<committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To expedite application for payment of rental arrearages by landlords and mandate tenant access to financial assistance, and for other purposes.</official-title></form><legis-body id="HBBF9F26E8F434042B344A7C595FD6ADF" style="OLC"><section id="HE5F4D808831147288663703B053EBB71" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expediting Assistance to Renters and Landlords Act of 2021</short-title></quote>. </text></section><section id="H2969D6D8D1FC41D796C1D8C22332FE24"><enum>2.</enum><header>Expediting Applications for Payment of Rental Arrearages by Landlords</header><subsection id="H61524F20666A452CA958ADAD3106A005"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 501(f) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(f)</external-xref>)is amended—</text><paragraph id="HEA99D49C8D664DFAB27A59CD15FA0FDE"><enum>(1)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="H68A5DA4D168E430BBA1A84C2E961C191" display-inline="no-display-inline"><paragraph id="H85F118874D7546B694266F611D7C33DA"><enum>(3)</enum><header>Requirements for applications submitted on behalf of tenant without tenant consent</header><subparagraph id="H52AA397FAE854740BAB21F54B08912B0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall not later than 30 days after the date of the enactment of this paragraph establish a process for a landlord of a residential dwelling to submit an application on the behalf of a renter when such landlord is unable to obtain the consent of such renter to submit such application for after taking reasonable steps to obtain such signature, as determined by the Secretary.</text></subparagraph><subparagraph id="HB933EB69190F4847A91E584A646509FF"><enum>(B)</enum><header>Notice of application</header><text>The process established by the Secretary pursuant to subparagraph (A) shall require a landlord of a residential dwelling who submits an application for assistance without the consent of the renter of such dwelling to notify the renter of the intent of the landlord to submit such application not less than 10 days before such landlord submits such application.</text></subparagraph><subparagraph id="HC6C5B1A4B243444F96B67EA70F3F090D"><enum>(C)</enum><header>Satisfaction of outstanding monetary claims</header><text display-inline="yes-display-inline">If a landlord of a residential dwelling submits an application for assistance on behalf of a renter without the consent of such renter and receives assistance under this section, such amount shall be deemed to satisfy all monetary claims relating to rent such landlord may have against such renter during the period between the date on which the national emergency concerning the novel coronavirus disease (COVID–19) outbreak was declared by the President and the date on which the application is submitted by the landlord.</text></subparagraph><subparagraph id="H7F42313AD5B041FB8DA6B47F8CD00432"><enum>(D)</enum><header>Documentation</header><clause id="HDA1AFF3B0F5545CC84BC6C1E5ACBD42F"><enum>(i)</enum><header>In general</header><text>The Secretary shall, with respect to documentation required for applications for assistance, establish methods for landlords to establish the income of a renter when the landlord does not have the consent of the renter, including the use of proxies of income. </text></clause><clause id="H454FAA986CA54FEE8F917B1001287839"><enum>(ii)</enum><header>4 or fewer dwellings</header><text>The Secretary shall, where possible, limit the amount of documentation required for an application for assistance in the case of a landlord that owns 4 or fewer residential dwellings. </text></clause></subparagraph><subparagraph id="H4D7D2CFA551E47D69701F60A674FF236"><enum>(E)</enum><header>Conditions on assistance</header><clause id="H4DB550B6D8AE4B53AF809624F513B6E2"><enum>(i)</enum><header>In general</header><text>The landlord shall comply with any conditions the Secretary of the Treasury may prescribe to ensure that renters remain stably housed.</text></clause><clause id="H2CD42F11FABA4082A8C4D92F4B86090E"><enum>(ii)</enum><header>120-day eviction prohibition</header><text>The Secretary of the Treasury shall, not later than 30 days after the date of the enactment of this paragraph, to ensure that renters remain stably housed, prohibit any landlord that receives assistance from a grantee under this section with respect to a particular renter from evicting such renter, except when the tenancy constitutes a direct threat to the health and safety of other individuals or would result in substantial physical damage to the property of others, during the 120-day period after the date on which such assistance was received by the landlord from the grantee.