which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Consumer Financial Protection Act of 2010 to update the purpose of the Bureau of Consumer Financial Protection, and for other purposes.</official-title></form><legis-body id="HC43CDDDE185548848948D115A024B42F" style="OLC"><section id="HC3D0542379E24E9C92FBAB1DD1251D97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CFPB Dual Mandate and Economic Analysis Act</short-title></quote>.</text></section><section id="H86C111C8426542FEB5E4A161A3DFC1CC" section-type="subsequent-section"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">Section 1021(a) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5511">12 U.S.C. 5511(a)</external-xref>) is amended—</text><paragraph id="H6739BCE031FA4708B898B4BF5920C628"><enum>(1)</enum><text>by striking <quote>fair, transparent, and competitive</quote> and inserting: <quote>fair and transparent</quote>; and</text></paragraph><paragraph id="H369BDF86371C46BABF05248C52B6BEA5"><enum>(2)</enum><text>by adding at the end the following: <quote>In addition, the Bureau shall seek to implement and, where applicable, enforce Federal consumer financial law consistently for the purpose of strengthening private sector participation in markets, without Government interference or subsidies, to increase competition and enhance consumer choice.</quote>.</text></paragraph></section><section id="HFC6570F0173E41159E28C749F60CA160"><enum>3.</enum><header>Office of Economic Analysis</header><subsection id="H82BE18E56E0E4F11AAB5AD6D37C9DBDE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1013 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5493">12 U.S.C. 5493</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE0910011F7044E02873B1026F621B349" style="OLC"><subsection id="H4CB42AF6DFD24CE299B510368A27B644"><enum>(i)</enum><header>Office of Economic Analysis</header><paragraph id="HFBAD31E2F1944969931CC4DB26A205E5"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director shall establish an Office of Economic Analysis.</text></paragraph><paragraph id="H4C9A842FAB0B435498FD7DD285EFC207"><enum>(2)</enum><header>Review and assessment of proposed guidance, orders, rules and regulations</header><text display-inline="yes-display-inline">The Office of Economic Analysis shall—</text><subparagraph id="H2E9796D49ACB4BA99F9988E2DA8DF47E"><enum>(A)</enum><text display-inline="yes-display-inline">review all proposed guidance, orders, rules and regulations of the Bureau;</text></subparagraph><subparagraph id="H38922765C3634C40B2DBC5B9B44BB3AE"><enum>(B)</enum><text display-inline="yes-display-inline">assess the impact of such guidance, orders, rules and regulations on consumer choice, price, and access to credit products; and</text></subparagraph><subparagraph id="H711E36F364324F96B99E30F770D1F7F7"><enum>(C)</enum><text display-inline="yes-display-inline">publish a report on such reviews and assessments in the Federal Register.</text></subparagraph></paragraph><paragraph id="HEEB820CF9E0E4583B50AF045419AA6B9"><enum>(3)</enum><header>Measuring existing rules, regulations, guidance, and orders</header><text display-inline="yes-display-inline">The Office of Economic Analysis shall—</text><subparagraph id="H8316899F0359438A93B41A221499D09D"><enum>(A)</enum><text>review each rule, regulation, guidance, and order issued by the Bureau after 1, 2, 5, and 10 years;</text></subparagraph><subparagraph id="HE46C0104EB3346BFAB14A8681F7D0B00"><enum>(B)</enum><text display-inline="yes-display-inline">measure the rule, regulation, guidance, or order’s success in solving the problem that the rule, regulation, guidance, or order was intended to solve when issued; and</text></subparagraph><subparagraph id="HB214A7B9FDE84EEAAA7ADD4D6ED4FAA5"><enum>(C)</enum><text display-inline="yes-display-inline">publish a report on such review and measurement in the Federal Register.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3F3853936F42455E9DB9ED8B87601920"><enum>(b)</enum><header>Consideration of review and assessment; rulemaking requirements</header><text display-inline="yes-display-inline">Section 1022(b) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8951D6E84D9F4F20BA13EF9DB4AB96BA" style="OLC"><paragraph id="H71ABD133ABD648F2B443A92EF691D642"><enum>(5)</enum><header>Consideration of review and assessment by the Office of Economic Analysis</header><subparagraph id="H4F7623F4BA9D486DBA90CADE8E1D0113"><enum>(A)</enum><header>In general</header><text>Before issuing any guidance, order, rule, or regulation, the Director shall consider the review and assessment of such guidance, order, rule, or regulation carried out by the Office of Economic Analysis.</text></subparagraph><subparagraph id="H50A1905A8DF94118AA9886F0CA25F220"><enum>(B)</enum><header>Notice of disagreement</header><text display-inline="yes-display-inline">If the Director disagrees with any part of a review and assessment described under subparagraph (A) with respect to any guidance, order, rule, or regulation, the Director shall accompany any such guidance, order, rule, or regulation with a statement explaining why the Director so disagrees.</text></subparagraph></paragraph><paragraph id="HE470A09DEA084D69BCF731096C1E2046"><enum>(6)</enum><header>Identification of problems and metrics for judging success</header><subparagraph id="H9AF847B7010648B281C623E765B0F9E2"><enum>(A)</enum><header>In general</header><text>The Director shall, in each proposed rulemaking of the Bureau—</text><clause id="H03D9E4F7997F4418B73476E1CC3A30D8"><enum>(i)</enum><text>identify the problem that the particular rule or regulations is seeking to solve; and</text></clause><clause id="HB965F5FB96044784BB643BA74381CAAB"><enum>(ii)</enum><text>specify the metrics by which the Bureau will measure the success of the rule or regulation in solving such problem.</text></clause></subparagraph><subparagraph id="HEA2BE09B0BA446399120C77D99ACA018"><enum>(B)</enum><header>Required metrics</header><text display-inline="yes-display-inline">The metrics specified under subparagraph (A)(ii) shall include a measurement of changes to consumer access to, and cost of, consumer financial products and services.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
