R. 512</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="B001285">Ms. Brownley</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require any bus purchased for use in public transportation with funds provided by the Federal Transit Administration to be a zero-emission bus, and for other purposes.</official-title></form><legis-body id="HDB5FB9A4F135433EAA0F2152EF400968" style="OLC"><section id="H246C235B36264123B7C47915F7A2DEBA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Green Bus Act of 2021</short-title></quote>.</text></section><section id="H65D6A28309D34483A101232DB84C3A0B" section-type="subsequent-section"><enum>2.</enum><header>Zero-emission bus requirements</header><subsection id="H1AFF016712D44D1A9C67D2163C233844"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/5312">section 5312</external-xref> the following:</text><quoted-block display-inline="no-display-inline" id="H720647FE2A4D4ED7BFC0E3D22C5EAF1D" style="USC"><section id="H6866F1C513FD4C19ABCCCEF64A2A5785"><enum>5313.</enum><header>Zero-emission bus requirements</header><subsection id="HB0648C632B7C44F9989CAA1B2F318EE3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other requirements of this chapter, not later than October 1, 2029, any bus purchased or leased with funds provided under this chapter or otherwise provided by the Federal Transit Administration for purposes of providing public transportation shall be a zero-emission bus.</text></subsection><subsection id="HEB7B2DD84144428BB4DEE8460400B172"><enum>(b)</enum><header>Federal share</header><text>Notwithstanding any other requirements of this chapter, the Federal share of the cost of any zero-emission bus purchased or leased with funds provided under this chapter or otherwise provided by the Federal Transit Administration for purposes of providing public transportation shall be 90 percent.</text></subsection><subsection id="H8D32A1850D42428491C47910EC3757C6"><enum>(c)</enum><header>Definition of zero-Emission bus</header><text display-inline="yes-display-inline">In this section, the term <quote>zero-emission bus</quote> means a bus that, under any possible operational modes or conditions, produces no exhaust emissions of—</text><paragraph id="HD58B4C1F224F4DBF9CEFD098B2BE8CA6"><enum>(1)</enum><text>any greenhouse gas; or</text></paragraph><paragraph id="HE3C59A0289D14899818BEDEAB3D57804"><enum>(2)</enum><text>any air pollutant for which air quality criteria are issued under section 108 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7408">42 U.S.C. 7408</external-xref>) or for which a national ambient air quality standard has been promulgated under section 109 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC8060559EC1B421C819D1FD3A9F041D7"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by inserting after the item related to section 5312 the following new item:</text><quoted-block display-inline="no-display-inline" id="H5C8A1AB4714B452BB56840A4F3CCA761" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">5313. Zero-emission bus requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H817E466E051B473497D4F54F2A1815D5"><enum>3.</enum><header>Report on best practices implementing zero-emission bus fleets</header><subsection id="HBB49A7C8B9C547E58C84B449C9B3E2A5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall compile, and make publicly available, a report containing best practices and lessons learned by transit agencies and States that have implemented or are in the process of implementing zero-emission bus fleets.</text></subsection><subsection id="HDD092114236644ACA23295C7069C9C51"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In compiling the report, the Secretary shall consult with transit agencies, States, zero-emission bus manufacturers, and other stakeholders that the Secretary determines are appropriate.</text></subsection><subsection id="H2F2C8116DF8D48338F7946F3E83159C9"><enum>(c)</enum><header>Updates to report</header><text>The Secretary shall update the report required under subsection (a) annually.</text></subsection></section><section id="H340693AA4758434F99B1E5EA4B2C407F"><enum>4.</enum><header>Preference under Low- or No-Emission Vehicle Program for operators with full fleet transition plans</header><text display-inline="no-display-inline">Section 5339(c) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCA31336AA0C449FF88F826B8AD7DB2DC" style="USC"><paragraph id="H2F86D6ECD1A24EDDA46C2AD1649444C0"><enum>(8)</enum><header>Preference</header><text display-inline="yes-display-inline">In awarding grants under this subsection, the Secretary shall give preference to applicants who have completed a full fleet transition plan.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
