R. 5284</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210917">September 17, 2021</action-date><action-desc><sponsor name-id="N000190">Mr. Norman</sponsor> (for himself, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="B001305">Mr. Budd</cosponsor>, <cosponsor name-id="B001297">Mr. Buck</cosponsor>, <cosponsor name-id="B001274">Mr. Brooks</cosponsor>, <cosponsor name-id="W000812">Mrs. Wagner</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, <cosponsor name-id="B001311">Mr. Bishop of North Carolina</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, <cosponsor name-id="W000806">Mr. Webster of Florida</cosponsor>, and <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to include home-schooling supplies in the educator expense deduction, and for other purposes.</official-title></form><legis-body id="HCDE4BC2EA8D24C1F92AA98C7EB134DC8" style="OLC"><section id="H86314201EC3045538FD28C83EBCC644E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Home Educators are Teachers Act of 2021</short-title></quote>. </text></section><section id="HCF0621BABFAC4999B89BF9CDB9D21BE3"><enum>2.</enum><header>Home-school educators and home-schooling expenses included as part of deduction for certain expenses of elementary and secondary school teachers</header><subsection id="HAC54FDDC0F0D44DBB6909FF4A7126116"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/62">Section 62</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H5EBA1555E2DE4F14A6E75F5878686CCF"><enum>(1)</enum><text>in subsection (a)(2)(D), by inserting <quote>or home</quote> after <quote>in the classroom</quote>; and </text></paragraph><paragraph id="HC2963D028A14487BBD03844BD1BBEBD3"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting <quote>or home</quote> after <quote>in a school</quote>.</text></paragraph></subsection><subsection id="H3975216E09854BD3A08E7DE419EC36F8"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to taxable years beginning after December 31, 2021. </text></subsection></section><section id="H7FA5DA717C5B43BEAEB9E5E8CD605B89"><enum>3.</enum><header>Inflation adjustment for deduction for certain expenses of elementary and secondary school teachers</header><subsection id="H65D48F76F7A84831841CB7AA5DC72310"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/62">Section 62(d)(3)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="HBF2F66533BD24483874700719AD8E4FD"><enum>(1)</enum><text>by striking <quote>2015</quote> and inserting <quote>2023</quote>; and</text></paragraph><paragraph id="H3E7D8286EF774CA5BB83AE8A410EA2E0"><enum>(2)</enum><text>by striking <quote>calendar year 2014</quote> and inserting <quote>calendar year 2022</quote>.</text></paragraph></subsection><subsection id="H169DB9C58A74476CB2CE03FF409C80FF"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to taxable years beginning after December 31, 2021.</text></subsection></section><section id="HBD12E8B4DD3F4D768FFC53F4EF9F3BDF"><enum>4.</enum><header>Regulations or guidance clarifying application of deduction for certain expenses of elementary and secondary school teachers</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury (or the Secretary’s delegate) shall by regulation or other guidance clarify that individuals who provide home-school education are eligible educators for purposes of the educator expense deduction described in <external-xref legal-doc="usc" parsable-cite="usc/26/62">section 62(a)(2)(D)</external-xref> of the Internal Revenue Code of 1986, and such individuals may deduct home-schooling expenses under such section. </text></section></legis-body></bill>
