<official-title display="yes">To designate an Anomalous Health Incidents Interagency Coordinator to coordinate the interagency investigation of, and response to, suspected attacks presenting as anomalous health incidents, and for other purposes.</official-title>

<section id="HE71976F63D28494D9DC30F1069C33D5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Directed Energy Threat Emergency Response Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H1BC80EA4729C4183A8D43E9759EBF64D"><enum>2.</enum><header>Findings; sense of Congress</header> <subsection id="HE1F678C46BFE4325A705A9C13D43AD47"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
<paragraph id="H1E4C0F026C8C41449AE01D8970EFC3CC"><enum>(1)</enum><text>Since at least 2016, United States Government personnel and their family members have reported anomalous health incidents at diplomatic missions across the world and in the United States, which are sometimes referred to as <quote>Havana Syndrome</quote>.</text></paragraph> <paragraph id="H26DB5F501EC448E28B5448A9471F3CE0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>Some of the anomalous health incidents have resulted in unexplained brain injuries, which have had permanent, life-altering effects that have disrupted lives and ended careers.</text></paragraph>
<paragraph id="H80381A097F1740D8AC2D9F879AB0F457"><enum>(3)</enum><text display-inline="yes-display-inline">A panel of experts convened by the Bureau of Medical Services of the Department of State in July 2017 to review triage assessments of medically evaluated personnel from the United States Embassy in Havana came to a consensus that the findings were most likely related to neurotrauma from a nonnatural source.</text></paragraph> <paragraph id="H47CF28F92ECE4018A884BCDD6FCBA68F"><enum>(4)</enum><text>A 2020 report by the National Academy of Sciences found that <quote>many of the distinctive and acute signs, symptoms, and observations reported by [affected] employees are consistent with the effects of directed, pulsed radio frequency (RF) energy</quote> and that <quote>directed pulsed RF energy [...] appears to be the most plausible mechanism in explaining these cases</quote>.</text></paragraph>
<paragraph id="H6260B54EA93D49F3940B691507D0635A"><enum>(5)</enum><text display-inline="yes-display-inline">According to the National Academy of Sciences report, <quote>such a scenario raises grave concerns about a world with disinhibited malevolent actors and new tools for causing harm to others</quote>.</text></paragraph> <paragraph id="HAF9FDFB278334E17B2D0742FF8B35CB3"><enum>(6)</enum><text>The number and locations of these suspected attacks have expanded and, according to press reporting, there have been more than 130 possible cases that have been reported by United States personnel in Asia, in Europe, and in the Western Hemisphere, including within the United States.</text></paragraph>
<paragraph id="H1877EC67B395452BBE6D1F26E805EDC1"><enum>(7)</enum><text>The continuing and expanding scope of these suspected attacks is impacting the security and morale of United States personnel, especially those posted overseas.</text></paragraph> <paragraph id="H92E20DAFEF324BC09A9A85702F4F8C39"><enum>(8)</enum><text>The Convention on the Prevention and Punishment of Crimes against Internationally Protected Persons (including diplomatic agents) to which 180 countries are a party, protects diplomatic personnel from attacks on their persons, accommodations, or means of transport, and requires all state parties to punish and take measures to prevent such grave crimes.</text></paragraph></subsection>
<subsection id="HE47C34B2FEAE48A3989C6C8CC51C72B7"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> <paragraph id="H496A2363EE0641C1927FC07474C9FF26"><enum>(1)</enum><text>the threat to United States Government personnel from suspected attacks presenting as anomalous health incidents is a matter of urgent concern and deserving of the full attention of government;</text></paragraph>
<paragraph id="HA8E92250F8F945BD91B751DE0BF94F06"><enum>(2)</enum><text display-inline="yes-display-inline">personnel, dependents, and other appropriate individuals suffering anomalous health incidents from these suspected attacks deserve equitable, accessible, and high-quality medical assessment and care, regardless of their employing Government agency;</text></paragraph> <paragraph id="H76C6D0210FF94AA9A2A6EE33A43BD525"><enum>(3)</enum><text>diagnoses and determinations to treat personnel, dependents, and other appropriate individuals experiencing symptoms consistent with such injuries should be made by experienced medical professionals and made available by the Federal Government;</text></paragraph>
