committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To withhold Federal highway funds from States that provide driver’s licenses or identification cards to aliens who are unlawfully present in the United States, and for other purposes.</official-title></form><legis-body id="HB990429DF45B49F19C7990CA1B8FFC3F" style="OLC"><section id="HE134C4432F894AD8A9B9DB867A8009BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Red Light Act</short-title></quote>.</text></section><section id="HE40DF4D1336B482CAAE4ACAE9E45E2B1"><enum>2.</enum><header>Withholding of funds for providing identification cards to certain aliens</header><subsection id="H78A3A56466A54DCA83E4998000298858"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HD0ECE13880254FC6A1004B8C6F488932" style="USC"><section id="H900F02DAFF4A431E82A973CB2181EEEC"><enum>171.</enum><header>Withholding of funds for providing identification cards to certain aliens</header><subsection id="H21D51979B4684D7CA01E8B31BD9A7BF0"><enum>(a)</enum><header>Withholding of funds for noncompliance</header><text display-inline="yes-display-inline">For fiscal year 2021 and each fiscal year thereafter, the Secretary shall withhold 100 percent of the amount required to be apportioned under each of sections 104(b)(1), 104(b)(3), and 104(b)(4) of this title to any State that is described in subsection (b).</text></subsection><subsection id="H05ADD861A4A7451A8B39D81BBE4C0C41"><enum>(b)</enum><header>State described</header><text display-inline="yes-display-inline">A State described in this subsection is a State that has enacted a law that allows the State to provide a driver’s license or other identification card to an alien who is unlawfully present in the United States.</text></subsection><subsection id="HD7F8E5FE800249D08A3C9C8C7299203C"><enum>(c)</enum><header>Effect of withholding funds</header><paragraph id="HC20750AE612D481F85147782F6F7A423"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any funds withheld under subsection (a) from apportionment to any State shall remain available until the end of the fiscal year for which the funds are apportioned.</text></paragraph><paragraph id="H579D45A7451647C28FFDD17F08D1ABD7"><enum>(2)</enum><header>Reapportionment</header><text display-inline="yes-display-inline">If, before the last day of the fiscal year for which funds withheld under subsection (a) are apportioned to a State, the State repeals all laws of such State described in subsection (b), the Secretary shall, on the first day on which the State repeals all such laws, apportion to the State the funds withheld under subsection (a) that remain available for apportionment to the State.</text></paragraph><paragraph id="H3D4B2DB04DD44B2A8415FA6848727F48"><enum>(3)</enum><header>Apportionment among States</header><text display-inline="yes-display-inline">If, at the end of the fiscal year in which funds are withheld from a State under paragraph (1), the State has not repealed the law described in subsection (b), the Secretary shall apportion the corresponding withheld funds described in subsection (a) on a proportional basis to all remaining States that have not enacted laws described in subsection (b).</text></paragraph><paragraph id="H9EF71A1C1F6F46979EDC1F8EB9FDE5F4"><enum>(4)</enum><header>Withholding in future year</header><text>In the case in which a State has funds withheld under paragraph (1) and is reapportioned funds under paragraph (2) and subsequently enacts a law described in subsection (b) after the date on which the funds are reapportioned under paragraph (2), the Secretary shall withhold the amount of funds withheld under subsection (a) in the fiscal year following the fiscal year in which such actions occur and each fiscal year thereafter. </text></paragraph></subsection><subsection id="H529C49DAE6DF4DDF823C36F86244B6A1"><enum>(d)</enum><header>Identification card defined</header><text display-inline="yes-display-inline">The term <quote>identification card</quote> means a personal identification card, as defined in section 1028(d) of title 18, United States Code, issued by a State.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H478EA66555984E3794526D4ACDC23298"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, in the table of contents is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4891866F1EB949FB911A66F9BE2ADC23" style="OLC"><toc
