which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Housing and Urban Development to establish a national evictions database, and for other purposes.</official-title></form><legis-body id="H49B857797BA042B48C8DEAC3F88AC7E5" style="OLC"><section id="H4D4EE401ECC949C7A0CFCEC21F5D29D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>We Need Eviction Data Now Act of 2021</short-title></quote>.</text></section><section id="H9257ABCD34734B63B1891F2BD19E060A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="HE3409E66E8D6485E9CEA419091B7398A"><enum>(1)</enum><header display-inline="yes-display-inline">Administrative eviction</header><text>The term <term>administrative eviction</term> means a ruling in favor of the landlord in an administrative forum within a public housing agency, such as grievance procedures, to recover possession of residential property from a tenant, including a tenant residing in a public housing dwelling unit or receiving tenant-based assistance or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H02502EDBD9A947F08F8B689310FB2064"><enum>(2)</enum><header>Court-ordered eviction</header><text>The term <term>court-ordered eviction</term> means a court ruling in favor of the landlord in a legal action to recover possession of residential property from a tenant, including a tenant residing in a public housing dwelling unit or receiving tenant-based assistance or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBACCA2E889BE4E8EA2EB193F849AB3EC"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Housing and Urban Development.</text></paragraph><paragraph id="H8FC2EB1C0F4044778412FEF18CCC3652"><enum>(4)</enum><header>Executed eviction</header><text>The term <term>executed eviction</term> means a court order carried out by a sheriff's office or other law enforcement agency that resulted in the landlord recovering possession of residential property from a tenant, including a tenant residing in a public housing dwelling unit or receiving tenant-based assistance or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A80F39FC75A47A1A2089D131166A847"><enum>(5)</enum><header>Illegal eviction</header><text>The term <term>illegal eviction</term> means self-help measures taken outside of the legal process for eviction to recover possession of residential property from a tenant, including a tenant residing in a public housing dwelling unit or receiving tenant-based assistance or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), such as—</text><subparagraph id="H713AE76C73F54896A3858019AEC25D14"><enum>(A)</enum><text>willfully interrupting or permitting the interruption of essential items of services required by the rental agreement;</text></subparagraph><subparagraph id="H2B1145B7D9A6422C92A8EFDE32CD8548"><enum>(B)</enum><text>blocking or attempting to block the entry of a tenant upon the premises;</text></subparagraph><subparagraph id="HB0664C7FF3594FF0A7DAC3BD6D068C89"><enum>(C)</enum><text>changing the locks or removing the front door of the premises;</text></subparagraph><subparagraph id="HEB7B6A385C4D46DAAAEFAC3B5C198573"><enum>(D)</enum><text>removing the belongings of a tenant; and</text></subparagraph><subparagraph id="H8E9B0A3BF9AB4FF1A9F5D9D7BFFEC216"><enum>(E)</enum><text>any other action defined as a self-help eviction under State landlord-tenant law.</text></subparagraph></paragraph><paragraph id="H6A6E2D7495B4408287CF7D6A98B0D857"><enum>(6)</enum><header>Local ordinance impacting eviction</header><text>The term <term>local ordinance impacting eviction</term> means a local ordinance that is designed to address the number of emergency services calls resulting from assault, sexual harassment, stalking, disorderly conduct, or another type of behavior, situation, or condition that results in the need for emergency services, that results in loss of housing or limit the housing opportunities for victims of crime, including victims of domestic violence, or individuals with disabilities who may require emergency services, abnegating local landlord-tenant law by—</text><subparagraph id="H740B2BFA6C2A4C90B57AA6161C09116C"><enum>(A)</enum><text>requiring, encouraging, or permitting the eviction of a tenant or resident because of a certain number of calls for emergency services;</text></subparagraph><subparagraph id="H7ED0036EE9BA4FCAA4FF3B6EE62E0D29"><enum>(B)</enum><text>requiring, encouraging, or permitting the eviction of a tenant or resident because of an arrest even though the arrest has not resulted in the conviction of that tenant or resident; or</text></subparagraph><subparagraph id="H34E879001E9D42A5874EFB5163ED87AB"><enum>(C)</enum><text>requiring, encouraging, or permitting the eviction of a tenant or resident because of criminal activity occurring at or near the place of residence of the tenant or resident for which that tenant or resident has not been convicted.