<paragraph id="HEF66BFE74BC441298866272D075FEAB0"><enum>(4)</enum><text>any recriminations, retaliation, or punishment associated with personnel self-reporting symptoms is unacceptable and should be investigated by internal agency oversight mechanisms;</text></paragraph> <paragraph id="H820E16243DFD4D8EB7167A8F04F7A615"><enum>(5)</enum><text>information sharing and interagency coordination is essential for the comprehensive investigation, attribution, and mitigation of these injuries;</text></paragraph>
<paragraph id="HFD16CB16EF024831A594D06007EEF902"><enum>(6)</enum><text>the Administration should provide Congress and the public with timely and regular unclassified updates on the threat posed to United States Government personnel by the suspected causes of these injuries;</text></paragraph> <paragraph id="H330ABA6EDD824137ADBD84F3721518E6"><enum>(7)</enum><text>recent efforts by the Administration and among relevant agencies represent positive steps toward responding to the threat of anomalous health incidents, but more comprehensive measures must be taken to further assist victims, investigate and determine the cause of the injuries of such victims, and prevent future incidents;</text></paragraph>
<paragraph id="HFC990F35DC3F4A189039171402168746"><enum>(8)</enum><text>establishing the source and cause of these anomalous health incidents must be a top priority for the United States Government and requires the full coordination of relevant agencies;</text></paragraph> <paragraph id="HADF65DE2E91E414CBEDEB8300F103EA6"><enum>(9)</enum><text>if investigations determine that the anomalous health incidents are the result of deliberate acts by individuals, entities, or foreign countries, the United States Government should recognize and respond to these incidents as hostile attacks; and</text></paragraph>
<paragraph id="H84FBA7B2B0A24CABA65ED1CED96CF9A8"><enum>(10)</enum><text>any actors found to have been targeting United States Government personnel should be publicly identified, as appropriate, and held accountable.</text></paragraph></subsection></section> <section id="H72FC1C85DA1041D19C484C7E2C0AFBB2"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text>
<paragraph id="H54CB60311FE540119C438FF28B1264AD"><enum>(1)</enum><text display-inline="yes-display-inline">to detect, deter, and punish any clandestine attacks that cause persistent injuries to United States personnel;</text></paragraph> <paragraph id="HCC046C880370484798F4C1B8DD3B855A"><enum>(2)</enum><text>to provide appropriate assistance to United States personnel harmed by such attacks;</text></paragraph>
<paragraph id="HB13EA965C437474893CD7CA6CB222CAE"><enum>(3)</enum><text>to hold responsible any persons, entities, or governments involved in ordering or carrying out such attacks, including through appropriate sanctions, criminal prosecutions, or other tools;</text></paragraph> <paragraph id="H08A4328671344F588E7F031E6208466B"><enum>(4)</enum><text>to prioritize research into effective countermeasures to help protect United States personnel from such attacks; and</text></paragraph>
<paragraph id="HFB0E892AC40748A69AE4E037C1FA716E"><enum>(5)</enum><text>to convey to foreign governments through official contact at the highest levels the gravity of United States concern about such suspected attacks and the seriousness of consequences that may follow for any actors found to be involved.</text></paragraph></section> <section id="H7475A3CB526E48E6ABB212E143FC0550"><enum>4.</enum><header>Anomalous Health Incidents Interagency Coordinator</header> <subsection id="H42D0FA841ED3429C98CB1683A7F940C3"><enum>(a)</enum><header>Designation</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall designate—</text>
<paragraph id="HCFECAFF81C4844B28770388814C4C862"><enum>(1)</enum><text display-inline="yes-display-inline">an appropriate senior official to be known as the Anomalous Health Incidents Interagency Coordinator; and</text></paragraph> <paragraph id="HE4690B7A81A147C0A2E57F0FFF6D955F"><enum>(2)</enum><text>an appropriate senior official in the White House Office of Science and Technology Policy to be known as the Deputy Anomalous Health Incidents Interagency Coordinator.</text></paragraph></subsection>
