R. 5080</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210823">August 23, 2021</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> (for himself, <cosponsor name-id="J000032">Ms. Jackson Lee</cosponsor>, <cosponsor name-id="P000593">Mr. Perlmutter</cosponsor>, <cosponsor name-id="D000631">Ms. Dean</cosponsor>, and <cosponsor name-id="E000299">Ms. Escobar</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit a person who fails to meet age and residential requirements from shipping, transporting, possessing, or receiving firearms and ammunition, to increase the penalties for transfer of a firearm to any person who is under indictment, and for other purposes.</official-title></form><legis-body id="H9CE39D3ACD6443BD843D9047B2BDD118" style="OLC"><section id="HC8FE4ECBA5C245F5B3F081933A6AE6FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Background Checks Act of 2021</short-title></quote>.</text></section><section id="H007B108C5FAE4A4EB838FAC6B93BB9C7"><enum>2.</enum><header>Age and residential requirement</header><text display-inline="no-display-inline">Section 922(g) of title 18, United States Code, is amended—</text><paragraph id="HF985D32DEB9D4425AC80BA5D509C82AD" display-inline="no-display-inline"><enum>(1)</enum><text>in paragraph (8)(C)(ii), by striking <quote>or</quote> at the end; </text></paragraph><paragraph id="HF8333D8E2B274785A22D6AE9FCE9ABB6"><enum>(2)</enum><text>in paragraph (9), by striking the comma at the end and inserting a semicolon; and</text></paragraph><paragraph id="HCF917936FC1145B1A9AA7B2177987E38"><enum>(3)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H2D82405C647847E7893EDDC1FDF96B5F"><paragraph id="H2FFBDB68184241B7857AED29C38001BC"><enum>(10)</enum><text display-inline="yes-display-inline">who fails to meet the age requirement—</text><subparagraph id="HAFDF1E3561B3410388BB81F209525BAE"><enum>(A)</enum><text>described in subsection (b)(1); and</text></subparagraph><subparagraph id="H80C4DECD1CA1461C9BEAA6D6AA993BD5"><enum>(B)</enum><text display-inline="yes-display-inline">in the person’s State of residence; or</text></subparagraph></paragraph><paragraph id="HCC39019741EB4D65AE9F0BDDDA82AE05"><enum>(11)</enum><text display-inline="yes-display-inline">who—</text><subparagraph id="H2F1F167E4C044A2FAFB358BA5A834F09"><enum>(A)</enum><text>does not reside in (or if the person is a corporation or other business entity, does not maintain a place of business in) the State in which the licensee’s place of business is located; and</text></subparagraph><subparagraph id="H461BD9973B1745E6B93DB4D76CF213E7"><enum>(B)</enum><text>is not subject to an exception under subparagraph (A) or (B) of subsection (b)(3),</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HFE8CC7342D2D434789F5DE7AB9296D3B"><enum>3.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 924(a)(2) of title 18, United States Code, is amended by striking <quote>, or (o)</quote> and inserting <quote>(n), or (o)</quote>. </text></section></legis-body></bill>
