<section id="HC56817A4A3AD4AE2BED31000A6B7A91F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Desert Community Lands Act</short-title></quote>.</text></section> <section id="H49E5A37574D7435785B5A6C320B97581"><enum>2.</enum><header>Conveyance for Apple Valley Off-Highway Vehicle Recreation Area</header> <subsection id="HF2D1C08EFB8A49A1B7302CFC88CE52B5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDEA43BBAC6B740F79BFB5E5B1A66449D"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> <paragraph id="HC8C6498BD91E4A228E9CF22C3AE81D22"><enum>(2)</enum><header>Town</header><text>The term <term>Town</term> means the town of Apple Valley, California.</text></paragraph></subsection> 
<subsection id="HDB601CAACD264378B071BA74639A023F"><enum>(b)</enum><header>Conveyance of federal land to town</header> 
<paragraph id="HACBD928F3F78483890698A7CA8751118"><enum>(1)</enum><header>Conveyance required</header><text display-inline="yes-display-inline">At the request of the Town, not later than 5 years after the date of the enactment of this Act, the Secretary shall convey to the Town, without consideration, all right, title, and interest of the United States in and to the surface estate of the approximately 4,630 acres of land generally depicted as <quote>Proposed Conveyance Area</quote> on the map entitled <quote>Conveyance to Town of Apple Valley</quote> and dated June 1, 2015. Such land shall be known and designated as the <quote>Apple Valley Off-Highway Vehicle Recreation Area</quote>.</text></paragraph> <paragraph id="H7B382ECEAE294A93806C95EE10700956"><enum>(2)</enum><header>Existing rights and mineral estate</header><text>The conveyance under this subsection—</text> 
<subparagraph id="H44981E9648354D14A630B7E7B9B4B2D5"><enum>(A)</enum><text>is subject to valid existing rights; and</text></subparagraph> <subparagraph id="HF1578DAF10624AAB9CF39BB00C81B652"><enum>(B)</enum><text>does not include the mineral estate.</text></subparagraph></paragraph></subsection> 
<subsection id="H3AAD8099FD654A078D0FF2F485B3CF39"><enum>(c)</enum><header>Use of conveyed land</header> 
<paragraph id="H2380E91559D44DED80B67A916ECEF5FE"><enum>(1)</enum><header>In general</header><text>The land conveyed under subsection (b) may be used by the Town for any public purpose authorized in paragraph (2), consistent with the Act of June 14, 1926 (commonly known as the Recreation and Public Purposes Act; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>).</text></paragraph> <paragraph id="H220DE569D517441D850F844CE3B89898"><enum>(2)</enum><header>Authorized purposes</header><text>The purposes of the conveyance under subsection (b) are to allow the Town to use the conveyed land to provide—</text> 
<subparagraph id="H1ED27E70704A430EBF95905A5AE886A2"><enum>(A)</enum><text>a suitable location for the establishment of a centralized off-road vehicle recreation park;</text></subparagraph> <subparagraph id="H036C76E4961047789D70B0DFDEF231C4"><enum>(B)</enum><text>the public with opportunities for off-road vehicle recreation, including a location for races, competitive events, training, and other commercial services that directly support a centralized off-road vehicle recreation area and Town park; and</text></subparagraph> 
<subparagraph id="HD47AFDD1E2754314ACD63769D57E5B90"><enum>(C)</enum><text display-inline="yes-display-inline">a designated area and facilities that would discourage unauthorized use of off-highway vehicles in areas that have been identified by the Federal Government, the State of California, or San Bernardino County as containing environmentally sensitive land.</text></subparagraph></paragraph> <paragraph id="H5919A3A11E174627B107FFB6E83DEB81"><enum>(3)</enum><header>Disposal prohibited</header><text>The land conveyed under subsection (b) may not be disposed of by the Town without the approval of the Secretary.</text></paragraph></subsection></section> 
<section id="H59D1348471E442EB9C638DBF29E8F0CF"><enum>3.</enum><header>Conveyance to City of Twentynine Palms, California</header> 