<subsection id="HFC1B47D8C6444810AF6991580F95E610"><enum>(b)</enum><header>Duties</header><text>The Interagency Coordinator shall work through the President’s designated National Security process—</text> <paragraph id="H837B419AEF814E54ADCB380A6002BBD9"><enum>(1)</enum><text>to coordinate the response of the United States Government to anomalous health incidents;</text></paragraph>
<paragraph id="H65819B3C38554A1CB2CEB6025376849F"><enum>(2)</enum><text>to coordinate among relevant agencies to ensure equitable and timely access to assessment and care for affected personnel, dependents, and other appropriate individuals;</text></paragraph> <paragraph id="H7343DDCEFA734A35A209F3BBFCB92038"><enum>(3)</enum><text>to ensure adequate training and education for United States Government personnel;</text></paragraph>
<paragraph id="H3884EAEC157B4D5E850A7FA16F94B0B2"><enum>(4)</enum><text>to ensure that information regarding anomalous health incidents is efficiently shared across relevant agencies in a manner that provides appropriate protections for classified, sensitive, and personal information;</text></paragraph> <paragraph id="H33DA09634F204EE18F765390B2C920EA"><enum>(5)</enum><text display-inline="yes-display-inline">to coordinate through the White House Office of Science and Technology Policy, and across the science and technology enterprise of the Government, the technological and research efforts of the Government to address suspected attacks presenting as anomalous health incidents; and</text></paragraph>
<paragraph id="HCE2C642C20974CE2A4582E19E6D09423"><enum>(6)</enum><text>to develop policy options to prevent, mitigate, and deter suspected attacks presenting as anomalous health incidents.</text></paragraph></subsection> <subsection id="HD23DE71A35734EDC8E81FF89A8CEBC1C"><enum>(c)</enum><header>Designation of Agency Coordination Leads</header> <paragraph id="H62D8B2992A574B67A392FE8DFA4A971A"><enum>(1)</enum><header>In general</header><text>The head of each relevant agency shall designate a Senate-confirmed or other appropriate senior official, who shall—</text>
<subparagraph id="H82A50368903F41359B514DD5C9BB8C1D"><enum>(A)</enum><text>serve as the Anomalous Health Incident Agency Coordination Lead for the relevant agency;</text></subparagraph> <subparagraph id="HFD0345CFD30D458EAFEEBA890EBCFC49"><enum>(B)</enum><text>report directly to the head of the relevant agency regarding activities carried out under this Act;</text></subparagraph>
<subparagraph id="H22B3F53849EB4F9BB6B6F0EB3B544280"><enum>(C)</enum><text>perform functions specific to the relevant agency, consistent with the directives of the Interagency Coordinator and the established interagency process;</text></subparagraph> <subparagraph id="H2CFD32C98BC24D0CB0B7E1990CC7CDC8"><enum>(D)</enum><text>participate in interagency briefings to Congress regarding the response of the United States Government to anomalous health incidents; and</text></subparagraph>
<subparagraph id="H3519D182F60C449ABE0539AFE0086D2F"><enum>(E)</enum><text>represent the relevant agency in meetings convened by the Interagency Coordinator.</text></subparagraph></paragraph> <paragraph id="HBFF0D208B6AF4A3EA4F02D101E7E2449"><enum>(2)</enum><header>Delegation prohibited</header><text>An Agency Coordination Lead may not delegate the responsibilities described in subparagraphs (A) through (C) of paragraph (1).</text></paragraph></subsection>
<subsection id="HE2CD8EAC8459411191A0EC99EAFC1240"><enum>(d)</enum><header>Secure reporting mechanisms</header><text>Not later than 90 days after the date of the enactment of this Act, the Interagency Coordinator shall—</text> <paragraph id="HF71782192D4E468883DBAC4489210238"><enum>(1)</enum><text>ensure that each relevant agency develops a process to provide a secure mechanism for personnel, their dependents, and other appropriate individuals to self-report any suspected exposure that could be an anomalous health incident;</text></paragraph>
<paragraph id="H890DB9B3153747D9A2C195CCA23344D1"><enum>(2)</enum><text>ensure that each relevant agency shares all relevant data in a timely manner with the Office of the Director of National Intelligence, and other relevant agencies, through existing processes coordinated by the Interagency Coordinator; and</text></paragraph> <paragraph id="HC902DA25A3A1469281466C7F18D36CB0"><enum>(3)</enum><text>in establishing the mechanism described in paragraph (1), prioritize secure information collection and handling processes to protect classified, sensitive, and personal information.</text></paragraph></subsection>
