Budget</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the CARES Act to extend certain unemployment compensation provisions, and for other purposes.</official-title></form><legis-body id="H3722BAEEB87444D2AB5A2D3ECC48FA5C" style="OLC"><section id="HC6C0709A0C38417088B42D50394B2761" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Extend Unemployment Assistance Act of 2021</short-title></quote>. </text></section><section id="H4950825ABCCD4837A4C4FD8FAC4F0E72"><enum>2.</enum><header>Extension of Pandemic Unemployment Assistance</header><subsection id="H25C78D6274EE4562B41685548E30C302"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2102(c) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(c)</external-xref>) is amended—</text><paragraph id="H1A791DC996234425B2BA1D16AC8AB851"><enum>(1)</enum><text>in paragraph (1)(A)(ii), by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>; and</text></paragraph><paragraph id="H206358448D4B4067A62319AECE5EE165"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5) and (6) as paragraphs (4) and (5), respectively.</text></paragraph></subsection><subsection id="H6976CDAF819F43759D317445ACD9DF9E"><enum>(b)</enum><header>Increase in number of weeks</header><text display-inline="yes-display-inline">Section 2102(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(c)(2)</external-xref>) is amended—</text><paragraph id="H6433BC0018564675B7F8FFB0841A3CA1"><enum>(1)</enum><text>by striking <quote>79 weeks</quote> and inserting <quote>100 weeks</quote>; and</text></paragraph><paragraph id="HD65FB2BCF5614EF6BCD9C8B1E1BE16F8"><enum>(2)</enum><text>by striking <quote>79-week period</quote> and inserting <quote>100-week period</quote>.</text></paragraph></subsection><subsection id="HB7A7079452C9442B89A2616C39028E7D" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Hold harmless for proper administration</header><text display-inline="yes-display-inline">In the case of an individual who is eligible to receive pandemic unemployment assistance under section 2102 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021</external-xref>) as of the most recent week ending on or before September 6 and on the date of enactment of this Act becomes eligible for pandemic emergency unemployment compensation under section 2107 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025</external-xref>) by reason of the amendments made by this Act, any payment of pandemic unemployment assistance under such section 2102 made after the date of enactment of this Act to such individual during an appropriate period of time, as determined by the Secretary of Labor, that should have been made under such section 2107 shall not be considered to be an overpayment of assistance under such section 2102, except that an individual may not receive payment for assistance under section 2102 and a payment for assistance under section 2107 for the same week of unemployment. </text></subsection></section><section id="HE6AA834FAF1B4D19AAA5A8F948F27D7F"><enum>3.</enum><header>Extension of emergency unemployment relief for governmental entities and nonprofit organizations</header><subsection id="H118536FB6132457ABCFEE0486D263274"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 903(i)(1)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1103">42 U.S.C. 1103(i)(1)(D)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection><subsection id="HE7EE82FFC5FD48449F26E3A8334A0ACA"><enum>(b)</enum><header>Increase in reimbursement rate</header><text display-inline="yes-display-inline">Section 903(i)(1)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1103">42 U.S.C. 1103(i)(1)(B)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection></section><section id="H1465C0AA79D34A94917FC67DF7FA9E9F"><enum>4.</enum><header>Extension of Federal Pandemic Unemployment Compensation</header><subsection id="H69EBE6E412B1402AA988D6354264D8D2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2104(e)(2) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(e)(2)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection><subsection id="HA5AC48FE73A54B088BBB73F81625BA54" commented="no"><enum>(b)</enum><header>Amount</header><text display-inline="yes-display-inline">Section 2104(b)(3)(A)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(b)(3)(A)(ii)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection></section><section id="HD5FE5C673A9841FABD0DF01BD9228002" display-inline="no-display-inline"><enum>5.</enum><header>Extension of full Federal funding of the first week of compensable regular unemployment for States with no waiting week</header><text display-inline="no-display-inline">Section 2105(e)(2) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9024">15 U.S.C. 9024(e)(2)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></section><section display-inline="no-display-inline" id="H42EAD3C6000D48CD90A89E3FB9B70AA6"><enum>6.