</text></clause><clause id="HA888DEDB6C4A4B3B9B7CB5528C0E69B7"><enum>(iii)</enum><header>Eviction-related requirements</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall, not later than 30 days after the date of the enactment of this paragraph, require any landlord that receives assistance from a grantee under this section with respect to a particular renter to, with respect to such renter—</text><subclause id="H1A5A43BD634C462D80F6914FD6100B11"><enum>(I)</enum><text display-inline="yes-display-inline">set aside and vacate any past eviction judgement based on nonpayment of rent covered by the application for assistance; and </text></subclause><subclause id="H067600E356D64B9AB6BC794061896266"><enum>(II)</enum><text>rescind any eviction notice and agree to seal any eviction filing, if applicable. </text></subclause></clause></subparagraph><subparagraph id="H9CF1F463701249C28288EB43D2183049" display-inline="no-display-inline"><enum>(F)</enum><header>Notice of arrearages received</header><text display-inline="yes-display-inline">If a grantee provides rental arrearages to a landlord based on an application submitted by the landlord on behalf of a renter, such landlord must—</text><clause id="H03D6D15DA9D84B00A46A43048F258ABD"><enum>(i)</enum><text>notify such renter that such rental arrearages were received from the grantee;</text></clause><clause id="H51EF59AF83964053A14BE3D2CE0E2B0C"><enum>(ii)</enum><text display-inline="yes-display-inline">notify such renter if the landlord applies for assistance in the amount of rent due during the 120-day period described in subparagraph (F); and</text></clause><clause id="H32E73C61C8DB487BAC925292144FBA4D"><enum>(iii)</enum><text display-inline="yes-display-inline">inform such renter that the landlord is prohibited from terminating the lease agreement or evicting such renter, except when the tenancy constitutes a direct threat to the health and safety of other individuals or would result in substantial physical damage to the property of others, during the 120 day period after such rental arrearages were received by the landlord from the grantee.</text></clause></subparagraph><subparagraph id="H5297CB37DD834E5D978FD8B9CF32E18C" display-inline="no-display-inline"><enum>(G)</enum><header>Vacant properties</header><text display-inline="yes-display-inline">The Secretary shall establish a process for a landlord to submit an application for assistance on behalf of a renter who has vacated a dwelling, provided that the landlord did not file an eviction notice on such renter.</text></subparagraph><subparagraph id="H09A249AC3D8D46BF92A7B7F0C0A0E64F" display-inline="no-display-inline"><enum>(H)</enum><header>Grantee Notification Process</header><text display-inline="yes-display-inline">Each grantee that provides assistance to a landlord with respect to a residential dwelling under this paragraph shall establish a process to notify state and local courts and the renter of such residential dwelling that—</text><clause id="H52B7386C7573451AAD1010EAC8CF78C5"><enum>(i)</enum><text>rent is no longer past due with respect to such renter; and </text></clause><clause id="H3A91137BE1CB4922B727CDAF2EA8FB76"><enum>(ii)</enum><text display-inline="yes-display-inline">any eviction proceedings relating to the nonpayment of rent by such renter should be halted.</text></clause></subparagraph><subparagraph id="HF7287CE1459042B2871F8788E3AA38A3"><enum>(I)</enum><header>Notification of rights</header><text display-inline="yes-display-inline">Each grantee that provides assistance to a landlord with respect to a residential dwelling under this paragraph shall inform the renter of such residential dwelling about—</text><clause id="HB0F8DF1435CC46ECBECDB378445A400D"><enum>(i)</enum><text>the rights of such renter under the Fair Housing Act and relevant State and local laws relating to fair housing; and</text></clause><clause id="H3BDAD84F472547958620557DFEACB351"><enum>(ii)</enum><text>how such renter can file complaints with respect to violations of the Fair Housing Act and violations of relevant State and local laws relating to fair housing. </text></clause></subparagraph><subparagraph