<subsection id="HEE0B29C69CEA43C9A180C17121579351"><enum>(e)</enum><header>Briefings</header>
<paragraph id="H8383383E3BA44C8DACFCD633AF677AA1"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, and quarterly thereafter for the following 2 years, the Interagency Coordinator, the Deputy Coordinator, and the Agency Coordination Leads shall jointly provide a briefing to the appropriate national security committees regarding progress in carrying out the duties under subsection (b), including the requirements under paragraph (2).</text></paragraph> <paragraph id="H56D233C30F464BF1996B561E76BDCE2D"><enum>(2)</enum><header>Elements</header><text>The briefings required under paragraph (1) shall include—</text>
<subparagraph id="H0FF42AFEB2674485A2B7C0EBD61EDCE7"><enum>(A)</enum><text>an update on the investigation into anomalous health incidents impacting United States Government personnel and their family members, including technical causation and suspected perpetrators;</text></subparagraph> <subparagraph id="H6192E38329B740DCBE7CE4FBDFB4B0CF"><enum>(B)</enum><text>an update on new or persistent incidents;</text></subparagraph>
<subparagraph id="H2C2C111ADFBC408699797EBC91A81B92"><enum>(C)</enum><text>threat prevention and mitigation efforts to include personnel training;</text></subparagraph> <subparagraph id="HBB9CAC88137E42F1AF40E5BAD22B3B88"><enum>(D)</enum><text>changes to operating posture due to anomalous health threats;</text></subparagraph>
<subparagraph id="H5DA6DFE5DAC64B7EBFF28EFE6132B06D"><enum>(E)</enum><text>an update on diagnosis and treatment efforts for affected individuals, including patient numbers and wait times to access care;</text></subparagraph> <subparagraph id="H4B414F29AB6C4D8C900C64E4C659F742"><enum>(F)</enum><text>efforts to improve and encourage reporting of incidents;</text></subparagraph>
<subparagraph id="H3272AF80051B4F38BBC9578424944B49"><enum>(G)</enum><text>detailed roles and responsibilities of Agency Coordination Leads;</text></subparagraph> <subparagraph id="HB49BCC24065643578E59998AF681834F"><enum>(H)</enum><text>information regarding additional authorities or resources needed to support the interagency response; and</text></subparagraph>
<subparagraph id="HCAB7563F769F4555906B8B5CF458BA7D"><enum>(I)</enum><text>other matters that the Interagency Coordinator or the Agency Coordination Leads consider appropriate.</text></subparagraph></paragraph> <paragraph id="HC8948CBF2F3C43D882718EFB97B2A0E0"><enum>(3)</enum><header>Unclassified briefing summary</header><text>The Agency Coordination Leads shall provide a coordinated, unclassified summary of the briefings to Congress, which shall include as much information as practicable without revealing classified information or information that is likely to identify an individual.</text></paragraph></subsection>
<subsection id="H3E36FD4CE2E04B47955B3802CE122458" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Retention of authority</header><text>The appointment of the Interagency Coordinator shall not deprive any Federal agency of any authority to independently perform its authorized functions. </text></subsection> <subsection id="H130412DD3BD844E982842F231703744A"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit—</text>
<paragraph id="H1EA38B2C26B94AD887A77B4A16559AA1"><enum>(1)</enum><text>the President’s authority under article II of the United States Constitution; or </text></paragraph> <paragraph id="H79705623F68645A6B33EBD6C0FB9D13C"><enum>(2)</enum><text>the provision of health care and benefits to afflicted individuals, consistent with existing laws.</text></paragraph></subsection></section>
<section id="H1E402647D5C246E494F2BEE164044387"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated—</text> <paragraph id="H1DAF920C51C549CF8D9EEE4C6BF1D282"><enum>(1)</enum><text>to the Secretary of Defense $45,000,000 for fiscal year 2022, of which—</text>
<subparagraph id="HD872B1A7170C4ECBA54B1A18EC490768"><enum>(A)</enum><text>$30,000,000 shall be used—</text> <clause id="H689AF498129B4383AF526BE9304F5315"><enum>(i)</enum><text>to develop the necessary medical capacity to provide health assessments and appropriate care to United States Government personnel, dependents, and other appropriate individuals who have symptoms associated with anomalous health incidents;</text></clause>
