R. 5140</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210831">August 31, 2021</action-date><action-desc><sponsor name-id="K000389">Mr. Khanna</sponsor> (for himself, <cosponsor name-id="B001292">Mr. Beyer</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, and <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a process by which the appointment of Supreme Court Justices can occur at regular time intervals, and for other purposes.</official-title></form><legis-body id="H12960F4E83C74F3B9F90E3EDEAA556DE" style="OLC"><section id="H90B45B87B04F4705AC03B08F6C582DCA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supreme Court Term Limits and Regular Appointments Act of 2021</short-title></quote>.</text></section><section id="HC985331502354E7A8B87C65BE5D02A70" section-type="subsequent-section"><enum>2.</enum><header>Supreme Court term limits</header><subsection id="H962D4887C6E345C7B64D2EAF120D98F8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/1">Chapter 1</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HEB240B73AE5943E5B570771F1C360EE9" display-inline="no-display-inline"><section id="HB6C90DAB4BDE4FBAAE2994569C670F0C"><enum>7.</enum><header>Term limits</header><text display-inline="no-display-inline">The President shall, during the first and third years after a year in which there is a Presidential election, nominate, and by and with the advice and consent of the Senate, appoint one Justice of the Supreme Court.</text></section><section id="HC262BAF489504ADCA755464A517E4017"><enum>8.</enum><header>Senior Justices</header><subsection id="HE3463F790F574B0088CF137D9699C89B"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c), the panel of justices exercising Judicial power in Cases and Controversies shall comprise the nine most junior Justices.</text></subsection><subsection id="HFAA785CD46ED4E00B41B0C638E103A79"><enum>(b)</enum><header>Deemed retired</header><text>After a Justice has served 18 years, that Justice shall be deemed a Justice retired from regular active service under section 371(b).</text></subsection><subsection id="H36DCD4CF1D564F4EB67A21C08AE68E47"><enum>(c)</enum><header>Exception</header><text>No Justice appointed before the date of enactment of this Act shall be counted toward the panel of nine Justices described in subsection (a), nor shall they be required to retire from regular active service under subsection (b).</text></subsection></section><section id="H2BD69619F90B42259ADFCD315A20513A"><enum>9.</enum><header>Waiver of advice and consent authority</header><text display-inline="no-display-inline">If the Senate does not exercise its advice and consent authority with respect to a President’s nominee to the Supreme Court within 120 days after the nomination, the Senate shall be deemed to have waived its advice and consent authority with respect to such nominee, and the nominee shall be seated as a Justice of the Supreme Court.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5425C5BBE4E643EABE5A68415425BBDA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/1">chapter 1</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H2D703CDEAC3E42B1AAE1C980E777BB76" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">7. Term limits. </toc-entry><toc-entry level="section">8. Senior Justices. </toc-entry><toc-entry level="section">9. Waiver of advice and consent authority. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H23F2D67BA7C14C4090EA0BB7F717F2A7"><enum>3.</enum><header>Senior Justices</header><text display-inline="no-display-inline">Section 294 of title 28, United States Code, is amended—</text><paragraph id="H539B2878C1144FD0A26BAF3F0B33C63C"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="USC" id="HB5F8B0A886954C1081EB143675EC87E7" display-inline="no-display-inline"><subsection id="H5AFD74985B724E84AB46F97E046EB886"><enum>(a)</enum><text display-inline="yes-display-inline">Any Chief Justice of the United States or Associate Justice of the Supreme Court who has retired from regular active service under section 371(b) of this title shall be known and designated as a Senior Justice and may continue to perform such judicial duties as such Justice is willing and able to undertake, when designated and assigned by the Chief Justice of the United States. </text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H6FDB62711F534FD39BB6595C2EE77318"><enum>(2)</enum><text>in subsection (d), by striking <quote>of such court</quote> and all that follows through <quote>Supreme Court.</quote> and inserting: <quote>of such court, except that any designation or assignment made to the Supreme Court shall be in accordance with subsection (e).</quote>;</text></paragraph><paragraph id="H2EE9BA733EB049CCAAB9DD61FB5EE56D"><enum>(3)</enum><text>by redesignating subsection (e) as subsection (g); and</text></paragraph><paragraph id="HE0769943F4F74C56B926260BEA2B2B00"><enum>(4)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="USC" id="HAEFD5C07DFAB4AF9AF3E6E336B3234F0" display-inline="no-display-inline"><subsection id="H8C03647D401F4781BF4F375587C03603"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9A730B05004E4FEBB2C6F409A6815911"><enum>(1)</enum><text>When there is a vacancy on the Supreme Court due to the death, disability certification under section 372, or removal of a Justice, the retired Chief Justice of the United States or Associate Justice of the Supreme Court who has most recently become a Senior Justice shall be designated and assigned to serve as a Justice until an appointment is made under section 7 of this title.</text></paragraph><paragraph id="HCC17AABB248B401983D9E5D78DC571CD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If there is more than one vacancy on the Supreme Court, the Senior Justice who has served in such capacity for the least amount of time shall be designated and assigned to serve as a Justice by the Chief Justice until each vacancy on the Supreme Court is filled.</text></paragraph></subsection><subsection id="H0C3677FA0BBF4FFE88E367D6C7820437"><enum>(f)</enum><text display-inline="yes-display-inline">Any Chief Justice of the United States or Associate Justice of the Supreme Court who has retired from regular active service under section 372 may not be a Senior Justice.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H69AE2A9E8AAA4AE69058C06701392644"><enum>4.</enum><header>Exception to appointment of a successor</header><subsection id="H9CBEBA0078ED4CA6820867F86CD0E77C"><enum>(a)</enum><header>Retired justices</header><text display-inline="yes-display-inline">Section 371 of title 28, United States Code, is amended—</text><paragraph id="H54F458511D624DE09C3F2BA9FF11F614"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H53D929BC5BCF48FCAED3E846E0FB5BEC"><enum>(A)</enum><text>by striking <quote>justice or</quote>; and</text></subparagraph><subparagraph id="HB34451551D004B6AB8728BEF2575C003"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>or designate a Senior Justice in accordance with section 294(e) to fill a vacancy resulting from the retirement of a justice under this section</quote>; and</text></subparagraph></paragraph><paragraph id="HE255468777F4498C84C676187B6ED413"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H7D231D6E09F449E8BDEA921A5516BF43" display-inline="no-display-inline"><subsection id="HAFED30F187D746F59D08225E3EFB665D"><enum>(f)</enum><text display-inline="yes-display-inline">Any justice of the United States who has served a total of 18 years as a justice shall be treated as a justice retired from regular active service under this section, unless the justice is otherwise eligible to retire as a result of a disability under section 372.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3223E5BA24A0453CB54FF1DBC55E9E04"><enum>(b)</enum><header>Disabled justices</header><text display-inline="yes-display-inline">Section 372(a) of title 28, United States Code, is amended in the first sentence, by inserting after <quote>a successor</quote> the following: <quote>or, in the case of a justice of the United States, fill the vacancy in accordance with section 294(e)</quote>.</text></subsection></section></legis-body></bill>
