Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide for a phaseout of the investment income excise tax for certain private colleges and universities, and for other purposes.</official-title></form><legis-body id="H178E13F38A46438AB88DA07E46C6FE8A" style="OLC"><section id="H5309DCBDBB79437ABD82517585FCE76C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Endowment Tax Reform Act</short-title></quote>.</text></section><section id="HBA0CFA6B28B448B3B582AA056B3656E2" section-type="subsequent-section"><enum>2.</enum><header>Phaseout of investment income excise tax for private colleges and universities providing sufficient grants and scholarships</header><subsection id="H80EA0C0F7A294440A0E5792448C81D73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4968">Section 4968</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HF0D8E5BE162143D89B4BCB58E283CC94" display-inline="no-display-inline"><subsection id="HF072EFB223AA438D95FFFAD9536A8E5B"><enum>(e)</enum><header>Phaseout for institutions providing qualified aid</header><paragraph id="HF7823CD137CF471F921806F4C911E641"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amount of tax imposed by subsection (a) (determined without regard to this subsection) shall be reduced (but not below zero) by the amount which bears the same ratio to such amount of tax (as so determined) as—</text><subparagraph id="H8F262A7D03BF4E179C0FF91FE0BD9A48"><enum>(A)</enum><text>the excess (if any) of—</text><clause id="H379E6ABB8DC84311A17716E4EAAB3E0D"><enum>(i)</enum><text>the aggregate amount of qualified aid awards provided by the institution to its first-time, full-time undergraduate students for academic periods beginning during the taxable year, over</text></clause><clause id="HBFE455D052C044999CEA93D831B561F8"><enum>(ii)</enum><text>an amount equal to 20 percent of the aggregate undergraduate tuition and fees received by the institution from first-time, full-time undergraduate students for such academic periods, bears to</text></clause></subparagraph><subparagraph id="H51624F5AC1C64DB688B20BC1AB562053"><enum>(B)</enum><text>an amount equal to 13 percent of such aggregate undergraduate tuition and fees so received.</text></subparagraph></paragraph><paragraph id="H1C88DBDEDFBE4F6DB3EE4B842BEF21A2"><enum>(2)</enum><header>Institution must meet reporting requirement</header><subparagraph id="H92C3D2C86A054ECF87D1BDD31D7A640C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to an applicable educational institution for a taxable year unless such institution furnishes to the Secretary, and makes widely available, a statement detailing the average aggregate amount of Federal student loans received by a student for attendance at the institution, averaged among each of the following groups of first-time, full-time undergraduate students who during the taxable year completed a course of study for which the institution awarded a baccalaureate degree:</text><clause id="H66C81E1A7FC84315A91286F06231848F"><enum>(i)</enum><text>All such students.</text></clause><clause id="HA68B3B6A2CE14A10B276D1DC8C5A3627"><enum>(ii)</enum><text display-inline="yes-display-inline">The students who have been awarded a Federal Pell Grant under subpart 1 of part A of title IV of the Higher Education Act of 1965 for attendance at the institution.</text></clause><clause id="HB8A482C15B044BE19086F26797B9606D"><enum>(iii)</enum><text>The students who received work-study assistance under part C of title IV of such Act for attendance at such institution.</text></clause><clause id="H2CB1E3C8B2364A90A003AB4F6D113E38"><enum>(iv)</enum><text>The students who were provided such Federal student loans.</text></clause></subparagraph><subparagraph id="H88F274351C564FEF92A08387DE46C338"><enum>(B)</enum><header>Form and manner for report</header><text>Such statement shall be furnished at such time and in such form and manner, and made widely available, under such regulations or guidance as the Secretary may prescribe.</text></subparagraph><subparagraph id="HC5029F46342F4AFAA875B2A060FD1E91"><enum>(C)</enum><header>Federal student loans</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <quote>Federal student loans</quote> means a loan made under part D of title IV of the Higher Education Act of 1965, except such term does not include a Federal Direct PLUS Loan made on behalf of a dependent student.</text></subparagraph></paragraph><paragraph id="HF3B5A26839224FEEA46295B8609DB8B7"><enum>(3)</enum><header>Other definitions</header><text display-inline="yes-display-inline">For purposes of this subsection—</text><subparagraph id="HA618402BC0C04B0C9B4915879614599D"><enum>(A)</enum><header>First-time, full-time undergraduate student</header><text display-inline="yes-display-inline">The term <quote>first-time, full-time undergraduate student</quote> shall have the same meaning as when used in section 132 of the Higher Education Act of 1965.</text></subparagraph><subparagraph id="H1CB6A9768D874CED8AC34876178B2E2F"><enum>(B)</enum><header>Qualified aid awards</header><text display-inline="yes-display-inline">The term <quote>qualified aid awards</quote> means, with respect to any applicable educational institution, grants and scholarships to the extent used for undergraduate tuition and fees. </text></subparagraph><subparagraph id="HE632069335A74050B95DD6285161E6D9"><enum>(C)</enum><header>Undergraduate tuition and fees</header><text display-inline="yes-display-inline">The term <quote>undergraduate tuition and fees</quote> means, with respect to any institution, the tuition and fees required for the enrollment or attendance of a student as an undergraduate student at the institution.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H82CFF0101A43467193A8F5C19EF0E745"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after ….</text></subsection></section><section id="HFA5AD0D3FC9043F7A28C6BD77D5B67FE"><enum>3.</enum><header>Inflation adjustment and clarification for definition of applicable educational institution</header><subsection id="H302CB5EEFC9E4CB4AFA44887B17B85A3"><enum>(a)</enum><header>Inflation adjustment to per student asset threshold</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/4968">Section 4968(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H62DF5C8E55CC434B98433D1F81B14DA0" display-inline="no-display-inline"><paragraph id="HA56B4BAC4F724487A1B4AD51DF6E1106"><enum>(3)</enum><header>Inflation adjustment</header><text display-inline="yes-display-inline">In the case of any taxable year beginning after 2022, the dollar amount in paragraph (1)(D) shall be increased by an amount equal to—</text><subparagraph id="H6827C36F0B1749D8BB8F84870CE5E7F2"><enum>(A)</enum><text>such dollar amount, multiplied by</text></subparagraph><subparagraph id="H232D26CAC521440DB387A18404C45556"><enum>(B)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2021</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subparagraph><continuation-text continuation-text-level="paragraph">If any increase determined under this paragraph is not a multiple of $1,000, such increase shall be rounded to the nearest multiple of $1,000.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2D2614D7FF444A609A8CA1D96EBDAE56"><enum>(b)</enum><header>Clarification of <enum-in-header>500</enum-in-header> student threshold</header><text>Section 4968(b)(1)(A) of such Code is amended by inserting <quote>below the graduate level</quote> after <quote>500 tuition-paying students</quote>. </text></subsection><subsection id="HF23B0B2CE4BC49B980855712595A936B"><enum>(c)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section></legis-body></bill>
