which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles II and XVIII of the Social Security Act to lower the Medicare eligibility age to 60, and for other purposes.</official-title></form><legis-body id="H8B36505DF04740F9B6DC0CA858C29C19" style="OLC"><section section-type="section-one" id="H3EEDAD6B30FB4F81B32F4888641DC15A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Medicare Coverage Act</short-title></quote>.</text></section><section id="H0C90F0915BE546C4BACBD5C2D3797151"><enum>2.</enum><header>Medicare Eligibility Expansion</header><subsection id="HFA59F54005C34DBABBA48C9A159BD479"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 226 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/426">42 U.S.C. 426</external-xref>) is amended—</text><paragraph id="H11481B5CED7B48EE888D64F899237F27"><enum>(1)</enum><text>by striking <quote>65</quote> each place it appears and inserting <quote>60</quote>; and</text></paragraph><paragraph id="HB2BECEE2883341D8A7F330698903C1FF"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="HB764DF84216842169795AC833C7A12EA"><enum>(A)</enum><text>in paragraph (2)(A)—</text><clause id="H34E329DA2F254075BC528FB98E3D747A"><enum>(i)</enum><text>by inserting <quote>would be entitled to those benefits but for age,</quote> after <quote>section 202,</quote>; and</text></clause><clause id="HAC3E0428858B4F29BDF13AE60F0CC36D"><enum>(ii)</enum><text>by inserting <quote>(not including age)</quote> after <quote>meets all the criteria</quote>; and</text></clause></subparagraph><subparagraph id="H5F5C01107C8A4CEA86D081A71959FB07"><enum>(B)</enum><text>in the matter at the end—</text><clause id="HE8E7B7069CB4450CA46C5CCA491C6EE7"><enum>(i)</enum><text>by inserting <quote>, in the case of an individual who has attained age 65 before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>,</quote> after <quote>beginning with</quote>; and</text></clause><clause id="HBE797436EE5E467B83A1ABE3D84AF0BA"><enum>(ii)</enum><text>by inserting <quote>and, in the case of an individual who has not attained age 65 before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, the first month after the month that is 5 months after such date of enactment for which the individual meets the conditions specified in paragraphs (1) and (2)</quote> after <quote>and (2)</quote>. </text></clause></subparagraph></paragraph></subsection><subsection id="H83953879633F482786E1D4B8C319316A"><enum>(b)</enum><header>Enrollment periods for part B benefits</header><text>Section 1837(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(d)</external-xref>) is amended—</text><paragraph id="H9D994EECF3AF4FDB85CFB9627012B114"><enum>(1)</enum><text>by striking <quote>(d) In the case of</quote> and inserting <quote>(d)(1) Subject to paragraph (2), in the case of</quote>; and</text></paragraph><paragraph id="H0FF237DA533D417687558A59BC349561"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFDABD8DF1C7A43318CAF2E7CEB2C0F6E"><paragraph id="H16F44949D09A4D88AB9BC105FB4F705A" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of an individual described in paragraph (1) who has attained the age of 60 but not attained the age of 65 before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, such individual’s initial enrollment period shall begin on the date that is 3 months after such date of enactment, and shall end on the date that is 11 months after such date of enactment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE0259D8795AF4A9998CAAB6EBA962F53"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H7859AA1A5F854429A6A8F681ADD461B1"><enum>(1)</enum><header>Hospital insurance benefits for the aged</header><text display-inline="yes-display-inline">Section 1811 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395c">42 U.S.C. 1395c</external-xref>) is amended—</text><subparagraph id="HCDF8E64B51E9405B89869DC4728F19E7"><enum>(A)</enum><text>by striking <quote>65</quote> each place it appears and inserting <quote>60</quote>; and</text></subparagraph><subparagraph id="HDE45236FC65E499AB9932C84E4968F52"><enum>(B)</enum><text>by striking <quote>(or would be eligible for such benefits if certain government employment were covered employment under such title)</quote> and inserting <quote>(or would be eligible for such benefits if certain government employment were covered employment under such title, or would be eligible for such benefits but for age)</quote>.</text></subparagraph></paragraph><paragraph id="HED227B71DCD446C9A9C18EE6AA328ED1"><enum>(2)</enum><header>Hospital insurance benefits for uninsured elderly individuals not otherwise eligible</header><text>Section 1818 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-2">42 U.S.C. 1395i–2</external-xref>) is amended—</text><subparagraph id="HCCB93B0420634AB88E6B6D47626C7F53"><enum>(A)</enum><text>in subsection (a)(1), by striking <quote>65</quote> and inserting <quote>60</quote>; and</text></subparagraph><subparagraph id="H2E0D384846D64ABFA9DFAD63DFC42A97"><enum>(B)</enum><text>in subsection (d)—</text><clause id="H9D88A00FFBCC43E381C0EFFBB4D14552"><enum>(i)</enum><text>in paragraph (1), by striking <quote>65</quote> and inserting <quote>60</quote>; and</text></clause><clause id="HD042C35BCE224A40A9E93C72B19B1E7D"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>65</quote> and inserting <quote>60</quote>.