R. 5309</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210922">September 21, 2021</action-date><action-desc><sponsor name-id="D000216">Ms. DeLauro</sponsor> (for herself and <cosponsor name-id="M000312">Mr. McGovern</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to enter into contracts to provide individuals dealing with food and nutrition insecurity family-friendly fresh produce, and for other purposes.</official-title></form><legis-body id="H65F4401C25D1443AB0D3113508357AD6" style="OLC"><section id="H1E910BC2912B4971827A83A5CAC42508" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fresh Produce Procurement Reform Act of 2021</short-title></quote>.</text></section><section id="HF33C7FCEF2B24FB0A3A068DB95F98FBC"><enum>2.</enum><header>Contracts for fresh produce</header><subsection id="HA9E7321FE1B84FE9B920327A953894C4"><enum>(a)</enum><header>In general; purposes</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary, acting through the Administrator of the Agricultural Marketing Service and in consultation with the Administrator of Food and Nutrition Service, shall establish a program (in this section referred to as the <quote>Program</quote>) under which the Secretary shall enter into contracts with eligible entities to procure fresh produce for distribution to qualifying nonprofits that serve individuals at risk of food and nutrition insecurity. The Program shall aim to—</text><paragraph id="HE9E8A98F433248EC827D9BAD0F31302F"><enum>(1)</enum><text>increase access to a wide variety of fresh fruits and vegetables to low-income households;</text></paragraph><paragraph id="H7BB33288FB2F4355A37B226E61293A91"><enum>(2)</enum><text>directly connect fruit and vegetable producers and distributors to nonprofit emergency feeding entities;</text></paragraph><paragraph id="H9A71C3F335DE4E359B280FA1603FDF35"><enum>(3)</enum><text>increase the Federal Government’s procurement of fresh fruits and vegetables;</text></paragraph><paragraph id="H3F90F5FDAEA04F0E8218531209E589F3"><enum>(4)</enum><text>strengthen the local and regional food supply chain;</text></paragraph><paragraph id="HC7AABDA6BFA645E4A97AB2C45367F3E4"><enum>(5)</enum><text>reduce on-farm food loss; and</text></paragraph><paragraph id="HD784CB9153B94311A65668E1F2106607"><enum>(6)</enum><text>model nimbleness and responsiveness in and out of emergency situations.</text></paragraph></subsection><subsection id="HDCB4262F56D74B03B328865AF672919F"><enum>(b)</enum><header>Selection criteria</header><text>In determining whether to award contractors, the Secretary of Agriculture should consider whether the eligible entity—</text><paragraph id="H4D351D1A24264EF3A12B9931A174DE84"><enum>(1)</enum><text>has previous experience distributing fresh produce through the Department of Agriculture;</text></paragraph><paragraph id="H97BBDA4EE0BD408D93149E26E041F082"><enum>(2)</enum><text>has demonstrated experience in fresh produce supply chain distribution;</text></paragraph><paragraph id="H9FF320C70BCD43D3B45DF621519F47D7"><enum>(3)</enum><text>holds qualifications including, PACA license, food safety certifications, and any other requirements as determined by the Secretary;</text></paragraph><paragraph id="H0BBA7BBACD154477A18DC123B853C5A0"><enum>(4)</enum><text>operates a facility or facilities in or adjacent to the State where the produce will be distributed;</text></paragraph><paragraph id="HAB1DAD8C0AE84A93A24F014C11A808E8"><enum>(5)</enum><text>sources from small and medium sized growers and local and regional produce as geographically and seasonally feasible; and</text></paragraph><paragraph id="H3D3C406737E94056B8A96448B9B392FD"><enum>(6)</enum><text>offers the government a price determined to be the overall best value without limiting evaluation factors to lowest price or highest technical rating.</text></paragraph></subsection><subsection id="H124BEF6279904CA292F3A833309ED04C"><enum>(c)</enum><header>Priority</header><text>In entering into contracts under the Program, the Secretary shall give priority to the following:</text><paragraph id="HC8A8BE5256614F81BCF28CF9FA15577A"><enum>(1)</enum><text>Socially disadvantaged eligible entities, including women-owned and veteran-owned.</text></paragraph><paragraph id="H672381E1C15342B199612A6DABF87702"><enum>(2)</enum><text>Eligible entities that are, or source from, beginning farmers, or small or mid-sized farms that are structured as family farms, as defined in subsection (g).</text></paragraph><paragraph id="HA33668B1B5204135ADD667EA70EA08FC"><enum>(3)</enum><text>Eligible entities that can deliver to areas in most need of fresh produce, as determined by the Secretary.</text></paragraph><paragraph id="HA4A22611BE8F4AF8B388F111C4D47F8B"><enum>(4)</enum><text>Eligible entities that can demonstrate a commitment to serving local communities through strong relationships with qualifying nonprofits, public agencies, and Tribal governments, as determined by the Secretary.