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3127C56EBFA24A498E8608F333B59042"><enum>(7)</enum><header>Public housing; public housing agency</header><text>The terms <term>public housing</term> and <term>public housing agency</term> have the meanings given those terms in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF06E5CDC4B414C56A7DB0BA869EDE249"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="H73CC78131E78440B99A662D617034644"><enum>3.</enum><header>National database of evictions</header><subsection commented="no" display-inline="no-display-inline" id="HA0E846358F0546C2BE6C62E15C4E27C4"><enum>(a)</enum><header>Establishment of database</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish and maintain a database that—</text><paragraph commented="no" display-inline="no-display-inline" id="H6AE3B04F9218448AAF572A14DDC430F4"><enum>(1)</enum><text>is accessible to the Office of Policy Development and Research and the Office of Fair Housing and Equal Opportunity of the Department and other employees of the Department as determined necessary by the Secretary;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C4236CF572B44959E4741028A98D2D4"><enum>(2)</enum><text>includes the data described in subsection (b) with respect to court-ordered evictions, administrative evictions, and illegal evictions in the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE944DE027F2D42D39D6A3FF6843D04A9"><enum>(3)</enum><text>ensures appropriate security to prevent improper disclosure of that data.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H21EAEE4121F9476A84568077DA37EBA4"><enum>(b)</enum><header>Contents</header><text>The database established under subsection (a) shall contain the following data:</text><paragraph commented="no" display-inline="no-display-inline" id="H0E626544DB4745EB9240265E2FEAFE20"><enum>(1)</enum><header>Data on each court-ordered or administrative eviction</header><text>With respect to each court-ordered or administrative eviction case filed on or after the date on which the database is established:</text><subparagraph commented="no" display-inline="no-display-inline" id="H4C556C2F05D34987B2425D7E80AEE2B3"><enum>(A)</enum><text>Information on the tenant who is the defendant, including—</text><clause commented="no" display-inline="no-display-inline" id="H663409BB4E60422A97FD047B233A8948"><enum>(i)</enum><text>the name of the tenant;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA35C608E67364A4D95E0726085120BBA"><enum>(ii)</enum><text>the address of the residential property and the type of housing;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF92DADB062F14E6485B925E0C7BABFDC"><enum>(iii)</enum><text>the number of household members residing in the property, including the number of children; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HD636EC3F2C924664A3C7A33A73558F6A"><enum>(iv)</enum><text>whether the tenant is a recipient of tenant-based or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5FF3CAAF0FA0447795D547B993E30BA4"><enum>(B)</enum><text>Information on the landlord who filed the court-ordered or administrative eviction case, including—</text><clause commented="no" display-inline="no-display-inline" id="HB41E887118C54D04BDAF0BF3D871783B"><enum>(i)</enum><text>the name of the landlord;</text></clause><clause commented="no" display-inline="no-display-inline" id="HFE03EB63F64E41D685C0CE1DEFE5E976"><enum>(ii)</enum><text>the name of the attorney or legally permitted representative of the landlord, or an indication that the landlord was self-represented;</text></clause><clause commented="no" display-inline="no-display-inline" id="H696DA35263474D89AE8D32D13396E487"><enum>(iii)</enum><text>any amount