</text></clause></subparagraph></paragraph><paragraph id="H3D89E91C5FEA4B119043B9FA5B51704D"><enum>(3)</enum><header>Hospital insurance benefits for disabled individuals who have exhausted other entitlement</header><text>Section 1818A(a)(1) of such Act (42 U.S.C. 1395i–2a(a)(1)) is amended by striking <quote>65</quote> and inserting <quote>60</quote>.</text></paragraph><paragraph id="HD629A903284B4679BDC3C736E996CEA2"><enum>(4)</enum><header>Eligible individuals</header><text>Section 1836(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395o">42 U.S.C. 1395o(2)</external-xref>) is amended by striking <quote>65</quote> and inserting <quote>60</quote>.</text></paragraph><paragraph id="H1B42A9C019E442BAA55FCBAB1105BFD9"><enum>(5)</enum><header>Enrollment periods</header><text display-inline="yes-display-inline">Section 1837 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p</external-xref>), as amended by subsection (b), is further amended by striking <quote>65</quote> each place it appears and inserting <quote>60</quote>.</text></paragraph><paragraph id="H9B02CF08AB1D4638A3E4AC0D82E88545"><enum>(6)</enum><header>Coverage period</header><text>Section 1838 of the such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395q">42 U.S.C. 1395q</external-xref>) is amended—</text><subparagraph id="HD8108919F98B4D3D851E4377418C3A67"><enum>(A)</enum><text>by striking <quote>65</quote> each place it appears and inserting <quote>60</quote>; and</text></subparagraph><subparagraph id="HB19517B35C5D4428A3C141BAA74F3E51"><enum>(B)</enum><text>in subsection (a)(2)—</text><clause id="H9787496FDECE4AAF8D6200DAB004E136"><enum>(i)</enum><text>by striking <quote>subsection (d)</quote> each place it appears and inserting <quote>subsection (d)(1)</quote>;</text></clause><clause id="HE96DC2767F5F4BDC94CA0BBAB75CE9D3"><enum>(ii)</enum><text>in subparagraph (D), by striking <quote>; or</quote> and inserting <quote>, or</quote>; and</text></clause><clause id="H5A0E94B420DF4180BBB2AC98CC8B1B70"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC2C455FD790B480ABFBA6C3EB6AE4440"><subparagraph id="H73DAF7F43AA243BDBD93E44722F25794" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of an individual who enrolls pursuant to subsection (d)(2) of section 1837, on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H574406B8042D4C14A6F9FC8612B416CB"><enum>(7)</enum><header>Amounts of premiums</header><text>Section 1839 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r</external-xref>) is amended—</text><subparagraph id="H474796C7603F4B6987F40721FE8596EE"><enum>(A)</enum><text>in subsection (a)(1)—</text><clause id="H557684F03073402FBF4D285733080AA2"><enum>(i)</enum><text>by striking the first sentence and inserting <quote>The Secretary shall, during September of 1983 through September of 2021, determine the monthly actuarial rate for enrollees age 65 and over which shall be applicable for the succeeding calendar year (including, for 2022, with respect to individuals who enroll pursuant to subsection (d)(2) of section 1837) and, during September of 2022 and of each year thereafter, determine the monthly actuarial value for enrollees age 60 and over which shall be applicable for the succeeding calendar year.</quote>; and</text></clause><clause id="HA59E734EC93F417C9186EBF5A7C5C88A"><enum>(ii)</enum><text>by inserting <quote>(for years before 2023 and with respect to those enrollees age 50 or older (for 2023 and subsequent years)</quote> after <quote>age 60 and older</quote>; </text></clause></subparagraph><subparagraph id="H8AF06FFBB1A2433BB6171FDD047EA052"><enum>(B)</enum><text>in subsection (a)(3)—</text><clause id="H136E928EA01C42CCACBE610EBCC57B52"><enum>(i)</enum><text>by striking <quote>for enrollees age 65 and over, determined according to paragraph (1),</quote> and inserting <quote>determined according to paragraph (1)</quote>; and</text></clause><clause id="H276FAB1056C848ACB9EFC3D948B04D62"><enum>(ii)</enum><text>by striking <quote>age 65 and older</quote>;</text></clause></subparagraph><subparagraph id="H635764AF838544F095F85E35A3BBBE00"><enum>(C)</enum><text>in subsection (a)(4)—</text><clause id="H380AB167492F4BE199C404983E9A838B"><enum>(i)</enum><text>by striking the first sentence and inserting <quote>The Secretary shall, during September of 1983 through September of 2021, determine the monthly actuarial rate for disabled enrollees under age 65 which shall be applicable for the succeeding calendar year and, during September of 2022 and of each year thereafter, determine the monthly actuarial value for disabled enrollees under age 60 which shall be applicable for the succeeding calendar year.