<official-title display="yes">To amend the Health Care Quality Improvement Act of 1986 to recognize that physicians need to be protected from abuses of the peer reviewed process, and for other purposes.</official-title>

<section id="H6BA35A3607424724812B9B13825EB7B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shield and Protect Physician Peer-Reviews Act of 2021</short-title></quote>.</text></section> <section id="H3F4AA6E965314F9780C8780AF6B0EFA0"><enum>2.</enum><header>Recognizing that physicians need to be protected from abuses of the peer reviewed process</header> <subsection id="H607B29DDB11B411E8DEB53F86C9595EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 402 of the Health Care Quality Improvement Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/42/11101">42 U.S.C. 11101</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/99/660">Public Law 99–660</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H4707437B36094EBD828767328E4CDD62"><enum>(6)</enum><text display-inline="yes-display-inline">Some peer reviewed decisions may be based on factors other than competence or professional conduct. The stated reason for a professional review action may not be the actual reason for the action, and the actual reason may not be apparent from the face of the action. The need to provide incentive and protection for physicians engaging in effective professional peer review must be balanced against the need to protect competent physicians from peer review decisions that are not based on professional competence or conduct.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HE7FA30A234E94DAABEA0C13BF786D740"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect as if included in the enactment of the Health Care Quality Improvement Act of 1986.</text></subsection></section>
