which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to establish in the Department of Transportation a drone infrastructure inspection grant program and a drone education and training grant program, and for other purposes.</official-title></form><legis-body id="H2AF99C4A1A66437D9AA5F408E19D1350" style="OLC"><section id="HAFEF5BCDE1374A828F20A183C890CA2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drone Infrastructure Inspection Grant Act</short-title></quote>.</text></section><section id="HA830153F6C534AEBAEB6457664B27547"><enum>2.</enum><header>Drone infrastructure inspection grant program</header><subsection id="H4F1951F86F9B423DA61CF80037EE304A"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a drone infrastructure inspection grant program to make grants to governmental entities to facilitate the use of eligible small unmanned aircraft systems to increase efficiency, reduce costs, improve worker safety, and reduce carbon emissions related to the inspection, repair, modernization, and construction of critical infrastructure.</text></subsection><subsection id="H4AF1511E285A43A191673BE465671BD4"><enum>(b)</enum><header>Use of grant amounts</header><text display-inline="yes-display-inline">Amounts from a grant under this section may be used to—</text><paragraph id="H848D8C2860B64C6A8B98F766D1CADD5C"><enum>(1)</enum><text>purchase or lease eligible small unmanned aircraft systems;</text></paragraph><paragraph id="H4ECDBBD695E040C1A8FB3B728222AC76"><enum>(2)</enum><text>contract for services performed with an eligible small unmanned aircraft system; and</text></paragraph><paragraph id="HEE8991F32ED8407198551780763B58B5"><enum>(3)</enum><text>support the governmental entity’s small unmanned aircraft system program’s management capability.</text></paragraph></subsection><subsection id="H8647E21A40FE4C2EA3AC83648788D6D2"><enum>(c)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, a governmental entity shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require.</text></subsection><subsection id="HAF6AB6FDFABC4A109FCA1212E538DDDF"><enum>(d)</enum><header>Selection of applicants</header><text>In the selection of applicants for grants under this section, the Secretary shall prioritize projects that propose to—</text><paragraph id="H7657AAF12E3F4CFBAC8EDDCE7C3AC239"><enum>(1)</enum><text>use the grant for critical infrastructure projects in historically disadvantaged communities; or</text></paragraph><paragraph id="H13103896E3EE41A1839FC255F5484379"><enum>(2)</enum><text>address a significant safety risk in critical infrastructure inspection, maintenance, rehabilitation, or construction projects.</text></paragraph></subsection><subsection id="HF03A398F47104D93A0D0E7D10B1329A3"><enum>(e)</enum><header>Report to Congress</header><text display-inline="yes-display-inline"> Not later than 1 year after the first grant awards are made under this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that evaluates the program carried out under this section, including—</text><paragraph id="H0522423EC17C4CB380DDC55E64EC0FF5"><enum>(1)</enum><text>a description of the number of grants awarded;</text></paragraph><paragraph id="HA76F8859D3C144B89BF39C97224990C3"><enum>(2)</enum><text>the amount of each grant;</text></paragraph><paragraph id="H42FC1447D227413FA46A617D0420944A"><enum>(3)</enum><text>the activities funded under this section; and</text></paragraph><paragraph id="H05D886BE289D4249AEF5FC6664E8F0E6"><enum>(4)</enum><text>the effectiveness of such funded activities in meeting the objectives described in subsection (a).</text></paragraph></subsection><subsection id="HC92A7342419B489DAABE0E298744E9B9"><enum>(f)</enum><header>Funding</header><paragraph id="H945AD8D9358C411FA545AE3FBAD8E24F"><enum>(1)</enum><header>Federal share</header><subparagraph id="H0FDF01F0E78E4FDA8A8BE4EEBF748AFA"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share of the cost of a project carried out using a grant under this section shall not exceed 80 percent of the total project cost.</text></subparagraph><subparagraph id="H36D9C6BEECDB43D4B907E256D4B9A620"><enum>(B)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Secretary may increase the Federal share requirement under subparagraph (A) to up to 100 percent for a project carried out using a grant under this section by a governmental entity if such entity—</text><clause id="H6C06D476DCC24619A861EE27E3CB4E23"><enum>(i)</enum><text>submits a written application to the Secretary requesting an increase in the Federal share; and</text></clause><clause id="H8744351B7C9D4A8FAB211C178D01BD7E"><enum>(ii)</enum><text>demonstrates, to the Secretary’s satisfaction, that the additional assistance is necessary to facilitate the acceptance and full use of a grant under this section, such as alleviating economic hardship, meeting additional workforce needs, or such other uses that the Secretary determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="H3D8E6E340DB24E6D9C9AA64AC2320982"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><subparagraph id="H0888DEA116F24410BFAF9D7D21E43B93"><enum>(A)</enum><text>$50,000,000 for fiscal year 2022; and</text></subparagraph><subparagraph id="HD3805218FB904247AA8079EE1243DA41"><enum>(B)</enum><text>$50,000,000 for fiscal year 2023.