</quote>; and</text></clause><clause id="H09254F9774634DB9938A1AFB5FD01085"><enum>(ii)</enum><text>by inserting <quote>(for years before 2023) and with respect to those disabled enrollees under age 60 (for 2023 and subsequent years)</quote> after <quote>to disabled enrollees under age 65</quote>;</text></clause></subparagraph><subparagraph id="H0B22B1838F5F438B9F8C07677BFFA641"><enum>(D)</enum><text>in subsection (b), by inserting <quote>(in the case of an individual who attained the age of 65 before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>) or the age of 60 (in the case of an individual who did not attain the age of 65 before the date that is 6 months after such date of enactment)</quote> after <quote>the age of 65</quote>; </text></subparagraph><subparagraph id="HD85D4E4FB36B4939AB050DE3657ED87E"><enum>(E)</enum><text>in subsection (d), by inserting <quote>(in the case of an individual who attained the age of 65 before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>) or the age of 60 (in the case of an individual who did not attain the age of 65 before the date that is 6 months after such date of enactment)</quote> after <quote>age 65</quote>;</text></subparagraph><subparagraph id="HCDD3F449952747DDA0287956FE178AE6"><enum>(F)</enum><text>in subsection (i)(3)(A), by inserting <quote>(for years before 2023) or for enrollees age 60 and older (for 2023 and subsequent years)</quote> after <quote>age 65 and older</quote>; and</quote> and inserting a period; and </text></subparagraph><subparagraph id="H16037B0528D44A139C6C414A28433318"><enum>(C)</enum><text>by striking subparagraph (D).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6F67D40B76DD4822906553474C1BCCA5"><enum>(d)</enum><header display-inline="yes-display-inline">Eligibility for premium assistance</header><text display-inline="yes-display-inline">Coverage provided under the Medicare program under title XVIII of the Social Security Act pursuant to this section (relating to coverage of individuals who have attained the age of 60 but have not attained the age of 65) shall be treated as coverage under a qualified health plan in the individual market enrolled in through an Exchange where the individual resides for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986 other than subsection (c)(2)(B) thereof.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="H43EEF386DC5948068B2C8571C35934E6"><enum>(e)</enum><header>Automatic enrollment of individuals entitled to part A</header><text>The Secretary of Health and Human Services shall establish procedures to provide for the automatic enrollment of individuals who become entitled to benefits under part A of title XVIII of the Social Security Act as of the date that is 6 months after the date of the enactment of this Act pursuant to this section in descending order of age with enrollment of such individuals beginning not later than 3 months after such date of enactment and completed not later than 11 months after such date of enactment.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="HB6D3237947C44D9D920C86FD8326B152"><enum>(f)</enum><header>Clarification regarding coverage of dependents</header><text>Nothing in this section shall be construed to—</text><paragraph display-inline="no-display-inline" commented="no" id="HAAE7345ECBD7477D823C98C3B9D1F6D1"><enum>(1)</enum><text>provide coverage under the Medicare program of a dependent who is not otherwise eligible for such coverage as an individual; or</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="H8BD787E6B29142EC8139D9A26DC756C1"><enum>(2)</enum><text>affect a dependent’s eligibility under a group health plan, qualified health plan offered on an Exchange, or any other health plan for which the dependent is otherwise eligible.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="H4D1A78F9776B40118351DA90F362BC19"><enum>(g)</enum><header>Clarification of Medicare as secondary payer</header><text>Nothing in this section shall affect the requirements under section 1862(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)</external-xref>) (relating to Medicare as secondary payer).</text></subsection><subsection id="HB4D99D2708EC4595989A81BFB0246B18"><enum>(h)</enum><header>Effective date</header><paragraph id="H51C4C46CD90444ADB4E5102E87B49344"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the amendments made by this section shall take effect on the date that is 6 months after the date of the enactment of this Act.</text></paragraph><paragraph id="H7947374C7C384DB09CD3D2D49653D2C9"><enum>(2)</enum><header>Exceptions</header><text>The amendments made by subsection (b) and subsection (c)(1)(G) shall take effect on the date of enactment of this Act.</text></paragraph></subsection></section><section id="H77CF6C3FD7204061B650B8BE0B917CED"><enum>3.</enum><header>Medicare Cost Assistance Program</header><subsection id="H64DBC2D8EDF647F988D701C1DF2A7007"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4C6F6C88062A42D9B47B9FACB5E20169"><section id="HD949581516CF42FA9B4A7658C2B03250"><enum>1899B.</enum><header>Medicare Cost Assistance Program</header><subsection id="H693A99CAE9E04BC5A517BE7A9B153579"><enum>(a)</enum><header>In general</header><text>Effective beginning on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, in the case of a Medicare Cost Assistance Program eligible individual (as defined in subsection (b)(1)), the Secretary shall provide Medicare cost assistance for the following costs incurred with respect to the individual:</text><paragraph id="HE49A10241A9F48F4B4C7E87CF254F137"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H25A9C1FE233149A5B4D48EB4B9244E77"><enum>(A)</enum><text>premiums under section 1818; and</text></subparagraph><subparagraph indent="up1" id="H0ADD36112D884D479B68744D356762C1"><enum>(B)</enum><text>premiums under section 1839.