R. 5154</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210903">September 3, 2021</action-date><action-desc><sponsor name-id="B001309">Mr. Burchett</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit commercial DNA testing services from disclosing the genetic information of United States nationals to foreign entities, and for other purposes.</official-title></form><legis-body id="HBEBC857260D243FA8453DBC1F894865E" style="OLC"><section id="H2876ABF9F4444CFAA2E5EE84063EF3C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Genetic Privacy Act of 2021</short-title></quote>.</text></section><section id="H2AF285DD486D41FD9A3AC06AC2179A84"><enum>2.</enum><header>Prohibition on disclosing genetic information to China</header><subsection id="H90E2C6D55A7642859914BE9A3E2DF840"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A commercial DNA testing service may not disclose the genetic information of any individual, or any aggregate of such information, to the People’s Republic of China, or to any entity under the influence, control, or ownership of the People’s Republic of China.</text></subsection><subsection id="H5045BA37981549AB820E6C3671289690"><enum>(b)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H3402F45FF7F54D859F52E64BE2EE6EFA"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="H0F30FA8A6E2A4152A1BB9A147C9F33A7"><enum>(2)</enum><header>Powers of Commission</header><text>The Federal Trade Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made part of this section. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="HAA8493F5AF934526B6AAFB3504884E53"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF071F8A3EDAC498680746E0911CD8947"><enum>(1)</enum><header>Commercial DNA testing service</header><text display-inline="yes-display-inline">The term <term>commercial DNA testing service</term> means any person that provides genealogical or ancestry-related information based on an individual’s DNA. </text></paragraph><paragraph id="HE246A5FEC5BA4579A34E8EFA0B5BB510"><enum>(2)</enum><header>Genetic information</header><text>The term <term>genetic information</term> means, with respect to any individual, information about such individual’s genetic tests. </text></paragraph><paragraph id="H527B13100A55420F9D79673E0D3F9B44"><enum>(3)</enum><header>Genetic test</header><text>The term <term>genetic test</term> has the meaning given such term by section 201 of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/233">Public Law 110–233</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
