Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to adjust the applicable percentage of the new markets tax credit, the application of such credit to certain agricultural trades or businesses, and for other purposes.</official-title></form><legis-body id="HB7FDA4C11E974C1EA927AD02C5FEC402" style="OLC"><section id="H51FEBF3120444BF6976548DCEDD98A32" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Food Production Enhancement Act of 2021</short-title></quote>.</text></section><section id="HB3D4F212A80D4DD08D7060331AD99138"><enum>2.</enum><header>Increase in credit percentage of new markets tax credit</header><subsection id="H1614E974DDCE4CB5890A369B98F1F711"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45D">Section 45D(a)(2)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" id="HA2FCE16DA50545CA9F1882C2CF2663C4" display-inline="no-display-inline"><paragraph id="H1E3D11EF765444438BDAB754DAEBE784"><enum>(2)</enum><header>Applicable percentage</header><text display-inline="yes-display-inline">For purposes of paragraph (1)—</text><subparagraph id="H8D2C0F9356DD4565A3D77293EECCD78B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any qualified equity investment made after the date of the enactment of <short-title>Local Food Production Enhancement Act of 2021</short-title>, the applicable percentage is—</text><clause id="HC966FC207DE9478990AD4546F2EE4176"><enum>(i)</enum><text display-inline="yes-display-inline">6 percent with respect to the first 4 credit allowance dates, and</text></clause><clause id="HEE231E2C643A4A6A8B11F294CA5D6CAD"><enum>(ii)</enum><text>7 percent with respect to the remainder of the credit allowance dates.</text></clause></subparagraph><subparagraph id="HF30F7A16B2EB4085AD20B0594BC2131D"><enum>(B)</enum><header>Certain older investments</header><text>In the case of any qualified equity investment made on or before the date of the enactment of the <short-title>Local Food Production Enhancement Act of 2021</short-title>, the applicable percentage is—</text><clause id="H92533B721B3F48A4BD3BB6EA0A54A637"><enum>(i)</enum><text>5 percent with respect to the first 3 credit allowance dates, and</text></clause><clause id="H4DC4CCD0911A4D128D1EEBF4F204DE2B"><enum>(ii)</enum><text>6 percent with respect to the remainder of the credit allowance dates.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6D80636B71884AD096AA4A994D6D231B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to investments made after the date of the enactment of this Act.</text></subsection></section><section id="H2AAEF06278DD44D29952B3C411D9C149"><enum>3.</enum><header>Certain farming operations made eligible for investment under the new markets tax credit</header><subsection id="HFEFBA5290BDD4EC195935548AD9D4E45"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45D">Section 45D(d)(3)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of subparagraph (A), by striking the period at the end of subparagraph (B) and inserting <quote>, and</quote>, and by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H040B1B74CCC14B0D892B2639A098D36E" display-inline="no-display-inline"><subparagraph id="H518C72368A9649598B4D996B07F5F5BD"><enum>(C)</enum><text display-inline="yes-display-inline">a qualified farming business shall not fail to be treated as a qualified business by reason of paragraph (5)(B) thereof.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBD379167744B417CAF0131E09199FA34"><enum>(b)</enum><header>Qualified farming business</header><text>Section 45D(d) of such Code is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H45FA51FA3A96408B94E57B01F6505DEC" display-inline="no-display-inline"><paragraph id="H5AD11CEEA04E4F5DA2DEB8E48D1239A5"><enum>(4)</enum><header>Qualified farming business</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="HCB4D8A4564474E7588386B688A99A69B"><enum>(A)</enum><header>In general</header><text>The term <quote>qualified farming business</quote> means any trade or business of farming if—</text><clause id="HDBD8BBC5BC674731BF7F47AE57AE821C"><enum>(i)</enum><text>all of such farming is conducted in a qualified area or an area adjacent to a qualified area, and</text></clause><clause id="H53BF93DC96A54972A3418812A4158A9C"><enum>(ii)</enum><text display-inline="yes-display-inline">such trade or business has in effect a local distribution plan, a surplus stock distribution plan, and a local workforce plan, each of which is certified by the Secretary.