R. 5072</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210823">August 23, 2021</action-date><action-desc><sponsor name-id="B001287">Mr. Bera</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize use of rental assistance amounts for individuals and families from Afghanistan, and for other purposes.</official-title></form><legis-body id="HF9E4DF86F83944BEB5F67DC86EF0E6C8" style="OLC"><section id="HB39C618FFCF243DEACF86DFEFFFBB918" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing for Afghan Allies Act of 2021</short-title></quote>.</text></section><section id="H096CB998FE5341EF91F6B95B4A14C2D7"><enum>2.</enum><header>Use of emergency rental assistance</header><subsection id="HFBD138B89C374564BC383A818A33B674"><enum>(a)</enum><header>Fiscal Year 2021 Consolidated Appropriations Act funds</header><text display-inline="yes-display-inline">Subsection (c) of section 501 of subtitle A of title V of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058a">15 U.S.C. 9058a(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H4EDF23A06023402BBAF55DE82147F53B" display-inline="no-display-inline"><paragraph id="HBEC76C0C0CD74540A84434824185591B"><enum>(5)</enum><header>Use for individuals and families from Afghanistan</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, an eligible grantee may use not more than 25 percent of funds provided from a payment made under this section to provide financial assistance to pay rent, utilities, and home energy costs for any individual who is, or any household comprised of members who—</text><subparagraph id="HA4CCAAEC7C874359AC38F7FD5B499D2E"><enum>(A)</enum><text display-inline="yes-display-inline">are citizens or nationals of Afghanistan; </text></subparagraph><subparagraph id="H4598FBFBE7A542548AD8531EABFDF8F1"><enum>(B)</enum><text>are present within the United States; and</text></subparagraph><subparagraph id="H1046107F03F84CFFB9EA4937C5E475B8"><enum>(C)</enum><text>have—</text><clause id="HBD0FC2AB32314970BF836F383D305238"><enum>(i)</enum><text>been granted special immigrant status as described in section 602(b) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note); or</text></clause><clause id="HDE59C2FCA85F45D5B32D1F24D53ED8C5"><enum>(ii)</enum><text>received Priority 2 (P–2) refugee designation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC7044644AFDD40E4BB1E9FDD2E11A78D"><enum>(b)</enum><header>ARPA funds</header><text display-inline="yes-display-inline">Subsection (d) of section 3201 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9058c">15 U.S.C. 9058c(d)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HFC9A875A751D4A09B0057BF1EEFFA5F1" display-inline="no-display-inline"><paragraph id="H5B62C90932B04DB0880752EBCF454304"><enum>(3)</enum><header>Use for individuals and families from Afghanistan</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, an eligible grantee may use not more than 25 percent of funds provided from a payment made under this section to provide financial assistance to pay rent, utilities, and home energy costs for any individual who is, or any household comprised of members who—</text><subparagraph id="H2071849CD26441539E1BBD10E92C3FFC"><enum>(A)</enum><text display-inline="yes-display-inline">are citizens or nationals of Afghanistan; </text></subparagraph><subparagraph id="H4E2A391224234E10BDCF24A9BF7112DE"><enum>(B)</enum><text>are present within the United States; and</text></subparagraph><subparagraph id="H33F81EE124BA4FA494EB76DF44C62F69"><enum>(C)</enum><text>have—</text><clause id="H7287C5A6C7F5451EB7F10D90D605616E"><enum>(i)</enum><text>been granted special immigrant status as described in section 602(b) of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note); or</text></clause><clause id="H8DE70B03922E485786D36559D1B794B6"><enum>(ii)</enum><text>received Priority 2 (P–2) refugee designation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
