Boyle of Pennsylvania</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to extend the advanced energy project credit.</official-title></form><legis-body id="H0F989B84B1CD4B4A9EA86BE6236452A2" style="OLC"><section id="HCA93FCF9395E4EE1BC8F5519A5515EBE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovative Energy Manufacturing Act of 2021</short-title></quote>.</text></section><section id="HF6C14C29519640EA83E5D04CC3825237"><enum>2.</enum><header>Extension of the advanced energy project credit</header><subsection id="H9A9BE239CF3C4B22A499EEDE58352707"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/48C">Section 48C</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating subsection (e) as subsection (f) and by inserting after subsection (d) the following new subsection:</text><quoted-block id="H1F257ED93AF6436985EFA1E5E0EE809C" style="OLC"><subsection commented="no" id="H8C88721B62D14110994A3B732698B5A6"><enum>(e)</enum><header>Additional allocations</header><paragraph commented="no" id="HE8776424065F44EF992ACE0416D37035"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this paragraph, the Secretary, after consultation with the Secretary of Energy, shall establish a program to designate amounts of qualifying advanced project credit limitation to qualifying advanced energy projects.</text></paragraph><paragraph commented="no" id="HE4D0C95A0696473DA8B59342E639F3F1"><enum>(2)</enum><header>Annual limitation</header><subparagraph id="H03311A40D91E4B1C9A7D39AED52A8C89"><enum>(A)</enum><header>In general</header><text>The amount of qualifying advanced project credit limitation that may be designated under this subsection during any calendar year shall not exceed the annual credit limitation with respect to such year.</text></subparagraph><subparagraph commented="no" id="HE4CBED0233294AD9A8550AD03ADB7837"><enum>(B)</enum><header>Annual credit limitation</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>annual credit limitation</quote> means $2,500,000,000 for each of calendar years 2022, 2023, 2024, 2025, and 2026, and zero thereafter.</text></subparagraph><subparagraph id="H1962273F52EC425DBB82A588D90C7014"><enum>(C)</enum><header>Carryover of unused limitation</header><text display-inline="yes-display-inline">If the annual credit limitation for any calendar year exceeds the aggregate amount designated for such year under this subsection, such limitation for the succeeding calendar year shall be increased by the amount of such excess. No amount may be carried under the preceding sentence to any calendar year after 2026.</text></subparagraph></paragraph><paragraph id="H546CC04FFC39496A86EBA8E2A6366059"><enum>(3)</enum><header>Placed in service deadline</header><text display-inline="yes-display-inline">No credit shall be determined under subsection (a) with respect to any property which is placed in service after the date that is 4 years after the date of the designation under this subsection relating to such property.</text></paragraph><paragraph commented="no" id="H15B5111A06354E8385A6EA5FAC082D5C"><enum>(4)</enum><header>Selection criteria</header><text>Selection criteria similar to those in subsection (d)(3) shall apply, except that in determining designations under this subsection, the Secretary, after consultation with the Secretary of Energy, shall—</text><subparagraph id="H956A6E296CE64F14B4DD58F8FB7B13ED"><enum>(A)</enum><text>require that applicants provide written assurances to the Secretary that all laborers and mechanics employed by contractors and subcontractors in the performance of construction, alteration or repair work on a qualifying advanced energy project shall be paid wages at rates not less than those prevailing on projects of a similar character in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code, and</text></subparagraph><subparagraph id="HCE719E35B32C446180717FD856347EF2"><enum>(B)</enum><text>give the highest priority to projects which—</text><clause id="H3DA44577AF0A4C82A57E49C6D1B2D4BA"><enum>(i)</enum><text display-inline="yes-display-inline">manufacture (other than primarily assembly of components) property described in a subclause of subsection (c)(1)(A)(i) (or components thereof), and</text></clause><clause id="HE807F3782AD64095B4E8EAB49D173FFF"><enum>(ii)</enum><text>have the greatest potential for commercial deployment of new applications. </text></clause></subparagraph></paragraph><paragraph id="HAF742016EEC94A3B9F17AFB71F5D07B8"><enum>(5)</enum><header>Disclosure of designations</header><text>Rules similar to the rules of subsection (d)(5) shall apply for purposes of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF9CA4659DA714698AA3E487BDBBA38C8"><enum>(b)</enum><header>Clarification with respect to electrochromatic glass</header><text>Section 48C(c)(1)(A)(i)(V) of such Code is amended—</text><paragraph id="HF1CA99FD74C54FA3B95101AF480905CA"><enum>(1)</enum><text>by striking <quote>and smart grid</quote> and inserting <quote>, smart grid, </quote> and</text></paragraph><paragraph id="HEF1CA51DC016420DA14CC19CE47706D0"><enum>(2)</enum><text>by inserting <quote>, and electrochromatic glass</quote> before the comma at the end. </text></paragraph></subsection><subsection id="H5EBAE53822F54313B5A068BB5BDD4A5B"><enum>(c)</enum><header>Effective date</header><text>The amendment made by this section shall take effect on the date of the enactment of this Act.</text></subsection><subsection id="H4A084B97B41249EDA977199CF25F259A"><enum>(d)</enum><header>Progress report</header><text display-inline="yes-display-inline">During the 30-day period ending on December 31, 2027, the Secretary of the Treasury (or the Secretary’s delegate), after consultation with the Secretary of Labor, shall submit a report to Congress on any domestic job creation, and wages associated with such jobs, and the amount of such wages paid, attributable to the amendment made by this section.</text></subsection></section></legis-body></bill>
