Community Food Project Grant Program.</toc-entry></toc></subsection></section><title id="HBBC6648357834E8E87D5AF66D2625BE2"><enum>I</enum><header>Urban Agriculture Conservation Easement Program</header><section id="H6148ED541363433B86BF7DB16369A301"><enum>101.</enum><header>Establishment and purposes</header><subsection id="H3E57980227A84FE88B1D7ECB0DF9BF05"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish an urban agriculture conservation easement program for the conservation of eligible land, improved community food security, and improved access to cropland for beginning farmers or ranchers, socially disadvantaged farmers or ranchers, and majority-controlled producer-based business ventures through easements or other interests in land.</text></subsection><subsection id="HE148DCD6FCA549609DF10EFDA7AC0114"><enum>(b)</enum><header>Purposes</header><text>The purposes of the program are to—</text><paragraph id="H32D07263D8C64E6184F84D8AE54CC40C"><enum>(1)</enum><text>protect the agricultural use and future viability, and related conservation values, of eligible land by limiting nonagricultural uses of that land;</text></paragraph><paragraph id="HCC9E97CDF3C4435A90093B3F35917CDE"><enum>(2)</enum><text>to improve or provide affordable long-term access to land for agricultural and related uses in urban communities; and</text></paragraph><paragraph id="H83B4F55FDEE54779AFEE97FD0057B3DA"><enum>(3)</enum><text>to improve community food security.</text></paragraph></subsection></section><section id="H9B0DEAB874E04066893BC7FFD846A993"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" id="H10BF7C7204034FE382BD42661267F44A"><enum>(1)</enum><header>Beginning farmer or rancher</header><text display-inline="yes-display-inline">The term <term>beginning farmer or rancher</term> has the meaning given that term in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>).</text></paragraph><paragraph id="H275361687E6E4BE8984EF7883F42173A"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HB2C9CED7FD604C92B9E81B5640F74713"><enum>(A)</enum><text>a State or local governmental entity or an Indian Tribe; or</text></subparagraph><subparagraph id="HF5EAEECFD18C4D40AFE677AF38C5FAD0"><enum>(B)</enum><text>an organization that is—</text><clause id="H12BDC49C82A44CA6BFBD68B24F26569D"><enum>(i)</enum><text>organized for, and at all times since the formation of the organization has been operated principally for, 1 or more of the conservation purposes specified in clause (i), (ii), (iii), or (iv) of <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(4)(A)</external-xref> of the Internal Revenue Code of 1986;</text></clause><clause id="H8F6FFED4F95E42EEA936404B529BCC13"><enum>(ii)</enum><text>an organization described in section 501(c)(3) of that Code that is exempt from taxation under section 501(a) of that Code; or</text></clause><clause id="H3D41577F778444D3928AAF97F0C40722"><enum>(iii)</enum><text>described in—</text><subclause id="HA2FD1250E291438781196FB54C8D5441"><enum>(I)</enum><text>paragraph (1) or (2) of section 509(a) of that Code; or</text></subclause><subclause id="HF8AC9172FCFA4917A7A9AE5A29F27085"><enum>(II)</enum><text>section 509(a)(3) of that Code and is controlled by an organization described in section 509(a)(2) of that Code.</text></subclause></clause></subparagraph></paragraph><paragraph id="H2BF96B12A2E0418786EEA60E600D66A4"><enum>(3)</enum><header>Eligible land</header><text>The term <term>eligible land</term> means—</text><subparagraph id="HF4593A01580C4052B3B3FD86C4270B7B"><enum>(A)</enum><text>private land—</text><clause id="HD46AF2E46C2649C9BFF2C3ABDF8F4857"><enum>(i)</enum><text display-inline="yes-display-inline">that is subject to a pending offer for purchase of an urban agricultural land easement from an eligible entity;</text></clause><clause id="HF61742A256354E5F981A886BECD3818E"><enum>(ii)</enum><text>that is potentially or currently physically suitable for use as cropland and other attendant agricultural activities;</text></clause><clause id="H75ACAABA4BDF459E9BADE9A5B0665F52"><enum>(iii)</enum><text>the use of which for agricultural activities does not pose a threat to the human health of those working the land or the public, due to levels of environmental contaminants on the land or in the