</text></subparagraph></paragraph></subsection><subsection id="HF99CBA1A5EDD4C3983226968A3CD6C15"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4617AFC4A04D48BABA1CDD6BEECD52FB"><enum>(1)</enum><header>Critical infrastructure</header><text display-inline="yes-display-inline">The term <quote>critical infrastructure</quote> has the meaning given the term in section 1016(e) of the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c(e)</external-xref>) that is a bridge, road, dam, electric grid infrastructure, water infrastructure, or other related infrastructure.</text></paragraph><paragraph id="H98EFFDE1C03C419884F3111957202224"><enum>(2)</enum><header>Eligible small unmanned aircraft system</header><text>The term <quote>eligible small unmanned aircraft system</quote> means a small unmanned aircraft system that is manufactured or assembled by a company domiciled in the United States that is not subject to influence or control by the Government of the People’s Republic of China.</text></paragraph><paragraph id="H36FC0FC904D9489E9854F7501AFC8444"><enum>(3)</enum><header>Governmental entity</header><text>The term <quote>governmental entity</quote> means—</text><subparagraph id="H5ABC4AE7452A4BE6921326576F694740"><enum>(A)</enum><text>a State or political subdivision thereof;</text></subparagraph><subparagraph id="HA8FF8CC248F141E3A49E34D1CD03174B"><enum>(B)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="H2C056C22253E4CF88F539534EB2076F3"><enum>(C)</enum><text>a Tribal government,</text></subparagraph><subparagraph id="HFF849BD2129D48FA9D8F57FA0430D0E2"><enum>(D)</enum><text display-inline="yes-display-inline">a metropolitan planning organization; or</text></subparagraph><subparagraph id="HA2EC08481FA54B8FAFCFDB565F967F23"><enum>(E)</enum><text display-inline="yes-display-inline">a combination of the entities in subparagraphs (A) through (D) in a region or geographic area.</text></subparagraph></paragraph><paragraph id="H27486907D9B741A4B05E40E86458DA31"><enum>(4)</enum><header>Small unmanned aircraft; unmanned aircraft; unmanned aircraft system</header><text display-inline="yes-display-inline">The terms <quote>small unmanned aircraft</quote>, <quote>unmanned aircraft</quote>, and <quote>unmanned aircraft system</quote> have the meanings given such terms in section 44801 of title 49, United States Code.</text></paragraph><paragraph id="H844EC48C71AB4FDFAEDDDC082B08AF74"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. </text></paragraph></subsection></section><section id="H4AC086B0C475464386F86149C0B48F55"><enum>3.</enum><header>Drone education and workforce training grant program</header><subsection id="H6D1835C830184B7880CCCF18E581DC80"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary of Transportation shall establish a drone education and training grant program to make grants to educational institutions for workforce training for small unmanned aircraft system technology.</text></subsection><subsection id="HF2A4577D144F4A31B3C36E8A04158EB8"><enum>(b)</enum><header>Use of grant amounts</header><text display-inline="yes-display-inline">Amounts from a grant under this section shall be used in furtherance of activities authorized under sections 631 and 632 of the FAA Reauthorization Act 2018 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note).</text></subsection><subsection id="HB91B699BAE74404DB2280EF5F79D9990"><enum>(c)</enum><header>Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an educational institution shall submit an application to the Secretary at such time, in such form, and containing such information as the Secretary may require,</text></subsection><subsection id="H567FA56647F844C390521DAC4C8580B2"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section—</text><paragraph id="H943341C41FC84CE5A04B90BB8C0DB34D"><enum>(1)</enum><text>$50,000,000 for fiscal year 2022; and</text></paragraph><paragraph id="H213C26B741BD4B2E989CBB5D805A062C"><enum>(2)</enum><text>$50,000,000 for fiscal year 2023.</text></paragraph></subsection><subsection id="H63C74321DB8C4914A06EF1EC95FB8B2D"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H05E0F7C7DB73478B80DA890219AA6AE8"><enum>(1)</enum><header>Educational institution</header><text>The term <quote>educational institution</quote> means an institution of higher education as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>) that—</text><subparagraph id="H234DC64FA0834523BEC53D1FA1C916F8"><enum>(A)</enum><text>is designated by the Secretary of Transportation as a Community and Technical College Center of Excellence in Small Unmanned Aircraft System Technology Training under section 631(a) of the FAA Reauthorization Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note); or</text></subparagraph><subparagraph id="HA3D544C4D1514E35A9CD73725DA1422C"><enum>(B)</enum><text>has an agreement in effect with the Administrator of the Federal Aviation Administration under the collegiate training initiative program relating to unmanned aircraft systems under section 632 of the FAA Reauthorization Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note).</text></subparagraph></paragraph><paragraph id="HC283D6C3F0A44CE19F603586B4B7186B"><enum>(2)</enum><header>Small unmanned aircraft; unmanned aircraft; unmanned aircraft system</header><text display-inline="yes-display-inline">The terms <quote>small unmanned aircraft</quote>, <quote>unmanned aircraft</quote>, and <quote>unmanned aircraft system</quote> have the meanings given such terms in section 44801 of title 49, United States Code.</text></paragraph></subsection></section></legis-body></bill>