</text></subparagraph></paragraph><paragraph id="H3CDE752DD6114E7895316EADD1389B7B"><enum>(2)</enum><text>Coinsurance under this title (including coinsurance described in section 1813).</text></paragraph><paragraph id="H412B8DC51FFB40BBB1EDDAD0F5849D30"><enum>(3)</enum><text>Deductibles established under this title (including those described in section 1813 and section 1833(b)).</text></paragraph><paragraph id="H26B4B78636ED49AE8BBE2F99037533CD"><enum>(4)</enum><text>The difference between the amount that is paid under section 1833(a) and the amount that would be paid under such section if any reference to a percent less than 100 percent therein were deemed a reference to <quote>100 percent</quote>.</text></paragraph></subsection><subsection id="HB6E20E2FB2DF458CBC73101B1578C9BB"><enum>(b)</enum><header>Determination of eligibility</header><paragraph id="HC3B6181AA92346CD917427F68DAFCE39"><enum>(1)</enum><header>Medicare Cost Assistance Program eligible individual defined</header><text>The term <term>Medicare Cost Assistance Program eligible individual</term> means an individual who—</text><subparagraph id="H8DBA9A94F0C14C65A9DE1578F33BE263"><enum>(A)</enum><text>is eligible for and is receiving medical assistance for the payment of medicare cost-sharing under a State Medicaid program pursuant to clause (i), (iii), or (iv) of section 1902(a)(10)(E) as of the day prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>; or</text></subparagraph><subparagraph id="HCA53AD21E057430A9159125A58042B40"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HDCCEAF77B782403AAF82EFC794350199"><enum>(i)</enum><text>is entitled to hospital insurance benefits under part A (including an individual entitled to such benefits pursuant to an enrollment under section 1818); and</text></clause><clause id="HB8D2D917A2114279ACD032306FEA8B85" indent="up1"><enum>(ii)</enum><text>has income at or below 200 percent of the poverty line applicable to a family of the size involved. </text></clause></subparagraph></paragraph><paragraph id="H4CEF48F322414EBC931EEA2AA40214A2"><enum>(2)</enum><header>Joint determination by Commissioner of Social Security for LIS and Medicare cost assistance</header><subparagraph id="H450FD10B6A2442EA89CD1A93A3A666AA"><enum>(A)</enum><header>In general</header><text>The determination of whether an individual is a Medicare Cost Assistance Program eligible individual described in paragraph (1) shall be determined by the Commissioner of Social Security jointly with the determination of whether an individual is a subsidy eligible individual described in section 1860D–14(a)(3). Such determination shall be made with respect to eligibility for Medicare cost assistance under this section and premium and cost-sharing subsidies under section 1860D–14 upon application of an individual for a determination with respect to eligibility for either such assistance or such subsidies. There are authorized to be appropriated to the Social Security Administration such sums as may be necessary for the determination of eligibility under this paragraph.</text></subparagraph><subparagraph id="H2A7224CC51F04E25B2EEFC601548548F"><enum>(B)</enum><header>Effective period</header><text>Determinations under this paragraph with respect to eligibility for each of such assistance or such subsidies shall be effective beginning with the month in which the individual applies for a determination described in subparagraph (A) and shall remain in effect until such time as the Secretary determines the individual is no longer eligible as determined under subparagraph (C)(ii).</text></subparagraph><subparagraph id="H1B8A03E182B0427A81B683B426D766BB"><enum>(C)</enum><header>Redeterminations</header><text>With respect to eligibility determinations under this paragraph—</text><clause id="H8F1757103708462BBC16CD49E834C0E7"><enum>(i)</enum><text>redeterminations shall be made at the same time with respect to eligibility for Medicare cost assistance under this section and cost-sharing subsidies under section 1860D–14, but not more frequently than once every 12 months;</text></clause><clause id="H794C32AD0240439DB497A0599728D85A"><enum>(ii)</enum><text>a redetermination shall automatically determine that an individual remains eligible for such assistance or subsidies unless—</text><subclause id="H15E3A58D1C4B4E3380F63D69A682D559"><enum>(I)</enum><text>the Commissioner has information indicating that the individual's circumstances have changed such that the individual is no longer eligible for such assistance or subsidies; </text></subclause><subclause id="H24A95012F77D42F2A15200019B4178D4"><enum>(II)</enum><text>the Commissioner sends notice to the individual regarding such information that requests a response either confirming or correcting such information; and</text></subclause><subclause id="HD00EF648ABEF419F856CC2F80CBBE037"><enum>(III)</enum><text>the individual either confirms such information or fails to provide documentation indicating that such circumstances have not changed within 60 days of receiving the notice described in subclause (II);</text></subclause></clause><clause id="HD514297BCC264BAD84A13746B341428A"><enum>(iii)</enum><text>the Commissioner shall establish procedures for appeals of such determinations that are similar to the procedures described in the third sentence of section 1631(c)(1)(A); and</text></clause><clause id="H76E3E062604948B7BE3BE5D9B38170A9"><enum>(iv)</enum><text>judicial review of the final decision of the Commissioner made after a hearing shall be available to the same extent, and with the same limitations, as provided in subsections (g) and (h) of section 205.