which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title III of the Public Health Service Act to direct the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to award grants to eligible entities to carry out construction or modernization projects designed to strengthen and increase capacity within the specialized pediatric health care infrastructure, and for other purposes.</official-title></form><legis-body id="H9AD66C6DFC65463FB4CEB96A0E5FADA9" style="OLC"><section id="HB414AB688D5146459736BE6B72684A3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pediatric Access to Critical Healthcare Act</short-title></quote>.</text></section><section id="H37C56D6B8DF049FCA9411D43239B1ADB"><enum>2.</enum><header>Pediatric health care capacity grants</header><text display-inline="no-display-inline">Part D of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H7AC1F255F94A4EFAB90AB305A6105BCA" display-inline="no-display-inline"><subpart id="H1254988B667D47B9867B489FF7BDA3B5"><enum>XIII</enum><header>Pediatric Health Care Capacity</header><section id="H1FE8AF1CE920482CACBF7769CB1F5ADD"><enum>340J.</enum><header>Pediatric health care capacity grants</header><subsection id="HBA0E81309307430EAF377FD940640E1C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall award grants to eligible entities to carry out construction or modernization projects designed to strengthen and increase capacity within pediatric health care infrastructure<italic></italic>.</text></subsection><subsection id="HD0DDE91C71A1479AB769466AE1ED14FA"><enum>(b)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (a), an entity shall be a— </text><paragraph id="HE3B3D77A5BA547FD8D574450D020CE8B"><enum>(1)</enum><text>children’s hospital; </text></paragraph><paragraph id="HBF613621DDD24DFE93F2245C1818B6A1"><enum>(2)</enum><text>a facility that is eligible to receive funds under Section 340E of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256e">42 U.S.C. 256e</external-xref>); or </text></paragraph><paragraph id="H47480B30352D419FB9A30ED63D2A300C"><enum>(3)</enum><text>a nonprofit medical facility that predominantly treats individuals under the age of 21.</text></paragraph></subsection><subsection id="HA0A8796922B547D386EEB6ED10845763"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity selected to receive a grant under subsection (a) may use funds received through the grant for—</text><paragraph id="H6E13FAB7A3B64A828122BF35048B45A1"><enum>(1)</enum><text>expanding pediatric critical health care infrastructure, including the expansion, renovation, remodeling, and alteration of existing buildings (but not including the cost of acquisition of land or off-site improvements);</text></paragraph><paragraph id="H744507A0826E4218858C9001FF55153C"><enum>(2)</enum><text>maintaining and enhancing pediatric emergency preparedness;</text></paragraph><paragraph id="HDADECF1A3DD845B19BF1E804094E7943"><enum>(3)</enum><text display-inline="yes-display-inline">increasing the training, development, and retention of the pediatric health care workforce; </text></paragraph><paragraph id="HEA16AE711F194F819C374F1B0EDAFFA8"><enum>(4)</enum><text>upgrading digital health infrastructure, including upgrades related to preventing and addressing cybersecurity threats; </text></paragraph><paragraph id="H94263DF804D540EFBFAC6BCD0FE72FCD"><enum>(5)</enum><text>building additional patient care capacity to expand access to care; and</text></paragraph><paragraph id="H7861BB959CFB4DFD8B58D4008BA15B09"><enum>(6)</enum><text>other activities related to strengthening and increasing capacity within the pediatric health care infrastructure, as determined by the Secretary.</text></paragraph></subsection><subsection id="H130DB6BD661F4C56B3C5E25ADC216DF1"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under subsection (a) shall submit to the Secretary an application, at such time, in such manner, and containing such information as the Secretary may require, including— </text><paragraph id="HF28DFDE187164DD88E447C4A26456F4B"><enum>(1)</enum><text>a description of the entity’s planned activities described in subsection (c); and</text></paragraph><paragraph id="HB0EEC3959DBC42D5BED86FFEA938EDE3"><enum>(2)</enum><text>such documentation as may be necessary to demonstrate to the Secretary’s satisfaction of the estimated cost of the project for which the grant is made. <italic></italic></text></paragraph></subsection><subsection id="HCEDFC25E57CA46EEA4B35C12C9CEB379"><enum>(e)</enum><header>Considerations</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary, to the extent practicable, may ensure equitable distribution of awards among the geographical regions of the United States.</text></subsection><subsection id="H3324187AEC284BB49A1D80D2A99F32D7"><enum>(f)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting eligible entities to receive a grant under subsection (a), the Secretary shall give priority to eligible entities—</text><paragraph id="H3CA6367F57C544568149D0E7829C7B28"><enum>(1)</enum><text>for whom over 60 percent of the patients they serve are receiving medical assistance under a State plan (or a waiver of such plan) under title XIX of the Social Security Act or child health assistance under a State child health plan (or a waiver of such plan) under title XXI of such Act; or</text></paragraph><paragraph id="H5332B9F069304949B1E0761697226A94"><enum>(2)</enum><text display-inline="yes-display-inline">that primarily serve children from diverse and traditionally underserved populations, including racial and ethnic minorities.</text></paragraph></subsection><subsection id="H695985555CB24AFEA9C35B3F655F57E5"><enum>(g)</enum><header>Supplement, not supplant</header><text display-inline="yes-display-inline">Funds provided under this subsection shall be used to supplement, and not supplant, Federal and non-Federal funds available for carrying out the activities described in this section.</text></subsection><subsection id="H203B600971C945FAB4AE5369274D9D1D"><enum>(h)</enum><header>Matching funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall provide funds from sources other than funds provided through such grant in an amount that is at least equal to 50 percent of the amount of such grant. </text></subsection><subsection id="HFF516465E77D413D9E72CAACEAB6F828"><enum>(i)</enum><header>Reporting</header><paragraph id="H6F0279EDDD7F4EC1A615FDA9F17A89B3"><enum>(1)</enum><header>Reports from grantees</header><text display-inline="yes-display-inline">Following project completion, each entity awarded a grant under this section shall submit a report to the Secretary on the activities conducted under such grant, and other information as the Secretary may require.</text></paragraph><paragraph id="HD50E8386D0404955933E99A11111A457"><enum>(2)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Not later than September 30, 2026, and every 5 years thereafter, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on the activities conducted through, and outcomes of such projects, funded through the grants under subsection (a). Such reports shall include—</text><subparagraph id="HB83B8ADCA6B14E5982D64AB7FA6CFFD6"><enum>(A)</enum><text>the number of projects supported by the grants under subsection (a);</text></subparagraph><subparagraph id="HF5728A659B1944FBA01AF0AC13A04E0B"><enum>(B)</enum><text>an overview of the impact, if any, of such projects on pediatric health care infrastructure, including any impact on access to health care for pediatric populations; and</text></subparagraph><subparagraph id="H10EB4217D9F94367918B31EF178ED306"><enum>(C)</enum><text>recommendations for improving the grant program under this section, and any other considerations as the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="HF9745D05FE514F30937129469EFFF0A8"><enum>(j)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $600,000,000 for each of fiscal years 2023 through 2032.</text></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
