which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Homeland Security to conduct a threat assessment of terrorist threats to the United States posed by the prisoners released by the Taliban from the Pul-e-Charkhi Prison and Parwan Detention Facility in Afghanistan, and for other purposes.</official-title></form><legis-body id="HAEC2F9D2F4D84A8E8F308034FB988FCC" style="OLC"><section id="H26ED991510974AFAAD61DD19D6C2A8F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Afghanistan Withdrawal Threat Assessment Act</short-title></quote>.</text></section><section id="H4FC4B85BE5CC4A78A04886309984CEC0"><enum>2.</enum><header>Threat assessment of terrorist threats posed by prisoners released by Taliban in Afghanistan</header><subsection id="H79169A0D5AEE4067A4630ACD85C5AD27"><enum>(a)</enum><header>Threat assessment</header><paragraph id="H9C8EA66950A84C449465391FAE049021"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security, in coordination with the heads of other relevant departments or agencies, shall conduct a threat assessment of terrorist threats to the United States posed by the prisoners released by the Taliban from the Pul-e-Charkhi Prison and Parwan Detention Facility in Afghanistan. </text></paragraph><paragraph id="H5E6816DE3CAA432E853206064AD7755F"><enum>(2)</enum><header>Elements</header><text>The assessment required under paragraph (1) shall include the following:</text><subparagraph id="H23F47A1771B34B938C16EACD204F8ECD"><enum>(A)</enum><text>With respect to the prisoners released by the Taliban from the Pul-e-Charkhi Prison and Parwan Detention Facility in Afghanistan, information relating to—</text><clause id="H0448F152121C415983B74C16FAB101A8"><enum>(i)</enum><text display-inline="yes-display-inline">the number of such prisoners who were released;</text></clause><clause id="H11A8E7153A0A404FB58BB08D5CB0F651"><enum>(ii)</enum><text>the country of origin for each such prisoner; and</text></clause><clause id="HADB8314E60FD486DBD3D3244ECCA018E"><enum>(iii)</enum><text>any affiliation with a foreign terrorist organization for each such prisoner.</text></clause></subparagraph><subparagraph id="HBF5B27AE0BDD47D8A01AAC608CB54710"><enum>(B)</enum><text display-inline="yes-display-inline">The capability of the Department of Homeland Security to identify, track, and monitor such prisoners and any associated challenges with such capability.</text></subparagraph><subparagraph id="HE9C126BC079B4F86A2EF15AD16CE1E0E"><enum>(C)</enum><text display-inline="yes-display-inline">Any action of the Department with respect to—</text><clause id="HDBED75C0CC2A4E23BB10AB41E6AFB846"><enum>(i)</enum><text>mitigating the terrorist threats to the United States posed by such prisoners; and</text></clause><clause id="HEFA26FA38588481DBB532C64BCA442CC"><enum>(ii)</enum><text>preventing such prisoners from entering the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="H838A759B6A8D48B1917ED431EA5BC2D7"><enum>(b)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary shall—</text><paragraph id="H5BFF6EB949DB4B25A55A3EAD3F3CEFC1"><enum>(1)</enum><text>submit to the appropriate congressional committees the threat assessment required under subsection (a); and</text></paragraph><paragraph id="H16DFF79F4A1142469D6D5442A1BE7349"><enum>(2)</enum><text>provide a briefing to the appropriate congressional committees on such assessment.</text></paragraph></subsection><subsection id="H4CE5FD359F8E4A4E879D40DC49305C94"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H462CBFFD4F8248728BB9EB548CB7AD26"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H85A78D4EDB3B4EA7A52BB5B10C5D01AE"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives; and</text></subparagraph><subparagraph id="HCAFAFCD3B8D842FABF861E50586DE6BD"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="H9D8F5DCFA4634E14AD0265BD0CE4964A"><enum>(2)</enum><header>Foreign terrorist organization</header><text display-inline="yes-display-inline">The term <term>foreign terrorist organization</term> means an organization designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