</text></clause></subparagraph><subparagraph id="H0832DB2BF30D459BB6FFFB351F4DE6BB"><enum>(D)</enum><header>Treatment of medicaid beneficiaries</header><text>The Secretary shall provide that individuals who are full-benefit dual eligible individuals (as defined in section 1935(c)(6)) or who are recipients of supplemental security income benefits under title XVI shall be treated as a Medicare Cost Assistance Program eligible individual described in paragraph (1) and, in the case of such individual who is a part D eligible individual, a subsidy eligible individual described in section 1860D–14(a)(3).</text></subparagraph><subparagraph id="H7AA2B09BF3604877AC1758A2ABDD3B37"><enum>(E)</enum><header>Simplified application form</header><clause id="H005D99CEBB2E46B5ACA7421604F33DF2"><enum>(i)</enum><header>In general</header><text>The Secretary shall develop and distribute a simplified application form for use by individuals in applying for Medicare cost assistance under this section and premium and cost-sharing subsidies under section 1860D–14. Such form shall be easily readable by applicants and uniform nationally. The Secretary shall provide for the translation of such application form into at least the 10 languages (other than English) that are most often used by individuals applying for hospital insurance benefits under section 226 or 226A and shall make the translated forms available to the Commissioner of Social Security.</text></clause><clause id="HB13FBB4FE6724EFFB533058078BDD97A"><enum>(ii)</enum><header>Consultation</header><text>In developing such form, the Secretary shall consult with beneficiary groups. </text></clause></subparagraph></paragraph><paragraph id="H983FF3040EC24DB5AF55B1700ACD5070"><enum>(3)</enum><header>Income determinations</header><text>For purposes of applying this section—</text><subparagraph id="H8D667181E14B46AE97F874E8DF18745A"><enum>(A)</enum><text>in the case of an individual who is not treated as a Medicare Cost Assistance Program eligible individual or a subsidy eligible individual under paragraph (2)(D), income shall be determined in the manner described under section 1612 for purposes of the supplemental security income program, except that support and maintenance furnished in kind shall not be counted as income; and</text></subparagraph><subparagraph commented="no" id="HC2A04E9F83604551B6739A07E5104A45"><enum>(B)</enum><text>the term <term>poverty line</term> has the meaning given such term in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>), including any revision required by such section.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HA99525A1F9F34C4692B70F0E5BAD7920"><enum>(c)</enum><header>Beneficiary protections</header><paragraph id="H962EC3BADB5A4B4B81FFAECE5EDB5492"><enum>(1)</enum><header>In general</header><text>In the case in which the payment for Medicare cost assistance for a Medicare Cost Assistance Program eligible individual with respect to an item or service is reduced or eliminated the individual shall not have any legal liability to make payment to a provider of services or supplier or to an organization described in section 1903(m)(1)(A) for the service, and any lawful sanction that may be imposed upon a provider of services or supplier or such an organization for excess charges under this title or title XIX shall apply to the imposition of any charge imposed upon the individual in such case.</text></paragraph><paragraph id="HD08E14DC4D35448EAC18B19AFAD72B04"><enum>(2)</enum><header>Clarification</header><text>This paragraph shall not be construed as preventing payment of any medicare cost assistance by a medicare supplemental policy or an employer retiree health plan on behalf of an individual.</text></paragraph></subsection><subsection commented="no" id="HFC2E4B3DA1FA48AF8E492FFAAEAC956A"><enum>(d)</enum><header>Administration</header><paragraph commented="no" id="H3C402420D0994A819DF182A09B5C6DA7"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish procedures for the administration of the program under this section.</text></paragraph><paragraph commented="no" id="H34D55BF5991947A6BCA8E0C738BE6FD9"><enum>(2)</enum><header>Funding</header><text>For purposes of carrying out this section, the Secretary shall make payments from the Federal Hospital Insurance Trust Fund under section 1817 and the Federal Supplementary Medical Insurance Trust Fund under section 1841, in such proportion as the Secretary determines appropriate, of such amounts as the Secretary determines necessary to provide Medicare cost assistance under this section.