subsurface of the land; and</text></clause><clause id="H18DF1D973443427AA200AA63131C71C9"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="H29A7EC79DC0346C6BB9D4736BA5938B7"><enum>(I)</enum><text>that is currently vacant;</text></subclause><subclause id="HD4807769D28E413B9C0A6513574CFC77" indent="up1"><enum>(II)</enum><text>that is in tax delinquency;</text></subclause><subclause commented="no" id="H9D3737ABBD314BB29B87847C17873647" indent="up1"><enum>(III)</enum><text>that is a brownfield site, as defined in section 101(39) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601(39)</external-xref>);</text></subclause><subclause id="HEBBEDDFCF2A74C279B04B864D4E45962" indent="up1"><enum>(IV)</enum><text>that is currently being used for urban agriculture purposes; or</text></subclause><subclause id="H85B8C232AC414F8B84F7180AC651B919" indent="up1"><enum>(V)</enum><text>the protection of which will further a State or local policy consistent with the purposes of the program; or</text></subclause></clause></subparagraph><subparagraph id="H3386729F7A184920B6E2F07AD25B7189"><enum>(B)</enum><text>other private land that is incidental to land described in subparagraph (A), if the Secretary determines that it is necessary for the efficient administration of an easement under the program.</text></subparagraph></paragraph><paragraph commented="no" id="HE13600BF0AD0419985829257EC78694C"><enum>(4)</enum><header>Majority-controlled producer-based business venture</header><text display-inline="yes-display-inline">The term <term>majority-controlled producer-based business venture</term> has the meaning given that term in section 210A(a)(5) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c(a)(5)</external-xref>).</text></paragraph><paragraph id="H79B4244F27F64DFAA6F166E9C009CEBE"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the urban agricultural conservation easement program established by this subtitle.</text></paragraph><paragraph id="H2D59F1AA2F3F4E00966A44832D379BE5"><enum>(6)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Office of Urban Agriculture and Innovative Production.</text></paragraph><paragraph commented="no" id="H4435759EF4C046B8A4F6B1D14531BE33"><enum>(7)</enum><header>Socially disadvantaged farmer or rancher</header><text display-inline="yes-display-inline">The term <term>socially disadvantaged farmer or rancher</term> has the meaning given that term in section 355(e) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2003">7 U.S.C. 2003(e)</external-xref>).</text></paragraph><paragraph id="H545EAB09DA1C49B2A54DB71C4CD03556"><enum>(8)</enum><header>Urban agricultural land easement</header><text>The term <term>urban agricultural land easement</term> means an easement or other interest in eligible land that—</text><subparagraph id="H903AF8E62317434E8B06AF698508AEA2"><enum>(A)</enum><text>is conveyed for the purpose of protecting natural resources and the agricultural nature of the land in urban communities; and</text></subparagraph><subparagraph id="H7DFF2A7FA96B40B78F3745F71614DA4C"><enum>(B)</enum><text>permits the landowner the right to continue agricultural production and related uses subject to an urban agricultural land easement plan, as approved by the Secretary.</text></subparagraph></paragraph></section><section id="HDF0217092B8545658E3E20DB4995064E"><enum>103.</enum><header>Urban agricultural land easements</header><subsection id="H9DBE8B11811B42B9A6BE5DFC20411EF0"><enum>(a)</enum><header>Availability of assistance</header><text>The Secretary shall facilitate and provide funding for—</text><paragraph id="H87C5650991CA4165A920218CF33BF6F8"><enum>(1)</enum><text display-inline="yes-display-inline">the purchase by eligible entities of urban agricultural land easements in eligible land; and</text></paragraph><paragraph id="H3E3090C38FFE4F9492A502D39EA087E8"><enum>(2)</enum><text>technical assistance to provide for the conservation of natural resources pursuant to an urban agricultural land easement plan.</text></paragraph></subsection><subsection id="H1FFA42CF2669402E893E5797691858B2"><enum>(b)</enum><header>Cost-Share assistance</header><paragraph id="H5833EA8C01E1434F875362489F560FE0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall protect the agricultural use, including grazing, and related conservation and food security values of eligible land through cost-share assistance to eligible entities for purchasing urban agricultural land easements.