</enum><header>Extension of emergency State staffing flexibility</header><text display-inline="no-display-inline">Section 9015 of the American Rescue Plan Act of 2021 is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></section><section id="H19A4FC31B43C4876BE58667BAD7E7C30" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header>Extension of pandemic emergency unemployment compensation</header><subsection id="H49C1B307EC544CCDAA6F684FAB16BF88" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2107(g)(2) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(g)(2)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection><subsection display-inline="no-display-inline" id="HE9A8B7C5468A4518B7C1E0F8A126BDD4"><enum>(b)</enum><header>Increase in number of weeks</header><text display-inline="yes-display-inline">Section 2107(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(b)(2)</external-xref>) is amended by striking <quote>53</quote> and inserting <quote>74</quote>.</text></subsection><subsection id="HD7A2C57521F647ED9DF3C917546DB1B4"><enum>(c)</enum><header>Coordination of Pandemic Emergency Unemployment Compensation with Extended Compensation</header><text display-inline="yes-display-inline">Section 2107(a)(5)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(a)(5)(B)</external-xref>) is amended by inserting <quote>or for the week that includes the date of enactment of the <short-title>Extend Unemployment Assistance Act of 2021</short-title> (without regard to the amendments made by subsections (a) and (b) of section 7 of such Act)</quote> after <quote>such Act)</quote>. </text></subsection><subsection id="H2E45A7560FA2495585DD453A67B3DA4E"><enum>(d)</enum><header>Special rule for extended compensation</header><text display-inline="yes-display-inline">Section 2107(a)(8) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(a)(8)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>. </text></subsection></section><section id="HC0C3EF4F04FE408E98F880FBD7D7E467" display-inline="no-display-inline"><enum>8.</enum><header>Extension of temporary financing of short-time compensation payments in States with programs in law</header><text display-inline="no-display-inline">Section 2108(b)(2) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9026">15 U.S.C. 9026(b)(2)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></section><section id="HA6BC3EE98FE04BA4B2C46FD593B9E19F"><enum>9.</enum><header>Extension of temporary financing of short-time compensation agreements for States without programs in law</header><text display-inline="no-display-inline">Section 2109(d)(2) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9027">15 U.S.C. 9027(d)(2)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></section><section id="H28053137DC8B4BD3966E9B91A3D06363" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Extension of temporary assistance for States with advances</header><text display-inline="no-display-inline">Section 1202(b)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1322">42 U.S.C. 1322(b)(10)(A)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>. </text></section><section id="H77305E8D94114A849A5F1405C5659B0B" commented="no"><enum>11.</enum><header>Extension of full Federal funding of extended unemployment compensation</header><subsection commented="no" id="H2952D27D6D904017B41FB8D2FC0A32DC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4105 of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></subsection><subsection commented="no" id="H0AA03A8C384B4D0A93D9896B6B059A26"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply as if included in the enactment of the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>). </text></subsection></section><section id="H30AA003FF4FD4302B34739397841F013" section-type="subsequent-section" commented="no" display-inline="no-display-inline"><enum>12.</enum><header>Additional enhanced benefits under the Railroad Unemployment Insurance Act</header><subsection id="H15B98EE8ADF6479B8C50A964FF6A2D94" commented="no"><enum>(a)</enum><header>In general</header><text>Section 2(a)(5)(A) of the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/352">45 U.S.C. 352(a)(5)(A)</external-xref>) is amended—</text><paragraph commented="no" id="H569B0E9328B343D781A5BF8DD116C888"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>; and</text></paragraph><paragraph id="H8158DFD90F224298A952B22DD1004E26"><enum>(2)</enum><text display-inline="yes-display-inline">in the fourth sentence, by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></paragraph></subsection><subsection id="HD54BACE1911840C088CC27D2991F037F" commented="no"><enum>(b)</enum><header>Clarification on authority To use funds</header><text display-inline="yes-display-inline">Funds appropriated under subparagraph (B) of section 2(a)(5) of the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/352">45 U.S.C. 352(a)(5)</external-xref>) shall be available to cover the cost of recovery benefits provided under such section 2(a)(5) by reason of the amendments made by subsection (a) as well as to cover the cost of such benefits provided under such section 2(a)(5) as in effect on the day before the date of enactment of this Act. </text></subsection></section><section id="H9AE09C6C61E64A1886F31E6883F41878" display-inline="no-display-inline" section-type="subsequent-section"><enum>13.