</text></paragraph></subsection><subsection commented="no" id="HD70D1FC14EA348E39F8F4C587CB79C66"><enum>(e)</enum><header>References to medicare cost-Sharing</header><text>Effective beginning on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, any reference to medicare cost-sharing described in section 1905(p) shall be deemed a reference to Medicare cost assistance under this section.</text></subsection><subsection id="H46F438BA1B1941449A0E5EC1944211EC"><enum>(f)</enum><header>Outreach efforts</header><text>For provisions relating to outreach efforts to increase awareness of the availability of Medicare cost assistance, see section 1144.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAF00CFDAF22E4F5F8FD6B26395BA02F9"><enum>(b)</enum><header>Special enrollment period</header><paragraph id="HD336AC6E883346119827B8EEF85FA59A"><enum>(1)</enum><header>No premium penalty</header><text>Section 1839(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(b)</external-xref>) is amended, in the last sentence, by inserting the following before the period: <quote>or, effective beginning on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, for individuals who are Medicare Cost Assistance Program eligible individuals (as defined in section 1899B(b)(1)).</quote>.</text></paragraph><paragraph id="HA2B81723315C4CCB8AA104E13E2720E1"><enum>(2)</enum><header>Special enrollment period</header><text>Section 1837 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H36933F3D6010494295ADB766745C5785"><subsection id="H51489E6D99B04F0586ECE7F6BEE0F549"><enum>(o)</enum><header>Special enrollment period for Medicare Cost Assistance Program eligible individual</header><paragraph id="H3EDC69A2BD314B8AABFBBBCE5116BC1A"><enum>(1)</enum><header>In general</header><text>Effective beginning on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, the Secretary shall establish special enrollment periods for Medicare Cost Assistance Program eligible individuals (as defined in section 1899B(b)(1)).</text></paragraph><paragraph id="HCA4888E3E09D4061ACBEF710A69843E0"><enum>(2)</enum><header>Coverage period</header><text>In the case of an individual who enrolls during the special enrollment period provided under paragraph (1), the coverage period under this part shall—</text><subparagraph id="HA44BA8AAC41C4418992462DE85D1A208" commented="no"><enum>(A)</enum><text>begin on the first day of the first month in which the individual applies for a determination under section 1899B(b)(2)(A); and</text></subparagraph><subparagraph id="H75DBF5F23ED44BB89D3C8EA6E972DF89" commented="no"><enum>(B)</enum><text>remain in effect until such time as the Secretary determines the individual no longer eligible as determined under section 1899B(b)(2)(C)(ii).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H3EF967BD105E4A689DCC40230BC7C1E5" commented="no"><enum>(3)</enum><header>Conforming sunset of State agreements relating to enrollment of qualified medicare beneficiaries</header><subparagraph id="H16DF8586EEA348BA9B3480B88479240F"><enum>(c)</enum><header>Public awareness campaign</header><text>Section 1144 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-14">42 U.S.C. 1320b–14</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA58C23181ED145D5BA225DFB8389A862"><subsection id="H7209F303C4494F10A24E20BD6E04C3E9"><enum>(d)</enum><header>Public awareness campaign</header><paragraph id="HB8AFC52C377748CD8C426FB6CCD1B647"><enum>(1)</enum><header>In general</header><text>The Commissioner shall conduct a public awareness campaign to educate Medicare beneficiaries on the availability of Medicare cost assistance for low-income individuals under section 1899B.</text></paragraph><paragraph id="HBF2C87F69034406A91B0481D5B97120D"><enum>(2)</enum><header>Coordination</header><text>In carrying out such public awareness campaign, the Commissioner shall coordinate with State health insurance assistance programs described in subsection (a)(1)(A) of section 119 of the Medicare Improvements for Patients and Providers Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395b-3">42 U.S.C. 1395b–3</external-xref> note), the Administrator of the Administration for Community Living, and the Administrator of the Centers for Medicare &amp; Medicaid Services.</text></paragraph><paragraph id="HC765356FA5194AEAB59AB4D6F9F832CE"><enum>(3)</enum><header>Funding</header><text>There are hereby appropriated to the Commissioner, out of any funds in the Treasury not otherwise appropriated, $10,000,000 for each of fiscal years 2022 through 2024, to provide grants to State health insurance assistance programs to carry out outreach and education activities under the public awareness campaign pursuant to this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0A322BC56BC94E1487EF6741B96221CC"><enum>4.