that the landlord alleges that the tenant owes, including any penalties and attorney's fees; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1E64ADEE93AA4665928C08C3F24A97D2"><enum>(iv)</enum><text>any costs incurred by the landlord for engaging in the eviction process, including—</text><subclause commented="no" display-inline="no-display-inline" id="H3EC3B35DAC994217B747459C3E9BA595"><enum>(I)</enum><text>court costs, such as filing fees;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H309F76125BBE4857B0F1B6012C7AA1B3"><enum>(II)</enum><text>the cost of legal representation; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD9E35F1D9C464F3D8430FB16ED52CA8B"><enum>(III)</enum><text>the cost to set out a tenant.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36812BFBC8664624B363751A5B109D03"><enum>(C)</enum><text>Procedural data on the court-ordered or administrative eviction case, including—</text><clause commented="no" display-inline="no-display-inline" id="HE16F445DAA7F4C40ACAE4F0954D5D286"><enum>(i)</enum><text>the date, if applicable, on which the tenant was served with a notice to quit;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC1322CD3AAEA421792721EF6659A4EF2"><enum>(ii)</enum><text>the date of the initial court filing by the landlord;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0653F79ACAED497DA041605C7F94ED7E"><enum>(iii)</enum><text>the reason why the landlord filed for eviction, such as nonpayment or breach of lease;</text></clause><clause commented="no" display-inline="no-display-inline" id="HAE2E941CC5B84D71A3D7662B81C9A251"><enum>(iv)</enum><text>whether the eviction was as a result of the enforcement of a local ordinance impacting eviction;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC348D9B5627E4C739545976F0B52F0FB"><enum>(v)</enum><text>the final outcome of the court-ordered or administrative eviction case, including—</text><subclause commented="no" display-inline="no-display-inline" id="H79A310FB38F64E45B89B9ADAFAE75BD6"><enum>(I)</enum><text>the disposition of the case, including whether the initial hearing resulted in a default judgment, dismissal, consent agreement, settlement, or trial;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H4FA6A65763154AA8A3A6DEA27EA309CC"><enum>(II)</enum><text>the date of final disposition;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA049578E55F949819785D9CE30EFA355"><enum>(III)</enum><text>any amount owed to the landlord or tenant, if any, and over what time period;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HAF874C82FD614023ACEB25F503F9AE83"><enum>(IV)</enum><text>whether a judgment was made in favor of the tenant for code violations or warranty of habitability claims;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HAEB2767F13794FC280F0C05BD4DEF2DA"><enum>(V)</enum><text>the overall outcome of the case, including whether the tenant paid any amounts to the landlord and whether the tenant stayed in the housing or was evicted from the housing; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD752467AAF9145CF9C03A6427A04B9EB"><enum>(VI)</enum><text>whether the tenant had legal representation and the nature of that representation, including a lawyer, a law student participating in a clinic, or another non-lawyer trained to represent clients in landlord-tenant court, or whether the tenant was a lawyer representing himself or herself;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H906E06C9294340F487E451D6905A8672"><enum>(vi)</enum><text>the total court fees incurred by the tenant, separated into categories of fees;</text></clause><clause commented="no" display-inline="no-display-inline" id="H37EBDC125F6D4717A3E4A7F53BAF3FBC"><enum>(vii)</enum><text>the total court fees incurred by the landlord;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA88CED8BC3F14431988E8600E4392D9D"><enum>(viii)</enum><text>whether the landlord had appeared in landlord-tenant court for a court-ordered or administrative eviction matter involving the landlord in the 6-month, 1-year, or 2-year period preceding the court-ordered or administrative eviction case; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HEDCFDC6C1EE342D9A96643DF2B0F5ED2"><enum>(ix)</enum><text>whether the tenant had appeared in landlord-tenant court for a court-ordered or administrative eviction matter involving the landlord in the 6-month, 1-year, or 2-year period preceding the court-ordered or administrative eviction case.