id="H67986B35D0F14E1BA2E72284526C66F6" display-inline="no-display-inline"><enum>(J)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph may be construed to prevent a renter of a dwelling from applying for assistance related to items described in section 501(c)(2)(A) that are not included in an application submitted by a landlord on behalf of the renter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1EECE13A14EB4A9AACB11D855C53EA67"><enum>(b)</enum><header>Prioritization of assistance</header><text display-inline="yes-display-inline">Section 501(c)(4) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(c)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD6CE7E655F3C43AC806D986BD924D758" display-inline="no-display-inline"><subparagraph id="HB3BECD12E574440C93B5A6B0E568A2A9"><enum>(C)</enum><text display-inline="yes-display-inline">The grantee shall prioritize applications filed by renters and applications filed by landlords on behalf of renters with the consent of the renter over any application filed by a landlord without the consent of a renter. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H294720A95E1B49D385C688CF0E2380FC"><enum>3.</enum><header>Mandating Tenant Access to Financial Assistance</header><subsection id="H2630C67DCB3F40F397F4194A7F4114E1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 501(c) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(c)</external-xref>) is amended—</text><paragraph id="H209B5D88F2384E3B942BAD388E1222A5"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H73870B40E0C7440BAFCD672E4F5DDD49"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H0238C6CEE1C64E878E951408A844B43C"><enum>(i)</enum><text>by striking <quote>12 months</quote> and inserting <quote>20 months</quote>; and</text></clause><clause id="H944E933BE480491F86ECC4769B2B91F1"><enum>(ii)</enum><text>by striking <quote>for an additional 3 months</quote> and inserting <quote>for an additional 4 months</quote>;</text></clause></subparagraph><subparagraph id="HDF19EC6CE6C7429082265B97031E8B6B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by striking <quote>3 months</quote> and inserting <quote>4 months</quote>; and </text></subparagraph><subparagraph id="H75B37989FC93493A89BA447422E90EFC"><enum>(C)</enum><text>in subpargraph (C)(i)(I) by striking <quote>the grantee may make such payments</quote> and inserting <quote>the grantee shall make such payments</quote>; and</text></subparagraph></paragraph><paragraph id="HF3AC16F84D104F2BAB969C6D1B064C90"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking <quote>to provide eligible households</quote> and inserting <quote>to provide <quote>low-income families</quote> as such term is defined in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>)</quote>.</text></paragraph></subsection><subsection id="HEBB72DF515004BA78EB07633EFF7B604"><enum>(b)</enum><header>Extended period for assistance</header><text display-inline="yes-display-inline">Section 3201(d)(1)(A) of the American Rescue Plan Act of 2021 is amended—</text><paragraph id="H00434612F441415EAEF589F24928BEF1"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>18 months</quote> and inserting <quote>24 months</quote>; and</text></paragraph><paragraph id="H904F76813E6447469EAAE84A833B74A1"><enum>(2)</enum><text>in clause (ii), by striking <quote>18 months</quote> and inserting <quote>24 months</quote>. </text></paragraph></subsection><subsection id="H3BE3C76A3D764B4584E5EC2C9DB23447"><enum>(c)</enum><header>Limitation of liability</header><text display-inline="yes-display-inline">Section 501 of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HCCAC38EF48AC42B5B81FC392523FD121" display-inline="no-display-inline"><subsection id="H3AB2B39BD4104CDFA778DFD165E735C6"><enum>(m)</enum><header>Safe harbor</header><text display-inline="yes-display-inline">A grantee may not be subject to liability for the provision of assistance under this section to a renter who does not meet the eligibility requirements set forth under this section if such grantee provides such assistance in good faith reliance on attestations of eligibility or use of proxies of income provided by the renter pursuant to the requirements of this section or rules issued by the Secretary under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0FFA3F9C9B0F4A8EB62BA6681CF61117"><enum>(d)</enum><header>Eligible household defined</header><text display-inline="yes-display-inline">Section 501(k)(3) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(k)(3)</external-xref>) is