following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to maintain demographic information regarding veterans and publish such information on a website of the Department of Veterans Affairs.</official-title></form><legis-body id="H02B38C929D3749B7A8ED7F07E4952AB1" style="OLC"><section section-type="section-one" id="H551A64F0F273441DA00B22745A5D5BBD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Every Veteran Counts Act of 2021</short-title></quote>.</text></section><section id="HFBD29897AEBE46D584E63D1F6C5650C0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H0D0C344E12CE442E8473D0DC877259D4"><enum>(1)</enum><text>The Department of Veterans Affairs is responsible for providing a variety of benefits and services to more than 19,000,000 living veterans.</text></paragraph><paragraph id="HB5CEF91320334A84ACAB70F7A3774DCC"><enum>(2)</enum><text>Pursuant to section 527 of title 38, United States Code, the Secretary of Veterans Affairs has conducted the National Survey of Veterans to assess the needs and sentiments of a statistically valid sample of all veterans.</text></paragraph><paragraph id="H62E03A9ACCF74073A4B22E31FE3D7215"><enum>(3)</enum><text>The Secretary has conducted this National Survey of Veterans in the late 1970s, 1987, 1993, 2001, and 2010.</text></paragraph><paragraph id="H264AFB0F36F64D3D8FE91AA5D6A91595"><enum>(4)</enum><text>The last survey conducted in 2010 included veterans and other beneficiary groups, such as members of the Armed Forces serving on active duty, members of the reserve components of the Armed Forces, military spouses, and surviving spouses of such veterans and members.</text></paragraph><paragraph id="HF0902F0979484272B61923928DE32341"><enum>(5)</enum><text>The 2010 survey included information on demographics, awareness and utilization of benefits, health status, military service, and employment.</text></paragraph><paragraph id="HCB49039E55FF45AF8A09F3748C294196"><enum>(6)</enum><text>These surveys provide valuable information on the veteran population to the Secretary, Congress, Federal, State, and local governments, academic institutions, and various non-governmental organizations that serve veterans.</text></paragraph><paragraph id="H9C61FB58676543E793566428D4080DCE"><enum>(7)</enum><text>This information is used to inform policymaking efforts and to ensure the needs of the ever-changing veteran population are met.</text></paragraph><paragraph id="HFB30B19BAB4040A4B18FC6E27D8729B6"><enum>(8)</enum><text>However, since 2010, the statutory framework for data collection has substantially evolved, notably with the Foundations for Evidence-Based Policymaking Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/435">Public Law 115–435</external-xref>), the Data Act (<external-xref legal-doc="public-law" parsable-cite="pl/113/139">Public Law 113–139</external-xref>), and the Geospatial Data Act (subtitle F of title VII of <external-xref legal-doc="public-law" parsable-cite="pl/115/254">Public Law 115–254</external-xref>), known collectively as the <quote>Evidence Act</quote>, building on previously enacted laws.</text></paragraph><paragraph id="H7E438BC4D0A049A3BA26095455BD1F98"><enum>(9)</enum><text>Further, the Department, through the National Center for Veterans Analysis and Statistics, has leveraged the vast amount of data generated within the Department and collected by other Federal partners to improve population-based descriptive, statistical, and predictive analytic products to support the Secretary and in evidence-based policymaking, facilitate innovative and collaborative research, and empower modern business intelligence applications.</text></paragraph><paragraph id="HA8008435C7E4451F9450BFECB304398B"><enum>(10)</enum><text>The Department has been a consistent leader in the Federal Open Data program and offers a platform for scaling access to useful data and insight to external stakeholders.