</text></paragraph></subsection><subsection id="HC57ACE17A8754C03BC00542101FE49B8"><enum>(d)</enum><header>Contract terms and produce makeup</header><text>The Secretary shall ensure the following when administering contracts:</text><paragraph id="H2899B9D7AD8345E7AF904784A9B16A6B"><enum>(1)</enum><text>The period of performance under the contract shall be—</text><subparagraph id="HB1EA5F239ED94F02AE60DEE179E406EE"><enum>(A)</enum><text display-inline="yes-display-inline">at least 90 days; and</text></subparagraph><subparagraph id="H521FC09DAD5C4D22B4A105B9EE286C6A"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 120 days.</text></subparagraph></paragraph><paragraph id="H348711CC201645A695BC163FCB93EBC5"><enum>(2)</enum><text>Eligible entity is located in the State or locality in which produce is provided, or has demonstrated experience distributing to the service area.</text></paragraph><paragraph id="H5A2EFE5FFCBA4E348DFCEAB7FC82EF56"><enum>(3)</enum><text>Award multiple contracts within each of the United States Department of Agriculture’s Food and Nutrition Services regions to provide opportunities for a broad range of producers and entities.</text></paragraph><paragraph id="H6A36F60847BD44FCAFC7CD5B53E48BE0"><enum>(4)</enum><text>The makeup of the produce includes:</text><subparagraph id="H0A072926D7654B9BAB7C90C62FB4C33D"><enum>(A)</enum><text>Only fresh fruits and vegetables grown in the United States.</text></subparagraph><subparagraph id="HE8BC6189B9B64369BE22C4679FAC8093"><enum>(B)</enum><text>Locally grown fruits and vegetables where geographically and seasonally possible, as determined by the Secretary.</text></subparagraph><subparagraph id="HE090E46110944360BE2ACEAA3A078D20"><enum>(C)</enum><text>No fewer than seven varieties of fresh fruits and vegetables.</text></subparagraph><subparagraph id="HF9F4A8586F4C45048CFD9E02BCD4FDD4"><enum>(D)</enum><text>Offer a variety of both fruits and vegetables consistent with the most recent Dietary Guidelines for Americans published under section 301 of the National Nutrition Monitoring and Related Research Act of 1990.</text></subparagraph><subparagraph id="H7BA530C78CD147B58B0443B8598507B1"><enum>(E)</enum><text>Include culturally competent commodities, as determined by the Secretary in consultation with the distributing agency.</text></subparagraph></paragraph><paragraph id="H32CC008615804F5DB643B75677D8755D"><enum>(5)</enum><text>Price paid by the government is inclusive of all transportation and distribution costs associated with delivering to the final destination of eligible nonprofit distributing partner.</text></paragraph></subsection><subsection id="HFE07F0211DD148FFB45760FE15F1CB94"><enum>(e)</enum><header>Program administration</header><paragraph id="HF7AE0348B63F4D1D8BCDCDD504A112F1"><enum>(1)</enum><header>Qualifying nonprofits</header><text>The Secretary shall establish a process for which to identify qualifying nonprofit entities that may participate in the Program and conduct outreach to ensure that eligible nonprofits are made aware of the Program.</text></paragraph><paragraph id="H7088C2E8BEE34B5087CCC731E5473D3E"><enum>(2)</enum><header>Equity and geographic reach</header><text>In carrying out the Program each fiscal year, the Secretary shall enter into contracts with eligible entities in a manner that ensures the total value of contracts entered into in each State, territory, or Tribal entity, is proportionate to the number of households and individuals living in poverty within the State, territory, or Tribal entity, as determined by the Secretary.</text><subparagraph id="H6DF1C46A4C5E4273B32CA906E682559D"><enum>(A)</enum><header>Vulnerable areas</header><text>The Secretary shall establish a process—</text><clause id="HC58605D5FC39445E940CC9D6241CC622"><enum>(i)</enum><text>to determine the areas most in need of produce provision under the Program, including rural areas, the territories and possessions of the United States, and areas under the jurisdiction of a Tribal government; and</text></clause><clause id="H8075B99B221448D8A246022C1C254B57"><enum>(ii)</enum><text>to ensure such areas are served by the Program.</text></clause></subparagraph><subparagraph id="H3F5994E4ACA44593ABD390B5502D06F1"><enum>(B)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to eligible entities participating in the Program with respect to—</text><clause id="HF21C056E78F547AB8EF0DEA1AB174F16"><enum>(i)</enum><text>the contact terms and expectations applicable to covered entities under the Program;</text></clause><clause id="HAF2B293F905C42FBA441DB1F36A05104"><enum>(ii)</enum><text>best practices for the distribution of the produce and expectations of distribution; and</text></clause><clause id="HD93E319915E84595A8AAE3804083394A"><enum>(iii)</enum><text>food safety certification.