</text></paragraph><paragraph id="H5394304D0B5E429796BDF8445F961DB8"><enum>(2)</enum><header>Scope of assistance available</header><subparagraph id="H2C75748FD55F46879D70EAC42D86E1AA"><enum>(A)</enum><header>Federal share</header><text display-inline="yes-display-inline">An agreement described in paragraph (4) shall provide for a Federal share determined by the Secretary of an amount not to exceed 75 percent of the fair market value of the urban agricultural land easement, as determined by the Secretary using—</text><clause id="H9CFBCF4B77674C788E8908C8CE3467D1"><enum>(i)</enum><text>the Uniform Standards of Professional Appraisal Practice;</text></clause><clause id="H6D9C8D46237A4EEDB8A746104CA98879"><enum>(ii)</enum><text>an areawide market analysis or survey; or</text></clause><clause id="HF2AD9266062F4976866E24034B1E287B"><enum>(iii)</enum><text>another industry-approved method.</text></clause></subparagraph><subparagraph id="H0A8DB86B70ED42478A986542492846DD"><enum>(B)</enum><header>Non-Federal share</header><clause id="HED54E9F407FD4F2B8C64B5B01A1C8359"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Under the agreement, the eligible entity shall provide a share that is at least 25 percent of the fair market value of the urban agricultural land easement in accordance with subparagraph (A).</text></clause><clause id="H71842502D48446E18B80591E753816CB"><enum>(ii)</enum><header>Source of contribution</header><text>An eligible entity may include as part of its share under clause (i) a charitable donation or qualified conservation contribution (as defined by <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)</external-xref> of the Internal Revenue Code of 1986) from the private landowner if the eligible entity contributes its own cash resources in an amount that is at least 25 percent of the amount contributed by the Secretary.</text></clause></subparagraph><subparagraph id="H1481DCE30BBB4474A8E2B3CDC12BAA97"><enum>(C)</enum><header>Exception</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(ii), the Secretary may waive any portion of the eligible entity cash contribution requirement for projects of special significance, subject to an increase in the private landowner donation that is equal to the amount of the waiver, if the donation is voluntary and the property is in active agricultural production.</text></subparagraph></paragraph><paragraph id="H32ED2ED40A7E428BB8A989DBE1B85B8F"><enum>(3)</enum><header>Evaluation and ranking of applications</header><subparagraph id="H33459D9DA29C42E0867E0614475B891B"><enum>(A)</enum><header>Criteria</header><text>The Secretary shall establish evaluation and ranking criteria to maximize the benefit of Federal investment under the program.</text></subparagraph><subparagraph id="HB5B79E241E694CD29D6BABD855A48A79"><enum>(B)</enum><header>Considerations</header><text>In establishing the criteria, the Secretary shall emphasize support for—</text><clause id="HF2F687E7675249ACAED5CEB9AD4EC9E1"><enum>(i)</enum><text>improving community food security; and</text></clause><clause id="HE13131FA44244686B1D3CDF12E810A0E"><enum>(ii)</enum><text>facilitating improved access to cropland for beginning and socially disadvantaged producers and producer groups.</text></clause></subparagraph><subparagraph id="HC4C0FD4E78BA468182EA6B976D3C9A31"><enum>(C)</enum><header>Bidding down</header><text>If the Secretary determines that 2 or more applications for cost-share assistance are comparable in achieving the purpose of the program, the Secretary shall not assign a higher priority to any of those applications solely on the basis of lesser cost to the program.</text></subparagraph></paragraph><paragraph id="HFF29F443D6EB4EB6BE5E5B1D53375040"><enum>(4)</enum><header>Agreements with eligible entities</header><subparagraph id="H6850C554E53F4F9CB9F50CEDA7E51618"><enum>(A)</enum><header>In general</header><text>The Secretary shall enter into agreements with eligible entities to stipulate the terms and conditions under which the eligible entity is permitted to use cost-share assistance provided under this section.