which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of the Federal Highway Administration to establish a program to provide grants for reconnecting neighborhoods, and for other purposes.</official-title></form><legis-body id="HCD4CE6613E3E42C0B8DED7ABB2E6253D" style="OLC"><section id="H68F2E8F5F74E4CE5B3DBCEF3114E8133" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Neighborhood Access and Equity Grants Act</short-title></quote>.</text></section><section id="HE15C9EBF096A454D9386D0C9957E7A8F" section-type="subsequent-section"><enum>2.</enum><header>Reconnecting neighborhoods</header><subsection id="H4980F5AF16BB4926A40F90515CFBFE30"><enum>(a)</enum><header>Authorization</header><text>There is authorized to be appropriated from the General Fund of the Treasury, $3,950,000,000 for fiscal year 2022 for the purposes described in this section.</text></subsection><subsection id="H59E6FF66601E41EF91F7CDCB60C25E0F"><enum>(b)</enum><header>Grant authority</header><text>The Administrator of the Federal Highway Administration shall establish a program to provide discretionary grants to eligible entities described in subsection (c)—</text><paragraph id="H175704562E2043D698431BEA92CB233C"><enum>(1)</enum><text>to improve walkability, safety, and affordable transportation access through construction (as such term is defined in section 101 of title 23, United States Code) of projects that are sensitive to the context of the community—</text><subparagraph id="HB43C6ACE6D3749CFBF85E4C9931DCD81"><enum>(A)</enum><text>to remove, remediate, or reuse a facility described in subsection (d);</text></subparagraph><subparagraph id="H5EAF597C442D45C4A7A71E7ABA744D42"><enum>(B)</enum><text>to replace a facility described in subsection (d) with a facility that is at-grade or lower speed; or</text></subparagraph><subparagraph id="HAD39B771D62546A6A271315A956B62C7"><enum>(C)</enum><text>to retrofit or cap a facility described in subsection (d); and</text></subparagraph></paragraph><paragraph id="HC50F7C79123A464EAD89807F1E401E7C"><enum>(2)</enum><text>for planning and capacity building activities in disadvantaged or underserved communities to—</text><subparagraph id="HF662C892AC004AC7A8B87E47BBC4D822"><enum>(A)</enum><text>identify, monitor, or assess local and ambient air quality, emissions of greenhouse gases, hot spot areas of extreme heat or elevated air pollution, gaps in tree canopy coverage, or flood prone locations;</text></subparagraph><subparagraph id="H4E6C073878E444BCBB026D1269B05D86"><enum>(B)</enum><text>assess transportation equity or pollution impacts and develop local anti-displacement policies and community benefit agreements;</text></subparagraph><subparagraph id="HAC60D086E9754DECA9E68EC18A06C3A2"><enum>(C)</enum><text>conduct predevelopment activities for projects eligible under this subsection;</text></subparagraph><subparagraph id="H668D1B08A04841CEB3E5FC86C6560860"><enum>(D)</enum><text>expand public participation in transportation planning by individuals and organizations in disadvantaged or underserved communities; or</text></subparagraph><subparagraph id="HD3E33555B50C4D4A9A1A8B15FBAC05F5"><enum>(E)</enum><text>administer or obtain technical assistance related to activities described in this subsection.</text></subparagraph></paragraph></subsection><subsection id="HACBACF1153804CBD98E76C48D04023CE"><enum>(c)</enum><header>Eligible entities described</header><text>An eligible entity referred to in subsection (b) is—</text><paragraph id="H408447F9E1964EF99810063A0DEC7E8D"><enum>(1)</enum><text>a State (as such term is defined in section 101 of title 23, United States Code);</text></paragraph><paragraph id="HEE70B4CC94A7493AA6C774D4FDC0AB82"><enum>(2)</enum><text>a unit of local government;</text></paragraph><paragraph id="H98480F4C484B4A1D8FC998A7A5CEBFDE"><enum>(3)</enum><text>a political subdivision of a State (as such term is defined in section 101 of title 23, United States Code);</text></paragraph><paragraph id="H46F054AE4F5D43E189552C7F122A70C4"><enum>(4)</enum><text>a recipient of funds under section 202 of title 23, United States Code;</text></paragraph><paragraph id="H5AB087F02C394EEFA5E30254A663C5F9"><enum>(5)</enum><text>a territory of the United States;</text></paragraph><paragraph id="H87E8F625847B450A88AB6B7656C68FCF"><enum>(6)</enum><text>a metropolitan planning organization (as defined in section 134(b) of title 23, United States Code); or</text></paragraph><paragraph id="H5CEE13EE3D7644B3A7945F16F2C91935"><enum>(7)</enum><text>with respect to a grant described in subsection (a)(2), in addition to an eligible entity described in paragraphs (1) through (6), a nonprofit organization or institution of higher education that has entered into a partnership with an eligible entity described in paragraphs (1) through (6).</text></paragraph></subsection><subsection id="H6A97E8BA43FD4CA5A36A03FF8AE3437D"><enum>(d)</enum><header>Facility described</header><text>A facility is a surface transportation facility for which high speeds, grade separation, or other design factors create an obstacle to connectivity within a community.</text></subsection><subsection id="H670E149F55F8424FAD146AE54F886044"><enum>(e)</enum><header>Minimum investment</header><text>Not less than 40 percent of the amounts made available under subsection (a) shall be distributed for projects in communities that—</text><paragraph id="H804189B8AD864DF79EA513E126E8FBFE"><enum>(1)</enum><text>are economically disadvantaged, including an underserved community or a community located in an area of persistent poverty;</text></paragraph><paragraph id="H8B0F095ED07E48898647C41854F46BC6"><enum>(2)</enum><text>have entered or will enter into a community benefits agreement with representatives of the community;</text></paragraph><paragraph id="H69A4F8B989FB4FE79BA5D31D2584D398"><enum>(3)</enum><text>have an anti-displacement policy, a community land trust, or a community advisory board in effect; or</text></paragraph><paragraph id="HEB5483464CF64E4CA3B2AFC06C86110D"><enum>(4)</enum><text>have demonstrated a plan for employing local residents in the area impacted by the activity or project proposed under this section.</text></paragraph></subsection><subsection id="H8E09BC7055CD48609806FBBED4C59264"><enum>(f)</enum><header>Administration</header><text display-inline="yes-display-inline">Amounts made available under subsection (a) shall be administered as if made available under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, and a project carried out under this section shall be treated as a project on a Federal-aid highway under such chapter.</text></subsection></section></legis-body></bill>