amended—</text><paragraph id="H693F9C67211744119D7E68E28407BC31"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="HB497AB1049634A70A26AFE731D06AFC3"><enum>(A)</enum><text>by striking <quote>with respect to which the eligible grantee involved determines</quote> and inserting <quote>with respect to which the eligible grantee determines by accepting any attestation of the household as true,</quote>; and</text></subparagraph><subparagraph id="HE28352E95D0C45A6B8BE27DC19227E59"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>hardship due, directly</quote> an inserting <quote>hardship, during or due, directly</quote></text></subparagraph></paragraph><paragraph id="HCD304C30752748B7A1F7F461087E27FA"><enum>(2)</enum><text>by striking in subparagraph (C) and inserting the following:</text><quoted-block style="OLC" id="H743EAB6824A7481B90E1280357516E13" display-inline="no-display-inline"><subparagraph id="H08ADE84B7219402384A22834153AD506"><enum>(C)</enum><header>Income determination</header><text display-inline="yes-display-inline">In determining the income of a household for purposes of determining such household’s eligibility for assistance from a payment made under this section (including for purposes of subsection (c)(4)), the eligible grantee involved shall accept any attestation of the household with respect to eligibility as true.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H206ACF93117541B1BC300AD29D2F4520"><enum>(e)</enum><header>Lease requirement prohibited</header><text display-inline="yes-display-inline">Section 501 of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD5A77658C76440CBBF3CA91839108AA9" display-inline="no-display-inline"><subsection id="HBA0AB597B519498F9DA610D94367A53C"><enum>(n)</enum><header>Lease requirement prohibited</header><text display-inline="yes-display-inline">The Secretary shall prohibit grantees from requiring a renter to submit a written lease agreement to be eligible for assistance under this section. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H92FB762029F742138193C2304CF8A02B"><enum>4.</enum><header>Performance improvement plans</header><text display-inline="no-display-inline">Section 501(c) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HAC2BF975BDC945498C97DEBAFBF42E5F" display-inline="no-display-inline"><paragraph id="HB9D120ACF3934EC691C67A0E1B35570A"><enum>(6)</enum><header>Performance improvement plans</header><text display-inline="yes-display-inline">The Secretary shall require any eligible grantee that has, on September 30, 2021, obligated less than 25 percent of any amounts such eligible grantee has received under this section to provide to the Secretary a performance improvement plan that explains how such eligible grantee will expedite the delivery of assistance to renters and landlords. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HA1EB0D2CBD5E40BF900B0A3415A220A5"><enum>5.</enum><header>Outreach to renters and landlords and technical assistance</header><text display-inline="no-display-inline">Section 501 of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HA5B28859E940405F8EB6F1147877442F" display-inline="no-display-inline"><subsection id="H026935A791924BEAADF8DC2F73BE06A3"><enum>(o)</enum><header>Outreach and technical assistance</header><paragraph id="H1CB6C2A285CB4271A6EF91B81AC7D4F2"><enum>(1)</enum><header>Outreach</header><text>The Secretary and the grantee shall conduct outreach to renters and landlords to ensure maximum participation in the emergency rental assistance program established under this section, including by—</text><subparagraph id="HA20E9B0D01FA453FBA62A2B058891427"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 30 days after the date of the enactment of this subsection sending direct mail to all taxpayers that educates the taxpayers about the emergency rental assistance program established under this section and how the taxpayer may qualify for assistance;</text></subparagraph><subparagraph id="H49E9488DC07F4AD98BE8B315A54798A1"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 30 days after the date of the enactment of this subsection sending direct mail to taxpayers who received rental income in 2020 that informs such taxpayers that renters of their dwellings may qualify for the emergency rental assistance program established under this section; and </text></subparagraph><subparagraph id="HC1436F4BDECD44F0BAC2FF41BA74EABF"><enum>(C)</enum><text display-inline="yes-display-inline">purchasing television, radio and electronic advertisement to educate Americans about the emergency rental assistance program established under this section and how Americans may qualify for assistance.