</text></subparagraph><subparagraph id="H95B56E3705CF40C19A98444B6E8C1FEB"><enum>(B)</enum><header>Length of agreements</header><text>An agreement shall be for a term that is—</text><clause id="HF32A9178FF1E47B7B513A1F8FCC2EEBC"><enum>(i)</enum><text>in the case of an eligible entity certified under the process described in paragraph (5), a minimum of 5 years; and</text></clause><clause id="H964046726C0644469D94C71E0C550AAD"><enum>(ii)</enum><text>for all other eligible entities, at least 3, but not more than 5 years.</text></clause></subparagraph><subparagraph id="HFBEC6F65297E4BFB9BEB58A6C87D88A6"><enum>(C)</enum><header>Minimum terms and conditions</header><text display-inline="yes-display-inline">An eligible entity shall be authorized to use its own terms and conditions for urban agricultural land easements so long as the Secretary determines such terms and conditions—</text><clause id="H92C342037E944CFE9CE504C075413795"><enum>(i)</enum><text>are consistent with the purposes of the program;</text></clause><clause id="H04F4F2BDFAB548C7844F2C79B171E761"><enum>(ii)</enum><text>permit effective enforcement of the purposes of such easements;</text></clause><clause id="H0B9CCFF18C554DA8962EE47E4130F1AF"><enum>(iii)</enum><text>include a right of enforcement for the Secretary, that may be used only if the terms of the easement are not enforced by the holder of the easement;</text></clause><clause id="HA841643DAC5D47449CF119E38DA22B10"><enum>(iv)</enum><text>subject the land in which an interest is purchased to an urban agricultural land easement plan that describes the activities which promote the long-term viability of the land to meet the purposes for which the easement was acquired; and</text></clause><clause id="HA1CAE7F46B2C4BBE8D04799CC6E2B33F"><enum>(v)</enum><text>do not limit the generation of profit through agricultural activities on the land.</text></clause></subparagraph><subparagraph id="HB0740C50BEFD479686FC0981C2F8D506"><enum>(D)</enum><header>Substitution of qualified projects</header><text>An agreement shall allow, upon mutual agreement of the parties, substitution of qualified projects that are identified at the time of the proposed substitution.</text></subparagraph><subparagraph id="H68B93FD0F7D7479F9AE6FFDD435E582C"><enum>(E)</enum><header>Effect of violation</header><text>If a violation occurs of a term or condition of an agreement under this subsection—</text><clause id="H88F9BD97AB5A4B7888A0F7B3CD8F4960"><enum>(i)</enum><text>the Secretary may terminate the agreement; and</text></clause><clause id="H82A648F5C39C4BD7AC6BEEF906832CA6"><enum>(ii)</enum><text>the Secretary may require the eligible entity to refund all or part of any payments received by the entity under the program, with interest on the payments as determined appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="HD4D3B0EDA56745A4AD1F00DEFA41962C"><enum>(5)</enum><header>Certification of eligible entities</header><subparagraph id="HB40CAC074C554F51B131E78D9F510847"><enum>(A)</enum><header>Certification process</header><text>The Secretary shall establish a process under which the Secretary may—</text><clause id="H618F86033A0E42D88C94E59DF59222B4"><enum>(i)</enum><text>directly certify eligible entities that meet established criteria;</text></clause><clause id="H1A2406DBF0394154A9794906D2118F41"><enum>(ii)</enum><text>enter into long-term agreements with certified eligible entities; and</text></clause><clause id="H2E3FD953012248F191B8D0960843FEFB"><enum>(iii)</enum><text display-inline="yes-display-inline">accept proposals for cost-share assistance for the purchase of urban agricultural land easements throughout the duration of such agreements.