<section id="H989605B2F9B04EB8B742B40FD4FCBD3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Energy Manufacturing in Coal Communities Act</short-title></quote>. </text></section> <section id="HBBA882DE45174E2AACE3EBE1473C2AE3"><enum>2.</enum><header>Advanced energy manufacturing and recycling grant program</header> <subsection id="HFA32A752BDBF4D749AB7288EFB058223"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H1D859B4090344E00AB9D0BD56E7B3F98"><enum>(1)</enum><header>Advanced energy property</header><text>The term <term>advanced energy property</term> means—</text> <subparagraph id="H15D1FE22133B4C57B979BB9D668DE955"><enum>(A)</enum><text>property designed to be used to produce energy from the sun, water, wind, geothermal or hydrothermal (as those terms are defined in section 612 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17191">42 U.S.C. 17191</external-xref>)) resources, enhanced geothermal systems (as defined in that section), or other renewable resources;</text></subparagraph> 
<subparagraph id="H085598CA875C42E2848F393D759F4FFF"><enum>(B)</enum><text>fuel cells, microturbines, or energy storage systems and components;</text></subparagraph> <subparagraph id="H62A957A04D3C475EBB4D5000506F5302"><enum>(C)</enum><text>electric grid modernization equipment or components;</text></subparagraph> 
<subparagraph id="H93CB46C0DA4844ABA33156145906F53E"><enum>(D)</enum><text>property designed to capture, remove, use, or sequester carbon oxide emissions;</text></subparagraph> <subparagraph id="H557FC8FF2B8C486BA22A01E65F49E5C5"><enum>(E)</enum><text>equipment designed to refine, electrolyze, or blend any fuel, chemical, or product that is—</text> 
<clause id="H1B4DD7D608B142AD88D3F901AFEF0F21"><enum>(i)</enum><text>renewable; or</text></clause> <clause id="H4B9A48445F524392A36F2F4FE2491D30"><enum>(ii)</enum><text>low-carbon and low-emission;</text></clause></subparagraph> 
<subparagraph id="H53E2D91B646D48B78741A3AD08531ED4"><enum>(F)</enum><text>property designed to produce energy conservation technologies (including for residential, commercial, and industrial applications);</text></subparagraph> <subparagraph id="H9C553870414543A28EB0ED936DA4BF9B"><enum>(G)</enum> <clause commented="no" display-inline="yes-display-inline" id="H57701BD9971D481CAE142D820A9A2F1F"><enum>(i)</enum><text>light-, medium-, or heavy-duty electric or fuel cell vehicles, electric or fuel cell locomotives, electric or fuel cell maritime vessels, or electric or fuel cell planes; </text></clause> 
<clause id="H461978E472A84D52BCF8372521950A96" indent="up1"><enum>(ii)</enum><text>technologies, components, and materials of those vehicles, locomotives, maritime vessels, or planes; and</text></clause> <clause indent="up1" id="HD715517D02364ED4BE97FA0E8EDCA23D"><enum>(iii)</enum><text>charging or refueling infrastructure associated with those vehicles, locomotives, maritime vessels, or planes;</text></clause></subparagraph> 
<subparagraph id="H8CDFD135990048A9B5D751E3087AB557"><enum>(H)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HCC65683C50CE4CE0A6F00BAFB24114EE"><enum>(i)</enum><text>hybrid vehicles with a gross vehicle weight rating of not less than 14,000 pounds; and</text></clause> <clause indent="up1" id="H53F0A7C60B224D629521282CBC0CCC28"><enum>(ii)</enum><text>technologies, components, and materials for those vehicles; and</text></clause></subparagraph> 
<subparagraph id="H6A30501627A948AE9E7962D252168028"><enum>(I)</enum><text>other advanced energy property designed to reduce greenhouse gas emissions, as may be determined by the Secretary.</text></subparagraph></paragraph> <paragraph id="H986E4856866A4DA6800092BDE57DE1B2" commented="no"><enum>(2)</enum><header>Covered census tract</header><text>The term <term>covered census tract</term> means a census tract—</text> 
<subparagraph id="HAF70319DADF64B36971AA5F65B64C8C9" commented="no"><enum>(A)</enum><text>in which, after December 31, 1999, a coal mine had closed;</text></subparagraph> <subparagraph commented="no" id="H59621A3CC13F4834A638D10C54B3226F"><enum>(B)</enum><text>in which, after December 31, 2009, a coal-fired electricity generating unit had been retired; or</text></subparagraph> 
<subparagraph commented="no" id="HDF006B1F6D83446381E0CF1EE867445B"><enum>(C)</enum><text>that is immediately adjacent to a census tract described in subparagraph (A) or (B).</text></subparagraph></paragraph> <paragraph id="H6254BB57B91A4EE49E796E9D706DD8E8"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a manufacturing firm—</text> 
<subparagraph id="HE5FB14923ADF4B9D9D1DFDB7B537CD30"><enum>(A)</enum><text>the gross annual sales of which are less than $100,000,000;</text></subparagraph> <subparagraph id="H2D57020D3DC84E46816B2C6134E62F2E"><enum>(B)</enum><text>that has fewer than 500 employees at the plant site of the manufacturing firm; and</text></subparagraph> 
<subparagraph id="H6704A894EF8844C6AF118E7CE82DEF82"><enum>(C)</enum><text>the annual energy bills of which total more than $100,000 but less than $2,500,000.</text></subparagraph></paragraph> <paragraph id="HB027BDADE9A64CFFA1556DE52FEF7951"><enum>(4)</enum><header>Minority-owned</header><text>The term <term>minority-owned</term>, with respect to an eligible entity, means an eligible entity not less than 51 percent of which is owned by 1 or more individuals who are—</text> 