</text></subparagraph></paragraph><paragraph id="H744EE74663194B9B8B1E2C76A3DF3783"><enum>(2)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall provide technical assistance to grantees and this technical assistance shall include—</text><subparagraph id="HC4FEF41728094EC28C123EF4BE4D9EED"><enum>(A)</enum><text display-inline="yes-display-inline">assisting grantees with the development and administration of programs under this section;</text></subparagraph><subparagraph id="HB8476FFF6EA44AB9A63AFAD58E35EB74"><enum>(B)</enum><text>providing technical advice and technology to grantees, including software and automated payment disbursement tools; and </text></subparagraph><subparagraph id="H5BB481FF14954B3A992134B147EB5311"><enum>(C)</enum><text>other information and technical assistance as the Secretary determines appropriate to assist grantees to achieve the objectives of this section.</text></subparagraph></paragraph><paragraph id="HD8DC351F26A142098D031D87A21A25E4"><enum>(3)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary of the Treasury to carry out the outreach and technical assistance required under this subsection $50,000,000 for use in fiscal year 2022. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB9EB9604A8E448FCA9AB5977567DE296"><enum>6.</enum><header>Recapture process modification</header><text display-inline="no-display-inline">Section 501(d) of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(d)</external-xref>) is amended—</text><paragraph id="H1DFDDBDE762E4FB5A4EB53B0B7671642"><enum>(1)</enum><text>by striking <quote>Beginning on September 30, 2021, </quote> and inserting the following: </text><quoted-block style="OLC" id="HBC99A637B022403CB26551EBDB10809C" display-inline="no-display-inline"><paragraph id="HFC0F3F1381B0462DA7783092F10AD7A0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on September 30, 2021, </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H60C57DD5809B4FCBA3E0F79BEB07210A"><enum>(2)</enum><text>by striking <quote>The amount of any such reallocation</quote> and inserting the following:</text><quoted-block style="OLC" id="HF97B7B79E9254794A14A401AFDA744B8" display-inline="no-display-inline"><paragraph id="HAD5E9AD4DD224FB6B8C3D813F26EA909"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline"> The amount of any such reallocation</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H58F3A7624E3E4CC2BE9748A6C5460F9B"><enum>(3)</enum><text>in paragraph (1)—</text><subparagraph id="H33532D9376EB44FCB567E7416C3B23B1"><enum>(A)</enum><text>by striking <quote>uses described under subsection (c).</quote> and inserting <quote>uses described under subsection (c);</quote>;</text></subparagraph><subparagraph id="H83A1DC9E7BB0411E8A8B1AECA25FB92D"><enum>(B)</enum><text>by striking <quote>to eligible grantees</quote> and inserting the following:</text><quoted-block style="OLC" id="H2400B503116940A694BC451EBC4EEE60" display-inline="no-display-inline"><subparagraph id="HD794B9F2FE5B4EDB9E0F5FB2141A1D03"><enum>(A)</enum><text display-inline="yes-display-inline">to eligible grantees </text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph id="HECA8B6D0C628448AB5B188B738ADDC34"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" id="H4B24FEF0283547EF80A988473B1CDC82" display-inline="no-display-inline"><subparagraph id="H1B4233EBE4344EB8A51AF1F8A019DF5F"><enum>(B)</enum><text display-inline="yes-display-inline">to any nonprofit entity that primarily provides housing services and operates in the jurisdiction of the grantee from whom the funds were recaptured; or</text></subparagraph><subparagraph id="HF6A0021DBF5C49BD82691E67110B411B"><enum>(C)</enum><text display-inline="yes-display-inline">to a public or private entity supervised by a court that primarily provides housing services and operates in the jurisdiction of the grantee from whom the funds were recaptured.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H0A50F0B7309946278BD1034636CBA90D"><enum>7.