and</text></paragraph><paragraph id="H3638C515A9B241F4859735DD31AC11E6"><enum>(4)</enum><text display-inline="yes-display-inline">support the program management capability of the governmental entity to use an eligible small unmanned aircraft system.</text></paragraph></subsection><subsection id="HE1AD2AF0317340378F2C8A017EC85E6B"><enum>(c)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, a governmental entity shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require, including an assurance that the governmental entity or its contractor will comply with relevant federal regulations.</text></subsection><subsection id="H2A958A669BB84FCE955BA1B2951222EA"><enum>(d)</enum><header>Selection of applicants</header><text>In selecting an applicant for a grant under this section, the Secretary shall prioritize projects that propose to—</text><paragraph id="HC3767701D1AC4FAAB7D2F57A28B748BD"><enum>(1)</enum><text>carry out a critical infrastructure project in a historically disadvantaged community; or</text></paragraph><paragraph id="H2D4493D2DF154DAEACD3CFD9B8EF09D1"><enum>(2)</enum><text display-inline="yes-display-inline">address a safety risk in the inspection, operation, maintenance, repair, modernization, or construction of an element of critical infrastructure.</text></paragraph></subsection><subsection id="H9C697B5B684A4544A64C9F322C62D15F"><enum>(e)</enum><header>Limitation</header><text>Nothing in this section shall be construed as to interfere with an agreement between a governmental entity and a labor union.</text></subsection><subsection id="HECC145482F4F4981AF4A1D609CD35460"><enum>(f)</enum><header>Report to congress</header><text>Not later than 1 year after the first grant is provided under this section, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that evaluates the program carried out under this section, including—</text><paragraph id="HD38BF588E4034BD9A04210ED9817AD68"><enum>(1)</enum><text>a description of the number of grants awarded;</text></paragraph><paragraph id="H57088D526AE94F85AD79DDA3A83B2B41"><enum>(2)</enum><text>the amount of each grant;</text></paragraph><paragraph id="HEA70D2DE7B3D42B694D80DCBF8B6959C"><enum>(3)</enum><text>the activities funded under this section; and</text></paragraph><paragraph id="HD1EB961F5DA043CAA487C7E697F71841"><enum>(4)</enum><text>the effectiveness of such funded activities in meeting the objectives described in subsection (a).</text></paragraph></subsection><subsection id="H857F5E1B6B2948E98719170B67B278A8"><enum>(g)</enum><header>Funding</header><paragraph id="H6B4AD067347A4D8285DDA2B5A202B1E3"><enum>(1)</enum><header>Federal share</header><subparagraph id="H3044818A4B9F4B758C3B8B2C9EC08384"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of the cost of a project carried out using a grant under this section shall not exceed 80 percent of the total project cost.</text></subparagraph><subparagraph id="H6DFA66A2236C45279649A9FD8B38A485"><enum>(B)</enum><header>Waiver</header><text>The Secretary may increase the Federal share requirement under subparagraph (A) to up to 100 percent for a project carried out using a grant under this section by a governmental entity if such entity—</text><clause id="HBAEC721FB6A64CA8AA47A39EA17AA256"><enum>(i)</enum><text>submits a written application to the Secretary requesting an increase in the Federal share; and</text></clause><clause id="H64B6A2EC71D0452DA0280A84479A6E47"><enum>(ii)</enum><text>demonstrates that the additional assistance is necessary to facilitate the acceptance and full use of a grant under this section, such as alleviating economic hardship, meeting additional workforce needs, or such other uses that the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="HDC5F20B840CC49F8963F84A5ADCC1FBD"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><subparagraph id="H933E5A30B48A4DEB92587964C6C57586"><enum>(A)</enum><text>$50,000,000 for fiscal year 2023; and</text></subparagraph><subparagraph id="H50017E1FDE064D148781333C488599EC"><enum>(B)</enum><text>$50,000,000 for fiscal year 2024.</text></subparagraph></paragraph></subsection></section><section id="H7D5A31562E7F494E838EF24A25144865"><enum>3.</enum><header>Drone education and workforce training grant program</header><subsection id="HD79F02FF5F2D4FA8BAAFBB24C83ACB3C"><enum>(a)</enum><header>Authority</header><text>The Secretary of Transportation shall establish a drone education and training grant program to make grants to educational institutions for workforce training for eligible small unmanned aircraft system technology.</text></subsection><subsection id="HFB4646F781EE4A4FA234C68EDA7F0A58"><enum>(b)</enum><header>Use of grant amounts</header><text>Amounts from a grant under this section shall be used in furtherance of activities authorized under sections 631 and 632 of the FAA Reauthorization Act 2018 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note).