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B4406D48B6B41A1A05806312D05CF5D"><enum>(2)</enum><header>Aggregate data on court-ordered or administrative eviction cases</header><text>Aggregate data on court-ordered or administrative eviction cases filed on or after the date on which the database is established, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H33C439C862F7457B9D3F27127FEED3B0"><enum>(A)</enum><text>the total number of cases filed, including a breakdown by—</text><clause commented="no" display-inline="no-display-inline" id="H3363939719164EDEB56F3961909E631B"><enum>(i)</enum><text>the number of cases filed for nonpayment, other breach of lease, both nonpayment and breach of lease, and any other reason;</text></clause><clause commented="no" display-inline="no-display-inline" id="H413E8603383947F8B4426C4FC4B52F3C"><enum>(ii)</enum><text>the number of cases filed because of the enforcement of a local ordinance impacting eviction; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H091AD044221E446E89E89BA34446C47A"><enum>(iii)</enum><text>the outcome of the dispositive hearing, including default judgment, dismissal, a consent agreement, a trial, and a settlement with or without mediation;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1880DD57C7154A61B3185988434014DB"><enum>(B)</enum><text>the number of tenants and landlords who showed up for the dispositive hearing of a court-ordered or an administrative eviction case, and how many were represented by counsel;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D4C7B0BA8174E02B2674E33EE270FEF"><enum>(C)</enum><text>the average duration of a court-ordered or an administrative eviction case, including the average time from filing to first hearing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H82F7C52E00E840039C5DF5206F5E0177"><enum>(D)</enum><text>the average amount allegedly owed by a tenant, per landlord;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC5E7249EAF1B44218C3A7C1E1487D895"><enum>(E)</enum><text>the average months of rent allegedly owed by a tenant;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8DEBD9C6B1694421BC281096B0E571E8"><enum>(F)</enum><text>the average amount paid by a tenant to resolve the case and stay in the housing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H709A4F304AB04C28ACCD26FB30E00384"><enum>(G)</enum><text>the number of court-ordered or administrative eviction cases resulting in a judgment in favor of the tenant due to code violations or warranty of habitability claims;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3C76F21F6A874A6A8D8CB1C3E6B6087A"><enum>(H)</enum><text>the number and percentage of court-ordered or administrative eviction cases broken down by age bracket;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H27BA9DE7438D4715B6D93819D7A5FB0A"><enum>(I)</enum><text>the number and percentage of court-ordered or administrative eviction cases with a tenant or household with children;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAB6FF107562407D910B3FF7A545E3E5"><enum>(J)</enum><text>the number of tenants evicted from public housing, broken down by each public housing agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5AEE7BB95F7144FE9D07B38B3AC5FCE8"><enum>(K)</enum><text>the number of tenants evicted from dwelling units who were receiving tenant-based assistance or project-based assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H757DD2C65078426DB301D1B5302D2B5B"><enum>(L)</enum><text>the number of court-ordered or administrative eviction or cases where late fees were collected from tenants by landlords, and the average amount of late fees in those cases.</text></subparagraph></paragraph><paragraph id="HD13F87F3568948109A84ED1E46FC97D7"><enum>(3)</enum><header>Data on executed evictions</header><text>Local law enforcement or any other official who executes an eviction shall report to the adjudicating court or administrative forum sufficient data on each executed eviction, such that the court may determine which court-ordered or administrative evictions resulted in a law enforcement officer or other local official removing the tenant.