</enum><header>Collaboration with public entities</header><subsection id="HDC28FE5DAAD3419DAB5619E4D1B46270"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 501 of subtitle A of title V of Division M of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a</external-xref>) is amended—</text><paragraph id="H5D9FBF8D55F04907B25A5DBE93A93DD7"><enum>(1)</enum><text>in subsection (c)(5)(A)—</text><subparagraph id="H10010F9BC5934A37B859FCD0646A3B67"><enum>(A)</enum><text>by striking <quote>10 percent</quote> and inserting <quote>15 percent</quote>; and</text></subparagraph><subparagraph id="HF11F99F0C1C346A78EEAEDBF56DD067A"><enum>(B)</enum><text>by striking <quote>related to such funds.</quote> and inserting <quote>related to such funds and for collaboration with public entities as described in subsection (n).</quote>. </text></subparagraph></paragraph><paragraph id="HCD22FF182B82444488B9E0D38F35F3AB"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HFBA4DA8C819A43A18CC3DC32979BA53D" display-inline="no-display-inline"><subsection id="H9A1C541B4D5444F2A0192C5A12242AED"><enum>(p)</enum><header>Collaboration with public entities</header><paragraph id="HBDA6D24845924C34A2A03A5ED443E528"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall, not later than 30 days after the enactment of this subsection, issue guidance designed to instruct eligible grantees with respect to how best to collaborate with public entities to provide application assistance services.</text></paragraph><paragraph id="H5D0B6C9E837144D9B0354159307F9696"><enum>(2)</enum><header>Use of amounts paid to eligible grantee</header><text display-inline="yes-display-inline">Notwithstanding subsection (c)(5), an eligible grantee that collaborates with public entities pursuant to the guidance issued by the Secretary of the Treasury pursuant to paragraph (1) may use amounts available for administrative costs under section (c)(5) to, in coordination with one or more public entities, develop any administrative infrastructure necessary to provide application assistance services, including—</text><subparagraph id="HF38265D76C3B4C80B28E66EF04F42B6F"><enum>(A)</enum><text>training the employees of a public entity or other designated institutional representative of a public entity about how to complete the emergency rental application process;</text></subparagraph><subparagraph id="HC6D5295A22A6488AA40AF3C8684101FF"><enum>(B)</enum><text>maintaining physical and electronic copies of all documents needed to apply for assistance;</text></subparagraph><subparagraph id="H1D1B9082BFED4EC3B9BEA692953399E2"><enum>(C)</enum><text>establishing methods of communication between eligible grantees, public entities, community organizations, and individual households;</text></subparagraph><subparagraph id="H1E9FCEF004B44E2C830752823DF3745A"><enum>(D)</enum><text>providing language translation services;</text></subparagraph><subparagraph id="H2283766299E84C858ED442C43E230F27"><enum>(E)</enum><text>developing community outreach materials, programs, and initiatives; and</text></subparagraph><subparagraph id="H87BE8CBE7A034C58B8424B3063D0E2A6"><enum>(F)</enum><text>collecting and storing relevant documentation on-site at the public entity, or with a third party in a manner that complies with Federal, State, and local law. </text></subparagraph></paragraph><paragraph id="H80449412D1694F6EA6648A9C6F28F6A3"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H2E0CB74B59F24D79A17ABB29D3D1D067"><enum>(A)</enum><header>Application assistance services</header><text>The term <quote>application assistance services</quote> means—</text><clause id="HEEC5811AC4CC4FF69A048132047B8553" display-inline="no-display-inline"><enum>(i)</enum><text>distributing applications for assistance to individuals that may qualify for assistance; and </text></clause><clause id="HC050B7D59696420282D784E936D5BB6B"><enum>(ii)</enum><text>assisting individuals applying or assistance.</text></clause></subparagraph><subparagraph id="H7FF3A15518104E048025FEDB6AAF9CFB"><enum>(B)</enum><header>Public entity</header><text>The term public entity includes—</text><clause id="H97FDC3D751CD4D46BF8C5A5293F57E57"><enum>(i)</enum><text display-inline="yes-display-inline">public elementary schools and public secondary schools (as such terms are defined under section 8101 of the Elementary and Secondary Education Act of 1965);</text></clause><clause id="H49E73AE334984D23B7BB04D103DAF403"><enum>(ii)</enum><text>public libraries;</text></clause><clause id="HBACBA6B86C6D4018AB4C10D3C0F797EF"><enum>(iii)</enum><text display-inline="yes-display-inline">HUD-approved housing counseling agencies and other entities receiving funds under section 3204 of the American Rescue Plan Act of 2021;</text></clause><clause