Davis of Illinois</cosponsor>, and <cosponsor name-id="R000305">Ms. Ross</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for special enrollment periods during public health emergencies.</official-title></form><legis-body id="HB19F5096E9574ECC86A33394D0549B0C" style="OLC"><section id="H8DB3DF06624B4ED299B6EC50CF4F57B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Coverage in Public Health Emergencies Act of 2021</short-title></quote>.</text></section><section id="HFC1425EDDC2E489088532C61AAA9ADB8"><enum>2.</enum><header>Special enrollment periods during public health emergencies</header><subsection id="H6D6FDE87CE1B41B78F2EF0249782CB3E"><enum>(a)</enum><header>Public Health Service Act</header><text display-inline="yes-display-inline">Title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg</external-xref> et seq.) is amended—</text><paragraph id="HBF3B5630DD1E464E9BCCBAA4A34EA693"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2702(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-1">42 U.S.C. 300gg–1(b)(2)</external-xref>), by inserting <quote>, which shall include a special enrollment period of 30 days during a public health emergency declared under section 319, which period may be extended for such time as the Secretary may require</quote> before the period at the end; and</text></paragraph><paragraph id="H2E679865FEF14EDC9585F8C914F4DBED"><enum>(2)</enum><text>in section 2704(f) (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-3">42 U.S.C. 300gg–3(f)</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H568CA8F31E0B4834B051A56501008694"><paragraph id="H593FE2AA8C3C411DA62E473A3947B688"><enum>(4)</enum><header>Public health emergencies</header><text>If the Secretary declares a public health emergency under section 319, a group health plan, and a group health insurance issuer offering group health insurance coverage in connection with a group health plan, shall permit an employee who is eligible, but not enrolled, for coverage under the terms of the plan or coverage (or a dependent of such an employee if the dependent is eligible, but not enrolled, for coverage under such terms) to enroll for coverage under the terms of the plan or coverage during the special enrollment period required under section 2702(b)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-1">42 U.S.C. 300gg–1(b)(2)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H58C35C06488C43958F2DF668087D5ECF"><enum>(b)</enum><header>ERISA</header><text>Section 701(f) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1181">29 U.S.C. 1181(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H855D867D0BEC4A93AF575C3FCBC6DC3B"><paragraph id="HB60118CA2CEA49A78AF98AC40D6A1B9D"><enum>(4)</enum><header>Public health emergencies</header><text>If the Secretary of Health and Human Services declares a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), a group health plan, or a health insurance issuer offering group health insurance coverage in connection with such a plan, shall permit an employee who is eligible, but not enrolled, for coverage under the terms of the plan or coverage (or a dependent of such an employee if the dependent is eligible, but not enrolled, for coverage under such terms) to enroll for coverage under the terms of the plan or coverage during the special enrollment period required under section 2702(b)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-1">42 U.S.C. 300gg–1(b)(2)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0DAD1FD0F3CC443D84A09E06633074E4"><enum>(c)</enum><header>IRC</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9801">Section 9801(f)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/9801">26 U.S.C. 9801(f)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8453A28FFD814684A11A87C38F2C5216"><paragraph id="HB652D9C4AEE245EFBF99F567EB0066B4"><enum>(4)</enum><header>Public health emergencies</header><text>If the Secretary of Health and Human Services declares a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), a group health plan shall permit an employee who is eligible, but not enrolled, for coverage under the terms of the plan (or a dependent of such an employee if the dependent is eligible, but not enrolled, for coverage under such terms) to enroll for coverage under the terms of the plan during the special enrollment period required under section 2702(b)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-1">42 U.S.C. 300gg–1(b)(2)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDDA2BCCB22B34C3AB6C901288E65C7F3"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in the amendments made by this section shall be construed to prevent a group health plan or health insurance issuer from offering a special enrollment period in addition to any such period required under Federal law.</text></subsection></section><section id="H23479BF47DC64CD7AC929AB05BE710A7" commented="no"><enum>3.</enum><header>Effective date; application</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date of enactment of this Act and shall apply with respect to plan years in effect on the date of enactment of this Act, and plan years beginning on or after such date.</text></section></legis-body></bill>