</text></clause></subparagraph><subparagraph id="H604082886FB5465F81CCA0C57257A17F"><enum>(B)</enum><header>Certification criteria</header><text>In order to be certified, an eligible entity shall demonstrate to the Secretary that the entity will maintain, at a minimum, for the duration of the agreement—</text><clause id="H2714D53018C34D9794CC22E4447BFB08"><enum>(i)</enum><text>a plan for administering easements that is consistent with the purpose of the program;</text></clause><clause id="H2AD17CE6AFD24FE0A294E3D42BF984A5"><enum>(ii)</enum><text display-inline="yes-display-inline">the capacity and resources to monitor and enforce urban agricultural land easements; and</text></clause><clause id="H8964844CF6CF4A05BA88B7732674B318"><enum>(iii)</enum><text>policies and procedures to ensure—</text><subclause id="H3AB3BCDBBCEC41688F2E76FDAB454E13"><enum>(I)</enum><text display-inline="yes-display-inline">the long-term integrity of urban agricultural land easements on eligible land;</text></subclause><subclause id="H4073B86E09C54AF5BA4EA08E58A15136"><enum>(II)</enum><text>timely completion of acquisitions of such easements; and</text></subclause><subclause id="H42576CE0146248B3BC5BE09A815D9FDD"><enum>(III)</enum><text>timely and complete evaluation and reporting to the Secretary on the use of funds provided under the program.</text></subclause></clause></subparagraph><subparagraph id="HB9E9F30B7B174B108D8BBFEDA91E1ED8"><enum>(C)</enum><header>Review and revision</header><clause id="HF014408FD31443BB9930D26F55A82376"><enum>(i)</enum><header>Review</header><text>The Secretary shall conduct a review of eligible entities certified under subparagraph (A) every three years to ensure that such entities are meeting the criteria established under subparagraph (B).</text></clause><clause id="H3D9BB4A95ACD4DDCB984174FF933E425"><enum>(ii)</enum><header>Revocation</header><text>If the Secretary finds that a certified eligible entity no longer meets the criteria established under subparagraph (B), the Secretary may—</text><subclause id="HA0DE43EFEB3346BC9F77662BF8008338"><enum>(I)</enum><text>allow the certified eligible entity a specified period of time, at a minimum 180 days, in which to take such actions as may be necessary to meet the criteria; and</text></subclause><subclause id="H29BAB12EE3724D41B093F78083A6374C"><enum>(II)</enum><text>revoke the certification of the eligible entity, if, after the specified period of time, the certified eligible entity does not meet such criteria.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="HB66EF5F6D86944979AAACAC1AE171766"><enum>(c)</enum><header>Method of enrollment</header><text>The Secretary shall enroll eligible land under this section through the use of—</text><paragraph id="HA8298C42BBBE47D4A7B40AB612CE6875"><enum>(1)</enum><text>permanent easements; or</text></paragraph><paragraph id="HAD8C495879454D7A8FB51EA8AF8ED48A"><enum>(2)</enum><text>easements for the maximum duration allowed under applicable State laws.</text></paragraph></subsection><subsection id="HDEBB9E3EBF884A4798BFE261142FF3C6"><enum>(d)</enum><header>Technical assistance</header><text>The Secretary may provide technical assistance, if requested, to assist in—</text><paragraph id="H4C1F5C3807704C708868BF45853B777B"><enum>(1)</enum><text>compliance with the terms and conditions of easements; and</text></paragraph><paragraph id="HF5A410EBD03F4A229C12BCDBC58A8855"><enum>(2)</enum><text>implementation of an urban agricultural land easement plan.</text></paragraph></subsection><subsection commented="no" id="H8254A3AC502F4B1C97841EDC5714389D"><enum>(e)</enum><header>Funding</header><paragraph commented="no" id="H66B97506F85945D897CFD863676C13D4"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this title $20,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></paragraph><paragraph commented="no" id="H9904C52322264C65AD41D00040C2AC60"><enum>(2)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this title $20,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></paragraph></subsection></section></title><title id="H5A13E7DC584D42A8BB1F5C84B0FB64D6"><enum>II</enum><header>Other urban agriculture programs</header><section id="H8F5B572EC71F4578864CA2BAD5498E1D"><enum>201.</enum><header>Urban agriculture microentrepreneur assistance program</header><subsection id="H5DD1BB0CC12C4A0B85C4E5F20E3137B8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE055BC815D3140ED982563AE8BE229B3"><enum>(1)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph><paragraph id="H14392ECC4D3447729EE57C1197EDC9A9"><enum>(2)</enum><header>Microentrepreneur</header><text>The term <term>microentrepreneur</term> means an owner and operator, or prospective owner and operator, of an urban agriculture-related microenterprise who is unable to obtain sufficient training, technical assistance, or credit other than under this section, as determined by the Secretary.