</text></clause></subparagraph><subparagraph id="H947578CD41BE40BD9E49F1D201FCB181"><enum>(C)</enum><header>Financial assistance</header><text>the Secretary shall provide information to assist small, beginning, veteran, and socially disadvantaged farmers in obtaining food safety certifications and covering the associated costs of necessary changes and upgrades to practices and equipment to improve food safety.</text></subparagraph></paragraph></subsection><subsection id="HED9151886EEE4018BE72F630F600DCAD"><enum>(f)</enum><header>Reporting</header><paragraph id="HFB98F768D10F4278AF00E708A7F58618"><enum>(1)</enum><text>Not later than one year after the date of enactment of this Act, the Secretary shall provide to Congress a report on activities carried out under the Program, including counties and percentage of counties served, number of produce packages provided, quantity and variety of fresh produce distributed, number of farms sourced from, including size of farms, and percentage of produce procured locally and regionally and other data as determined by the Secretary.</text></paragraph><paragraph id="H428AA53AA6A0499CAB2DF3755C94761C"><enum>(2)</enum><text>Not later than 1 year after the enactment of this Act, the Comptroller General of the United States shall submit to the Committee of Agriculture of the House of Representatives a report that evaluates the Program’s effectiveness at meeting the goals as stated in subsection (a).</text></paragraph></subsection><subsection id="HB7B0CBBE5B554378BB5EC2D2F54C0578"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4A62F95EAE5F45288B24EBD27AEFD8B4"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means any of the following small businesses, as defined by the Small Business Administration:</text><subparagraph id="H8272CDC40545421E9162783323475C75"><enum>(A)</enum><text>Grower, packer, distributor, or food-hub.</text></subparagraph><subparagraph id="H21285162F84D4C57A1DF3A43C4194816"><enum>(B)</enum><text>A nonprofit organization.</text></subparagraph><subparagraph id="H8B7D8411262648789C3423A569B1B2C5"><enum>(C)</enum><text>A cooperative.</text></subparagraph></paragraph><paragraph id="H2EA1197317FF4A45BAA74B1A0BABA44B"><enum>(2)</enum><header>Qualifying nonprofit</header><text>The term <term>qualifying nonprofit</term> means all of the following:</text><subparagraph id="H7C9DFBC632544084A0CB1F22E6D1CCFF"><enum>(A)</enum><text>A nonprofit food bank, soup kitchen, school, child or senior care center, youth serving community based organization, Tribal organization, or public agency participating in an existing United States Department of Agriculture nutrition program including, but not limited to, National School Lunch Program, Summer Food Service Program, Child and Adult Care Food Program, Food Distribution Program on Indian Reservations, Commodity Supplemental Food Program, or Emergency Food Assistance Program.</text></subparagraph><subparagraph id="H18798586A33F47019E4713F20248B189"><enum>(B)</enum><text>A food bank or other nonprofit that does not meet criteria under subsection (a) but has demonstrated experience in serving needs of vulnerable populations facing food and nutrition insecurity and can demonstrate necessary food safety understanding and other requirements as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H9534C8DD5339464E8E852C7F6174389A"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture acting through the Administrator of the Agricultural Marketing Service of the Department of Agriculture.</text></paragraph><paragraph id="HA4065AF2F8D34D41A72BDC4869F14AB8"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means all States within the United States of America, the District of Columbia, territories and possessions, and Tribal governments.</text></paragraph><paragraph id="H8884D064CFBA4034854B5BA048857741"><enum>(5)</enum><header>Beginning farmer</header><text>The term <term>beginning farmer</term> has the meaning given the term in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>).</text></paragraph><paragraph id="H2289D7CEA6094D94A413B5937BA03738"><enum>(6)</enum><header>Socially disadvantaged applicant or farmer</header><text>The term <term>socially disadvantaged applicant or farmer</term> has the meaning given the term in section 761.2 of title 7, Code of Federal Regulations.</text></paragraph><paragraph id="H7F43889EA8F74B82AF33D35D1CD9D378"><enum>(7)</enum><header>Veteran farmer</header><text>The term <term>veteran farmer</term> has the meaning given the term in section 2501(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(e)</external-xref>).</text></paragraph><paragraph id="HBCB9CF8300414EA2BF5FEE104C8C9CB0"><enum>(8)</enum><header>Family farm</header><text>The term <term>family farm</term> has the meaning given the term in section 231(a) of the Agricultural Risk Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/1632">7 U.S.C. 1632(a)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