<clause id="H1EC40970328B459097E42407FB0E3716"><enum>(ii)</enum><text>to develop additional capability and capacity in the military healthcare system to provide assessment and timely care to affected United States Government personnel, dependents, and other appropriate individuals; and</text></clause> <clause id="HF03676E4085F4BD9B1905DE8EBDF50EE"><enum>(iii)</enum><text>to fund the assessment and care of civilian employees of the Department of Defense and other Department of Defense-affiliated non-beneficiaries, if such funding is not otherwise available; and </text></clause></subparagraph>
<subparagraph id="H06E40DECB2DA4D85BE36B207605AE07A"><enum>(B)</enum><text>the remaining $15,000,000 shall be used to support—</text> <clause id="HD4FA04A3C93B44F98EB6481DE5F93E2C"><enum>(i)</enum><text display-inline="yes-display-inline">the efforts of the Department of Defense to investigate and characterize the cause of anomalous health incidents, including investigations of technical causation, medical research, and other activities in support of attribution;</text></clause>
<clause id="H47AC00C889F544BCA3FC3DB93FB6EB0E"><enum>(ii)</enum><text display-inline="yes-display-inline">intelligence and data analysis by the Department of Defense of information related to anomalous health incidents; and</text></clause> <clause id="H79B109AE01E04FD49592963DC60362E0"><enum>(iii)</enum><text display-inline="yes-display-inline">development and implementation by the Department of Defense of force protection and mitigation efforts; and</text></clause></subparagraph></paragraph>
<paragraph id="HEBFB534C94864F5AA58FF3438DFF92DF"><enum>(2)</enum><text display-inline="yes-display-inline">to the Secretary of State $5,000,000 for fiscal year 2022 to be used—</text> <subparagraph id="H651B84255EE24740AF99270895EFC982"><enum>(A)</enum><text display-inline="yes-display-inline">to increase capacity and staffing for the Health Incident Response Task Force of the Department of State;</text></subparagraph>
<subparagraph id="HDB515F0347E14377A3B7E6538B079E14"><enum>(B)</enum><text>to support the development and implementation of efforts by the Department of State to prevent and mitigate anomalous health incidents affecting its workforce;</text></subparagraph> <subparagraph id="H2EF6091956A14687BC874B86AA93A8BA"><enum>(C)</enum><text>to investigate and characterize the cause of anomalous health incidents, including investigations of causation and attribution;</text></subparagraph>
<subparagraph id="H6C3398DC5ED040818DCD8D114F70522D"><enum>(D)</enum><text>to collect and analyze data related to anomalous health incidents;</text></subparagraph> <subparagraph id="H1A785D8186054A3FBA120CD7BD5A1536"><enum>(E)</enum><text>to coordinate with other relevant agencies and the National Security Council regarding anomalous health incidents; and</text></subparagraph>
<subparagraph id="HBCAE5019FD34444EB5B8E9488FEC7D40"><enum>(F)</enum><text>to support other activities to understand, prevent, deter, and respond to suspected attacks presenting as anomalous health incidents, at the discretion of the Secretary of State.</text></subparagraph></paragraph></section> <section id="H1D14505EED5A43F1AE33B17D363AC891"><enum>6.</enum><header>Development and dissemination of workforce guidance</header><text display-inline="no-display-inline">The President shall direct relevant agencies to develop and disseminate to employees who are at risk of exposure to anomalous health incidents, not later than 90 days after the date of the enactment of this Act, updated workforce guidance to report, mitigate, and address suspected attacks presenting as anomalous health incidents.</text></section>
<section id="H87811819590B4C05AF175D6855D135FD"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HFA5DF6026CB8461694AE5BA6C417581F"><enum>(1)</enum><header>Agency coordination lead</header><text>The term <term>Agency Coordination Lead</term> means a senior official designated by the head of a relevant agency to serve as the Anomalous Health Incident Agency Coordination Lead for such agency.</text></paragraph>
<paragraph id="HF963BC8DE6144DBD8F72B99FE3BDC39A"><enum>(2)</enum><header>Appropriate national security committees</header><text>The term <term>appropriate national security committees</term> means—</text> <subparagraph id="H64B7F3920AC541EA8683E216EBC9326C"><enum>(A)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></subparagraph>
<subparagraph id="H43B324213B7E49F28E9C3E11E20881DF"><enum>(B)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph> <subparagraph id="H6A447F1C928A40D4B1BAF7E18F05E57D"><enum>(C)</enum><text>the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>;</text></subparagraph>