</enum><header>Moving Medicare cost-sharing benefits from Medicaid to Medicare</header><subsection id="HAE658CBCCEFB4872A331B2E6E0FF2645"><enum>(a)</enum><header>Ending most Medicare cost-Sharing benefits under Medicaid</header><text>Section 1902(a)(10) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref>) is amended—</text><paragraph id="H66C291CA4A164A3DA47AA43460C9DBDE"><enum>(1)</enum><text>by inserting <quote>for calendar quarters beginning before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>,</quote> before <quote>for making</quote> each place it appears in clauses (i), (iii), and (iv) of subparagraph (E); and</text></paragraph><paragraph id="H01077F57FBB84C09A466F384B584FC07"><enum>(2)</enum><text>in the matter following subparagraph (G)—</text><subparagraph id="H269FD9EF7A664834A510A1523C153C89"><enum>(A)</enum><text>by inserting <quote>furnished during calendar quarters beginning before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title></quote> after <quote>(described in section 1905(p)(3))</quote>;</text></subparagraph><subparagraph id="HCA2E31DA56034820A39ED414E3938ECB"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H8A1D2111246743209F58F8D826674846"><enum>(1)</enum><header>Title XIX</header><subparagraph id="HB0BBB9E5F60A4D548B6D8EE03E37B414"><enum>(A)</enum><text>Section 1903(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended— </text><clause id="HD258519B88EC4BA4B51835FF6C644014"><enum>(i)</enum><text>in paragraph (26), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HC4E01053E4B34DD988BBB3BAEC2A2742"><enum>(B)</enum><text>Section 1905(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the first sentence, by inserting <quote>furnished during calendar quarters beginning before the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title></quote> after <quote>medicare cost-sharing</quote>.</text></subparagraph><subparagraph id="H89F99B02ACC64271A64042675686280D"><enum>(C)</enum><text>Section 1933(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-3">42 U.S.C. 1396u–3(g)</external-xref>) is amended—</text><clause id="HD5D58BAC57954C50AFAD209322370B6E"><enum>(i)</enum><text>in paragraph (2)(Q), by striking <quote>paragraph (4), for each subsequent year</quote> and inserting <quote>paragraphs (4) and (5), for each subsequent year (prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title></quote>; and</text></clause><clause id="HACD227C5C8CC42F7AEAB1530F0400C5B"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA843B8B775BF46E9AA8E96FB40305FA0"><paragraph id="H3505429FEAF240F7AB66C7E6AB8A17F2"><enum>(5)</enum><header>Sunset</header><text>No individual shall be selected to be a qualifying individual for any calendar year or period under this section beginning on or after the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, and no State allocation shall be made for any fiscal year or period under this section beginning on or after the date that is 6 month after such date of enactment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF5BBF0EF9F71421DB275BE2253A14C35"><enum>(D)</enum><text>Section 1935(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5(a)</external-xref>) is amended—</text><clause id="H33A04E19DA984ED6863FEB79A00C5731"><enum>(i)</enum><text>in paragraph (2), by striking <quote>make determinations</quote> and inserting <quote>prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, make determinations</quote>; and</text></clause><clause id="H499E6A684AD04711AE301CF1F3D1B0E7"><enum>(ii)</enum><text>in paragraph (3), by inserting <quote>prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>,</quote> before <quote>the State shall</quote>.</text></clause></subparagraph></paragraph><paragraph id="H48F6A5253FCA4D7DAA774D28E5E9AE7D"><enum>(2)</enum><header>Title XI</header><text>Section 1144 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-14">42 U.S.C. 1320b–14</external-xref>) is amended—</text><subparagraph id="H84B3663B68B0408587F7523F6B7C32AB"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H37673907E13F4B008DB3D1ABF13F8AB0"><enum>(i)</enum><text>in paragraph (1)(A)—</text><subclause id="H468629B2DB3B4AA5A5832DAD9E617E5B"><enum>(I)</enum><text>by striking <quote>sections 1902(a)(10)(E) and 1933</quote> and inserting <quote>section 1902(a)(10)(E) and (prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage paragraph (1) shall state that eligibility for such medical assistance, subsidies, or program is conditioned upon meeting the applicable eligibility criteria.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H9503699FFBD648DE8FCD7D8EF1051E91"><enum>(B)</enum><text>in subsection (b)(1)(A)—</text><clause id="HC988531E771941E1B7F528B003214F81"><enum>(i)</enum><text>by striking <quote>sections 1902(a)(10)(E) and 1933</quote> and inserting <quote>section 1902(a)(10)(E) and (prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>) section 1933</quote>; </text></clause><clause id="HECCBC017BA2443A99B324A2C16F36BF0"><enum>(ii)</enum><text>in paragraph (2), in the paragraph header, by inserting <quote><header-in-text style="traditional" level="paragraph">medicare savings program application and</header-in-text></quote> before <quote><header-in-text style="traditional" level="paragraph">lis application</header-in-text></quote>; and</text></clause><clause id="HC27FA36BACA04F8B9856FB1B5EC7AC75"><enum>(iii)</enum><text>in paragraph (7), by striking <quote>means the program of medical assistance</quote> and all that follows through the period and display-inline="yes-display-inline">prior to the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, the program of medical assistance for payment of the cost of medicare cost-sharing under the Medicaid program pursuant to sections 1902(a)(10)(E) and 1933; and</text></subparagraph><subparagraph id="H7BA146A6D9894E9F9FBDF124CD70725C"><enum>(B)</enum><text display-inline="yes-display-inline">beginning on the date that is 6 months after the date of the enactment of the <short-title>Improving Medicare Coverage Act</short-title>, the program for medical assistance for payment of the cost of medicare cost-sharing for qualified disabled and working individuals described in section 1905(s) pursuant to section 1902(a)(10)(E)(ii) and medicare premium and cost-sharing assistance provided under section 1899B.