</text></paragraph><paragraph id="HB6458020015A4F408521588850CD7FF6"><enum>(11)</enum><text>Notwithstanding these recent advances, opportunities exist to strengthen the capability of the Department to develop and disseminate actionable insights into the veteran population through—</text><subparagraph id="H5BBCBF73A55645CBA4F6BE6B6B88E49A"><enum>(A)</enum><text display-inline="yes-display-inline">developing enterprise-focused management and improvements in the quality of administrative data collected by the Department through its delivery of benefits and services;</text></subparagraph><subparagraph id="H41C17347BD774F139CD8F02A9F1EF162"><enum>(B)</enum><text>increased access to data collected by other Federal entities through more flexible and efficient information sharing policies;</text></subparagraph><subparagraph id="H75C447ACAACD4FADB5BD7D5CB5A57BB1"><enum>(C)</enum><text>increased use of publicly available and commercially generated data; and</text></subparagraph><subparagraph id="H6653EB7E8B354A3189591C30E893DCFB"><enum>(D)</enum><text display-inline="yes-display-inline">maturing data management of the Department.</text></subparagraph></paragraph><paragraph id="H34D2188E0B77492B9F5E8B710B548052"><enum>(12)</enum><text>In line with the Evidence Act, it is incumbent upon the Secretary to regularly engage with key stakeholders, including Congress, veterans service organizations, advocacy groups, and open government groups to—</text><subparagraph id="H439E360D073A47F4BB0735216DA718F4"><enum>(A)</enum><text>enhance the open data program of the Department; and</text></subparagraph><subparagraph id="HE185B81BF25941B6857FE8AD9FD50871"><enum>(B)</enum><text>improve development and dissemination of relevant data assets and analytic products to provide more current, accurate, and useful insights on veterans and their families.</text></subparagraph></paragraph><paragraph id="HEA2DFE3F0A7C492DAC04EA9D4A2B0052"><enum>(13)</enum><text>It is necessary for the Department to collect, collate, and analyze all available data on veteran demographics, and to share this data with Congress and other stakeholders on an ongoing basis, in an easily digestible format, to direct outreach and align policy with the needs of the changing veteran population.</text></paragraph></section><section id="HDACBAAD4558B4AD8924CE936B4569F9A"><enum>3.</enum><header>Demographic data of veterans: collection; retention; publication</header><subsection id="H057CC5AD341A4B618C2CE5C940B33ABC"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/5">chapter 5</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/527">section 527,</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="HB566C76BA311426DA8269CBE91953E74"><section id="HF0E32AFA6F604166B4CBE346CDCC6A7D"><enum>528.</enum><header>Demographic data of veterans: collection; retention; publication.</header><subsection id="H3BB7B9C2E86F4CA5A6852B642D6F7976"><enum>(a)</enum><header>Database</header><paragraph commented="no" display-inline="yes-display-inline" id="H009F46689F4647F5971CF6359BEF5B84"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall collect demographic data of veterans (from any source of such data available to the Secretary, including the National Center for Veterans Analysis and Statistics of the Department, the Bureau of the Census, and the Social Security Administration) and maintain a database of such data.</text></paragraph><paragraph id="H8C77406089BF480A9575C43557C047F2" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Data collected and maintained under paragraph (1) shall include the following:</text><subparagraph id="HD085A223D0F34BA6B4D2715EDB235341"><enum>(A)</enum><text>Sex.</text></subparagraph><subparagraph id="H3C5740E6AC274DFF9C396A46444FA219"><enum>(B)</enum><text>Gender identity, disaggregated by—</text><clause id="H505D3C928DE5470A8DB3C506B1A3728B"><enum>(i)</enum><text>male;</text></clause><clause id="H1EA52135E71144BEAAC233574160D71F"><enum>(ii)</enum><text>female;</text></clause><clause id="H960EFC4D19DD43ECBCEEBD03F8A56BEB"><enum>(iii)</enum><text display-inline="yes-display-inline">cisgender;</text></clause><clause id="HDC78A0E0E81C414BA8DEA2175A2D7716"><enum>(iv)</enum><text>transgender;</text></clause><clause id="HE9B61AEF41BF4E26864C80F60393FC7D"><enum>(v)</enum><text>gender diverse;</text></clause><clause id="H33A4A076BFB348B1A0691D50DBF7533D"><enum>(vi)</enum><text>nonbinary; and</text></clause><clause id="H23A40539637141E2B74747B5EDA89487"><enum>(vii)</enum><text>combinations of clauses (i) through (vi).