<subparagraph id="H11120B66C0844D9AAAA40CC538D6ED66"><enum>(A)</enum><text>citizens of the United States; and </text></subparagraph> <subparagraph id="H660B483FAEF14D54940A1935F93A48E5"><enum>(B)</enum><text>Asian American, Native Hawaiian, Pacific Islander, African American, Hispanic, Puerto Rican, Native American, or Alaska Native. </text></subparagraph></paragraph> 
<paragraph id="HEF1DEEC3F609432E925AB5BC656AB8A9"><enum>(5)</enum><header>Program</header><text>The term <term>Program</term> means the grant program established under subsection (b).</text></paragraph> <paragraph id="H72DE56ED06CB460D986EA3F270268630"><enum>(6)</enum><header>Qualifying advanced energy project</header><text>The term <term>qualifying advanced energy project</term> means a project that—</text> 
<subparagraph id="HA063050694E349E78CF1D9EFC2D8C7F1"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H7E007D80F2F24D7483DC49A101E19938"><enum>(i)</enum><text>re-equips, expands, or establishes a manufacturing or recycling facility for the production or recycling, as applicable, of advanced energy property; or</text></clause> <clause id="H7DF5085D386C4B85BF74D5937697BAF0" indent="up1"><enum>(ii)</enum><text>re-equips an industrial or manufacturing facility with equipment designed to reduce the greenhouse gas emissions of that facility substantially below the greenhouse gas emissions under current best practices, as determined by the Secretary, through the installation of—</text> 
<subclause id="H89E82D63F8964279A943A66A7D1E59AE"><enum>(I)</enum><text>low- or zero-carbon process heat systems;</text></subclause> <subclause id="H9B0642CE28464CF39F11334794ECFC95"><enum>(II)</enum><text>carbon capture, transport, utilization, and storage systems;</text></subclause> 
<subclause id="HE2BAA37521944657A22FDCC841B9B19E"><enum>(III)</enum><text>technology relating to energy efficiency and reduction in waste from industrial processes; or</text></subclause> <subclause id="H2A1C3821F8794F6C80BC315A2E8F0709"><enum>(IV)</enum><text>any other industrial technology that significantly reduces greenhouse gas emissions, as determined by the Secretary;</text></subclause></clause></subparagraph> 
<subparagraph id="H3697A5F8CC0644F09A0AA43A256CF456"><enum>(B)</enum><text>has a reasonable expectation of commercial viability, as determined by the Secretary; and</text></subparagraph> <subparagraph id="H03304E9D6E0440ACB0CAC47FBF279FE4" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>is located in a covered census tract.</text></subparagraph></paragraph> 
<paragraph id="H5BFD7562BBF04B618A7913BC908BBBEE"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy. </text></paragraph></subsection> <subsection id="H49095FC2BB744FF2B82AC1CCE338EBA3"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to award grants to eligible entities to carry out qualifying advanced energy projects.</text></subsection> 
<subsection id="HB248FB1E848C4453BAB1E608361EC939"><enum>(c)</enum><header>Applications</header> 
<paragraph id="H680F14F1BC2947FC9BA261FF2B061B67"><enum>(1)</enum><header>In general</header><text>Each eligible entity seeking a grant under the Program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a description of the proposed qualifying advanced energy project to be carried out using the grant.</text></paragraph> <paragraph id="HBE5414EF6B34409BA6FC88303D660789"><enum>(2)</enum><header>Selection criteria</header> <subparagraph id="HD125745C57764272AC3C9FD8187BCCEB"><enum>(A)</enum><header>Projects</header><text>In selecting eligible entities to receive grants under the Program, the Secretary shall, with respect to the qualifying advanced energy projects proposed by the eligible entities, give higher priority to projects that—</text> 
<clause id="HB91B4B0B1C9B447F9CE0CF9D48733F2A"><enum>(i)</enum><text>will provide higher net impact in avoiding or reducing anthropogenic emissions of greenhouse gases;</text></clause> <clause id="H36F63A5C8CD443709AB452EADCF73895"><enum>(ii)</enum><text>will result in a higher level of domestic job creation (both direct and indirect) during the lifetime of the project;</text></clause> 
<clause id="HB3E09D3DEEC741DC8AF23202395ACCB7"><enum>(iii)</enum><text>will result in a higher level of job creation in the vicinity of the project, particularly with respect to—</text> <subclause id="H15AE7EBB2ACF4C0BBBB22CF0DF63843A"><enum>(I)</enum><text>low-income communities (as described in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986); and</text></subclause> 
<subclause id="H820054FE595341388572959F8782A142"><enum>(II)</enum><text>dislocated workers who were previously employed in manufacturing, coal power plants, or coal mining;</text></subclause></clause> <clause id="H7F733890B5304701ABF5F04BBD850037"><enum>(iv)</enum><text>have higher potential for technological innovation and commercial deployment;</text></clause> 