</text></clause></subparagraph><subparagraph id="H323582484DFE4E66AD990AB99BE44170"><enum>(B)</enum><header>Qualified area</header><clause id="HD1BF739E32254511B72C5FBF9CD3A630"><enum>(i)</enum><header>In general</header><text>The term <quote>qualified area</quote> means—</text><subclause id="HFFBFE80D12554CC7A9BC7F79A4EAD132"><enum>(I)</enum><text>any low-income community if at least 500 individuals (or at least 33 percent) of the population of such community lives more than 0.5 miles (10 miles if such community is in a rural area) from a large grocery store, and</text></subclause><subclause id="H231FB12F8521417A9F24BAB24D767064"><enum>(II)</enum><text>any population census tract adjacent to a low-income community described in subclause (I).</text></subclause></clause><clause id="HDF3F590F5260403F8B788163D75A45CF"><enum>(ii)</enum><header>Large grocery store</header><text>For purposes of this subparagraph, the term <quote>large grocery store</quote> means any means any single retail grocery store location which includes all of the major food departments and has annual sales of at least $2,000,000. </text></clause></subparagraph><subparagraph id="HB0F8A072C7CC46AB9A18DD2CA95E8848"><enum>(C)</enum><header>Local distribution plan</header><text display-inline="yes-display-inline">The term <quote>local distribution plan</quote> means, with respect any trade or business, having the following in effect with respect to such trade or business:</text><clause id="H24200FDBDED34710B81D6D079C1F93B2"><enum>(i)</enum><text display-inline="yes-display-inline">A list of grocery retailers within 5 miles of the principal location of such trade or business (20 miles if such principal location is in a rural area).</text></clause><clause id="H9C67F7E1DD7F4F1FBE36D87592F0BD03"><enum>(ii)</enum><text>A documented offer to distribute agricultural or horticultural products to at least 80 percent of such grocery retailers.</text></clause><clause id="H98C32E6AA52E49A889189B8A1BF58ECE"><enum>(iii)</enum><text>A documented agreement to provide fresh produce year-round to grocery retailers who agree to such offer.</text></clause></subparagraph><subparagraph id="HDFEF221F97F04F4E83D855DBC0496FD8"><enum>(D)</enum><header>Local workforce plan</header><text>The term <quote>local workforce plan</quote> means, with respect to any trade or business, having the following in effect with respect to such trade or business—</text><clause id="HC5BFF26538E1498B8DC176846B1CD92C"><enum>(i)</enum><text>a documented commitment to hiring locally including—</text><subclause id="H497E69E0CCF44DDEB4B4988F6B047B05"><enum>(I)</enum><text>a list of local media such trade or business will use to publicize job openings,</text></subclause><subclause id="H12BBDF28BD07437DADBCD67BB6E5CB0D"><enum>(II)</enum><text>a list of local job centers, trade schools, and other workforce development organizations, and</text></subclause><subclause id="H541D5977A4CB4F129A7DFFB43F1D86D4"><enum>(III)</enum><text>a written plan to carry out agreements with entities listed under subclause (II) to hire locally when feasible, and</text></subclause></clause><clause id="HC7C7AFEBEE064D6E8CA418CB4CB09731"><enum>(ii)</enum><text>a list of local youth science, technology, engineering, and math programs supported or operated by the trade or business.</text></clause></subparagraph><subparagraph id="HF2F571A5ACF34656B1CA0E715C90652B"><enum>(E)</enum><header>Surplus stock distribution plan</header><text>The term <quote>surplus stock distribution plan</quote> means, with respect to any trade or business, having in effect a plan for distributing surplus agricultural or horticultural products to food banks and other nonprofit food providers located in qualified areas.</text></subparagraph><subparagraph id="H3DFD5C5E17B14E008DC16C481A8158D2" commented="no"><enum>(F)</enum><header>Farming</header><text display-inline="yes-display-inline">The term <quote>farming</quote> means raising or harvesting any agricultural or horticultural commodity, not including the raising, shearing, feeding, caring for, or management of animals.</text></subparagraph><subparagraph id="H4D347BED6FFC4600B63B570EA8694D67" commented="no"><enum>(G)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <quote>rural area</quote> has the meaning given such term by section 1393(a)(2). </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7B6DFD53D52E441AAE1C63ECCD113FFC"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