</text></paragraph><paragraph id="HE3F7D10D4C2143B9A1616FE3A3E78B7A"><enum>(4)</enum><header>Data on tenant status following a court-ordered or administrative eviction</header><text>Each court or administrative forum responsible for adjudicating evictions should contact landlords to determine whether tenants who were the subject of a court-ordered or administrative eviction were removed or remained in the property 90 days after the court-ordered or administrative eviction.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2916289FCE048F78DCF8B3DF70849F0"><enum>(5)</enum><header>Data on each illegal eviction</header><text>With respect to each illegal eviction occurring on or after the date on which the database is established, as reported by local governments and nonprofit organizations receiving grants under section 6:</text><subparagraph id="H08419BAC9F6241E68A86F96A61498F32"><enum>(A)</enum><text>The data described in paragraph (1)(A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H14FBE48115604786A01BE1AFF224A290"><enum>(B)</enum><text>Information on the landlord, including—</text><clause commented="no" display-inline="no-display-inline" id="H214D95E969D5486FAE3657F8887A6DDE"><enum>(i)</enum><text>the name of the landlord; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HA10DD702F63C4394BCA459D841614C8F"><enum>(ii)</enum><text>any amount that the landlord alleges that the tenant owes, including any penalties.</text></clause></subparagraph><subparagraph id="H16A1157DD994418D9CE011284E76D7FF"><enum>(C)</enum><text>The reason the tenant was evicted.</text></subparagraph><subparagraph id="H1124E6BD51BC422CAB8CC4DA47C18D4C"><enum>(D)</enum><text>If the tenant was evicted for nonpayment, the amount owed.</text></subparagraph><subparagraph id="HB3CD01EEB09248A098BD53176539FA38"><enum>(E)</enum><text>If the tenant was evicted for nonpayment, the total number of months owed.</text></subparagraph><subparagraph id="H4297F2FAD47646AB8E750BBDE5238769"><enum>(F)</enum><text>Whether the tenant was evicted because of the enforcement of a local ordinance impacting eviction.</text></subparagraph></paragraph><paragraph id="H17EF1CFB361349A4871A7EF8C2CC011C"><enum>(6)</enum><header>Aggregate data on illegal evictions</header><text>Aggregate data on illegal eviction cases occurring on or after the date on which the database is established, as reported by local governments and nonprofit organizations receiving grants under section 6, including—</text><subparagraph id="HE560202B66664718B9C43D2BE4930CBD"><enum>(A)</enum><text>the average amount owed by a tenant, per landlord;</text></subparagraph><subparagraph id="H3C01D89265AC40D4BEC6F333357BC1D3"><enum>(B)</enum><text>the average months of rent owed by a tenant;</text></subparagraph><subparagraph id="H73A2F4BBBD9F401091464A6F0AD1E207"><enum>(C)</enum><text>the number and percentage of illegal eviction cases broken down by age bracket;</text></subparagraph><subparagraph id="HC163A3CE8AEE41F4979E2B7E3351F282"><enum>(D)</enum><text>the number and percentage of illegal eviction cases with a tenant or household with children;</text></subparagraph><subparagraph id="H6E47CAD01D2145F69130169337FC9041"><enum>(E)</enum><text>the number and percentage of illegal eviction cases broken down by race and ethnicity;</text></subparagraph><subparagraph id="H941D4901CDBA4BB49B775726BCF535B3"><enum>(F)</enum><text>the number and percentage of illegal eviction cases broken down by gender;</text></subparagraph><subparagraph id="H2166CF79090D4BC9A92977DA3449025A"><enum>(G)</enum><text>the number and percentage of illegal eviction cases broken down by disability status; and</text></subparagraph><subparagraph id="HEC8469F2BDA347279CAF1142EA1AF402"><enum>(H)</enum><text>the number and percentage of illegal eviction cases based on the enforcement of a local ordinance impacting eviction.