</text></paragraph><paragraph id="HE550B03D4C6A47D1992D0B3169DD30F4"><enum>(3)</enum><header>Microenterprise development organization</header><text>The term <term>microenterprise development organization</term> means an organization that—</text><subparagraph id="H5223921EBCEC493FB4D9371C45858A4F"><enum>(A)</enum><text>is—</text><clause id="H92BBBCD6C8954AE58BBCFA8F5A8C883D"><enum>(i)</enum><text>a nonprofit entity;</text></clause><clause id="H627C39AF6D4E4A758DD884CEBCC7C441"><enum>(ii)</enum><text>an Indian tribe, if the tribal government of which certifies to the Secretary that—</text><subclause id="HE5289401E2BD4720A42D1C720023A37F"><enum>(I)</enum><text>no microenterprise development organization serves the Indian tribe; and</text></subclause><subclause id="HC0432886AE8B44939991F84260A722F1"><enum>(II)</enum><text>there is no urban microentrepreneur assistance program under the jurisdiction of the Indian tribe; or</text></subclause></clause><clause id="H831908C9AF5C47BA9E5BC9F812E63881"><enum>(iii)</enum><text>a public institution of higher education;</text></clause></subparagraph><subparagraph id="HA77B55A9F3D2455FB2FD0ED5673EA4E5"><enum>(B)</enum><text>provides training and technical assistance to microentrepreneurs;</text></subparagraph><subparagraph id="HE53F974F349F46089D6F28344B9AFD65"><enum>(C)</enum><text>facilitates access to capital or another service described in subsection (b) for urban microenterprises; and</text></subparagraph><subparagraph id="HDE30989AF1884437AE19010DA472CBAA"><enum>(D)</enum><text>has a demonstrated record of delivering services to microentrepreneurs, or an effective plan to develop a program to deliver services to microentrepreneurs, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HF5B2CC4AC94B41EAA97D18C60ADB900F"><enum>(4)</enum><header>Microloan</header><text>The term <term>microloan</term> means a business loan of not more than $75,000 that is provided to a microenterprise.</text></paragraph><paragraph id="HB3440E468D904F12A1176AA175CA091B"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the urban agriculture microentrepreneur assistance program established under subsection (b).</text></paragraph><paragraph id="H95E3AECA2FE9440FB8025D297F2C4C8A"><enum>(6)</enum><header>Urban agriculture microenterprise</header><text>The term <term>urban agriculture microenterprise</term> means an entity that—</text><subparagraph id="HED7264F0D2C34800A984C06175F11B5E"><enum>(A)</enum><text display-inline="yes-display-inline">is—</text><clause display-inline="no-display-inline" id="H8F8CAFABCBA848D4B2528E78CC5D6096"><enum>(i)</enum><text>a sole proprietorship located in a urban area as defined by the Census Bureau; or</text></clause><clause id="H921E7C8F22A940FE81AF36854D79766A"><enum>(ii)</enum><text>a business entity with not more than 10 full-time equivalent employees located in a urban area; and</text></clause></subparagraph><subparagraph id="HC0609C8C2E0E43AA9F87466322EC3F2B"><enum>(B)</enum><text>is engaged in agriculture production and attendant activities, such as harvesting, packing, and minimal processing.</text></subparagraph></paragraph></subsection><subsection id="H62581EDB156C422F8AC78CDB66E0D44B"><enum>(b)</enum><header>Urban agriculture microentrepreneur assistance program</header><paragraph id="H2ADEB8CBFA0E4FE3AAEBFBBDA64B9EF9"><enum>(1)</enum><header>Establishment</header><text>The Secretary shall establish an urban agriculture microentrepreneur assistance program to provide loans and grants to support microentrepreneurs in the development and ongoing success of urban agriculture microenterprises.</text></paragraph><paragraph id="H9AD34523566E4AE1A788B1F91EBC4650"><enum>(2)</enum><header>Purpose</header><text>The purpose of the program shall be to provide microentrepreneurs with—</text><subparagraph id="HE1332B8066314151947681BC0A8700CB"><enum>(A)</enum><text>the skills necessary to establish new urban agriculture microenterprises; and</text></subparagraph><subparagraph id="H1526F5F8C52A422DB12712162550F81F"><enum>(B)</enum><text>continuing technical and financial assistance related to the successful operation of urban agriculture microenterprises.