<clause id="H5148C1D49EFE4F258F2C5D758C5EBE24"><enum>(v)</enum><text>have a lower levelized cost of—</text> <subclause id="H014A9B24BC08464ABD0730CFA2484D4F"><enum>(I)</enum><text>generated or stored energy; or</text></subclause> 
<subclause id="HD127D6EBFE004690A4A2B6C386154110"><enum>(II)</enum><text>measured reduction in energy consumption or greenhouse gas emission (based on costs of the full supply chain); and</text></subclause></clause> <clause id="H4CCD2987FC36440AA732D15B2DC3748D" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text>have a shorter project time. </text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H216344060AEF4D829C853892800ED964"><enum>(B)</enum><header>Eligible entities</header><text>In selecting eligible entities to receive grants under the Program, the Secretary shall give priority to eligible entities that are minority-owned.</text></subparagraph></paragraph></subsection> <subsection id="H4E3204A2F1E2487C9FA73F868A16A797"><enum>(d)</enum><header>Prevailing wages</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the Program, an eligible entity shall submit to the Secretary a written assurance that all laborers and mechanics employed by any contractor or subcontractor in the performance of work funded, in whole or in part, by the grant shall be paid wages at rates not less than those prevailing on work of a similar character in the locality, as determined by the Secretary of Labor under subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code (commonly referred to as the Davis-Bacon Act). With respect to the labor standards in this subsection, the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subsection> 
<subsection id="H2292354E06734E9198372A482E78E5B4"><enum>(e)</enum><header>Project completion and location; return of unobligated funds</header> 
<paragraph id="HE188013C61A14E26BCF3EE496FF2B980"><enum>(1)</enum><header>Completion; return of unobligated funds</header><text>An eligible entity that receives a grant under the Program shall be required—</text> <subparagraph id="H86E9A45B26C249AFABA3ED463ED90B30"><enum>(A)</enum><text>to complete the qualifying advanced energy project funded by the grant not later than 3 years after the date of receipt of the grant funds; and</text></subparagraph> 
<subparagraph id="H264B0CB6E8AD4803A21A64696AEB1E36"><enum>(B)</enum><text>to return to the Secretary any grant funds that remain unobligated at the end of that 3-year period. </text></subparagraph></paragraph> <paragraph id="H59D2637238834D9991722FCDC0FD8451"><enum>(2)</enum><header>Location</header><text>If the Secretary determines that an eligible entity awarded a grant under the Program has carried out the applicable qualifying advanced energy project at a location that is materially different from the location specified in the application for the grant, the eligible entity shall be required to return the grant funds to the Secretary.</text></paragraph></subsection> 
<subsection id="H1CF384B65635457B9383F86AEC088ABF"><enum>(f)</enum><header>Technical Assistance</header> 
<paragraph id="H0BA2E3D4643B4A4E97E9CDD4FAB48CF6"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall provide technical assistance on a selective basis to eligible entities that are seeking a grant under the Program to enhance the impact of the qualifying advanced energy project to be carried out using the grant with respect to the selection criteria described in subsection (c)(2)(A).</text></paragraph> <paragraph id="H46E55981210246CAAB1A0CA7845639D3"><enum>(2)</enum><header>Applications</header><text>An eligible entity desiring technical assistance under paragraph (1) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> 
<paragraph id="H0BACEFF136DE4FE9B108E3D01681FFEE"><enum>(3)</enum><header>Factors for consideration</header><text>In selecting eligible entities for technical assistance under paragraph (1), the Secretary shall give higher priority to eligible entities that propose a qualifying advanced energy project that has greater potential for enhancement of the impact of the project with respect to the selection criteria described in subsection (c)(2)(A).</text></paragraph></subsection> <subsection id="H317785C6BBFE4717ACF9F9BA3CB48B5A"><enum>(g)</enum><header>Publication of grants</header><text>The Secretary shall make publicly available the identity of each eligible entity awarded a grant under the Program and the amount of the grant. </text></subsection> 
<subsection id="H93E02D55B93C47BF84B1F027FC4BA5E2"><enum>(h)</enum><header>Report</header><text>Not later than 4 years after the date of enactment this Act, the Secretary shall—</text> <paragraph id="H363F3278A4F74BAF9B1D13645F291EA8"><enum>(1)</enum><text>review the grants awarded under the Program; and</text></paragraph> 
<paragraph id="H4CDA6642C7BD432E95E457F440E184D5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing those grants. </text></paragraph></subsection> <subsection id="H9DD232B3AF3B4916982231A6B15BC168" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the Program $750,000,000 for the period of fiscal years 2022 through 2026. </text></subsection></section>