</enum><header>Extended unemployment benefits under the Railroad Unemployment Insurance Act</header><subsection id="HEA05FC8810F44C5A8FA470789AA22834"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2(c)(2)(D) of the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/352">45 U.S.C. 352(c)(2)(D)</external-xref>) is amended—</text><paragraph id="H0EFBCE8C41B04D8BADD13405D4653980"><enum>(1)</enum><text>in clause (i)—</text><subparagraph id="HCDCE54404369418E8954467A90469B08"><enum>(A)</enum><text>in subclause (I), by striking <quote>330 days</quote> and inserting <quote>435 days</quote>; and</text></subparagraph><subparagraph id="H9252DFFE709F428E986369187B07CCE2"><enum>(B)</enum><text>in subclause (II)—</text><clause id="H8BB94233716D4C7F8C47BF8989FFA682"><enum>(i)</enum><text>by striking <quote>33 consecutive 14-day periods</quote> and inserting <quote>44 consecutive 14-day periods</quote>; and</text></clause><clause id="HAD89CAEF054844789C4C13736F46F924"><enum>(ii)</enum><text>by striking <quote>20 consecutive 14-day periods</quote> and inserting <quote>31 consecutive 14-day periods</quote>;</text></clause></subparagraph></paragraph><paragraph id="HE21939413CFB49AAB1265AC763C3A305"><enum>(2)</enum><text>in clause (ii)—</text><subparagraph id="HF9B8222F25354B6EBE33DB8959E4BAF6"><enum>(A)</enum><text>by striking <quote>265 days of unemployment</quote> and inserting <quote>370 days of unemployment</quote>;</text></subparagraph><subparagraph id="HFADF2264CB3449EE852B84C200BD1C32"><enum>(B)</enum><text>by striking <quote>27 consecutive 14-day periods</quote> and inserting <quote>37 consecutive 14-day periods</quote>; and</text></subparagraph><subparagraph id="H5D434A0047384B7E8A8B49EC58E64E7D"><enum>(C)</enum><text>by striking <quote>20 consecutive 14-day periods</quote> and inserting <quote>31 consecutive 14-day periods</quote>; and</text></subparagraph></paragraph><paragraph id="H03071E79C46445CAB7C28591ACFC666E"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>.</text></paragraph></subsection><subsection id="H10B804215DEB48BCA7F4AC4300728757"><enum>(b)</enum><header>Clarification on authority To use funds</header><text>Funds appropriated under the first, second, or third sentence of clause (v) of section 2(c)(2)(D) of the Railroad Unemployment Insurance Act shall be available to cover the cost of additional extended unemployment benefits provided under such section 2(c)(2)(D) by reason of the amendments made by subsection (a) as well as to cover the cost of such benefits provided under such section 2(c)(2)(D) as in effect on the day before the date of enactment of this Act.</text></subsection></section><section id="HE48A3DBF9524417DAE5A0FE6EDD4BE41" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>14.</enum><header>Extension of waiver of the 7-day waiting period for benefits under the Railroad Unemployment Insurance Act</header><subsection id="H89FBA65948E74D439CFEC4E88DD25E1F" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2112(a) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9030">15 U.S.C. 9030(a)</external-xref>) is amended by striking <quote>September 6, 2021</quote> and inserting <quote>February 1, 2022</quote>. </text></subsection><subsection id="H081300225B6740E8AE34AFE205ECB9BE" commented="no"><enum>(b)</enum><header>Clarification on authority To use funds</header><text display-inline="yes-display-inline">Funds appropriated under section 2112(c) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9030">15 U.S.C. 9030(c)</external-xref>) shall be available to cover the cost of additional benefits payable due to section 2112(a) of such Act by reason of the amendments made by subsection (a) as well as to cover the cost of such benefits payable due to such section 2112(a) as in effect on the day before the date of enactment of this Act.</text></subsection></section><section id="HBCD561DB84C246B482AFE1D19D6B07AA"><enum>15.</enum><header>Railroad Retirement Board funding</header><text display-inline="no-display-inline">In addition to amounts otherwise made available, there are appropriated for fiscal year 2021, out of any money in the Treasury not otherwise appropriated, $2,000,000, to remain available until expended, for the Railroad Retirement Board, for additional hiring and overtime bonuses as needed to administer the Railroad Unemployment Insurance Act.</text></section><section id="H24D5DE06D71849068BB8A638E2D06236"><enum>16.</enum><header>Budgetary effects</header><text display-inline="no-display-inline">Each Federal payment made to a State as a result of the amendments made by this Act, and any additional benefits paid as a result of such amendments, shall be exempt from any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985.</text></section><section id="H22AA08402612419780EF6EC92A750552" commented="no" display-inline="no-display-inline"><enum>17.</enum><header>Effective date</header><text display-inline="no-display-inline">Except where otherwise provided, the amendments made by this Act shall apply as if included in the enactment of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>), except that no amount shall be payable by virtue of such amendments with respect to any week of unemployment ending on or before September 6, 2021.</text></section></legis-body></bill>