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9016DD19B370414D9A0EF1A888B1645B"><enum>(c)</enum><header>Submission of data</header><paragraph commented="no" display-inline="no-display-inline" id="H9BEE855A24F649E7BD8CF04A90E009E7"><enum>(1)</enum><header>Submission by courts</header><text>Not later than March 1 of each year, the Attorney General of each State shall submit to the Secretary data on court-ordered eviction cases that occurred in that State during the preceding calendar year for inclusion in the database established under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H72FF959F4649497FB7EA9B799B0A79EA"><enum>(2)</enum><header>Submission to Secretary</header><subparagraph commented="no" display-inline="no-display-inline" id="H31D40BF0213648749A8810F6469EA02F"><enum>(A)</enum><header>In general</header><text>The Attorney General of the State shall—</text><clause commented="no" display-inline="no-display-inline" id="HD665E9789A124422920A66C6F6919923"><enum>(i)</enum><text>ensure the accuracy and consistency of the data submitted under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H5CDEA28B6C74444D897C4051CAF8EC8E"><enum>(ii)</enum><text>upon receipt of the data, aggregate the data and report the individual and aggregate data to the Secretary in a timely manner.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5CF5FB44D298472AAD961B5F11432ABB"><enum>(B)</enum><header>Submission by courts</header><text>If the Attorney General of the State fails to submit the data described in paragraph (1) to the Secretary in a timely manner under subparagraph (A), the clerk of each State or local court that handles landlord-tenant cases may submit the data directly to the Secretary.</text></subparagraph></paragraph></subsection><subsection id="H75D22793E72F4722BFCA15CB662CA954"><enum>(d)</enum><header>Guidelines</header><text>The Secretary shall promulgate rules and establish guidelines for the submission of data under subsection (c) and publication of data in the database established under this section, which shall include—</text><paragraph id="H54DE407D997F457AB662A332BB441639"><enum>(1)</enum><text>a technological solution that provides a single point of entry for data submissions to reduce the burden on clerks of the courts;</text></paragraph><paragraph id="HBD39885171C048A0B50F4889A1C421C4"><enum>(2)</enum><text>in consultation with local governments and judges, appropriate safeguards for protecting the privacy of personally identifiable information of vulnerable populations, which shall incorporate confidentiality measures to ensure that any personally identifiable information regarding a tenant who is a victim of domestic violence, dating violence, sexual assault, or stalking is not disclosed during the process of data submission and publication;</text></paragraph><paragraph id="HD38639E0AB7E4F2A9A739469EEAAA3E4"><enum>(3)</enum><text>standards for—</text><subparagraph id="H24C285D8CBD047BA9E1B26C371F28604"><enum>(A)</enum><text>external researchers to be granted permission to access data in the database, including both aggregate data and, if necessary for the conduct of their research, personally identifiable information, with appropriate safeguards to ensure identities are protected in any publicly released analysis;</text></subparagraph><subparagraph id="H89B33EC03EA44F499E8D015D7B4DC3CB"><enum>(B)</enum><text>the establishment of a research data center to support analysis of that data; and</text></subparagraph><subparagraph id="HCA38A083EB55467389A772EFFA5C07A9"><enum>(C)</enum><text>using generally accepted statistical principles to validate the data, in consultation with outside participants;</text></subparagraph></paragraph><paragraph id="HE4A8C6E9FC514BD78DE799E6D23DE744"><enum>(4)</enum><text>methods for collecting data required under subsection (b) that are not currently collected;</text></paragraph><paragraph id="H5451EBB942E64681AADAC3C4AAB934DC"><enum>(5)</enum><text>establishing definitions for terms related to the eviction process based on how they are legally defined by courts of jurisdiction handling eviction cases; and</text></paragraph><paragraph id="HF413F44ED06547079ECBB2689E5C4168"><enum>(6)</enum><text>standards for local officials to identify and designate social services agencies that may access the database to provide targeted social services to those tenants.</text></paragraph></subsection><subsection id="HC37D27F92F234EBBA05B91AE299B67BA"><enum>(e)</enum><header>Annual reports</header><text>Not later than 1 year after the date of enactment of this Act, and each year thereafter, the Secretary shall make publicly available a report on the contents of the database established under this section.