R. 539</legis-num><associated-doc role="report" display="yes">[Report No. 117–61, Part I]</associated-doc><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="G000546">Mr. Graves of Missouri</sponsor> (for himself, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, <cosponsor name-id="G000559">Mr. Garamendi</cosponsor>, <cosponsor name-id="G000582">Miss González-Colón</cosponsor>, <cosponsor name-id="T000460">Mr. Thompson of California</cosponsor>, <cosponsor name-id="H001068">Mr. Huffman</cosponsor>, and <cosponsor name-id="C001112">Mr. Carbajal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HBU00">the Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc>Additional sponsors: <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>, <cosponsor name-id="D000630">Mr. Delgado</cosponsor>, and <cosponsor name-id="P000610">Ms. Plaskett</cosponsor></action-desc></action><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc>Reported from the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc>Committee on <committee-name committee-id="HBU00">the Budget</committee-name> discharged; committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Disaster Recovery Reform Act of 2018 to require the Administrator of the Federal Emergency Management Agency to waive certain debts owed to the United States related to covered assistance provided to an individual or household, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H837202B8538D4A7FBD53950E976D31A2" style="OLC"><section id="HC422C6279D694BC189452E8A65B5497F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Disaster Revictimization Act</short-title></quote>.</text></section><section id="HF70D9A079BE44027A21AFF1AAE554935" section-type="subsequent-section"><enum>2.</enum><header>Flexibility</header><text display-inline="no-display-inline">Section 1216(a) of the Disaster Recovery Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/42/5174a">42 U.S.C. 5174a(a)</external-xref>) is amended—</text><paragraph id="H18D9F541B54D4D0B91D94857E1330A5E"><enum>(1)</enum><text>by amending paragraph (2)(A) to read as follows:</text><quoted-block style="OLC" id="H2F15DC0957C04A9CAA88E5DF7F05D41E" display-inline="no-display-inline"><subparagraph id="H27CCF99105AC43BD8F33F5779A2EC0B2"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), shall—</text><clause id="HAB6587C6F4394C05A835F1B954250A0C"><enum>(i)</enum><text>waive a debt owed to the United States related to covered assistance provided to an individual or household if the covered assistance was distributed based on an error by the Agency and such debt shall be construed as a hardship; and</text></clause><clause id="H7770CB7C21F947C696E338FD41D83E1C"><enum>(ii)</enum><text display-inline="yes-display-inline">waive a debt owed to the United States related to covered assistance provided to an individual or household if such assistance is subject to a claim or legal action, including in accordance with section 317 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5160">42 U.S.C. 5160</external-xref>); and </text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H74F66C0B640D47F6BBD54CCB00811BFC"><enum>(2)</enum><text>in paragraph (3)(B)—</text><subparagraph id="H8FF9C9EBDF5B4A509B10CEACE27F7D4A"><enum>(A)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">Removal of</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Report on</header-in-text></quote>; and</text></subparagraph><subparagraph id="HCCE35DD722344453B36057C727CDBA05"><enum>(B)</enum><text>in clause (ii) by striking <quote>the authority of the Administrator to waive debt under paragraph (2) shall no longer be effective</quote> and inserting <quote>the Administrator shall report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate actions that the Administrator will take to reduce the error rate</quote>. </text></subparagraph></paragraph></section><section id="HA55ADA95B9B642B4AC2820838A00595A"><enum>3.</enum><header>Report to Congress</header><text display-inline="no-display-inline">The Administrator of the Federal Emergency Management Agency shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report containing a description of the internal processes used to make decisions regarding the distribution of covered assistance under section 1216 of the Disaster Recovery and Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/42/5174a">42 U.S.C. 5174a</external-xref>) and any changes made to such processes.</text></section><section id="H8CC0BD25FCFA4523BAB8341A209AC91A"><enum>4.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage. </text></section></legis-body><endorsement display="yes"><action-date>June 14, 2021</action-date><action-desc>Reported from the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc><action-date>June 14, 2021</action-date><action-desc>Committee on <committee-name committee-id="HBU00">the Budget</committee-name> discharged; committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
