R. 5390</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210928">September 28, 2021</action-date><action-desc><sponsor name-id="M001214">Mr. Mrvan</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the <committee-name committee-id="HWM00">Committees on Ways and Means</committee-name>, and <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the American Rescue Plan Act of 2021 to extend the premium assistance for COBRA Continuation Coverage for individuals and their families.</official-title></form><legis-body id="H35B0E319FE7745D89B480E94C53DCC23" style="OLC"><section id="H2501A4835D944BE79CF65AB9B7E544CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COBRA Subsidy Extension for Workers and Families Act</short-title></quote>. </text></section><section id="HC9E3966B2C934E44AB129B4E906E585F"><enum>2.</enum><header>Extension of premium assistance for COBRA Continuation Coverage for individuals and their families</header><text display-inline="no-display-inline">Section 9501(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>) is amended—</text><paragraph id="H2C6841B9C69B4110B8093BFE04351DD9"><enum>(1)</enum><text>in paragraph (1)(A), by striking <quote>September 30, 2021</quote> and inserting <quote>September 30, 2022</quote>;</text></paragraph><paragraph id="H3B2855D9328648EA96869819E161FB31"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>September 30, 2021</quote> and inserting <quote>September 30, 2022</quote>;</text></paragraph><paragraph id="H6B3CB927BE8946E29BD6C418803B718F"><enum>(3)</enum><text>in paragraph (7), by striking <quote>and (8)</quote> and inserting <quote>(8), and (9)</quote>; </text></paragraph><paragraph id="HF5F13205ABA545B0B4D6B98AFBD72595"><enum>(4)</enum><text>by redesignating paragraphs (9) and (10) as paragraphs (10) and (11), respectively; and</text></paragraph><paragraph id="H1C8B4C4BD619428EA796CB9A947E753D"><enum>(5)</enum><text>by inserting after paragraph (8) the following new paragraph:</text><quoted-block style="OLC" id="H2B57AA88495B4708BA0A1FDC36BC1F16" display-inline="no-display-inline"><paragraph id="HF067B1F88A1342D0A429FE6599DF4B27"><enum>(9)</enum><header>Expedited review of denials of premium assistance</header><text display-inline="yes-display-inline">In any case in which an individual requests treatment as an assistance eligible individual and is denied such treatment by the group health plan, the Secretary of Labor (or the Secretary of Health and Human Services in connection with COBRA continuation coverage which is provided other than pursuant to part 6 of subtitle B of title I of the Employee Retirement Income Security Act of 1974), in consultation with the Secretary of the Treasury, shall provide for expedited review of such denial. An individual shall be entitled to such review upon application to such Secretary in such form and manner as shall be provided by such Secretary. Such Secretary shall make a determination regarding such individual’s eligibility within 15 business days after receipt of such individual’s application for review under this paragraph. Either Secretary’s determination upon review of the denial shall be de novo and shall be the final determination of such Secretary. A reviewing court shall grant deference to such Secretary’s determination. The provisions of this paragraph and paragraphs (1) through (6) shall be treated as provisions of title I of the Employee Retirement Income Security Act of 1974 for purposes of part 5 of subtitle B of such title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
