R. 5118</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210827">August 27, 2021</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> (for himself and <cosponsor name-id="L000273">Ms. Leger Fernandez</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to prioritize the completion of the Continental Divide National Scenic Trail, and for other purposes.</official-title></form><legis-body id="H5246704F1D0B44EEB76BA5E8403FC986" style="OLC"><section id="H456AC9E1AAEB4534AA293AF213E30810" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Continental Divide Trail Completion Act</short-title></quote>. </text></section><section id="H63E99EAED6E845268876A0A56E749327"><enum>2.</enum><header>Continental Divide National Scenic Trail</header><subsection id="HB809E60B91424B7F8103E8C82C4DED39"><enum>(a)</enum><header>Completion of trail</header><text display-inline="yes-display-inline">Not later than November 10, 2028, the Secretary shall substantially complete the land acquisition program necessary to ensure the completion of the Continental Divide National Scenic Trail, consistent with sections 3(a)(2) and 5(a)(5) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1242">16 U.S.C. 1242(a)(2)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/16/1244">16 U.S.C. 1244(a)(5)</external-xref>). The Secretaries of Agriculture and the Interior shall take necessary actions to achieve this goal, including the following steps, listed in order of priority:</text><paragraph id="H6B5304463A8C484DBFF02D103EA66183"><enum>(1)</enum><text display-inline="yes-display-inline">Complete the Continental Divide National Scenic Trail by acquiring land as necessary to eliminate gaps between sections of the Trail and secure corridors compatible with the nature and purposes of the Trail.</text></paragraph><paragraph id="H3056AA4DC83F46959A835B6684F86EDC"><enum>(2)</enum><text display-inline="yes-display-inline">Optimize the Trail by relocating existing portions of the Trail on Federal land as necessary to maximize conservation and enjoyment of the nationally significant scenic, historic, natural, and cultural qualities of the Trail corridor.</text></paragraph><paragraph id="HEF9A7E54B4E741378D891F2820F825DB"><enum>(3)</enum><text display-inline="yes-display-inline">Publish maps of the completed trail corridor.</text></paragraph></subsection><subsection id="HD136B27ACDB0459ABFC75A705344F229"><enum>(b)</enum><header>Land Acquisition Team</header><paragraph id="HE4AB745C05424AD29F115A37445D4718"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out subsection (a), not later than 1 year after the date of the enactment of this section, the Secretary, in coordination with the Secretary of the Interior, shall establish a joint Forest Service and Bureau of Land Management land acquisition team to work in coordination with the Trail Administrator to facilitate the completion and optimization of the Trail, pursuant to the purposes of section 3(a)(2) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1242">16 U.S.C. 1242(a)(2)</external-xref>).</text></paragraph><paragraph id="H528E492E72574ECF9907C964E0E7DF6B"><enum>(2)</enum><header>Duties of the Team</header><text>The Team shall carry out the following:</text><subparagraph id="HAA9804E9166F403EA68514E4B85E22E1"><enum>(A)</enum><text>Conduct Optimal Location Reviews to identify land that—</text><clause id="H0171B54AEC73455F9C27648D547050B5"><enum>(i)</enum><text>eliminates gaps between sections of the Trail;</text></clause><clause id="H15D6233866064C6AAC24DC24CBD6CDFE"><enum>(ii)</enum><text>may be acquired by the Secretary or the Secretary of the Interior by purchase from a willing seller, donation, or exchange; and</text></clause><clause id="H92834897F7B94C659E614B4CB937112C"><enum>(iii)</enum><text display-inline="yes-display-inline">is best suited for inclusion in the Trail in accordance with the purposes and policy of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1241">16 U.S.C. 1241 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H2DFC9B00836748769DFCE295CC4FEA6E"><enum>(B)</enum><text display-inline="yes-display-inline">Provide the necessary administrative support to complete conveyances of land identified under subparagraph (A).</text></subparagraph><subparagraph id="HCBF2013F3ADE4966841953149C43DCEB"><enum>(C)</enum><text>Consistent with the priorities described in subsection (a), conduct Optimal Location Reviews to identify—</text><clause id="HF8712C75BEB14864BA5E3542CBAEBD68"><enum>(i)</enum><text display-inline="yes-display-inline">portions of the Trail on Federal land that should be relocated to maximize the conservation and enjoyment of the nationally significant scenic, historic, natural, or cultural qualities of the Trail corridor; and</text></clause><clause id="H8B5AE19757804D2986338CAD4C47E75A"><enum>(ii)</enum><text display-inline="yes-display-inline">where to relocate such portions of the Trail. </text></clause></subparagraph><subparagraph id="HF65403A6CF184292BAFD2C70EBD6FAC0"><enum>(D)</enum><text>Provide the necessary administrative support to relocate portions of the Trail identified under subparagraph (C).