<section id="H6CA75FC2B44E4A87BEC09D10ED98E652" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unruly Passenger Restraint Review Act</short-title></quote>.</text></section> <section id="H7A02EAB9C209415184983D367F64A93E"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H4154DBC5FA0F41D3B059D5BF45B883A2"><enum>(1)</enum><text>incidents of unruly passenger conduct pose substantial operational and safety risks to passenger air carrier (as defined in section 3(f)) personnel and passengers on board an aircraft;</text></paragraph> <paragraph id="H3B319D324DEA43ED9EE5EF3C239740E1"><enum>(2)</enum><text>the forcible restraint of unruly passengers, while sometimes necessary, should only occur as a last resort to ensure the safety of passenger air carrier personnel and passengers on board an aircraft;</text></paragraph> 
<paragraph id="HCCD5D61A3B5C4DD7B8B50811C39689F1"><enum>(3)</enum><text>individuals who perpetrate such incidents, especially those that require forcible restraint, should be held fully accountable under all applicable Federal and State laws;</text></paragraph> <paragraph id="HC629FDE7759C468597FEF24AE5028D19"><enum>(4)</enum><text>particular caution and judgement should be exercised by passenger air carrier personnel when determining whether a situation requires the forcible restraint of an unruly minor passenger or passenger experiencing mental distress;</text></paragraph> 
<paragraph id="H4B777C74D36C4C3F80B582FF26AB8B25"><enum>(5)</enum><text>the Federal Aviation Administration, in coordination with appropriate Federal Agencies, should provide guidance and establish procedures for passenger air carrier personnel to address incidents of unruly passenger conduct, including the procedures, equipment, and training requirements for passenger air carrier personnel to—</text> <subparagraph id="HD6718D32A93A4A0EAD44717DF6AD0A4C"><enum>(A)</enum><text>recognize and respond to an instance of an unruly passenger behavior in a manner that attempts to de-escalate a situation;</text></subparagraph> 
<subparagraph id="H55EE84AC6BF54982848A7BF262BD35D3"><enum>(B)</enum><text>properly and safely, if necessary, restrain an unruly passenger;</text></subparagraph> <subparagraph id="HB4FCB172E9B34A7983CC375DD34AFC62"><enum>(C)</enum><text>appropriately differentiate between unruly conduct from an adult passenger, a minor passenger, and a passenger experiencing mental distress and respond accordingly;</text></subparagraph> 
<subparagraph id="H1D93A902928946668A9B05E43B6790DA"><enum>(D)</enum><text>facilitate the reporting of such incidents to appropriate law enforcement agencies;</text></subparagraph> <subparagraph id="H2FF984AC35954E40956F30B51E763F15"><enum>(E)</enum><text>communicate expectations of conduct to air carrier passengers; and</text></subparagraph> 
<subparagraph id="H20F8E36258EE43AC9B8B1313363530A7"><enum>(F)</enum><text>communicate the rights of air carrier passengers with respect to passenger conduct towards passenger air carrier personnel; and</text></subparagraph></paragraph> <paragraph id="H76F82A1512E044C6986754B870388E11"><enum>(6)</enum><text>each passenger air carrier should have the procedures, equipment, and training in place to comply with the Federal Aviation Administration’s guidance and requirements described in paragraph (5).</text></paragraph></section> 
<section id="HF676977A50F94BB08A7E9B76219BE97F"><enum>3.</enum><header>Government accountability office report</header> 
<subsection id="HB72A6C9CC48747249D20D2B714723214"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Comptroller General of the United States shall initiate a study to review current passenger air carrier procedures related to unruly passengers, including all policies, training, and equipment requirements put in place by the Federal Government and provide recommendations to address and mitigate the impacts of such incidents, including significant operational disruptions, safety risks, and the need to restrain a disruptive passenger aboard an aircraft.</text></subsection> <subsection id="H158D7DAE577842A5A53C7757639D44D4"><enum>(b)</enum><header>Considerations</header><text>In carrying out the study required under subsection (a), the Comptroller General shall, at a minimum—</text> 
<paragraph id="HBEABD1FB534247FF8F1F69AB186BFBD9"><enum>(1)</enum><text>review current passenger air carrier procedures and protocols for responding to unruly passenger behavior;</text></paragraph> <paragraph id="H4F04E14873234C7593B9840B216A36F6"><enum>(2)</enum><text>examine current passenger air carrier personnel training requirements as put in place by the Federal Government and programs related to de-escalation techniques for passenger disruptions and provide recommendations for improvement; and</text></paragraph> 
<paragraph id="HCC3D3EEB67EE4D238DD4FE84D1876A40"><enum>(3)</enum><text>review current passenger air carrier and Federal Government procedures for restraining an unruly adult passenger, an unruly minor passenger, and a passenger experiencing mental distress in a situation in which Federal law enforcement is unable to intervene.</text></paragraph></subsection> <subsection id="H7D36994E4ABF4BEEA72355E6C6576E07"><enum>(c)</enum><header>Report</header><text>Upon completion of the study required under subsection (a), the Comptroller General shall submit to the Committee of Transportation and Infrastructure of the House of Representatives and Committee on Commerce, Science, and Transportation of the Senate a report on the findings and recommendations of the study.</text></subsection> 
<subsection id="H262CA501C4914F0CA8ED68F0C60F388D"><enum>(d)</enum><header>Best practices</header><text>Not later than 1 year after the completion of the study required under subsection (a), the Administrator of the Federal Aviation Administration shall—</text> <paragraph id="H610C8530018C47F8ACB6D2001FC37C96"><enum>(1)</enum><text>develop, in consultation with passenger air carriers and labor unions representing passenger air carrier personnel, best practices to address and mitigate the impacts of unruly passenger incidents; and</text></paragraph> 
<paragraph id="H7F022DEB18344557AEB54D36DA128EB0"><enum>(2)</enum><text>take the findings and recommendations of the report submitted under subsection (c) into consideration when developing such best practices.</text></paragraph></subsection> <subsection id="H76B21F0203C749F79DD102F9FBB79630"><enum>(e)</enum><header>Consultation</header><text>In developing best practices under subsection (d), the Administrator shall consult with the heads of such other Federal agencies as the Administrator determines appropriate.</text></subsection> 
<subsection id="H47C4BA9C216341C8A14C25F22C954CB1"><enum>(f)</enum><header>Passenger air carrier defined</header><text>In this Act, the term <term>passenger air carrier</term> means an air carrier that provides scheduled passenger air transportation. </text></subsection></section> </legis-body></bill>