</text></subsection><subsection id="H7F9F18D016FF4393AD1049795900CB77"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary to carry out this section.</text></subsection></section><section id="H79A93CA485EE452F9AD2B269BE7B44A9"><enum>4.</enum><header>Grant program to collect data on illegal evictions</header><subsection id="HC10AD10A834048E1B37E96D6F836E29C"><enum>(a)</enum><header>In general</header><text>The Secretary shall award grants to local governments and nonprofit organizations to set up programs to collect data from landlords on illegal evictions in the United States.</text></subsection><subsection id="H75ED390C431E4B26A0DDD2AAFDB0B434"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as may be necessary for each of fiscal years 2022 through 2026 to provide grants under this section.</text></subsection></section><section id="HBED40AAEECD4440795DCD1844A2CD96C"><enum>5.</enum><header>Advisory Committee</header><subsection id="H9F5DDFC7C0AB414D90AF3AF7BCB254A0"><enum>(a)</enum><header>In General</header><text>The Secretary shall establish an advisory committee to be known as the Committee on Eviction Research (in this section referred to as the <term>Committee</term>) to advise the Secretary on matters relating to—</text><paragraph id="HC558F08A325A478B83994CF3D33C6A7E"><enum>(1)</enum><text>the creation, operation, maintenance, methodology, and privacy matters of the statistical efforts relating to the database established under section 5;</text></paragraph><paragraph id="H5290982BE1C4461786760C916DC9F66D"><enum>(2)</enum><text>developing a research agenda to determine the causes and consequences of evictions; and</text></paragraph><paragraph id="HC6CA773D360746B398848127D50C43EE"><enum>(3)</enum><text>illuminating policies or practices that reduce the number of evictions or mitigate the consequences of evictions.</text></paragraph></subsection><subsection id="HBBA97A01BC664C15AC558EA45450D572"><enum>(b)</enum><header>Membership</header><paragraph id="HB41B93C5A5B142DA98F2DECF02BC3472"><enum>(1)</enum><header>In general</header><text>The Committee shall be composed of 14 members who shall be appointed by the Secretary, in consultation with the chair and ranking member of the Committee on Banking, Housing, and Urban Affairs of the Senate and the chair and ranking member of the Committee on Financial Services of the House of Representatives, of whom—</text><subparagraph id="HB16CD5E7474E44FF8D26F58A3C542EF5"><enum>(A)</enum><text>2 members shall be employees of the Department with expertise in housing data and an interest in issues relating to evictions and housing instability;</text></subparagraph><subparagraph id="H5AAA9881209C449EBD30F418C93B33C3"><enum>(B)</enum><text>2 members shall be representatives of landlords;</text></subparagraph><subparagraph id="H4851A795E12D468DB251CF863340E2C8"><enum>(C)</enum><text>5 members shall be from the academic or research community;</text></subparagraph><subparagraph id="H18893C1625044A33B73111779BCEB878"><enum>(D)</enum><text>3 members shall be from civil society, of whom not less than 2 shall be from entities that advocate for civil rights related to housing or eviction; and</text></subparagraph><subparagraph id="HF67CCE9C0AD0480EA1FE62E3C2A93986"><enum>(E)</enum><text>2 members shall be from private industry, civil society, or the academic community with backgrounds in data science and privacy.</text></subparagraph></paragraph><paragraph id="H3126BE059A4F4036ABF32601A3FB7BE4"><enum>(2)</enum><header>Chair</header><text>The Secretary shall appoint a chair of the Committee from among the members of the Committee.</text></paragraph><paragraph id="H6D125E054B9B4010986CC7D2A775CDBF"><enum>(3)</enum><header>Period of appointment; vacancies</header><subparagraph id="HD800B4FF01D94A40AF65AA5229858AB3"><enum>(A)</enum><header>In general</header><text>A member of the Committee shall be appointed for a period of 2 years.</text></subparagraph><subparagraph id="HDC668BCBAB944E04AA01472B44D6BD36"><enum>(B)</enum><header>Vacancies</header><text>A vacancy in the Committee—</text><clause id="H62A862C5D9294F6381A134235CF9114B"><enum>(i)</enum><text>shall not affect the powers of the Committee; and</text></clause><clause id="H89BAB7929B304CECB5BCD16586F8AEEA"><enum>(ii)</enum><text>shall be filled in the same manner as the original appointment.