</text></subsection><subsection id="HFC21699CAAB648B18F9420070DCFBF39"><enum>(c)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an educational institution shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require.</text></subsection><subsection id="H906374021F8944858A0DCC49A2585C87"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="H9775B780D15143C3B2B2985469F54C12"><enum>(1)</enum><text>$50,000,000 for fiscal year 2023; and</text></paragraph><paragraph id="HEFB2155C81DF4016AB6C308680DC393D"><enum>(2)</enum><text>$50,000,000 for fiscal year 2024.</text></paragraph></subsection></section><section id="H5EC827FC398947E196ADA875CF113E97"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H90D9BF0F0DA2416F9FC8E5551038A3DF"><enum>(1)</enum><header>Critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure</quote> has the meaning given such term in section 1016(e) of the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>).</text></paragraph><paragraph id="H1AD21F0048A44EBCAD6BB9BF40D67F50"><enum>(2)</enum><header>Critical infrastructure project</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure project</quote> means a project for the inspection, operation, maintenance, repair, modernization, or construction of an element of critical infrastructure, including mitigating environmental hazards to such infrastructure.</text></paragraph><paragraph id="HB6DD0AC9AAF044368D32A0E199BA87DB"><enum>(3)</enum><header>Covered foreign entity</header><text>The term <quote>covered foreign entity</quote> means an entity—</text><subparagraph id="HE26B520FFE1C4FF19D2AFF13988B1A85"><enum>(A)</enum><text>included on the Consolidated Screening List or Entity List as designated by the Secretary of Commerce;</text></subparagraph><subparagraph id="H2C0FD4AB839140399F7ABEFB81E608F3"><enum>(B)</enum><text>domiciled in the People’s Republic of China or the Russian Federation;</text></subparagraph><subparagraph id="H883ACEF0978A496097CACC3426199F44"><enum>(C)</enum><text>subject to influence or control by the government of the People’s Republic of China or by the Russian Federation; or</text></subparagraph><subparagraph id="H9EA2CD064FEF49F190F13D3F2023017C"><enum>(D)</enum><text>is a subsidiary or affiliate of an entity described in subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="HB156D5C4A6AA4EBB90858EE28A450115"><enum>(4)</enum><header>Educational institution</header><text display-inline="yes-display-inline">The term <quote>educational institution</quote> means an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that participates in a program authorized under sections 631 and 632 of the FAA Reauthorization Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note). </text></paragraph><paragraph id="HE80579E5039F4DE6B222ECA5CBC352F0"><enum>(5)</enum><header>Element of critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>element of critical infrastructure</quote> means a critical infrastructure facility or asset, including public bridges, tunnels, roads, highways, dams, electric grid, water infrastructure, communication systems, pipelines, or other related facilities or assets, as defined by the Secretary. </text></paragraph><paragraph id="H623DA1CC623E4AEF8B30DB103E677807"><enum>(6)</enum><header>Eligible small unmanned aircraft system</header><text>The term <quote>eligible small unmanned aircraft system</quote> means a small unmanned aircraft system manufactured or assembled by a company that is domiciled in the United States and is not a covered foreign entity.</text></paragraph><paragraph id="H124901B496C446E99904D443ED16CF95"><enum>(7)</enum><header>Governmental entity</header><text>The term <quote>governmental entity</quote> means—</text><subparagraph id="H2B17B0ED22434045A39AD2BF8219CE73"><enum>(A)</enum><text>a State, the District of Columbia, the Commonwealth of Puerto Rico, a territory of the United States, or a political subdivision thereof;</text></subparagraph><subparagraph id="H48533D3F7F77491AA55C19A5F6C80E99"><enum>(B)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="H3564C0615F974A388BAAC749A27A8133"><enum>(C)</enum><text>a Tribal Government;</text></subparagraph><subparagraph id="H655F4941F55541EA862B79AB2C9FB319"><enum>(D)</enum><text>a metropolitan planning organization; or</text></subparagraph><subparagraph id="H44B3F94A16CA477BB221835F56EA1811"><enum>(E)</enum><text>a combination of the entities described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="HF7E7458D08B34BDAB74BB9C43F45A544"><enum>(8)</enum><header>Small unmanned aircraft; unmanned aircraft; unmanned aircraft system</header><text>The terms <quote>small unmanned aircraft</quote>, <quote>unmanned aircraft</quote>, and <quote>unmanned aircraft system</quote> have the meanings given such terms in section 44801 of title 49, United States Code.</text></paragraph></section></legis-body><endorsement><action-date date="20220913">September 13, 2022</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
