<section id="H683E5401EE10428791AE49F7CF7958F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Back To Work Act</short-title></quote>.</text> </section> <section id="H52A0F7B1CDA64801B95021CD991DBF87"><enum>2.</enum><header>Study of pandemic unemployment programs</header> <subsection id="H270D4C6E6A3748D19F5A7312990ABFE4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The covered agency heads shall conduct a joint study on pandemic unemployment programs, including an analysis of the following:</text> 
<paragraph id="HB00F50677D14446E9D8BDCD2AD7FB8F1"><enum>(1)</enum><text>The impact of such programs on—</text> <subparagraph id="H920EF83D6F16451181F15AECC948D61A"><enum>(A)</enum><text>individuals, including recipients’ engagement in work, participation in work search, receipt of and amount of earnings, receipt of and amount of other government benefits, duration of unemployment, and whether the recipient’s total income counting all benefits exceeds his or her prior earnings from work;</text></subparagraph> 
<subparagraph id="H8A9BB78319F2458DAFA75D01BDB0B3E5"><enum>(B)</enum><text>businesses, with a focus on small businesses, including effects on sales, profits, tax payments, hours of operation, employment, and closures attributable to staffing shortages related to the availability of benefits; and</text></subparagraph> <subparagraph id="H3B20512CD45049349376FA284EE53157"><enum>(C)</enum><text>the economy, including key labor market metrics such as the number of employed and unemployed individuals, job openings, total earnings from work, the labor force participation rate, State and national unemployment rates, engagement of individuals in full or part time employment, average durations of unemployment, and the number of long-term unemployed.</text></subparagraph></paragraph> 
<paragraph id="H7560063AC8E84E22B0F4BBFB7D5ACF83"><enum>(2)</enum><text display-inline="yes-display-inline">The demographics of the recipients of benefits under such programs, including with respect to key characteristics of recipients, including age, gender, race and ethnicity, prior work experience, educational attainment, whether the individual resides in an urban or rural community, whether that community is considered disadvantaged, whether the individual was engaged in employment immediately prior to first receiving benefits, the nature of such prior employment (such as whether employed, self employed, or independent contractor), whether the individual engaged in partial work while collecting benefits, whether such partial work was while a participant in a short-time compensation or another program, and the reason for leaving benefits such as due to benefit exhaustion, return to work, or another reason.</text> </paragraph> <paragraph id="H15CBF69782B8460D85A302E4C3F7D777"><enum>(3)</enum><text>With respect to Pandemic Unemployment Assistance—</text> 
<subparagraph id="HC73ECE090DE0442FBC028342BE2276FF"><enum>(A)</enum><text>the number of individuals who applied for such Assistance after applying for regular unemployment compensation; </text></subparagraph> <subparagraph id="H77D7C37077C944FC8B848EF3A0BA0617"><enum>(B)</enum><text display-inline="yes-display-inline">the number of individuals applying for and ultimately receiving benefits, as compared with similar data under the State Unemployment Compensation program, and whether the program’s allowance of self-certification of eligibility was a significant factor contributing to any such differences; and</text></subparagraph> 
<subparagraph id="H19A107527D6E4367AB5F4B6EA7ABA06D"><enum>(C)</enum><text display-inline="yes-display-inline">the degree to which the backdating of claims resulted in the overstatement of the apparent number of Pandemic Unemployment Assistance recipients, especially during the program’s early months.</text> </subparagraph></paragraph></subsection> <subsection id="H62012B18CD2A4319AF515114E131B90D"><enum>(b)</enum><header>Early termination of pandemic unemployment program participation</header><text>In carrying out the study required under subsection (a), the covered agency heads shall compare States that terminated agreements to participate in pandemic unemployment programs prior to September 6, 2021, with States that maintained such agreements until September 6, 2021.</text></subsection> 
<subsection id="HDC4EDB55DA1A4F9FA1144E8C8C8127FF"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of the enactment of this Act, the covered agency heads shall provide to Congress a report on the results of the study required under subsection (a).</text></subsection> <subsection id="HE4AD9340F7D24554AA52E8C171BA8F6A"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H8D06D75A209C4BB4A4D18F79330053D8"><enum>(1)</enum><header>Covered agency heads</header><text display-inline="yes-display-inline">The term <term>covered agency heads</term> means the Commissioner of the Bureau of Labor Statistics, the Comptroller General of the United States, and the Administrator of the Small Business Administration.</text></paragraph> <paragraph id="HC3633E23065E4D009EC65E1B451638DA" display-inline="no-display-inline"><enum>(2)</enum><header>Pandemic Unemployment Assistance</header><text display-inline="yes-display-inline">The term <term>Pandemic Unemployment Assistance</term> means assistance under section 2102 of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021</external-xref>).</text></paragraph> 
<paragraph id="HA9AEA37F23C74B43A31CA6B99FE8974E"><enum>(3)</enum><header>Pandemic unemployment programs</header><text display-inline="yes-display-inline">The term <term>pandemic unemployment programs</term> means—</text> <subparagraph id="H3E378FD9761243F9835A0DEB84AE2DED"><enum>(A)</enum><text display-inline="yes-display-inline">Federal Pandemic Unemployment Compensation under section 2104 of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023</external-xref>);</text></subparagraph> 
<subparagraph id="H4D0BDD3FD6464C38A59C7627D006BD7F"><enum>(B)</enum><text>Pandemic Emergency Unemployment Compensation under section 2107 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025</external-xref>); and</text></subparagraph> <subparagraph id="H35CE715172464107B8F21C09A6062611"><enum>(C)</enum><text>Pandemic Unemployment Assistance.</text></subparagraph></paragraph></subsection></section>