</text></clause></subparagraph></paragraph></subsection><subsection id="HEA24F01F0AA542AAAC298D591B262311"><enum>(c)</enum><header>Meetings</header><text>The Committee shall meet—</text><paragraph id="H7D48C934A499465E9EDC2845AA1C6813"><enum>(1)</enum><text>in person not less frequently than twice each year; and</text></paragraph><paragraph id="H6CD6F52DBBF6428BBFF648B7B1BF4302"><enum>(2)</enum><text>via teleconference not less frequently than once every 2 months.</text></paragraph></subsection><subsection id="HA64CE1DC6E7540A19DD70BB9A53F4858"><enum>(d)</enum><header>Powers</header><text>In carrying out the duties of the Committee, the Committee may—</text><paragraph id="H4A09B5F9EFC549E098821D3585F4008D"><enum>(1)</enum><text>hold such hearings, sit, and act at such times and places, take such testimony, and receive such evidence as the Committee determines to be appropriate;</text></paragraph><paragraph id="H9C83BF09E1144B32B58D4A4E6A6B65BA"><enum>(2)</enum><text>issue reports, guidelines, and memoranda;</text></paragraph><paragraph id="H537D08FBC6D4416EA924A9C462F1DDC6"><enum>(3)</enum><text>hold or host conferences and symposia;</text></paragraph><paragraph id="HEE90DD2E9EFB4BAAA073E9A75513D548"><enum>(4)</enum><text>enter into cooperative agreements with third-party experts to obtain relevant advice or expertise, and oversee staff;</text></paragraph><paragraph id="H9D526722E7904FD39652D7E26D071D88"><enum>(5)</enum><text>establish subcommittees; and</text></paragraph><paragraph id="HD69435FE6BF442B1AB9995C1D480D62E"><enum>(6)</enum><text>establish rules of procedure.</text></paragraph></subsection><subsection id="HB167A116F67040CC881DFBC7C0DF5B87"><enum>(e)</enum><header>Gifts</header><text>The Committee may accept, use, and dispose of gifts or donations of services or property.</text></subsection><subsection id="HEAF9B7E0947747A087CBA289FAF07C08"><enum>(f)</enum><header>Travel expenses</header><text>The members of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of service for the Committee.</text></subsection><subsection id="HCE6B9E8AE4B24C00BE681485788273A5"><enum>(g)</enum><header>Staff</header><paragraph id="H0424F00775BA41FB87145582AD4CC4F8"><enum>(1)</enum><header>In general</header><text>The chair of the Committee may, without regard to the civil service laws (including regulations), appoint and terminate an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties, except that the employment of an executive director shall be subject to confirmation by the Commission.</text></paragraph><paragraph id="HA6A3968DFC5B4F83BC74C8E881D2381C"><enum>(2)</enum><header>Compensation</header><text>The chair of the Committee may fix the compensation of the executive director and other personnel without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></paragraph></subsection><subsection id="HA0D27CCC4941442D9AF47C6EA83D8E19"><enum>(h)</enum><header>Report</header><text>Not later than 90 days after the date on which the Committee terminates, the Committee shall submit to the Secretary a report containing—</text><paragraph id="H1A5D5F5AC49443FF902FB5695A2DD783"><enum>(1)</enum><text>recommendations for statistical efforts relating to the database established under section 5, including how additional data may potentially be collected, consistent with civil rights protections, to understand eviction trends by race, gender, disability status, ethnicity, age, and immigration status; and</text></paragraph><paragraph id="H63939818B98D4B30BD0753A09B95D30D"><enum>(2)</enum><text>a research agenda to determine the causes and consequences of evictions and to illuminate policies or practices that reduce the number of evictions or mitigate the consequences of evictions, including an assessment of the housing challenges resulting from the prohibition on public housing participation due to the prior eviction of an individual.</text></paragraph></subsection><subsection id="H2D4422DC3CF0491C95B9C685186CC99A"><enum>(i)</enum><header>No additional funds</header><text>The amounts necessary to carry out this section shall be derived from amounts appropriated or otherwise made available to the Secretary.</text></subsection></section></legis-body></bill>