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="HEFDA2E4E1A6B4215AA5C809DAFE9B4F5" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Ensuring that Medicare cost-Sharing beneficiaries under Medicaid receive Medicare cost assistance</header><text>Not later than 3 months after the date of the enactment of this Act, the Secretary of Health and Human Services and the Commissioner of Social Security shall jointly develop and implement a transition plan to ensure that all individuals who are eligible for and are receiving medical assistance for the payment of medicare cost-sharing under a State Medicaid program pursuant to clauses (i), (iii), and (iv) of section 1902(a)(10)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(E)</external-xref>) as of the day prior to the date that is 6 months after the date of the enactment of this Act, receive Medicare cost assistance under section 1899B of such Act, as added by section 3, as of the date that is 6 months after such date of enactment.</text></subsection></section><section id="HB7094453541D4F188E1D3AC5D521F3C6" commented="no"><enum>5.</enum><header>Enhancing prescription drug affordability by expanding access to assistance with out-of-pocket costs under Medicare part D for low-income seniors and individuals with disabilities</header><subsection id="H64ECB7357E1942A8A87B1B86D0AB08DC"><enum>(a)</enum><header>Expanding access</header><text display-inline="yes-display-inline">Section 1860D–14 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114</external-xref>) is amended—</text><paragraph id="H29FAB78EC5B7455596A5D1397D7867DC"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H688D23C3D69A4A70BC747FE4E49E0135"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">150 percent</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">200 percent</header-in-text></quote>;</text></subparagraph><subparagraph inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3CA44B11363C4A88BFBE88EB4642A438"><subparagraph display-inline="no-display-inline" commented="no" id="HB8C0D91FC8724DA3A445108031446EE9"><enum>(B)</enum><header>Determinations</header><text>For provisions relating to joint determinations with respect to eligibility for Medicare cost assistance under section 1899B and premium and cost-sharing subsidies under this section, see section 1899B(b)(2).</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="H5F7E957B55F443C3B0C1492A39A43FAA"><enum>(C)</enum><header>Income determinations</header><text>For purposes of applying this section—</text><clause id="H5738B81C0F9049B1A6EF3047DD542CD6"><enum>(i)</enum><text>in the case of an individual who is not treated as a Medicare cost-sharing assistance eligible individual and a subsidy eligible individual under section 1899B(b)(2)(D), income shall be determined in the manner described under section 1612 for purposes of the supplemental security income program, except that support and maintenance furnished in kind shall not be counted as income; and</text></clause><clause commented="no" id="HE1C6B40102FD479882F4F6D8991A83CA"><enum>(ii)</enum><text>the term <term>poverty line</term> has the meaning given such term in section 673(2) of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902(2)</external-xref>), including any revision required by such section. </text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="H2A25347F431C44D78966BF870356AAE7"><enum>(iii)</enum><text>by striking subparagraphs (D), (E), and (G); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H149143FEB33F4519857221DB282A6A6A"><enum>(E)</enum><text>in paragraph (4), by striking subparagraph (B); and</text></subparagraph></paragraph><paragraph 1860D–14(a)(1)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(1)(D)</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" commented="no" id="H6614C0BB485E4C4B82316C0E2B2ABEAF"><enum>(1)</enum><text>by striking <quote>who would be such an institutionalized individual or couple, if the full-benefit dual eligible individual were not</quote>; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HB435C9AF5667478289A9CD32873422DA"><enum>(2)</enum><text>by striking <quote>or subsection (c) or (d) of section 1915 or under a State plan amendment under subsection (i) of such section</quote> and inserting <quote>, section 1115A, section 1915, or under a State plan amendment</quote>.</text></paragraph></subsection><subsection id="HBC2CD99169E4424CB5081ABC6519689D" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning on or after the date that is 6 months after the date of the enactment of this Act, and apply on or after such date.</text></subsection></section><section display-inline="no-display-inline" commented="no"