</text></subparagraph></paragraph></subsection><subsection id="HC5153CB88C9F40AD9FA433A4B39027B3"><enum>(c)</enum><header>Acquisition Plan</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary shall, after consultation with the Secretary of the Interior, Governors of the affected States, Indian Tribes, and the Continental Divide Trail Coalition, submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a comprehensive acquisition or protection plan. This plan should identify any incomplete segments or gaps where the respective agencies have not been able to acquire access, right-of-ways, easements, or acquisitions to date from willing sellers, donations, or exchanges, and a plan for all lands to be acquired by fee title or lesser interest, along with detailed explanation of anticipated necessary cooperative agreements for any lands not to be acquired; and general and site-specific development plans, including anticipated costs.</text></subsection><subsection id="H0DD1D49E91864C9E808CD0B1A9231E4C"><enum>(d)</enum><header>Method of acquisition</header><text>In carrying out this section, the Team—</text><paragraph id="H8C24980257BF431F9D9BDB44429FE988"><enum>(1)</enum><text display-inline="yes-display-inline">may acquire land only by purchase from a willing seller with donated or appropriated funds, donation, or exchange; and </text></paragraph><paragraph id="HF99790748BEC4289AF3BDBC441721D91"><enum>(2)</enum><text>may not acquire land by eminent domain. </text></paragraph></subsection><subsection id="HA12B09A20B5C492986E63E5A4DE22B3C"><enum>(e)</enum><header>Maintaining existing partnerships</header><text>In carrying out this section, the Secretary and the Team shall continue to maintain and develop working partnerships with volunteer and nonprofit organizations that assist in the development, maintenance, and management of the Trail.</text></subsection><subsection id="H1696AD17666B4E5CB898DF83C388625A"><enum>(f)</enum><header>Reports</header><paragraph id="HC209EC9352234F6A852000C60F77B550"><enum>(1)</enum><header>Secretary</header><text>Not later than 1 year after the creation of the Team, and at the close of each fiscal year until the acquisition program is completed, the Secretary shall transmit, in writing, the following information to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate:</text><subparagraph id="H042289314D9A430193C2BA4359FBF9C0"><enum>(A)</enum><text>The amount of land acquired during the fiscal year and the amount expended for such land.</text></subparagraph><subparagraph id="H4248C6316B144103AF50C7985A6C6B7E"><enum>(B)</enum><text>The amount of land planned for acquisition in the ensuing fiscal year and the estimated cost of such land.</text></subparagraph><subparagraph id="HF3AB46DB323141F3A1E39BE14896AAC9"><enum>(C)</enum><text>The estimated amount of land remaining to be acquired.</text></subparagraph></paragraph><paragraph id="H011F5C6D5C294A99BFE1D33403174584"><enum>(2)</enum><header>Continental Divide Trail Coalition</header><text display-inline="yes-display-inline">Not later than 1 year after the creation of the Team, and until the entire acquisition program is completed, the Continental Divide Trail Coalition shall transmit a report at the close of each fiscal year to the Committee of Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate, which shall include the following:</text><subparagraph id="H23008380721948F3A3C546B09E0FAA6D"><enum>(A)</enum><text>The progress of the Secretary in making the necessary acquisitions to complete and optimize the Trail.</text></subparagraph><subparagraph id="H9639B8E0B6A24E26B57389163E21F685"><enum>(B)</enum><text>The manner in which negotiations for the acquisition program are being conducted for every section of the Trail.</text></subparagraph><subparagraph id="H3825215706364E898B250FBAE5938BE3"><enum>(C)</enum><text>Whether in any case larger interests in land are being acquired than are necessary to carry out the purposes of this Act.</text></subparagraph></paragraph></subsection><subsection id="H4E40A7ADDE1E4E2BAB3C725A05703E76"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC160A32C5C0849BA97A025F350BB4136"><enum>(1)</enum><header>Optimal Location Review</header><text>The term <term>Optimal Location Review</term> means the procedures described in the Continental Divide National Scenic Trail Optimal Location Review Guide, dated November 2017. </text></paragraph><paragraph id="H5E131030177648EB81FBDD2EC36BD38C"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="HB9E0A467F2A14E6DA9DA3BE4B3F6FBCD"><enum>(3)</enum><header>Team</header><text>The term <term>Team</term> means the land acquisition team established under subsection (b).</text></paragraph><paragraph id="HF8935021D31F403B93FD79CB2CF56C03"><enum>(4)</enum><header>Trail</header><text>The term <term>Trail</term> means the Continental Divide National Scenic Trail established by section 5 of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1244">16 U.S.C. 1244</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