</text></clause></subparagraph><subparagraph id="HA14AE9FFB05645BFB4F2BF578BB9D12C"><enum>(C)</enum><text>Age.</text></subparagraph><subparagraph id="HD03AC32360684454BA45847251B8EF2A"><enum>(D)</enum><text>Educational level.</text></subparagraph><subparagraph id="HDC053C323BAD4F8F911A3DB9674099A7"><enum>(E)</enum><text display-inline="yes-display-inline">Race and ethnicity, disaggregated by—</text><clause id="H353259ED1F5249B2A95B0F706A1A0301"><enum>(i)</enum><text>membership in an Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></clause><clause id="HCFF6EC08A55844F3923AE8946C962A4A"><enum>(ii)</enum><text>the same major race groups as the decennial censuses.</text></clause></subparagraph><subparagraph id="H73B75E301F3C430F97B410BEDDE7BB32"><enum>(F)</enum><text display-inline="yes-display-inline">Sexual orientation, disaggregated by—</text><clause id="H776A08DD77CA48B79A9FB2A83A631F11"><enum>(i)</enum><text>heterosexual;</text></clause><clause id="H66774D867F5342018DA15E7C8032BB67"><enum>(ii)</enum><text>lesbian;</text></clause><clause id="HA0646CD019224B62BAFDCD3B0B3A7798"><enum>(iii)</enum><text>gay;</text></clause><clause id="H467156C6662D4109989C3F9B6720A809"><enum>(iv)</enum><text>bisexual; and</text></clause><clause id="HF5FC52F72F5245D592D2624062DFE4B2"><enum>(v)</enum><text>queer.</text></clause></subparagraph><subparagraph id="HE1670DDB5531405680ABA3B2AF325708"><enum>(G)</enum><text>Household makeup, including marital status and number of dependents.</text></subparagraph><subparagraph id="H277EA2BF420D4A5FA2D1E3902E2E9524"><enum>(H)</enum><text>Gross income and sources of income.</text></subparagraph><subparagraph id="H48CC0A7661554C09AA23FCDC03D0F921"><enum>(I)</enum><text display-inline="yes-display-inline">Housing status, disaggregated by—</text><clause id="HA585849A485441D5A18C0C22A9B4E689"><enum>(i)</enum><text>renter;</text></clause><clause id="H472F5EE501A94D27806CC644CEA57EDD"><enum>(ii)</enum><text>homeowner; or</text></clause><clause commented="no" id="H1F1F2D352DDB4B3EAAB1D0CEF5F5093B"><enum>(iii)</enum><text>residing in a home owned or rented by another person.</text></clause></subparagraph><subparagraph id="HB330611AE5B24A92B2289A81E34B817F"><enum>(J)</enum><text display-inline="yes-display-inline">Employment status, disaggregated by—</text><clause id="H29227BC9EAB64ED69C0892E702A808C8"><enum>(i)</enum><text>employed;</text></clause><clause id="HA2E979041DEB41CA8421B4DDF2739AF7"><enum>(ii)</enum><text>seeking employment; and</text></clause><clause id="H2C83DC717220471DAD96FC93DCA98EF0"><enum>(iii)</enum><text>self-employed.</text></clause></subparagraph><subparagraph id="HD3883089B5E941E1BA9303BC39978A43"><enum>(K)</enum><text display-inline="yes-display-inline">History of service in the Armed Forces, disaggregated by—</text><clause id="HE989DD1444E44803B03B0C2975DE1100"><enum>(i)</enum><text>Armed Force;</text></clause><clause id="H35821465DB0E4461ABD047A71777D360"><enum>(ii)</enum><text>regular or reserve component;</text></clause><clause id="H5E52461F0A384219BC23DEDB9F7206E0"><enum>(iii)</enum><text>service in a combat theater of operations or war zone;</text></clause><clause id="HC85A019F065C4985AABE3F8A113820E0"><enum>(iv)</enum><text>service during a period of war;</text></clause><clause id="HF90F6E4D337446088FE1FB84ACE3BC00"><enum>(v)</enum><text>whether a veteran is a former prisoner of war;</text></clause><clause id="HEF049F23A82F47E8A3B3539763E4CDC2"><enum>(vi)</enum><text display-inline="yes-display-inline">whether the veteran was exposed to dead, dying, or wounded people during active military, naval, air, or space service;</text></clause><clause id="H9C1D88BB1E2149BBAE1FDF3017B81D2B"><enum>(vii)</enum><text display-inline="yes-display-inline">whether the veteran was exposed to environmental hazards during active military, naval, air, or space service; and</text></clause><clause id="H7B5401C6BE5D4278989EB91576BFCF81"><enum>(viii)</enum><text>whether the veteran experienced military sexual trauma (as that term is defined in section 1166 of this title).