opportunities for public comment under subparagraph (A), including—</text><clause display-inline="no-display-inline" commented="no" id="H1B932D3F8F5E4C73B6FBBEDEDE062DC1"><enum>(i)</enum><text>1 opportunity on the East Coast;</text></clause><clause display-inline="no-display-inline" commented="no" id="H8B8BD4B9CE7D42358A91E10CE0411132"><enum>(ii)</enum><text>1 opportunity on the West Coast; and</text></clause><clause display-inline="no-display-inline" commented="no" id="HAD278B994B04448B8075A7C7C31F616E"><enum>(iii)</enum><text>1 opportunity in the middle region of the United States.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