id="HDDFA67600E8949F9AEF180F0FC04A268"><enum>(iv)</enum><text>courts that handle eviction related matters;</text></clause><clause id="H552A26CB066A4E3A8A4A47CD838CDD33"><enum>(v)</enum><text>public housing agencies;</text></clause><clause id="H21F38E51B6FA4665B54A7649C75829C6"><enum>(vi)</enum><text>public transit systems;</text></clause><clause id="H410E0F7E6B0D472AB5A29D8DB0EBCF66"><enum>(vii)</enum><text>State departments of motor vehicles;</text></clause><clause id="H1BC8A46FF4A74FC09F5182B838557FF3"><enum>(viii)</enum><text>the United States Postal Service; and</text></clause><clause id="H48F265F117F3479288D754BD628C3698"><enum>(ix)</enum><text display-inline="yes-display-inline">Federal, State, and local social service providers. </text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H442216379AD64A559C02564E0A1ECD02"><enum>(b)</enum><header>Collaboration with public entities</header><text display-inline="yes-display-inline">Section 3201 of the American Rescue Plan Act of 2021 is amended by adding at the end the following: </text><quoted-block style="OLC" id="H0F1953C4EA294DB18546D3D3E37F06DC" display-inline="no-display-inline"><subsection id="HE93009B9D43E4304ADF6BC886F3AD5E9"><enum>(i)</enum><header>Collaboration with public entities</header><paragraph id="HF18A6255C2244ECDAB902C7605C28E63"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall, not later than 30 days after the enactment of this subsection, issue guidance designed to instruct eligible grantees with respect to how best to collaborate with public entities to provide application assistance services.</text></paragraph><paragraph id="HB11F0780CBB44E4BA994E118544821C0"><enum>(2)</enum><header>Use of amounts paid to eligible grantee</header><text display-inline="yes-display-inline">An eligible grantee that collaborates with public entities pursuant to the guidance issued by the Secretary of the Treasury pursuant to paragraph (1) may use not more than 15 percent of the amount paid to such eligible grantee under this section to, in coordination with one or more public entities, develop any administrative infrastructure necessary to provide application assistance services, including—</text><subparagraph id="H393B7B163BB949E486E1927B0E7594E9"><enum>(A)</enum><text>training the employees of a public entity or other designated institutional representative of a public entity about how to complete the emergency rental application process;</text></subparagraph><subparagraph id="H25DC2605A0A24142BB2D5E5C185B2B03"><enum>(B)</enum><text>maintaining physical and electronic copies of all documents needed to apply for assistance;</text></subparagraph><subparagraph id="H12E99EFCA7784834877483401BDB794C"><enum>(C)</enum><text>establishing methods of communication between eligible grantees, public entities, community organizations, and individual households;</text></subparagraph><subparagraph id="H5D005A9E836E4EC994B54E0CE76D6A33"><enum>(D)</enum><text>providing language translation services;</text></subparagraph><subparagraph id="HE186AC25C4C349EB9EC575A623798D59"><enum>(E)</enum><text>developing community outreach materials, programs, and initiatives; and</text></subparagraph><subparagraph id="H0DC3255057A64693B591BE4B2D849C56"><enum>(F)</enum><text>collecting and storing relevant documentation on-site at the public entity, or with a third party in a manner that complies with Federal, State, and local law. </text></subparagraph></paragraph><paragraph id="H914F93D31BB84DDCBB55386692800E80"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H98D558EC97A14D53996359F5645A8331"><enum>(A)</enum><header>Application assistance services</header><text>The term <quote>application assistance services</quote> means—</text><clause id="HB2294013FC70469EB7AAEC97C112C607" display-inline="no-display-inline"><enum>(i)</enum><text>distributing applications for assistance to individuals that may qualify for assistance; and </text></clause><clause id="H0478085558D648899DCDD9681A77C2BC"><enum>(ii)</enum><text>assisting individuals applying or assistance.</text></clause></subparagraph><subparagraph id="H6D2DDE2B7C054B1DBA1FB56A5345D37F"><enum>(B)</enum><header>Public entity</header><text>The term public entity includes—</text><clause id="HE5932DF5FAC342B59EB9EB30468D22FE"><enum>(i)</enum><text display-inline="yes-display-inline">public elementary schools and public secondary schools (as such terms are defined under section 8101 of the Elementary and Secondary Education Act of
