R. 5212</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210910">September 10, 2021</action-date><action-desc><sponsor name-id="C001110">Mr. Correa</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to require an annual report on veteran access to gender specific services under community care contracts, and for other purposes.</official-title></form><legis-body id="HD5E3C7DB4FD6414C82B806F87EF65FF6" style="OLC"><section id="H1BFFE7A730F5498ABA0E65A31B898268" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Oversight of Women Veterans’ Care Act of 2021</short-title></quote>.</text></section><section id="HBCC1D13F550A49A7AAD6EE179F4B47B0"><enum>2.</enum><header>Annual report on veteran access to gender specific services under Department of Veterans Affairs community care contracts</header><subsection id="H07797E6B42AE4A46A62C1116CCE89305"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H7FB5438A9B294BDD961DE01348FFE659" style="USC"><section id="H093D4402BBA7471FBA796584E5D6259B"><enum>1730D.</enum><header>Annual report on veteran access to gender specific services under community care contracts</header><subsection id="HFAF30C9D5C854850BAECFC59A19703BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives an annual report on the access of women veterans to gender specific services under contracts, agreements, or other arrangements with non-Department medical providers entered into by the Secretary for the provision of hospital care or medical services to veterans. Such report shall include data and performance measures for the availability of gender specific services, including—</text><paragraph id="HA4775A1DDE66487F9CFBE9FB67133B31"><enum>(1)</enum><text>the average wait time between the veteran’s preferred appointment date and the date on which the appointment is completed;</text></paragraph><paragraph id="HCA0AC497F73E4FD28156F7F11585A833"><enum>(2)</enum><text>the average driving time required for veterans to attend appointments; and</text></paragraph><paragraph id="H71C5CB6286724B95BDA87788FE30FF7C"><enum>(3)</enum><text>reasons why appointments could not be scheduled with non-Department medical providers.</text></paragraph></subsection><subsection id="H45D454C6A9F548D1AD693B7267777850"><enum>(b)</enum><header>Gender specific services</header><text display-inline="yes-display-inline">In this section, the term <quote>gender specific services</quote> means mammography, obstetric care, gynecological care, and such other services as the Secretary determines appropriate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB81EF238CDD8413A90A6A6125CC53CDE"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1730C the following new item:</text><quoted-block display-inline="no-display-inline" id="H0B58E2C49835402E8021C9CC1086F354" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">1730D. Annual report on veteran access to gender specific services under community care contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H31346DD432094F2F89F8F24DF04E96E5"><enum>3.</enum><header>Establishment of environment of care standards and inspections at Department of Veterans Affairs medical centers</header><subsection id="H8634CCD7129E44438E9B3BED63A98528"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall establish a policy under which—</text><paragraph id="HA161109989424D5084F48824D3A94FF4"><enum>(1)</enum><text>the environment of care standards and inspections at Department of Veterans Affairs medical centers include—</text><subparagraph id="HD0CA16A024694A1DBBD27F6451921E69"><enum>(A)</enum><text display-inline="yes-display-inline">an alignment of the requirements for such standards and inspections with the women's health handbook of the Veterans Health Administration;</text></subparagraph><subparagraph id="H77F2A21D339744CE8978191E5ED74B15"><enum>(B)</enum><text>a requirement for the frequency of such inspections;</text></subparagraph><subparagraph id="HAB4E38B93F4B4F75AB65EDEDCEFF75C1"><enum>(C)</enum><text>delineation of the roles and responsibilities of staff at the medical center who are responsible for compliance; and</text></subparagraph><subparagraph id="H50CE714552134D578F606A9225F7BF37"><enum>(D)</enum><text>the requirement that each medical center submit to the Secretary a report on the compliance of the medical center with the standards; and</text></subparagraph></paragraph><paragraph id="H94981A7A35C544489EAB0742D36BB338"><enum>(2)</enum><text display-inline="yes-display-inline">for the purposes of the End of Year Hospital Star Rating, no medical center is eligible for a five-star rating as reported under the Strategic Analytics for Improvement and Learning Value Model unless it meets the environment of care standards.</text></paragraph></subsection><subsection id="HC8FBAE74EB6947BD8E5C3BB201C5A31F"><enum>(b)</enum><header>Report</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives certification in writing that the policy required by subsection (a) has been finalized and disseminated to Department all medical centers.</text></subsection></section></legis-body></bill>