</text></clause></subparagraph><subparagraph id="H34FADDE95F9C4850BCA12C239B84221B"><enum>(L)</enum><text>Whether the veteran is enrolled in the patient enrollment system under section 1705 of this title.</text></subparagraph><subparagraph id="HE149347188D347C696D3C2A5DBC8DD63"><enum>(M)</enum><text display-inline="yes-display-inline">Whether the veteran has received a disability rating from under section 1155 of this title.</text></subparagraph><subparagraph id="H069E514E15FC4F658E81DB4FF9293154"><enum>(N)</enum><text>Location of the veteran’s residence, disaggregated by—</text><clause id="HC80EFFCFA8804C47BF4163AABC7F17C9"><enum>(i)</enum><text>rural or urban setting;</text></clause><clause id="HAAF6D61085334E0B8CFF8E5A3D3E164B"><enum>(ii)</enum><text>distance to a facility of the Department; and</text></clause><clause id="H2E8879E948384421ACB3E244029CE957"><enum>(iii)</enum><text>whether the veteran has access to broadband service.</text></clause></subparagraph><subparagraph id="H762962DBEF8241C8BC40ACDB1AD92D0E"><enum>(O)</enum><text>Any other information the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="HDE10B5BF64A54406805633490E87565A"><enum>(b)</enum><header>Data retention standards</header><text>Demographic data in the database under subsection (a) shall be—</text><paragraph id="H8A937B381EB642A3A2AFC4126F1210A9"><enum>(1)</enum><text>anonymized to prevent the release of sensitive personal information (as that term is defined in section 5727 of this title); and</text></paragraph><paragraph id="HF4AC49EB8F3644C5899BC31443E896A7"><enum>(2)</enum><text>machine readable.</text></paragraph></subsection><subsection id="H2665220FD91A4D9D9AEC97C412223D43"><enum>(c)</enum><header>Website</header><text display-inline="yes-display-inline">The Secretary shall maintain a publicly accessible website of the Department that provides access to the database under subsection (a). The Secretary shall update such website not less frequently than once each year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H60FCABD2E2564B9E84F8AE75F0189F0F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting, after the item relating to section 527, the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="H65803C31EF794485B6FA225EF8B5E9A0"><toc regeneration="no-regeneration"><toc-entry level="section">528. Demographic data of veterans: collection; retention; publication.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8B87D42688D543B18E48F828228F5C96"><enum>(c)</enum><header>Implementation date</header><text>The Secretary of Veterans Affairs shall carry out section 528 of such title, as added by this section, not later than 180 days after the date of the enactment of this Act.</text></subsection></section><section id="HC3533193700E40DDADEC45A200DF1F65"><enum>4.</enum><header>Report on data strategy of the Department of Veterans Affairs</header><subsection id="H6413A06C2ABA4108907E8D0F6101978D"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report describing the progress, challenges, performance, and opportunities of implementing the data strategy of the Department of Veterans Affairs.</text></subsection><subsection id="H8EB1E5AA25B548C5B9573688089A21F2"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report under this section shall include the following:</text><paragraph display-inline="no-display-inline" id="H6116709F01074925AD8BB802B4406B5D"><enum>(1)</enum><text>Qualitative and quantitative progress towards strengthening data management of the Department, including business and mission impact enabled by management of data as a strategic asset.