</text></subparagraph></paragraph><paragraph id="H908EFE29C47D4F65AE251BC893954273"><enum>(3)</enum><header>Loans</header><subparagraph id="HC08A1CD602BD4138A6B30764CE1AA134"><enum>(A)</enum><header>In general</header><text>The Secretary shall make loans to microenterprise development organizations for the purpose of providing fixed interest rate microloans to microentrepreneurs for startup and growing urban agriculture microenterprises.</text></subparagraph><subparagraph id="H71BDEF2099C74B9AABC2F6577F8CB4F4"><enum>(B)</enum><header>Loan terms</header><text>A loan made by the Secretary to a microenterprise development organization under this paragraph shall—</text><clause id="HF7CDF0D46B1B4CF19B0D2DC8D5AD33AB"><enum>(i)</enum><text>be for a term not to exceed 20 years; and</text></clause><clause id="H0DBC2520EF4D49858247B9883C84CC53"><enum>(ii)</enum><text>bear interest at a rate of at least 1 percent per year.</text></clause></subparagraph><subparagraph id="H45961D5CB35D45A5B2517006FA4B32D3"><enum>(C)</enum><header>Loan loss reserve fund</header><text>The Secretary shall require each microenterprise development organization that receives a loan under this paragraph to—</text><clause id="H16D1439E1CE649CD98E9C72ED66A63DB"><enum>(i)</enum><text>establish a loan loss reserve fund; and</text></clause><clause id="H5DDF7A885CE341B099F03DAF4D0A93FE"><enum>(ii)</enum><text>maintain the reserve fund in an amount equal to at least 5 percent of the outstanding balance of the loans owed by the organization, until all obligations owed to the Secretary under this paragraph are repaid.</text></clause></subparagraph><subparagraph id="HA0754F32E8784FDB963F60ED8A47B544"><enum>(D)</enum><header>Deferral of interest and principal</header><text>The Secretary may permit the deferral of payments on principal and interest due on a loan to a microenterprise development organization made under this paragraph for a 2-year period beginning on the date the loan is made.</text></subparagraph></paragraph><paragraph id="H9B3112C539A8468A93C09D53CDE895CC"><enum>(4)</enum><header>Grants</header><subparagraph id="HC295FC11B2AB437D9D6099E3B824E387"><enum>(A)</enum><header>Grants to support urban agriculture microenterprise development</header><clause id="HDE5D428776BC472D95BF9848CFE766F8"><enum>(i)</enum><header>In general</header><text>The Secretary shall make grants to microenterprise development organizations to—</text><subclause id="H7EB44CC2982647B8B887B27E179EA87B"><enum>(I)</enum><text>provide training, operational support, business planning, and market development assistance, and other related services to urban agriculture microentrepreneurs; and</text></subclause><subclause id="HF3133F47FFBC49A9AE2D04BB59D29D51"><enum>(II)</enum><text>carry out such other projects and activities as the Secretary determines appropriate to further the purposes of the program.</text></subclause></clause><clause id="H394D7247449148AF9804466C6F514A5F"><enum>(ii)</enum><header>Selection</header><text>In making grants under clause (i), the Secretary shall—</text><subclause id="HDE39CBA760DB4F2CA339610195C7CE9F"><enum>(I)</enum><text>place an emphasis on microenterprise development organizations that serve microentrepreneurs that are located in areas of concentrated poverty with limited access to fresh locally or regionally grown foods, as determined by the Secretary; and</text></subclause><subclause id="H89E3E2571755416D81243F172B8E7DF7"><enum>(II)</enum><text>ensure, to the maximum extent practicable, that grant recipients include microenterprise development organizations—</text><item id="H2E8221CEB40845DA8C8C382B5A6FB202"><enum>(aa)</enum><text>of varying sizes; and</text></item><item id="H6E6EDD63324647F4A213D7C03C4B95E8"><enum>(bb)</enum><text>that serve racially and ethnically diverse populations.</text></item></subclause></clause></subparagraph><subparagraph id="H5CF2131F11964D97A8232D52EE2F3178"><enum>(B)</enum><header>Grants to assist microentrepreneurs</header><clause id="HABF97E8D887148D7A716F1AE0E9DA739"><enum>(i)</enum><header>In general</header><text>The Secretary shall make grants to microenterprise development organizations to provide marketing, management, and other technical assistance to microentrepreneurs that received or are seeking a loan from the organization under paragraph (3).