<subsection id="H19D16C0C734A4796BB767BBDDEEDFD7C"><enum>(a)</enum><header>Conveyance required</header><text display-inline="yes-display-inline">At the request of the city of Twentynine Palms, California, not later than 1 year after the date of the enactment of this Act, the Secretary of the Interior shall convey to the city of Twentynine Palms, California, without consideration, all right, title, and interest of the United States in and to the surface estate of the land generally depicted as <quote>Proposed Conveyance to Twentynine Palms</quote> on the map entitled <quote>Proposed Conveyance to Twentynine Palms</quote> and dated September 18, 2015.</text></subsection> <subsection id="H6E47F4157F5540E5B66150403C0927E6"><enum>(b)</enum><header>Existing rights and mineral estate</header><text>The conveyance under this section—</text> 
<paragraph id="H48FF96112B164428B40B1AC7BE408B46"><enum>(1)</enum><text>is subject to valid existing rights; and</text></paragraph> <paragraph id="HFB2971C59765415F9C08E0358F29EB17"><enum>(2)</enum><text>does not include the mineral estate.</text></paragraph></subsection></section> 
<section id="H18D4D1D558804559B6E8C8E95FA11759"><enum>4.</enum><header>Conveyance to City of Barstow, California</header> 
<subsection id="HD7E09E67465347DCBD25065A82C443BF"><enum>(a)</enum><header>Conveyance required</header><text display-inline="yes-display-inline">At the request of the city of Barstow, California, not later than 1 year after the date of the enactment of this Act, the Secretary of the Interior shall convey to the city of Barstow, California, without consideration, all right, title, and interest of the United States in and to the surface estate of the land generally depicted as <quote>Proposed Conveyance</quote> on the map entitled <quote>Proposed Conveyance to the City of Barstow</quote> and dated January 13, 2017.</text></subsection> <subsection id="H90132F28809049A18F61DF8B56AE2939"><enum>(b)</enum><header>Existing rights and mineral estate</header><text>The conveyance under this section—</text> 
<paragraph id="H6956D453D5FF41ED8B7C4B8C61EF0DC7"><enum>(1)</enum><text>is subject to valid existing rights; and</text></paragraph> <paragraph id="H550B4100828C460C981335B75D14CD0D"><enum>(2)</enum><text>does not include the mineral estate.</text></paragraph></subsection></section> 
<section id="H65CC99DBF9DC40A693663B94E067A15C"><enum>5.</enum><header>Conveyance to City of Victorville, California</header> 
<subsection display-inline="no-display-inline" id="HAF652D05ED5441C88E79401D30474F15"><enum>(a)</enum><header>Conveyance required</header><text display-inline="yes-display-inline">At the request of the city of Victorville, California, not later than 1 year after the date of the enactment of this Act, the Secretary of the Interior shall convey to the city of Victorville, California, without consideration, all right, title, and interest of the United States in and to the surface estate of the land generally depicted as <quote>Proposed Conveyance</quote> on the map entitled <quote>Proposed Conveyance to the City of Victorville</quote> and dated April 25, 2017.</text></subsection> <subsection id="H293CD1FBD18440228580BB20E73BD795"><enum>(b)</enum><header>Existing rights and mineral estate</header><text>The conveyance under this subsection—</text> 
<paragraph id="HD2F5E928F6C44AAAAD734046FD4F134D"><enum>(1)</enum><text>is subject to valid existing rights;</text></paragraph> <paragraph id="H810CE2AA709443C497FBD491DCF19287"><enum>(2)</enum><text>does not include the mineral estate; and</text></paragraph> 
<paragraph id="HF3864D0E56D5434F917EBDE27642B056"><enum>(3)</enum><text display-inline="yes-display-inline">is subject to the reservation of a permanent easement and right of way for flood control, utility, pipeline, or telecommunications facilities located within the strips of land described in the right of way grant from the United States Department of the Interior to Pacific Gas and Electric Company, Serial Number R 06259, dated March 2, 1965, and the easement from J. Harley Long to Pacific Gas and Electric Company, dated February 4, 1957, and recorded in Book 4192, Official Records at page 42, San Bernardino County Records. </text></paragraph><continuation-text continuation-text-level="subsection">These easements include the right, at any time and from time to time, to construct, reconstruct, maintain, operate, replace, remove, repair, renew, and enlarge facilities for public utility purposes, the right to trim and cut down trees and brush that the public utility may deem to be a hazard to its facilities, and the requirement that the strips of land be kept open and free of buildings, structures, and wells of any kind.</continuation-text></subsection></section> </legis-body></bill>