</text></paragraph><paragraph id="H91927E9AEB5E4C56BEAF54D9DB45FCC7"><enum>(2)</enum><text display-inline="yes-display-inline">Recommendations of the Secretary regarding legislation that may accelerate data management maturity of the Department.</text></paragraph><paragraph id="H26F63D086C124585B6AA8393A084B690"><enum>(3)</enum><text>Progress and results in cataloging and inventorying data assets of the Department and using such assets to support—</text><subparagraph id="HDE6157417B1F40818B644DC6415A08C4"><enum>(A)</enum><text>internal evidence-based policymaking; and</text></subparagraph><subparagraph id="H33B1D007961448D685CDE18884FEB131"><enum>(B)</enum><text>ethical and appropriate dissemination of statistical aggregates, data-driven analysis, and open data.</text></subparagraph></paragraph><paragraph id="HCCF17305490F42388AAD633CB260C71B"><enum>(4)</enum><text>Progress in implementing requirements under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), and related data quality efforts to support strategic management of data collected by the Department.</text></paragraph><paragraph id="H6D636A82E00244BE9ED5293819158F03"><enum>(5)</enum><text>Efforts to move towards a rules-based, transparent, Department-wide approach to management, integration, and sharing of, and access to, data.</text></paragraph><paragraph id="HEB1FEC21840949D4B87928D615DA0FE3"><enum>(6)</enum><text display-inline="yes-display-inline">Recommendations of the Secretary regarding adjustments to data requirements of the Department.</text></paragraph><paragraph id="H6DA649BFB3B641F7B9254474078E6D17"><enum>(7)</enum><text>Information sharing agreements and outstanding requirements with other Federal entities, including gaps best addressed by the addition of survey questions to an existing Federal survey instrument.</text></paragraph><paragraph id="H53BDB8DDB81643B0A479335306102B3F"><enum>(8)</enum><text>Progress on recently enacted public laws, Executive orders, Presidential memoranda, and outstanding recommendations of the Comptroller General of the United States or an inspector general as it pertains to veteran population-based data collection, quality, integration, sharing, interoperability, and analytics within the scope of improving and ensuring equity in services to veterans, their families, and other beneficiaries.</text></paragraph><paragraph id="H5B8D4A5771A74AE7BD0CAEECCDE7509C"><enum>(9)</enum><text>A discussion of current risk assessments regarding data breaches and information security (as those terms are defined in section 5727 of title 38, United States Code) of the Department.</text></paragraph><paragraph id="HE37751DE049B4153983374AAC810D5A1"><enum>(10)</enum><text>Priority data requirements of the Department, identified through consultation with the following entities:</text><subparagraph commented="no" id="HAE725CE4CAF14DCBBFF6044EF3CA476E"><enum>(A)</enum><text>The Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives. </text></subparagraph><subparagraph id="HE1FEFEF3C58C4F3DAD514ED35846EE0C"><enum>(B)</enum><text>The Congressional Budget Office.</text></subparagraph><subparagraph id="HFD167E439FD14E3DB5D88EAC9DA6B2E5"><enum>(C)</enum><text>Veterans service organizations.</text></subparagraph><subparagraph id="H702044BE4A1A40FAB0D2DA152526F661"><enum>(D)</enum><text>The Advisory Committee on Minority Veterans of the Department.</text></subparagraph><subparagraph id="HBFB1B6F65368423F9D8FFB0D8186A22F"><enum>(E)</enum><text display-inline="yes-display-inline">The Advisory Committee on Women Veterans of the Department.</text></subparagraph><subparagraph id="HD568CB83362342539833A1693C90CCC2"><enum>(F)</enum><text display-inline="yes-display-inline">The Advisory Committee on Homeless Veterans of the Department.</text></subparagraph></paragraph></subsection><subsection id="H569D8029475B45318FB5B277D19CFB6C"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 30 days after submitting the report under this section, the Secretary shall publish such report on the open data website of the Department, with all metrics and data included in a machine readable format.</text></subsection></section></legis-body></bill>