</text></clause><clause id="H2330824CEEFE4B82833121000C46C70A"><enum>(ii)</enum><header>Maximum amount of grant</header><text>A microenterprise development organization shall be eligible to receive an annual grant under this subparagraph in an amount equal to not more than 25 percent of the total outstanding balance of microloans made by the organization under paragraph (3), as of the date the grant is awarded.</text></clause></subparagraph><subparagraph id="HBD7473AF522242019164F8AB8F0C63AB"><enum>(C)</enum><header>Administrative expenses</header><text>Not more than 10 percent of a grant received by a microenterprise development organization for a fiscal year under this paragraph may be used to pay administrative expenses.</text></subparagraph></paragraph></subsection><subsection id="H4D3394F4936949829CE119F23A8C5351"><enum>(c)</enum><header>Administration</header><paragraph id="HB42C3A88DD1E48CD9CB9D5CDF772D2A6"><enum>(1)</enum><header>Cost share</header><subparagraph id="H31C83B95AE7E4CDAA83D6A0C42091E50"><enum>(A)</enum><header>Federal share</header><text>Subject to subparagraph (B), the Federal share of the cost of a project funded under this section shall not exceed 75 percent.</text></subparagraph><subparagraph id="HCFA337BCD9E3470EA9FBF94DA205A420"><enum>(B)</enum><header>Matching requirement</header><text>As a condition of any grant made under this subparagraph, the Secretary shall require the microenterprise development organization to match not less than 15 percent of the total amount of the grant in the form of matching funds, indirect costs, or in-kind goods or services.</text></subparagraph><subparagraph id="H64BBAD44955A4D9AA01B7BDD72415B16"><enum>(C)</enum><header>Form of non-federal share</header><text>The non-Federal share of the cost of a project funded under this section may be provided—</text><clause id="HE705B6E7ECFC4673A16E6CE51732A2AD"><enum>(i)</enum><text>in cash, including through fees, grants (including community development block grants provided by the Department of Housing and Urban Development), and gifts; or</text></clause><clause id="H7415E787CD3448FC99EFC6ECE314E52B"><enum>(ii)</enum><text>in the form of in-kind contributions.</text></clause></subparagraph></paragraph><paragraph id="HF9275E5AAA6B402A84EBC0C9910A9B79"><enum>(2)</enum><header>Oversight</header><text>At a minimum, not later than December 1 of each fiscal year, a microenterprise development organization that receives a loan or grant under this section shall be required to ensure that assistance provided under this section is used for the purposes for which the loan or grant was made.</text></paragraph></subsection><subsection id="H6AC5601741924015B0CE8F3E8709411A"><enum>(d)</enum><header>Funding</header><paragraph id="H49F65139CA35446BA980FE7C2AA96A99"><enum>(1)</enum><header>Mandatory funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $3,000,000 for fiscal year 2022 and each fiscal year thereafter, which shall remain available until expended.</text></paragraph><paragraph id="H29BCC0B7008A49B9A30E68989F107F13"><enum>(2)</enum><header>Discretionary funding</header><text display-inline="yes-display-inline">In addition to amounts made available under paragraph (1), there are authorized to be appropriated to carry out this section $10,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></paragraph></subsection></section><section id="H6782932AC6584E0F855AB8C229215685" section-type="subsequent-section"><enum>202.</enum><header>Community Food Project Grant Program</header><text display-inline="no-display-inline">Section 25(b)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034(b)(2)</external-xref>) is amended—</text><paragraph id="H9AAB5CB728CA4663912DB91D978A09E3"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H0C66B07802DF4A45A32D9871F97C7420"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>and each fiscal year thereafter.</quote> and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HBC6398EE117248479B18A7106B3B4FA7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF9D5EB715F484E1FA0E224E378F5C9FD" style="OLC"><subparagraph id="HB56429E0834E488AB715E126D016437B"><enum>(E)</enum><text display-inline="yes-display-inline">$15,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title></legis-body></bill>
