Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To abolish the Space Force as an Armed Force, and for other purposes.</official-title></form><legis-body id="H7A2048A70B684BEAB87502AA2E70B4CB" style="OLC"><section id="H7C7B21BA85CF418E889160B1E5A1E117" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Militarization of Space Act</short-title></quote>.</text></section><section id="H03545E5438C947C8929EF2ACDE508D94"><enum>2.</enum><header>Abolishment of the Space Force as an Armed Force</header><subsection id="H3ACE230965904571BC88AEDA415E263A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after submitting to the congressional defense committees the report required under subsection (c)(2), but not later than one year after the date of the enactment of this Act, the Secretary of Defense, acting through the Secretary of the Air Force, shall abolish the Space Force as an Armed Force within the Department of the Air Force in accordance with this section.</text></subsection><subsection id="H1B6CBB0609B24E5D80AEBE0F9477C5C5"><enum>(b)</enum><header>Cessation of certain transfer activities</header><text display-inline="yes-display-inline">During the period preceding the abolishment of the Space Force pursuant to subsection (a), the Secretary of Defense may not transfer any authorities, duties, functions, missions, personnel, units, facilities, or assets from another Armed Force to the Space Force.</text></subsection><subsection id="HB97CD95CF2724A4CBB3520AA77B71FE4"><enum>(c)</enum><header>Plan for transfer</header><paragraph id="H4F86EAF1E59848E18670F2305E518622"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall complete the development of a plan to transfer all authorities, duties, functions, missions, personnel, units, facilities, and assets from the Space Force to the appropriate commands of the Armed Forces. </text></paragraph><paragraph id="H2262AD278DC74C13B5E8A13A830BD3B2"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees a report on the plan described in paragraph (1).</text></paragraph></subsection><subsection id="HC708C298336A424BBF6AE2D888FD4E85"><enum>(d)</enum><header>Dissolution of the Space Force</header><paragraph id="HBB4FC67AADE246F099404D61F1C5AFDC"><enum>(1)</enum><header>Transfer to Air Force Space Command</header><text>Except as provided by paragraph (2), effective upon the abolishment of the Space Force, there are transferred to the Air Force Space Command the authorities, duties, functions, missions, personnel, units, facilities, and assets of the Space Force.</text></paragraph><paragraph id="H86ABC9BA220D463E8DA6FBB9FB4F019A"><enum>(2)</enum><header>Transfer outside of Air Force Space Command</header><text display-inline="yes-display-inline">Effective upon the abolishment of the Space Force, any authorities, duties, functions, missions, personnel, units, facilities, and assets transferred to the Space Force from a command of an Armed Force other than the Air Force Space Command shall be returned to such other command. </text></paragraph></subsection><subsection id="H70C39641A8AE47B1815AA28BD3EF47D5"><enum>(e)</enum><header>Repeal of relevant laws</header><text>Effective upon the abolishment of the Space Force, the following subtitles are repealed and any provisions of law amended or repealed by such subtitles are restored or revived as if such subtitles had not been enacted:</text><paragraph id="H666ACD9205A94108929CDC899734AD24"><enum>(1)</enum><text display-inline="yes-display-inline">Subtitle D of title IX of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>).</text></paragraph><paragraph id="H45AB8EDAB6AB44748D2033AB428A5869"><enum>(2)</enum><text display-inline="yes-display-inline">Subtitle C of title IX of the National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></paragraph></subsection><subsection id="H8F684D0B2CEC4C9786D43EA1C2950496"><enum>(f)</enum><header>References in law</header><text>Effective upon the abolishment of the Space Force, any reference to the Space Force in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Air Force Space Command.</text></subsection><subsection id="H6DA6819F18A04D81AECAFA53DE97B75A"><enum>(g)</enum><header>Congressional defense committees defined</header><text>The term <term>congressional defense committees</term> has the meaning given such term in section 101(a)(16) of title 10, United States Code. </text></subsection></section></legis-body></bill>
