R. 509</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="B001285">Ms. Brownley</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 14, United States Code, to ensure that the Commandant of the Coast Guard responds to safety recommendations by the National Transportation Safety Board.</official-title></form><legis-body id="HD025BF0D58FE413FB6E481BFCFB73EE7" style="OLC"><section id="H6F18BB4F7AA5452A91DE97879347F03D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coast Guard Safety and Accountability Act</short-title></quote>. </text></section><section id="H06BDBEAD63624E83B0F33910AE79A7C4"><enum>2.</enum><header>Commandant of the Coast Guard's responses to safety recommendations</header><subsection id="H183FF6E0B9D742B29D1AFD11EE7769FC"><enum>(a)</enum><header>Amendment to title 14</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">Chapter 7</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF0F7BC4DDD434AC4A6EBFD9FC7990327" display-inline="no-display-inline"><section id="HFFD37248E5E64C2997046D8E61140152"><enum>719.</enum><header>Responses to safety recommendations</header><subsection id="H2C5BAEBEBDCE48538CC4D1B4D0CD377F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">When the National Transportation Safety Board submits a recommendation about transportation safety to the Commandant of the Coast Guard, the Commandant, not later than 90 days after receiving the recommendation, shall give the Board a formal written response to each recommendation. The response shall indicate whether the Commandant intends—</text><paragraph id="H3FC069544CAB4EBAAB25976D48F403C8"><enum>(1)</enum><text>to carry out procedures to adopt the complete recommendation;</text></paragraph><paragraph id="H1383D033D35E42798D88FC7DC12B73A9"><enum>(2)</enum><text>to carry out procedures to adopt a part of the recommendation; or</text></paragraph><paragraph id="H5D1971F9486E4D79BB0E76EDA4A8C7BC" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to refuse to carry out procedures to adopt the recommendation.</text></paragraph></subsection><subsection id="H8DDC06B36C3F43C4B2E0F131D1F344FD"><enum>(b)</enum><header>Timetable for completing procedures and reasons for refusal</header><text>A response under paragraphs (1) or (2) of subsection (a) shall include a copy of a proposed timetable for completing the procedures. A response under subsection (a)(2) shall detail the reasons for the refusal to carry out procedures on the remainder of the recommendation. A response under subsection (a)(3) shall detail the reasons for the refusal to carry out procedures.</text></subsection><subsection id="HCA2F39DCED0A4FFA960E4CA341FCE783"><enum>(c)</enum><header>Public availability</header><text>The Board shall make a copy of each recommendation and response available to the public at reasonable cost.</text></subsection><subsection id="HEE06C27BC3FA48D2B239B314EDB82E89"><enum>(d)</enum><header>Reporting requirements</header><paragraph id="H61AC509E07554984AC6915690D7443B3"><enum>(1)</enum><header>Annual regulatory status reports</header><text>On February 1 of each year, the Commandant shall submit a report to Congress and the Board containing the regulatory status of each recommendation made by the Board to the Commandant that is on the Board's <quote>most wanted list</quote>. The Commandant shall continue to report on the regulatory status of each such recommendation in the report due on February 1 of subsequent years until final regulatory action is taken on that recommendation or the Commandant determines and states in such a report that no action should be taken.</text></paragraph><paragraph id="H7962A4C158704CAA8EC54DC27EB090F8"><enum>(2)</enum><header>Failure to report</header><text>If on March 1 of each year the Board has not received the Commandant's report required by this subsection, the Board shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of the Commandant's failure to submit the required report.</text></paragraph><paragraph id="H34A4707DBC094DB5AF663BC81735FFFE"><enum>(3)</enum><header>Compliance report with recommendations</header><text>Not later than 90 days after the date on which the Commandant submits a report under this subsection, the Board shall review the Commandant's report and transmit comments on the report to the Commandant, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6E024277C2FA4BFEBF2D6E050A1629A5"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">chapter 7</external-xref> of title 14, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/14/718">section 718</external-xref> the following:</text><quoted-block style="OLC" id="H950F95A4DEB3463390DA73D53C0B8371" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">719.
