which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to transfer certain National Forest System land in the State of Washington to Skamania County, Washington.</official-title></form><legis-body id="H068558D2689B4A6AB862798523A795DD" style="OLC"><section id="H6FF6363F504E464FA62547C52FCCC0BA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wind River Administrative Site Conveyance Act</short-title></quote>.</text></section><section id="H4DDA4037BE73437FB30389A671519578"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline"> In this Act:</text><paragraph id="H339C4BAD71BC4B068BE5D346CD506FC6"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means the Skamania County, Washington.</text></paragraph><paragraph id="HD24176427D72405E826A985BEFB3A6C7"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map entitled <quote>Wind River Administrative Site Conveyance Proposal</quote> and dated July 7, 2020.</text></paragraph><paragraph id="HD14B2CD9E79E4527BD0C71456C90EB3E"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph></section><section id="H9DFE248A812045DF90B2A47988CD5A74"><enum>3.</enum><header>Conveyance of land and improvements</header><subsection id="H93EDD4BC20C147E284AA8042DF633E2D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the County submits a written request to the Secretary not later than 180 days after the date of enactment of this Act, the Secretary shall, not later than 24 months after the date of the enactment of this Act, convey to the County all right, title, and interest of the United States in and to the approximately 23.4 acres of National Forest System land, related infrastructure, and all improvements, as generally depicted as <quote>proposed conveyance</quote> on the map. </text></subsection><subsection id="H5E74B6C7FDD747B68FFC7EB78D0374B8"><enum>(b)</enum><header>Map</header><paragraph id="HCA5BBA3BAC374E92A4C4828144F50FE1"><enum>(1)</enum><header>Availability of map</header><text>The map shall be kept on file and available for public inspection in the appropriate office of the Forest Service.</text></paragraph><paragraph id="HA7C4011D8B6F4D5D87C15A04C96FC978"><enum>(2)</enum><header>Correction of errors</header><text>The Secretary may correct minor errors in the map.</text></paragraph></subsection><subsection id="H409DB70287E14A04B3B50762B5A14123"><enum>(c)</enum><header>Terms and conditions</header><text>The conveyance under subsection (a) shall be—</text><paragraph id="HB0635AE8475F4451993E4FC68FAD2259"><enum>(1)</enum><text>subject to valid existing rights;</text></paragraph><paragraph id="H6398B486E14B41F29E1B785043CC466F"><enum>(2)</enum><text>notwithstanding any other provision of law, made without consideration;</text></paragraph><paragraph id="HFBF4CE055DA5458896343A671F17CF6D"><enum>(3)</enum><text>made by quitclaim deed;</text></paragraph><paragraph id="HA20E54E093F04C669797DD54C0E2D2EC"><enum>(4)</enum><text display-inline="yes-display-inline">subject to a right-of-way and restrictive easement reservation of a width to be determined by the Secretary, for the protection of the Pacific Crest National Scenic Trail;</text></paragraph><paragraph id="H052FFFDC63BF4F04A3A735A5491BA0DC"><enum>(5)</enum><text display-inline="yes-display-inline">completed in accordance with the Forest Service Facility Realignment and Enhancement Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/580d">16 U.S.C. 580d et seq.</external-xref>), except that section 504(b) and (c) of that Act shall not apply;</text></paragraph><paragraph id="H802E195813524F05A1EC2CE2D1B7D058"><enum>(6)</enum><text>subject to right-of-way reservations made pursuant to section 507 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1767">43 U.S.C. 1767</external-xref>); and</text></paragraph><paragraph id="HA5375E735C614442AEDF1A1FFCB729BA"><enum>(7)</enum><text>subject to any other terms and conditions as the Secretary determines appropriate.</text></paragraph></subsection><subsection id="H2F7E7E93907D4122A406963B713A7269"><enum>(d)</enum><header>Federal property disposal</header><text>Chapter 5 of subtitle I of title 40, United States Code, shall not apply to the conveyance under subsection (a).</text></subsection><subsection id="H869536617F114FBB84EB8099FBD2917B"><enum>(e)</enum><header>Hazardous materials</header><text>With respect to the conveyance under subsection (a), the Secretary—</text><paragraph id="H9F51BB6506384650AD347BBC3887D55B"><enum>(1)</enum><text>shall meet disclosure requirements for hazardous substances, pollutants, or contaminants under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)</external-xref>); and</text></paragraph><paragraph id="H27C91AF6AF0840CBBECE1C15DD56A9EA"><enum>(2)</enum><text>shall not otherwise be required to remediate or abate the hazardous substances, pollutants, or contaminants disclosed pursuant to paragraph (1).</text></paragraph></subsection><subsection id="H12617C53B1C84B839CB64F349B63D75C"><enum>(f)</enum><header>Closing costs</header><text>As a condition for the conveyance under subsection (a), the County shall pay all closing costs associated with the conveyance, including for—</text><paragraph id="H294122EE952A46AF983843E94D175B18"><enum>(1)</enum><text>title insurance and title search; and</text></paragraph><paragraph id="HE4FE58A4503F4C0792D8EF60E14BFF62"><enum>(2)</enum><text>any applicable inspection fees, escrow fees, attorneys fees, and recording fees.</text></paragraph></subsection><subsection id="H1310A69F49C54BC7B394A034F86AF506"><enum>(g)</enum><header>Survey</header><paragraph id="H3F7F4C3883CF404893606B86F6056CC7"><enum>(1)</enum><header>In general</header><text>The exact acreage and legal description of the National Forest System land to be conveyed under subsection (a) shall be determined by a survey satisfactory to the Secretary.</text></paragraph><paragraph id="H2FE9C45A192B4DC18C50F3E08F653B48"><enum>(2)</enum><header>Costs of survey</header><text>The Secretary shall bear all costs associated with the survey under paragraph (1).</text></paragraph></subsection><subsection id="H6279C6A8352D4D78A7C0AF324C4FB61B"><enum>(h)</enum><header>Use of land</header><paragraph id="HEE874890C50143888A78B720D0DF1B0D"><enum>(1)</enum><header>In general</header><text>The lands and related infrastructure conveyed under subsection (a) shall be maintained by the County pursuant to standards established by the Secretary of the Interior under section 306101 of title 54, United States Code.</text></paragraph><paragraph id="HDD6C4A0FD2A54745BCA344EC4EF68C5A"><enum>(2)</enum><header>Reversion</header><text>If any portion of the land conveyed under subsection (a) is used in a manner that is inconsistent with the use described in paragraph (1), the land shall, at the discretion of the Secretary, revert to the United States.</text></paragraph></subsection></section></legis-body></bill>
