which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish an Office of Native American Affairs within the Small Business Administration, and for other purposes.</official-title></form><legis-body id="H0777E676DD7143DFB80D5C780119BDE4" style="OLC"><section id="H7B01B81D6CEB412DA99A7EA4B3558D6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Entrepreneurial Opportunity Act</short-title></quote>.</text></section><section id="HC73B2F99903A49F3B3575C81CB91A50F"><enum>2.</enum><header>Office of Native American Affairs</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text><paragraph id="H7723BD1514124E7CA857E013B4E34541"><enum>(1)</enum><text>by redesignating section 49 (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) as section 50; and</text></paragraph><paragraph id="H9DDF496DD81942EE91FF9D8C6D7DA1DF"><enum>(2)</enum><text>by inserting after section 48 (<external-xref legal-doc="usc" parsable-cite="usc/15/657u">15 U.S.C. 657u</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H031599168FBA423498BD865CC981D9A3"><section id="H3D4F1E68DAA24BCEA55DEF2E8AE26733"><enum>49.</enum><header>Office of Native American Affairs</header><subsection id="H6573737C62C0450DA491E332EEE8D8C6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBFB85AA693794C18BD2CEC469B940FD3"><enum>(1)</enum><header>Associate Administrator</header><text>The term <term>Associate Administrator</term> means the Associate Administrator for Native American Affairs appointed under subsection (c).</text></paragraph><paragraph id="H9E7894E043384E8F9C13EE8CA81F3EB7"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 8(a)(13). </text></paragraph><paragraph id="H67AE9DE1602843D6BCBF6AED4F9F8425"><enum>(3)</enum><header>Native Hawaiian Organization</header><text>The term <term>Native Hawaiian Organization</term> has the meaning given the term in section 8(a)(15).</text></paragraph><paragraph id="H4423407AD11F4095A593C38811E3E771"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Native American Affairs described in this section.</text></paragraph></subsection><subsection id="H6D9CE2AA110245549839357B6D2F1C19"><enum>(b)</enum><header>Establishment</header><paragraph id="H7EFAED67CEE24BF4986EA0B09C06BEB8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established within the Administration the Office of Native American Affairs, which shall be responsible for establishing a working relationship with Indian Tribes and Native Hawaiian Organizations by targeting programs of the Administration relating to entrepreneurial development, contracting, and capital access to revitalize small business concerns owned and controlled by individuals who are members of Indian Tribes or Native Hawaiian Organizations and economic development in Indian country. </text></paragraph><paragraph id="H0AEEBCCC6D0C437E9948C06029CCEAC7"><enum>(2)</enum><header>Connection with other programs</header><text>To the extent reasonable, the Office shall connect Indian Tribes and Native Hawaiian Organizations to programs administered by other Federal agencies related to the interests described in paragraph (1). </text></paragraph><paragraph id="H108C4A6E70C74E3D851017B03DCF48E3"><enum>(3)</enum><header>Field offices</header><text>The Office may establish field offices within such regional offices of the Administration as may be necessary, with initial focus on those parts of Indian Country most economically disadvantaged, to perform efficiently the functions and responsibilities of the Office. </text></paragraph></subsection><subsection id="H0E174EF9F9EE4FFE84B30735204895CE"><enum>(c)</enum><header>Associate Administrator</header><text>The Office shall be headed by an Associate Administrator for Native American Affairs, who shall—</text><paragraph id="H206933E7DCC642238DE1A4777C12621F"><enum>(1)</enum><text>be appointed by and report to the Administrator;</text></paragraph><paragraph id="H250EECED8CE3498AA2CA9EC7A92E02B3"><enum>(2)</enum><text>have knowledge of Native American cultures and experience providing culturally tailored small business development assistance to Native Americans; </text></paragraph><paragraph id="HD8358F4DF38A4B748298DA7ACEEFA7AF"><enum>(3)</enum><text>carry out the program to provide assistance to Indian Tribes and Native Hawaiian Organizations and small business concerns owned and controlled by individuals who are members of those groups;</text></paragraph><paragraph id="HE724E10848AA4FD281E35E2B33E37364"><enum>(4)</enum><text>administer and manage Native American outreach expansion;</text></paragraph><paragraph id="H2FE42B8F5DA04C1C8D3FF4A6FB8F2864"><enum>(5)</enum><text>enhance assistance to Native Americans by formulating and promoting policies, programs, and assistance that better address their entrepreneurial, capital access, business development, and contracting needs, and collaborate with other Associate Administrators and intergovernmental leaders with similar missions across Federal agencies on the development of policies and plans to implement new programs of the Administration, while supplementing existing Federal programs to holistically serve those needs; </text></paragraph><paragraph id="HAE0B9A2B20BF4F69B7604DDDBB438BDA"><enum>(6)</enum><text>act as an ombudsman for Native Americans for programs of the Administration; </text></paragraph><paragraph id="HBA657AB508BE4FC9927D1ED2C5C0E8CB"><enum>(7)</enum><text>provide grants, contracts, cooperative agreements, or other financial assistance to Indian Tribes and Native Hawaiian Organizations, or to private nonprofit organizations governed by members of those entities, that have the experience and capability to—</text><subparagraph id="H86790D6050DA449889DB5FE4BAEB6FE7"><enum>(A)</enum><text>deploy training, counseling, workshops, educational outreach, and supplier events; and</text></subparagraph><subparagraph id="H23110D45D5804275B7559AD0A9863601"><enum>(B)</enum><text>access the entrepreneurial, capital, and contracting programs of the Administration, including the Community Navigator pilot program; </text></subparagraph></paragraph><paragraph id="HDC850840FA0343398A808DCE9B25D58C"><enum>(8)</enum><text>assist the Administrator in conducting, or conduct, Tribal consultation to solicit input and facilitate discussion of potential modifications to programs and procedures of the Administration; and </text></paragraph><paragraph id="H6A1ABE19BE4F4B85BCCA0BFE42138D7A"><enum>(9)</enum><text>recommend annual budgets for the Office. </text></paragraph></subsection><subsection id="H56FEF3A5682F491AAB4A817379A35F10"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Office to carry out this section $5,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
